I. PRE-QUALIFICATION REQUIREMENTS :
The following conditions have to be satisfied by the tenderer, with documentary proof to be
enclosed with tender bid. In case the agency fails to enclose the following documentary proof
with tender, the tender will be liable for rejection. Particulars of experience for the works successfully completed/executed of similar nature. Similar
nature means jobs like: Electrical, fitting, machinist jobs in Engineering/Manufacturing /Process
industries which are semiskilled nature of works consisting at least any one of the scope given below.

Scope of work : The above work consists of execution of semiskilled work with ITI qualified
Fitters, Electricians, Turners, Machinists, Welders, in assembly of generators, taping of coils,
winding of 2 Pole/4 Pole rotors, winding works in stator winding. Fitter operations in the area of
power generation equipments, machine tools or equipments assembly, disassembly/ Electrical works
in the area of tapping or winding or brazing operations related to electrical equipments or machines/
turning works on lathes/milling work on milling machines/welding operations in the area of welding
of pipes, plates etc., Contractor has to carry-out any type of relevant works as per the instructions of
the concerned officials.
BHEL SCOPE: BHEL will arrange electrical power supply, instruments, tools and necessary battery
trucks, forklift etc., required for carrying out the works.
1. The contractor should have a minimum of one year experience (on the date of opening of
tender) in execution of similar works contract as mentioned in scope of work above.
2. Experience of having successfully completed similar works during last 7 years ending last day
of month previous to the one in which applications are invited should be either of the following:-
(Relevant documents to be submitted) :
a. Three similar completed works costing not less than the amount
equal to 40% of the estimated cost.
or
b. Two similar completed works costing not less than the amount
equal to 50% of the estimated cost.
or
c. One similar completed work costing not less than the amount equal
to 80% of the estimated cost
3. The contractor should submit the following documentary evidence in support of similar
works experience :
Work awardal copy, Contract Agreement copy and certificate of satisfactory completion of
work indicating contract period, scope of work and value of contract (work completion
certificate)
4. Average Annual financial turnover during the last 3 years, ending 31st
March of the previous
Financial year, should be at least 30% of the estimated cost. Relevant documents of computation
of income, P&L statement and IT returns duly certified by practicing CA are to be submitted.
5. The Contractor should invariably furnish details and submit a photostat copy :
(i) A valid Labour licence issued by Central Labour Commissioner/competent
authorities(central). In case Labour license is not available the same can be submitted
before commencement of work.
(ii) PF code (if available), in case PF code is not available the same can be submitted before
commencement of work.
(iii) ESI code
(iv) Income Tax PAN number.
(v) Service Tax Registration number.
Tenderer shall affix signature along with rubber seal on each page of the tender document and
also on all supporting documents enclosed with tender.
Tenders submitted without enclosing tender document cost or EMD are liable to be rejected.

II. TENDERING PROCESS :
1. Tender documents can be collected from Electrical Machines Dept./Planning, 02 Annexe, Ground
floor on all working days from 21/11/2012 (10.00 AM ) to 29/11/2012 (2.00 PM) after paying
Rs.1000/- at BHEL cash office or DD in favour of BHEL, R C Puram, Hyd - 32.
Tender documents can also be had through BHEL web site http://www.bhel.com
Bidders can download the tender document till the due date and time of submission of the
tender document. The cost of Tender documents Rs.750/- (if down loaded from website) shall be
paid in the form of Demand Draft in favour of BHEL, R C Puram, Hyderabad – 32 and shall be
enclosed to the Techno Commercial Bid (Part -A). No other means of payment shall be accepted.
The cost of tender documents is Non refundable. 2. Earnest Money Deposit (EMD) :
An amount of Rs.1,00,000/- towards EMD shall be paid in cash at BHEL cash office or by
Demand Draft drawn in favour of M/s. Bharat Heavy Electricals Limited, R C Puram, Hyderabad
payable at Hyderabad and shall be enclosed to the Techno Commercial Bid (Part -A). One time
EMD will also be accepted as per terms of BHEL works policy. No other means of payment shall be
accepted.
3. Tender box is available at OFFICE OF SR.DGM / PLANNING (EM), 02 ANNEXE, GROUND
FLOOR, BHEL, R.C. Puram, Hyderabad – 502 032; tenders can be dropped in Tender Box before
the due date & Time. Tenders can also be sent through post.
4. The bids shall be submitted in two parts.
Techno - Commercial bid - Part A
Price bid - Part B
a) Techno - Commercial Bid (Part A): The envelope shall contain the Techno- Commercial
Bid as per the enclosed technical bid proforma with relevant documents like copies of ESI,
PF code, Labour license , PAN No & relevant Experience meeting pre qualification criteria,
turnover etc; Acknowledged IT returns copies duly certified by chartered accountant for
the 3 previous years, EMD, cost of tender document. The envelop shall be super scribed
"Technical bid" for Name of work: Partial off- loading for additional Semi-skilled
operations in core assly & machine assly, machine shops, copper shop, coil shop, stator
winding, rotor winding and insulation shop area of 02 shop, Tender notice no. :
HY/EMP/ TENDERS / 2012-13/07 Dt : 19.11.2012. b) Price bid (Part B): The second envelope shall contain only the quoted price bid. The
envelope shall be sealed and super scribed “Price Bid” for Name of work: Partial off-
loading for additional Semi-skilled operations in core assly & machine assly, machine
shops, copper shop, coil shop, stator winding, rotor winding and insulation shop area
of 02 shop, Tender notice no. : HY/EMP/ TENDERS / 2012-13/07 Dt : 19.11.2012.
c) Both the above two sealed envelopes must be kept into another sealed cover. The cover
shall be super-scribed with - Name of work: Partial off- loading for additional Semi-
skilled operations in core assly & machine assly, machine shops, copper shop, coil
shop, stator winding, rotor winding and insulation shop area of 02 shop, Tender notice
no. : HY/EMP/ TENDERS / 2012-13/07 Dt : 19.11.2012., Tender due date :30/11/2012,
and it should also contain from address and shall be addressed to Sr.Dy. General
Manager/Planning, Electrical Machines, 02 Annexe, Bharat Heavy Electricals
Limited, Ramachandrapuram, Hyderabad – 502 032 to reach on or before due date by
11.00 hrs. Covers with out Name of work and type of bid (Techno- Commercial/ Price
Bid) shall not be opened. BHEL is not responsible for any postal delay.

