SYNOPSIS
1. Common Law Admiss ion Tes t (CLAT) i s a non -s ta tu tory body
crea ted under Memorandum of Unders tanding (MoU). This
Memorandum of Unders tanding (MoU) was s igned by the Vice
Chance l lors of the seven Nat ional Law Univers i t ies on 23
November 2007 to conduct a common admiss ion tes t . The
Common Law Admiss ion Tes t was to be conducted every year
by each of the NLUs and the res pons ib i l i t y of conduct ing the
exam was to be ro ta ted and g iven on the bas i s of sen ior i ty in
es tab l i shment .The present PIL has been f i led chal lenging the
age e l ig ib i l i t y c r i te r ia for tak ing admiss ion in to under -graduate
program in the Common Law Admiss ion T es t (CLAT) be ing
u l t ravi res to the Rules of Legal Educa t ion , 2008, f ramed by
Bar Counci l of Ind ia under the powers confer red to them b y the
Advoca te s Act , 1961 and a l so aga ins t the pr inc i ples of na tura l
jus t ice and i s uncons t i tut ional .
2 . In 2014, a f resh Me morandum of Unders tanding was s igned by
a l l the Nat iona l Law Univers i t ies except Nat iona l Law
Univers i ty, Delh i . The new MoU replaced the ear l ie r CLAT
MoU, which was s igned in 2007. Accord ing to th i s MoU, now
a l l the 16 par t ic ipa t ing univers i t ies a re en t i t l ed to conduct
CLAT by ro ta t ion every year which sha l l be in accordance wi th
the i r year of es tabl i shment .
3 . That the Common Law Admiss ion Tes t (CLAT) for the year
2015 wi l l be conducted by Dr . Ram ManoharLohiya Nat ional
Law Univers i ty, Lucknow (RMLNLU) on the bas is of the
Memorandum of Unders tanding da ted on 10t h
May, 2015. The
CLAT core Commit tee for the year 2015 compr ises of the Vice
Chance l lors of a l l the par t ic ipat ing NLUs. Dr.Gurdip S ingh , by
v i r tue of being the Vice Chance l lor of the organis ing
univers i ty, i s the Convenor of CLAT Core Commit tee . The
appl ica t ion forms for CLAT 2015 are to be f i l l ed on l ine and
there i s no o ther mode of f i l l ing the appl ica t ion . The las t da te
for submi t t ing the appl ica t ion form is 31s t
March 2015
4 . That the Common Law Adm iss ion Tes t core commit tee has set
an e l ig ib i l i t y c r i te r ia because of which asp i rants above the age
of twenty years a re unable to apply for Common Law
Admiss ion Tes t which i s a l so u l t ra v i res to the Rules of Legal
Educa t ion , 2008 f ramed by Bar Counci l of I nd ia as Bar Counci l
o f Ind ia has withdrawn such e l igib i l i t y c r i te r ia through a
not i f ica t ion da ted 20 .09 .2013. Fur ther , i t i s a lso v iola t ive of
the lega l , cons t i tu t iona l and fundamenta l r igh ts of the CLAT
aspi rants .
5 . That the CLAT organizing commit tee does n ot have power,
whatsoever , to f ix such an age e l ig ib i l i ty c r i te r ia , as the same
i s ves ted only and only wi th the Bar Counci l of Ind ia under the
Advoca tes act , 1961. Hence , such an age el ig ib i l i ty c r i te r ia is
v io la t ive of the rules f ramed bythe Bar Counci l of Ind ia .
6 . That var ious High Cour ts , af te r cons ider ing the BCI
not i f ica t ion and the re levant ru les on the age res t r ic t ion
i ssued an ad - in ter im Mandamus to the respondent no .2 to
accept the hard of the appl icat ion form. Thus th i s i s an i ssue
af f ec t ing ple thora of aspi ran ts and hence Hon’ble cour t should
t ake cognizance of the same

