Six Week Extension of TAA Program On December 29, 2010, the President signed the bill to extend the 2009 Amendments that were scheduled to expire on December 31, 2010, including the HCTC provisions.   Please note that this bill also delays the effective date of the merit staffing requirements in the new TAA Regulations (20 CFR 618.890(b)) until no earlier than February 12, 2011. In effect, this legislation substitutes February 13, 2011 for December 31, 2010 (and December 15th for merit staff). 

Workers covered by certifications for petitions filed before February 13, 2011 will continue to be eligible for benefits available under the 2009 amendments.

If the expanded TAA Program does continue…

All current rules and expansions which began for all petitions certified after May 18, 2009 will stay in existence.

This includes:• 26 week deadlines for TRA eligibility• Training full-time or part-time, although full-time

training is required in order to meet TRA eligibility requirements.

• 78 weeks of Additional TRA• tax credits for 80% of the monthly health insurance

premium they pay. Qualifying insurance coverage includes COBRA, state COBRA, continuing individual coverage or other state-qualified plans.

• RTAA (ReEmployment Trade Adjustment Assistance)• Apprenticeship Training• Incumbent worker training

If the expanded TAA Program does not continue…Reversion to the former TAA parameters will result for Petition FILED on or after {an effective date}; those rules in effect prior to May 18, 2009 will include:

• The 8/16 deadlines for TRA benefits • Use of good cause provisions no longer in use• Non inclusion of service industry, public sector, etc. as

potentially eligible;• a reduction in Additional TRA benefits from 78 weeks to 52

weeks• No TRA election• No earnings disregard• Only the ATAA program-non continuation of RTAA program• a reduction in available training funds; and• a reduction from the 80% to 65% for the HCTC.