5. Tenders received as Technical & Price bid documents kept together in same envelope
(combined bid) without putting in separate sealed envelopes shall be rejected. Offer submitted in
single bid instead of two part bid will not be considered.
6. The techno commercial bids will be opened at, Vendor complex, BHEL R.C.Puram
Hyderabad- 32 on tender due date at 13.00 hrs in presence of those tenderer who choose to be
present.
7. Date of opening of price bids (in case reverse auction is not resorted) will be intimated later to
the agencies technically qualified during the scrutiny of the techno commercial bid.
8. Security Deposit should be collected from successful tenderer as per terms of BHEL Works
policy. EMD of successful tenderer shall be converted and adjusted against the security deposit.
Security deposit shall not carry any interest.
9. The EMD will be refunded to the unsuccessful tenders on application after rejection of the
tender is intimated.
10. Copy of BHEL Works Policy, HR Circulars and OMI 195 applicable for job work contracts is
available for reference to contractors/contract representatives in the office of Sr.Dy. General
Manager/Plng (EM), 02 Annexe, Ground floor, BHEL, R.C.Puram, Hyd-32 during office hours.
III. TERMS AND CONDITIONS : 1. Quantities mentioned are approximate and may be operated fully or partially.
2. Quotations should be valid for at least 90 days from date of opening of technical bid.
3. The data required as per prequalification criteria and NIT conditions should be submitted
inevitably along with tender document. No extra time will be given for submitting the
documents as the contract is to be finalised and execution is to be started immediately due
to urgency of production work. Contractor/tenderer is not allowed to submit any data/
supporting documents at later stage during technical bid processing. If any contractor/
tenderer fails to submit all the supporting documents to fulfil the prequalification and
NIT conditions along with tender document it is the contractor/tenderer risk to forgo the
offer. This is one time contract job work activity up to 31.03.2013 only.
4. The Contract shall be executed in accordance with MODEL CONTRACT conditions and as
per OMI-195 applicable to job works.
5. The contractor shall not resort to subcontracting under any circumstances. If found
subcontracting at a later date, BHEL reserves the right to take whatever action it deems fit,
including cancellation of the contract.
6. PENALTY : If there is any delay or any interruption in execution of work, Penalty will be
recovered from the contractor @ Rs 5,000/- per day subject to maximum of 10% of total
contract value.
7. Any statutory increase in the labour wages during the period of execution shall be borne
by the agency. The agency shall quote the rates considering the possible labour wages
escalation also.
8. The contractor shall pay 20% bonus to contract work force as per Bonus Act 1965 and BHEL
circular.
9. Any increase in rate of DA/Wage hike shall not be reimbursed to the contractor.
Contractor shall anticipate such hike and quote accordingly.
10. The contractor should pay double the wages to the labour, if engaged on over time.
As per the provisions of Factories Act 1948 and its AP rules thereof.

11. The tenderer should quote the value exclusive of Service Tax.
Service Tax will be payable extra as per applicable rules subject to submission of document
proof.
12. BHEL reserves the right to reject or cancel the tender at any stage of the tendering process
without assigning any reasons thereof.
13. The contractor shall pay wages to the workmen as per minimum wages act 1971,
For daily wage rates applicable with effect from 01.10.12 please refer BHEL Circular No.
HR/IR/CL/DA/01.10.2012 Dt : 16.10.12. Contractor shall make payment as per the
applicable rate at the time of execution of the contract including arrears if any.
14. BHEL reserves the right to verify the information provided by the vendor/ contractor and
call for such of documentary evidence as required for the above including payment details
with cheque no‟s/TDS. In case the information provided by vendor/contractor is found to be
false/ incorrect , the offer shall be rejected and EMD of such vendors shall be forfeited.
15. The contractor is wholly responsible for loss of life or partial disability of any of their employees
while on duty. In case of occurrence of any accident/ injury to contractor labour, BHEL will not
pay any compensation. Contractor shall indemnify BHEL against all such costs resulting out of
accident to his employees.
16. The contractor shall submit the daily progress report to the concerned Engineer-in-charge.
17. Offers not accepting BHEL terms and conditions or offers with counter conditions are liable
for rejection.
18. The Tenderer should quote the unit rate per operation in the price bid. If the unit rate is
not quoted, the offer shall be rejected. BHEL will not work back for unit rate. Offers
will be evaluated based upon unit rate.
19. All columns must be filled with proper information. In complete bids are liable to be rejected.
20. Payment: progressive payments at monthly intervals for the work completed on quantifiable
basis in all respects as per Measurement Book. Contractor shall submit muster roll, wage
register, overtime register, PF challan and ESI challan for billing executed quantities. All
payments will be released subject to submission of clearance certificate issued by HR - IR
dept. Payments will be credited to bank account through electronic funds transfer.
21. If there is a delay in execution of work or denial, the work shall be awarded to another
contractor on “RISK PURCHASE BASIS” and the extra cost incurred on account of delay
or denial shall be recovered from the contractor.
22. If any information furnished by the tenderer is found false at a later stage, the tenderer shall be
Banned and the existing agreement and contract will also be cancelled at the risk and cost of the
contractor.
23. B.H.E.L reserves the right to short close the contract at any stage in case the performance of the
contractor is not satisfactory or any other reasons detrimental to the interests of BHEL.
24. Contractor shall have sufficient pool of experienced manpower in various semiskilled jobs like
Fitting jobs, Electrician jobs for assisting in taping of coils, stator/rotor winding, welding works
and machinist works for deploying them in three shifts as per work requirement without
operating any extra hours/over time beyond normal working hours.
25. Contractor shall obtain prior approval/permission of contract executing officer for engaging
contract workers on extra hours/over time.
26. Upon awardal of the work, within 7 (seven) days the party has to execute an agreement with
BHEL as per model contract before commencement of work.
27. Payment to the workers by contractor to be made on or before 7th
day of every month
without fail through their Bank accounts, otherwise suitable action shall be taken at
contractor’s risk and cost. Contractor has to issue wage slips to their workers.

28. The company does not expressly or by implication agree that the actual amount of the work
to be done shall correspond there with, but reserves the right to increase or decrease the
quantity of any item or portion of the work as it deems necessary.
29. Supervision of contract work force shall be monitored by contract supervisor. Contractor
And supervisor shall be available whenever required.
30. A tender may be rejected while scrutiny of technical bid, in case there is any unsatisfactory
past performance in the execution of an earlier contract.
IV. SAFETY MEASURES :
(a) The Contractor shall provide the required safety equipment like helmets, uniform,
safety belt, safety shoes, hand gloves, Nose mask etc., to the contract labourers engaged
by him. All sorts of safety measures to be taken shall be deemed to form an integral part of
the agreement and non-compliance with safety requirement amounts to breach of the contract.
(b) Contractor has to obtain work permit for “ working at heights above 3 meters height
from ground level ” wherever applicable .
(c) All tools, tackles, lifting appliances, scaffolds, cradles, safety nets, ladders, equipments etc. used
by the contractor shall be safe design and construction. The authorized BHEL officials shall
have the right to ban the use of any item, if such use is considered to be dangerous by the
concerned BHEL officials.
(d) If the contractor fails to take appropriate safety precautions or to provide necessary safety
devices and equipment or to carry out instructions issued by the authorized BHEL officials,
BHEL shall have the right to take corrective steps at the risk and cost of the contractor.
The contractor shall take necessary fire safety precautions as per directions of the authorized
BHEL officials.
(e) In case of a fatal or disabling injury accident to any person due to lapses by the contractor
BHEL shall have the right to impose appropriate financial penalty on the contractor and
recover the same from payments due to the contractor for suitably compensating the victim or
his/her dependents. Before imposing the penalty, appropriate enquiry shall be held by
BHEL.
(f) In case of any damage to property due to lapses by the contractor, BHEL shall have the right to
recover the cost of such damages from the payments due to the contractor after holding an
appropriate enquiry.

V. SPECIAL INSTRUCTIONS
1. If the tender is made by an individual, it shall be signed with his full name and his address shall
be furnished. If it is made by firm, it shall be signed with the co-partnership name by a member
of the firm, who shall also sign his own name also furnish the name and address of each member
of the firm. If the tender is made by a corporation it shall be signed by a duly authorized officer
who shall produce with the tender satisfactory evidence of his authorization. Such tendering
corporation firm is required to furnish evidence of its existence along with bid.
2. The EMD will be refunded to the unsuccessful tenders on application after rejection of the tender
is intimated. The earnest will be retained in the case of successful tenders and either of the cases
will not carry any interest. It will be dealt with as provided in the conditions attached to the
tender.
3. Whenever a tender is to be accepted, the tenderer, who‟s tender is under consideration, shall
attend the office of “Officer inviting the tender” on the date fixed by written intimation to him.
He shall forth with, upon intimation being given to him by the “Officer inviting the Tender” for
acceptance of his tender, completed the execution of the agreement by signing all the documents
connected there with. Failure to do so and not to commence the work with in one month from
date of intimation shall entail forfeiture of the earnest money.
4. Tenderers shall pursue carefully the instructions and directions to parties in tendering and the
conditions of the agreement and all other relevant documents before tendering the rates for the
work. The approximate quantity of work to be executed under each clause is given in the
schedule. The quantities are given with a view to enable tenderer to quote his overall rate for
each class of work in the tender form and for an uniform comparison of tenders. It shall be
definitely understood that BHEL does not accept any responsibilities for the correctness or
completeness of this schedule and the schedule is liable to alternations by omissions, deductions
or additions at the discretion of accepting authority.
5. The tenderer shall keep the offer valid for a period of 90 days from the date of opening of tender.
It is being understood that the tender documents have been sold/issued to the tenderer is being
permitted to tenderer in consideration of the stipulation on his part that after submitting the
tender, he will not recall his offer or modify the terms and conditions there of in a manner not
acceptable to the “Officer inviting the Tender”. Should the tenderer fail to observe to comply
with foregoing stipulations, the EMD shall be forfeited.
6. Tenderers have to quote their rates in the tender schedule legibly written in figures and words
and those not submitted in proper form are liable for rejection.
7. Contractor shall be deemed to have included in his tender price of all the appliances required
for the purpose of all operations connected with the work embraced under the contract to
secure a satisfactory quality of work and rate of progress which in the opinion of the
" Contract Signing Officer" will ensure the completion of the work within the time specified.
8. BHEL reserves the right to negotiate for price reduction with L1 party and negotiated price
will be considered as contract amount for all practical purposes.

9. BHEL reserves the right to terminate the contract at any stage without assigning any reason.
10. Contractor need to comply statutory obligations :
a) payment to contract labour as per the minimum wages act 1971 latest by 7th
of every month
through their bank account. b) Issue of monthly pay slip to contract labour indicating basic wage,
Dearness allowance and PF , ESI deductions and PF accumulation. c) Copies of PF and
ESI contributions paid through bank challan to be submitted to Contract executing officer
before submitting monthly bill.
11. Contractor is wholly responsible for injuries/ death of the person employed by him arising
due to accident during the contractual period. At any point of time BHEL will not be responsible
for any loss/ damage to the person arising out of accident for performing the contractual obligations.
12. Withdrawal from contract during contract period in BHEL will entail forfeiture of security deposit.
13. Labour engaged by the contractor should be disciplined & exhibit good behavior in dealing
with employees of BHEL. In case of any misbehavior or misconduct of any Peron engaged
by the contractor, contractor shall change that person immediately or else it may even
lead to termination of the contract & security deposit will be forfeited as penalty.
14. The contractor should abide by the company‟s CISF Security/ safety rules and provide such
safety requirements as per statutory rules and requirements of the factories act.
15. In case of breach of any of the terms and conditions of the contractor, BHEL reserves the right to
cancel the contract either in part or full.
16. In the agreement no mention shall be made regarding the number or the sex of the labourers to
be employed by the contractor. The agreement shall not contain provision to hire labour like
number of men, category of men, and number of mandays from the contractor for any type of
work. All types of job work agreements shall be based on clearly quantified volume of work
only.
17. The Executing Officer shall ensure the execution of work on quantifiable basis taking into
account equipment and machinery deployed rather than availability of labour.
18. Disputes, grievances between the contractor and his labour, will have to be settled by the
contractor only.
19. The contractor must satisfy himself by personal study and examination of the drawings/
specifications furnished and understand thoroughly the scope of proposed work in detail
and all conditions affecting the work before entering into the contract. There shall not be at
any time, dispute/complaint of any misunderstanding with regard to nature or omission of the
work to be done nor shall any application for compensation in terms of time and money
shall be accepted by BHEL regarding the above.

20. The contractor shall ensure adherence to all statutory requirements under the State rules in respect
of service conditions for the employment of contract labour. The contractor shall get himself
licenced from the Central Labour Commissioner as a contractor. It is understood by the
contractor that for this agreement to be effective, the prime condition is his fulfilling the
conditions of being licenced as a contractor and continuance of this agreement is subject
to the sustained ensurance of fulfillment to all statutory requirements in respect of
employment conditions for contract labour specified by Government from time to time.
Further as and when there are changes in the service conditions/wages rates for contract
labour, as notified by the State Labour Department, the same will be implemented even
if some modification is given at any time after the conclusion of the agreement.
21. Before quoting rates for the work, the tenderer shall inspect the site of work and should satisfy
himself about the nature and scope of work to be executed. BHEL will not, however, after
acceptance of a contract rate, Pay extra charges for any other reason. In case the contractor is
found later on to have misjudged the nature and scope of the work and also the availability of
materials.
22. BHEL reserves the right to deviate whether by addition or by deletion from the schedule of
items of work given in the tender document after awarding the work.
VI. GENERAL TERMS AND CONDITIONS
BHEL has the privity of the contract with the contractor only and will give instructions to the
contractor or his authorized representative. BHEL will have nothing to do or be concerned with the
employment of employees working for the contractor. The relationship between BHEL and the
Contractor will be that of independent entities and nothing herein contained will amount to joint
venture, partnership or an employer-employee relationship.
1. SELECTION AND CONTROL OF EMPLOYEES
a) Contractor to ensure that the employees deployed in the premises of BHEL are physically
and mentally fit and do not have any criminal record.
a) Contractor to maintain appropriate records of his employees deployed to carry out the job(s).
b) Contractor to provide employment card/Identity card with photograph duly attested by the
Contractor to his employees.
c) Contractor to provide uniforms / safety appliances to his employees.
d) In the event of completion/ termination/closure of contract for any reason whatsoever, the
contractor shall withdraw all his employees from the establishment of BHEL. In case
contractor decides to terminate services of his employees he should settle all terminal dues
including retirement compensation at his own cost.
e) Contractor shall obtain complete bio-data, of the labour employment certificate and
Antecedent verification in the prescribed form for each labour and supervisor engaged by
him and shall submit the same to the personnel department/IR section through the contract
executing officers before commencement of the work.

f) The contractor should engage only those who shall be more than 18 (Eighteen) years of
age.
g) A copy of the agreement between contractor and his labour shall be submitted to the
personnel department.
h) Personnel engaged in welding/painting work shall be qualified and their certificates to be
submitted along with the quotation.
i) In case of employment of women for work by the contractor, contractor will have to discharge
his obligations under relevant laws, Acts.
2. STATUTORY LIABILITIES
a) All statutory requirements under Minimum Wages Act, 1948, Payment of Wages Act, 1936,
Workmen Compensation Act. 1923, EPF & MP Act, 1952, Payment of Gratuity Act, 1972, ESI
Act, 1948, The Contract Labour (R&A) Act, 1970, Payment of Bonus Act, 1965, Income Tax Act
etc. shall be complied with by the contractor.
b) Contractor shall comply with all statutory requirements, rules, regulations, notifications in
relation to employment of his employees issued from time to time by the concerned authorities.
c) Contractor shall ensure payment of statutory prescribed minimum wages as applicable from time
to time through bank accounts and maintain proper records of their timely disbursement. These
records need to be preserved for a period of at least 3 years and should be made available even
after the contract is over for any verification by the statutory authorities.
d) Contractor to provide PF pass book to his employees and ensure payment of PF, EDLI, pension
dues under EPF & MP Act , 1952 to the RPFC.
e) Contractor shall ensure payment of ESI contribution under ESI Act, 1948.
f) Contractor shall produce proof of deductions as well as remittances of PF, EDLI, Pension, ESI
contribution, administrative charges etc. wherever applicable and shall maintain proper records.
g) Contractor shall furnish proper returns to the concerned statutory authorities.
h) Contractor shall be solely responsible for non payment/ delayed payment of wages, contributions
under EPF & MP Act, ESI Act etc.
i) In case the contractor fails to make payment of wages to his employees or remittance of
contribution to the concerned authorities, the security deposit/other dues under the contract can be
utilized by BHEL to discharge the liability of the contractor.
j) Contractor shall indemnify BHEL against all claims and losses under various statutes or any civil
or criminal law in connection with employees deployed by him.

k) The liability for any compensation on account of injury sustained by an employee of the
contractor will be exclusively that of the contractor.
l) Contractor to obtain insurance cover for his employees and take third party risk insurance
coverage at his own cost .
m) Contractor should have independent code numbers under EPF & MP Act, 1952 and ESI Act, 1948
and shall cover his employees under the said codes.
n) Every contractor shall submit a notice regarding commencement and completion of work in
Form-VI A&B (Rule 25 (viii) & 81 (3) to personnel department, IR section through the contract
executing officer, for forwarding the same to Central Labour Commissioner.
o) The contractor shall attend to all inspections notified/conducted by the personnel department,
Labour department, P.F authorities, Factory Inspectors ESI Inspectors, or any other such
authorities.
p) Non-Compliance of any provisions under the act/rule/instructions /guidelines shall make the
contractor liable for penal action including termination of contract.
q) Contractor shall furnish in a separate letter his place of residence and postal address. The delivery
at the above mentioned place or posting in a post box regularly maintained by the post and
telegraph department or sending letters registered for acknowledgement of any notice, letter or
other communication to the contractor shall be deemed sufficient service thereof upon the
contractor. Change in address shall come into force at any time by an instrument executed by the
contractor and delivered to the BHEL official who has signed the contract.
3. SUPERVISION
a) Contractor shall supervise the work allotted to him and to be carried out by his employees or to
post a supervisor for this purpose.
b) Contractor will be responsible for the good conduct of his employees/supervisors. In case of any
misconduct/misbehaviour by any employee/supervisors, the contractor will replace such
employee /supervisors immediately.
c) Contractor will ensure that the job is executed through his employees on his rolls and under no
circumstances the contractor will deploy any casual employee to carry out the job nor shall sub-
contract the job.
d) Contractor will keep watch on his employees and he will be liable for any pilferage / loss to
BHEL due to acts of omission and commission by his employees. Similarly, liability for any
compensation to outsiders on account of any act of omission and commission by the employees
deployed by the contractor shall lie exclusively with him.
e) Contractor to ensure that all precautions are taken for safety of his employees.

4. SUPPLY OF TOOLS, TACKLES AND MATERIALS
a) Contractor shall provide safety appliances at his own cost which may be required under the
statute or otherwise.
b) Contractor shall provide all material at his cost as mentioned in the contract to his employees for
carrying out the job.
5. OBLIGATION OF THE CONTRACTOR
a) Contractor shall fully comply with the following (General Terms and conditions) and
special instructions / enactments:
1) Contract Labour (R&A) Act,1970 and rules formed there under in A.P.
2) Wage Rates not less than that notified by State Labour Department /from time to time.
3) Payment of Wages Act.
4) ESI Act, 1948.
5) EPF Act, 1952.
6) Workmen's Compensation Act, 1923.
7) BHEL instructions as issued from time to time in regard to working hours, holidays,
or any other statutory provision.
8) Payment of Bonus Act, Gratuity Act, works contract Act, Service Tax Act,
Factories Act, Income Tax Act and any other applicable Acts. And all
other Act applicable in execution of contract.
b) The contractor shall obtain License from the Competent Authority if he engages 5 (Five) or more
workmen.
c) Contractor has to pay double the wages to his labour, if engaged beyond normal working hours.
d) Contractor shall pay the wages to the labour on or before 7th
of the following month.
e) The Contractor shall produce the following registers and forms before commencement of work,
for verification by the Executing Officer.

The Contractor shall maintain the above neatly, completely and legibly for inspection by
various authorities even at short notice. The Executing Officer of BHEL shall periodically inspect
these registers and forms and shall send his inspection note to Industrial relation (IR) section of
personnel department.
f) The contract shall observe

g) The contractor shall ensure that entry and exit of labour shall be as per the procedure laid down
by the BHEL personnel department. Entry permits for the labour are to be issued by the
contractor with contractors monogram.
h) Contractor shall in his absence keep competent agent constantly on the works and any direction
or explanations given by the “Contract signing officer” or his representative to such agent shall
be held to have been given to the contractor himself.
i) Contractor on the advice of BHEL official shall immediately remove any person employed by
him, who may in the opinion of the BHEL official is incompetent or misconduct‟s himself such
persons shall not be again employed on the works without written permission of the BHEL
official.
j) The contractor shall give all notices required by the acts, regulation, bylaws, legal acts and pay
all fees in connection therewith unless and otherwise arranged and decided in writing with
BHEL. He shall also ensure that no attachments are made against materials or work forming part
of or for the used of the contractor. In all such cases, contractor shall protect and indemnity
BHEL against any claim or liability arising from or based on the violation of any such laws,
ordinances, regulations, orders, decrees or attachment either by himself or by his employees.
k) It shall be contractor‟s sole responsibility to protect the public and his employees against
accident from any cause and provide required safety equipments and shall indemnify BHEL
against any claims for damages for injury to the person or property resulting from any such
accidents and shall, where the provisions of the workmen‟s compensation Act apply, take steps
to property insure against claims there under.
l) In the event of any accident in respect of which compensation may become payable under the
workmen‟s compensation Act, VIII of 1923 whether by the contractor or by BHEL as principal,
it shall be lawful or BHEL to retain out of moneys due and payable to the contractor such sum or
sums of money as may, in the opinion of BHEL shall be final in regard to all matter raising in
this clause.
m) No work shall be done on Sunday or any other declared Holidays of BHEL with out the written
permission of BHEL official In-charge of the work. The contractor shall comply with the
provisions of the factory act if the same are applicable.
n) The contractor shall keep his work place clean and safe to avoid injuries to men and damage to
finished products/equipment.

o) On the occurrence of an accident, which results in the death of any of the workmen employed by
the contractor or which is so serious as to be likely to result in the deathly of any such workmen,
the contractor shall within 24 hrs. of the happening of such an accident intimate in writing to the
BHEL official In-charge of the work.
p) Not withstanding the above clause, in case of any financial loss incurred by company on account
of contravention of the Provident Fund regulations or any regulations of rule touching the same
by the contractor, the contractor shall submit an undertaking to indemnify the company to the
extent of the loss incurred by the company.
q) The contractor shall provide the required safety equipment to the labours engaged by him.
r) Contractor shall issue “Employment Card” to all labour and supervisors covered under the job
work contract.
s) The contractor shall be responsible to settle the grievances of the labour deployed by him.
t) The daily wages to be paid to the contract Labour by the contractor after deducting the
employee contributions towards PF & ESI at the rate of 12% and 1.75% respectively, and
deposit the same to the appropriate authority. In addition to this the contract Labour are entitled
for Weekly off,11 paid Holidays per year and 18 paid leaves per year as per Wage rates as on
date. Contractor has to pay 20% Bonus to his workforce.
6. RIGHTS AND OBLIGATIONS OF THE PRINCIPAL EMPLOYER
a) In case the contractor does not carry out the contractual/statutory obligations or the services
rendered by him are found to be unsatisfactory, BHEL shall bring the same to his notice and he
will be obliged to discharge the obligations and rectify the deficiency / anomaly within three
days time failing which BHEL reserves the right to terminate the contract without assigning any
reason whatsoever. In such an event, no damages will be payable for short closure of the
contract.
b) Without prejudice to the aforesaid clause, BHEL reserves its right to terminate the contract
without assigning any reason thereof by giving 30 days notice in writing to the contractor.
c) The decision of BHEL regarding interpretation of any terms and conditions set forth in the
Agreement shall be final and binding on the contractor.
7. ARBITRATION AND GOVERNING LAW
a) In case of any dispute concerning the terms and conditions of the contract or its implementation,
attempts need to be made by the parties to settle the matter amicably. In case the dispute is not
resolved, the dispute needs to be referred for conciliation by an officer of BHEL. In case it
remains unresolved, the dispute be referred for arbitration by an officer of BHEL. In case
arbitration by an officer of BHEL is not acceptable, the same could be entrusted to any mutually
agreeable Government functionary or an independent person.
b) In case of any suit or other legal proceeding arising under this contract, the courts at Sangareddy
(Medak Dist.) A.P only shall have the jurisdiction.

VII. SPECIAL CONDITIONS
1. Whenever the term „CONTRACTOR‟ is used, it shall be understood to refer to the particular
person, full of co-operation with whom an agreement has been made by the concerned the
company official for Executing the work defined in the concerned agreement and for the purpose
of instructions regarding the complaints with contract conditions, it shall include the contractor‟s
authorised agents who are entrusted with the work by the contractor.
2. The quantities mentioned may or may not be actuals required for execution.
3. The company does not expressly or by implication agree the actual amount of the work to be
done shall correspond there with, but reserves the right to increase or decrease the quantity of
any clause or portion of the work as he deems necessary.
4. All work shall be carried out in accordance with the directions and to the satisfaction of the
company official in accordance with the drawings, specifications and instructions.
Supplementary or explaining the same as may from time to time shall be done by the company
official.
5. For all modifications, omissions or additions to the approved drawings and specifications, the
company shall issue revised plans or written instructions and no modifications, omission or
addition shall be made unless so authorised and directed by the company in writing.
6. The company shall have the privilege of ordering modifications, omissions, or additions at any
time before completion of the work.
7. All materials, articles and workman ship shall be the best of their respective kind for the class of
work described in the contract specifications and schedule and materials to be obtained by the
contractor shall be from sources approved by the company.
8. Sample of materials shall be furnished by the contractor at his expense to the company when
called for before execution of any work.
9. The company shall have power to reject at any stage. Any work which is considered to be
defective in quality of material or workmanship and shall not be debarred from rejecting wrong
materials by reasons or having previously passed them in an unworked condition. Any portion
of the work or materials rejected or pronounced to be inferior or not in accordance with
specifications shall be taken down and removed from the work site at the contractor‟s expenses.
10. The decision of the company shall be final and binding on the contractor on all technical
questions which may raise in the contract with respect to material, workmanship, removal of
improper work, interpretation of the working drawings, specifications, notes, procedures etc.
11. The decision of the “Contract Signing Officer” or any other officer deputed by him duly
authorised on his behalf, in respect of the rate of progress and the quality of work or material
shall be final.

12. Contractor shall be deemed to have included in his tender price of all the plant machinery and
appliances required for the purpose of all operations connected to secure a satisfactory quality of
work and rate of progress which in the opinion of the company will ensure the completion of the
work within the time specified.
13. If any time, during the progress of work or any part of it such methods or equipment appear to
the company official to be insufficient or inappropriate for ensuring the quality of work required
or rate of progress, he may order the contractor to increase their efficiency or to improve their
quality of work and the contractor shall comply with such order and on failure of which the
company may take such action as it deems it fit to improve the quality of work or the progress
required from the contractor and all such actions taken by the company shall be at the cost and
risk of the contractor.
14. It is open to the company to lend or supply to the contractor any tools, implements, materials and
machinery that are needed by the contractor, which in the opinion of the company is essential to
improve the quality or progress of work. The contractor shall pay such deposit or charges that
may fixed or determined by the company for any such articles or machinery lent or hired to the
contractor.
15. Any electric power required for contractors machinery for the purpose of work shall be supplied
by the company at the written request of the contractor at one point subject to the observance of
rules and regulations of Electricity Board/Company and charges there on shall be recovered from
the contractor.
16. The contractor shall conform to the regulations and laws of Central/State Govt. or any local
authority and that of the company with whose system the machinery is supposed to be
concerned.
17. All rubbish as it accumulates shall be removed from the site to the point of disposal as indicated
from time by the company. If this is not adhered to the company shall remove the scrap and
recover the cost of these operations from the bills of the contractor.
18. Any sum due from the contractor on account of tools and plants, stores or any other items
provided by the company shall be deducted from the respective bill due to him.
19. In case of breach of any of the terms and conditions of the contractor a claim shall be lodged
under the bank guarantee with the guarantor at the discretion of the competent authority of the
company. On successful completion of the contract to the satisfaction of the company, the bank
guarantee shall be released after due claim period.
20. In the event of any question or dispute under his contract, the same shall be referred to a
competent authority in the company for sole arbitration and his decision shall be final and
binding on the parties to this contract.
21. The company reserves the right to enter into parallel agreement with one or more contractor at
their discretion.
22. Disputes, grievances between the contractor and his labour will have to be secured by the
contractor only.

23.The labour employed by the contractor, if found in abetting any fellow labour or contractors or
any BHEL employee, the same shall be considered as an act of indiscipline. Such labourers shall
be removed from the services of the contractor, on the advice of BHEL. Further the contractor
shall initiate every necessary action in accordance with the relevant laws, Rules & Regulations
and enactments of State and Central govt.
24. Wherever BHEL/Company standards are mentioned, copies of which are enclosed shall be
strictly followed.
25. Nothing contained in the contract agreement and its conditions shall be deemed to preclude or
render inoperative the service of any notice, letter or other communication upon the contractor
personally.
26. The decision of the “Contract Signing Officer” shall be final and binding on the contractor on
all technical questions which may raise touching the contract with respect to the quality of
material, workmanship, removal of improper work, interpretation of the working drawings,
specifications, notes, procedure etc.
27. Entry and exit from the factory will be controlled by CISF Security as per the rules and which
the contractor has to follow.
28. The contractor has to execute the job in shifts as directed by the Sr. DGM/Plng. (EM).
29. Material/Facilities and tools required for carrying out the works inside the factory will be
supplied by the department free of cost.
30. The work is fully intermittent in nature and can be operated in spells in accordance with our
requirement.
31. In case it is found that particular area has not been attended to and /or the requirement of labour
as specified has not been engaged on the work, recoveries will be made from the bills in
proportion of the rates quoted.
32. All BHEL General Conditions of contract will apply to this work.
33. The decision of the SR.DGM/PLNG(EM) will be final and binding on the contractor in all the
matters of the contractor.
34. The contractor and his men should follow BHEL security regulation in force and amended from
time to time. Suitable action will be taken including summary termination/legal action for
breach of out security regulation by either the contractor or his men.
35. Any partner / Director of the firm/Company of the contractor banned by BHEL earlier and got
registered under different company/firm name are not eligible to quote.

BUSINESS RULES FOR REVERSE AUCTION
GENERAL TERMS AND CONDITIONS OF REVERSE AUCTION Against this Enquiry for the subject with detailed scope of supply/services as per our requirement, BHEL may resort to “ONLINE REVERSE AUCTION PROCEDURE” i.e. ONLINE BIDDING on INTERNET.
1. For the proposed reverse auction, technically and commercially acceptable bidders only shall be eligible to participate.
2. BHEL will engage the services of a Service Provider who will provide all necessary training
and assistance before commencement of on line bidding on Internet.
3. Business rules like event date, time, start price, bid decrement, extensions, etc. also will be communicated through Service Provider for compliance.
4. Contractors have to email a scanned copy of the Process Compliance Form (provided by
Service Provider) before start of Online Initial Sealed Bid. Without this form, the vendor will not be eligible to participate in the event.
5. Reverse auction will be conducted on schedule date & time.
6. At the end of reverse auction event, the lowest bidder value will be known on the network.
7. The lowest bidder has to email a scanned copy of the price break-up & confirmation duly
signed filled-in prescribed format (as per BHEL’s price excel sheet) as provided on case-to-case basis to BHEL through Service Provider within 24 hours of the reverse auction without fail.
8. Any variation between the on-line bid value and signed document will be considered as
sabotaging the tender process and will invite disqualification of vender to conduct business with BHEL as per prevailing procedure.
9. In case BHEL decides not to go for Reverse auction procedure for this tender
enquiry, the price bids and price impacts, if any already submitted and available with BHEL shall be opened as per BHEL standard practice.
10. Only those vendors, who participate in the Online Initial Sealed Bid, will be eligible to
participate in the subsequent Online English Reverse Auction.
11. The reverse auction will be treated as closed only when the bidding process gets closed in all respects for the works listed in the tender.

Please go through the guidelines given below and submit your acceptance to the same. 1. Computerized reverse auction shall be conducted by BHEL, on pre-specified date, while the
vendors shall be quoting from their own offices/ place of their choice. Internet connectivity shall have to be ensured by vendors themselves. In extreme case of failure of Internet connectivity, (due to any reason whatsoever may be) it is the bidders’ responsibility / decision to send fax communication immediately to Service Provider. Furnishing the price the bidder wants to bid online with a request to the Service Provider to upload the faxed price on line so that the Service Provider will up load that price on line on behalf of the Bidder. It shall be noted clearly that the concerned bidder communicating this price to Service Provider has to solely ensure that the fax message is received by the Service Provider in a readable / legible form and also the Bidder should simultaneously check up with Service Provider about the clear receipt of the price faxed. It shall also be clearly understood that the bidder shall be at liberty to send such fax communications of prices to be up loaded by the Service Provider only within the closure of Bid time and under no circumstance it shall be allowed beyond the closure of Bid time / reverse auction. It shall also be noted that the service provider should be given a reasonable required time by the bidders, to upload such prices online and if such required time is not available at the disposal of the Service provider at the time of receipt of the fax message from the bidders, the Service Provider will not be uploading the prices and either BHEL or the Service Provider are not responsible for this unforeseen circumstances. In order to ward-off such contingent situation bidders are requested to make all the necessary arrangements/ alternatives whatever required so that they are able to circumvent such situation and still be able to participate in the reverse auction successfully. Failure of power at the premises of vendors during the Reverse auction cannot be the cause for not participating in the reverse auction. On account of this, the time for the auction cannot be extended and neither BHEL nor Service Provider are responsible for such eventualities.
2. Service Provider shall arrange to demonstrate/ train your nominated person(s), without any cost to you. They shall also explain you, all the Rules related to the Reverse Auction/ Business Rules Document to be adopted along with bid manual. You are required to give your compliance on it before start of bid process.
3. The quoted rates on all works shall be Exclusive of all taxes as applicable. 4. The prices quoted should be firm.

5. Procedure of Reverse Auction:
i. Online Initial Sealed Bid: The opening bid (In the initial auction) of the bidders shall be same as that quoted in their Final Sealed price submitted to BHEL. The bidders shall confirm in writing to BHEL that their opening bid shall be same as that quoted in their final valid Sealed price bid submitted against tender notice no. HY/EMP/TENDERS/2012-13/07 Dt.19/11/2012. If it is found to be otherwise at a later date, the bidder will be disqualified from the tender.
ii. Online English Reverse (no ties) Auction {Dynamic Reverse Auction}: BHEL will
declare its Opening Price (OP), which shall be visible to all the vendors during the start of the Dynamic Reverse Auction. You will be required to start bidding after announcement of Opening Price and decrement amount. Also, please note that the start price of work in the online reverse auction is open to all the participating bidders. Any bidder can start bidding, in the online reverse auction, from the start price itself. If the start price is your own Online Initial Sealed Bid price, you still need to bid in the online reverse auction. Moreover, please note that the first online bid that comes in the system during the online reverse auction can be equal to the auction's start price, or lesser than the auction's start price by one decrement, or lesser than the auction's start price by multiples of decrement. The second online bid and onwards will have to be lesser than the L1 rate by one decrement value, or lesser than the L1 rate by multiples of the decrement value.
iii. The bid decrement amount shall be specified by BHEL.
iv. After the completion of English Reverse (no ties), the Closing Price (CP) shall be
available for further processing. 6. Successful vendor shall be required to submit the final prices, quoted during the English
Reverse (no ties) in the Format after the completion of Auction to BHEL, duly signed and stamped as token of acceptance without any new conditions other than those already agreed to before start of auction.

8. During the Online English Reverse (No Ties) Auction, if no bid is received in the auction
system/website within the specified time duration of the reverse auction, then BHEL, at its discretion, may decide to revise the auction's Opening Price / scrap the online reverse auction process / proceed with the conventional mode of tendering (opening of the hard copy final bids submitted by you earlier to BHEL).
9. Your bid will be taken as an offer to execute the work. Bids once made by you, cannot be
cancelled/withdrawn and you shall be bound to execute the work as mentioned above at your final bid price. Should you back out and not execute the contract as per the rates quoted, BHEL shall take action as appropriate.
10. You shall be assigned a Unique User Name & Password by BHEL or/ Service Provider.
You are advised to change the Password and edit the information in the Registration Page after the receipt of initial Password from BHEL/ Service Provider to ensure confidentiality. All bids made from the Login ID given to you will be deemed to have been made by your company.
11. You shall be able to view the following on your screen along with the necessary fields in the
English Reverse (no ties) { Reverse Auction} :
a. Leading Bid in the Auction (only total price of package) b. Bid Placed by you c. Your rank d. Opening Price & decrement value.
12. At the end of the Reverse Auction, BHEL will decide upon the winner. BHEL’s decision on award of Contract shall be final and binding on all the Bidders.
13. BHEL shall be at liberty to call the lowest bidder for negotiations / cancel the reverse auction
process / tender at any time, before ordering, without assigning any reason. 14. BHEL shall not have any liability to bidders for any interruption or delay in access to the site
irrespective of the cause. 15. Other terms and conditions shall be as per your techno-commercial offers and other
correspondences till date. 16. You are required to submit your acceptance to the terms/ conditions/ modality given above
before participating in the reverse auction. 17. Those vendors, who have participated in the Online Initial Sealed Bid, will only be eligible to
participate in the subsequent Online English Reverse Auction.

19. Material for Bid
i. Works contract for Partial off- loading for additional Semi-skilled operations in core assly
& machine assly, machine shops, copper shop, coil shop, stator winding, rotor winding
and insulation shop area of 02 shop as per Tender notice no.HY/EMP/TENDERS/12-13/07
Dt.19/11/2012 for a quantity of 3,187.5 M T, equivalent to 6,375 Mandays for total
value of Rs.36,75,188/-.
ii. Starting bid/Bid decrement : The opening price of Reverse Auction and Bid
decrement value shall be available to the bidders. At start of RA the same
will be displayed on the auction website.
iii. Bidding currency and unit of measurement, bidding and evaluation will
be conducted in Indian Rupees (INR) of the item.
iv. The above work consists of execution of semiskilled works by Fitters, Electricians,
Turners, Machinists, Welders, in assembly of generators, taping of coils, winding of 2
Pole/4 Pole rotors, winding works in stator winding. Fitter operations in the area of power
generation equipments, machine tools or equipments assembly, disassembly/ Electrical
works in the area of tapping or winding or brazing operations related to electrical
equipments or machines/ turning works on lathes/milling work on milling
machines/welding operations in the area of welding of pipes, plates etc., Contractor has
to carry-out any type of relevant works as per the instructions of the concerned officials.
v. BHEL SCOPE: BHEL will arrange electrical power supply, instruments, tools
and necessary battery trucks, forklift etc., required for carrying out the above
works.
vi. Rates are to be quoted Exclusive of all taxes and rates are to be quoted in
figures and words by the tenderer. In case of discrepancy in figures and words
the rates quoted in words shall only be considered by BHEL.
vii. BHEL estimates semiskilled worker can work for 0.5 MT of Material processing in
a Man-day.
viii. No increase in rate of DA / Wages hike shall be reimbursed to the
contractor. Contractor shall anticipate such hike and quote in the tender.
ix. The prices quoted should be valid for a period of 60 days from the date of Reverse
Auction and firm till the complete execution and extension period (if any) , in the event
of order.

TERMS AND CONDITIONS FOR REVERSE AUCTION
1. LOG IN NAME & PASSWORD: Each Bidder is assigned a Unique User Name & Password by Service Provider. The Bidders are requested to change the Password and edit the information in the Registration Page after the receipt of initial Password from Service Provider. All bids made from the Login ID given to the bidder will be deemed to have been made by the bidder.
2. BIDS PLACED BY BIDDER: The bid of the bidder will be taken to be an offer to execute the
work. Bids once made by the bidder cannot be cancelled. The bidder is bound to execute the work as mentioned above at the price that they bid. Should any bidder back out and not make the supplies as per the rates quoted, BHEL and / or Service Provider shall take action as appropriate.
3. LOWEST BID OF A BIDDER: In case the bidder submits more than one bid, the lowest bid
will be considered as the bidder’s final offer to execute the work.
4. AUCTION TYPE: 1) Online Initial Sealed Bid / Initial Auction. 2) Online English Reverse (No Ties) Auction (refer Bidder Manual for details) / Dynamic Reverse Auction.
5. DURATION OF AUCTION: The duration of Auction will be for 30 Minutes. If a bidder places
a bid in the last 5 minutes of closing of the Reverse Auction and if that bid gets accepted, then the auction’s duration shall get extended automatically for another 5 minutes, for the entire auction (i.e. for all the items in the auction), from the time that bid comes in. Please note that the auto-extension will take place only if a bid comes in those last 5 minutes and if that bid gets accepted. If the bid does not get accepted, the auto-extension will not take place even if that bid might have come in the last 5 minutes. In case, there is no bid in the last 5 minutes of closing of Reverse Auction, the auction shall get closed automatically without any extension. 6. BID DECREMENT: The minimum Bid decrement shall be available to the Bidders at the
start of the auction. The bidder can view the same by clicking on the Item details at the start of the auction. The bidder can bid lower than the Lowest Bid in the auction by a decrement, multiples of the minimum Bid decrement. Also, please note that the start price of an item in the online reverse auction is open to all the participating bidders. Any bidder can start bidding, in the online reverse auction, from the start price itself. If the start price is your own Online Initial Sealed Bid price, you still need to bid in the online reverse auction. Moreover, please note that the first online bid that comes in the system during the online reverse auction can be equal to the auction's start price, or lesser than the auction's start price by one decrement, or lesser than the auction's start price by multiples of decrement. The second online bid and onwards will have to be lesser than the L1 rate by one decrement value, or lesser than the L1 rate by multiples of the decrement value.

8. AUCTION WINNER: At the end of the Reverse Auction, BHEL will evaluate all the bids
submitted and will decide upon the winner. 9. PROXY BIDS: Proxy bidding feature is a pro-supplier feature to safe guard the supplier’s
interest of any Internet failure or to avoid last minute rush. The Proxy feature allows Bidders to place an automated bid against other Bidders in an auction and bid without having to enter a new amount each time after competing Bidder submits a new offer.
The bid amount that a Bidder enters is the minimum that the Bidder is willing to offer. Here the software bids on behalf of the supplier.
- The proxy amount is the minimum amount that the Bidder is willing to offer. During the course of bidding, the Bidder cannot delete or change the amount of a Proxy Bid.
- Bids are submitted in decrements (decreasing bid amounts). The application
automates proxy bidding by processing proxy bids automatically, according to the decrement that the auction originator originally established when creating the auction, submitting offers to the next bid decrement each time a competing Bidder bids, regardless if competing bids are submitted as proxy or standard bids. However it may please be noted that if a manual bid and proxy bid are submitted at the same instant manual bid will be recognized as the L1 at that instant.
- This feature can be used only once during a particular Reverse Auction and only
after the L1 rate is equal to or less than the minimum bid amount that the bidder has put in the system will he get the option to manually bid for the same. In no case during the bidding till the L1 rate or less is not reached as equivalent to the minimum bid amount offered by the bidder, will the bidder get the option to manually bid for the same.
10. OTHER TERMS & CONDITIONS:
- The Bidder shall not involve himself or any of his representatives in Price
manipulation of any kind directly or indirectly by communicating with other suppliers / bidders.
- The Bidder shall not divulge either his Bids or any other exclusive details of BHEL to any other party.
- BHEL’s decision on award of Contract shall be final and binding on all the Bidders. - BHEL along with Service Provider can decide to extend, reschedule or cancel any
Auction. Any changes made by BHEL and / or Service Provider after the first posting will have to be accepted if the Bidder continues to access the site after that time.
- Service Provider shall not have any liability to Bidders for any interruption or delay in access to the site irrespective of the cause.
- Service Provider is not responsible for any damages, including damages that result from, but are not limited to negligence.
- Service Provider will not be held responsible for consequential damages, including but not limited to systems problems, inability to use the system, loss of electronic information etc.
11. The details of Service Provider and other formats related to Reverse Auction will be intimated to Contractors, who are technically and commercially acceptable bidders only.

Guidelines and statutory payments for submitting tenders for

As per BHEL HR Circular HR/IR/CL/DA/01.10.2012 Dt : 16.10.12 the daily wage rate is
exclusive of Holiday and Leave ,Bonus, PF,ESI, PPE‟s and Uniform. Wage rates with effect from