thwwor ld .The preamble of the Cons t i tu t ion of India
unequivoca l ly a f fords the count ry and i t s c i t i zens wi th
s ign if icant ob ject ives l ike Democra t ic , republ ic ,
equa l i ty e tc . Tha t no person sha l l be depr ived of the
fundamenta l r igh t of equal i ty before law.
2 . Tha t Art ic le 14 of the Cons t i tut ion of India assures
the r igh t to equa l i ty before law. The Sta te i s under a
cons t i tu t iona l obl iga t ion to see tha t ru les and
regulat ions f ramed by i t s ins t i tut ions do not vio la te
the sa id fundamenta l r igh t . The s ta te should ensure
tha t a l l the rules and regulat ions re la t ing the lega l
educa t ion should be in consonance wi th the provis ions
of the Cons t i tu t ion of India .
3 . Tha t the f ie ld of lega l educa t ion i s a d i s t inguished
and magnif ic ien t f ie ld of educa t ion . This f ie ld in
India i s regula ted by the Bar Counci l of Ind ia in
accordance wi th the provis ions of Advoca tes Act ,
1961. To provide a be t ter regula tory f ramework for
the noble f ie ld of lega l educat ion, ru les on s tandards
of lega l educat ion and recogni t ion of degrees in law
for the purpose of enro lment as an advoca te and
inspec t ion of Univers i t ies for recogniz ing i t s degree
in law under Sect ions 7(1)(h) and ( i ) , 24(1) (c ) ( i i i ) ,
and ( i i ia ) , 49(1) (af ) , (ag) ,and (d) of the Advoca tes
Act , 1961 were ma de by the Bar Counci l of Ind ia in
consul ta t ion with Law Univers i t i es and S ta te Bar
Counci l s .
4 . Tha t the year 1987 sa w a paradigm sh if t in
percept ions about law as a career f rom one of the leas t
a t t ract ive careers , to one of the most sought af ter ,
wi th the es tab l i shment of the Nat iona l Law School ,
Bangalore . I t was a t ime of hope for the lega l
f ra te rn i ty. The concept of a nat ional ins t i tu t ion to ac t
as a pace -se t ter and a te s t ing ground for bo ld
exper iments in lega l educa t ion came up before the Bar
Counci l of Ind ia in the contex t of the Counci l ' s
s ta tu tory respons ib i l i t y for main ta in ing s tandards in
profess iona l legal educa t ion (under the Advoca tes
Act ) . Subsequent ly, wi th th e passage of t ime many
more Nat iona l Law Univers i t ies were es tabl i shed in
dif f e ren t s ta tes th rough s ta tu tes passed by the ir
respect ive s ta te leg is la tures in thi s regard .
5 . That the Common Law Admiss ion Tes t ( CLAT)is a
common law ent rance examina t ion for admiss ion to
prominent Nat iona l Law Univers i t ies in India . The
Nat ional Law Univers i t i es a re es tab l i shed through
s ta tu tes passed by the i r respec t ive s ta te legis la tures in
th i s regard . The CLAT for undergradua te programm es
i s taken af te r the Higher Secondary Examina t ion or
the 12th grade for admiss ion to
in tegra ted undergradua te prog rammes in Law and af te r
Graduat ion in Law for Maste r of Laws (LL.M)
programmes conducted by these law
univers i t ies .Before the in troduct ion of CLAT,
the autonomous law schools in India conducted the ir
own separa te en trance tes t s , requi r ing the candida tes
to prepare and appear separa tely for each of these
tes t s .
6 . Tha t a Publ ic Inte res t L i t iga t ion WP(civ i l ) was f i led
in the Hon’bleSupereme Cour t . In th i s Pe t i t ion , WP
(Civ i l ) No. 68 of 2006 , VarunBhagat v . Union of India
and Others , where in the Hon’ble Cour t direc ted the
Union of India to consul t wi th the Nat iona l Law
Univers i t ies to formula te a common ent rance tes t for
admiss ion in NLUs . Thereaf te r , the Minis t ry of
Human Resources Development , (Government of
Ind ia ) and the Univers i ty Grants Commiss ion of
Ind ia organized a meet ing of the Vice -Chance l lors of
seven Nat iona l Law Univers i t ies a long wi th the
Chai rman of the Bar Counci l of Ind ia . Af te r few such
meet ings , a memorandum of unders tanding (MoU) was
executed by seven Nat ional Law Univers i t ies for
conduct ing an a l l Ind ia leve l en t rance exam by the
name of Common Law Admiss ion Tes t (CLAT) and the
Common Law Admiss ion Tes t Commit tee was
cons t i tu ted which cons is ted of Vice -Chance l lors of
the seven par t ic ipa t ing NLUs. The law univers i t ies
tha t s igned th i s MoU are :

7 . Common Law Admiss ion Test (CLAT) is a non -
s ta tu tory body crea ted under Memorandum of
Unders tanding (MoU). This Memorandum of
Unders tanding (MoU) was s igned by the Vice
Chance l lors of the seven Nat iona l Law Univers i t ies on
23 November 2007 to conduct a com mon admiss ion
tes t . The Common Law Admiss i on Tes t was to be
conducted everyyear by each of the NLUs and the
responsib i l i t y of conduct ing the exam was to be
ro ta ted and given on the bas i s of sen ior i ty in
es tab l i shment .The f i r s t Common Law Admi ss ion Test
(CLAT) was conducted successful ly by The Nat iona l
Law School of Ind ia Univers i ty, Bangalore on 11t h
May, 2008. The CLAT was conducted each year b y
NLU in accordance with MoU. The las t exam was
conducted by Gujara t Nat iona l Law Univers i ty,
Gandhinagar (GNLU) on 11t h
May, 2014.
8 . Later on in 2009, o ther Nat iona l Law Univers i t ies
namely, Dr . Ram ManoharLohiya Nat iona l Law
Univers i ty, Lucknow (RMLNLU); Raj iv Gandhi
Nat ional Univers i ty of Law, Pa t ia la (RGNUL)
;Chanakya Nat iona l Law Univers i ty, Pa tna (CNLU)
and Nat iona l Univers i ty of Advanced Legal S tu dies ,
Kochi (NUALS) agreed in pr inc iple to u t i l i se the
CLAT score for admiss ions . Hence , the number of
par t ic ipa t ing univers i t ie s in CLAT increased to
e leven. Thereaf te r , i n the f i f th ed i t ion of CLAT which
was organised by Nat ional Law Univers i ty, Jodhpur in
2012, three o ther NLUs, namely, Nat ional Univers i ty
of S tudy & Research in Law, Ranchi (NUSRL);
Nat ional Law Univers i ty & Judic ia l Academy, Assam,
Guwahat i (NLUJAA) and Nat ional Law Univers i ty
Odisha , Cut tack (NLUO) joined .
9 . In 2014, a f resh Memorandum of Unders tanding was
s igned by a l l the Nat iona l Law Univers i t ies except
Nat ional Law Univers i ty, Delh i . The new MoU
replaced the ear l ie r CLAT MoU, which was s igned in
2007. Accord ing to th i s MoU, now a l l the 16
par t ic ipa t ing univers i t ie s are en t i t l ed to conduct
CLAT by ro ta t ion every year which sha l l be in

May, 2015. The CLAT core Commit tee
for the year 2015 compr ises of the Vice Chance l lors
of a l l the par t ic ipa t ing NLUs. Dr .Gurdip S ingh , by

11 . That the e l ig ibi l i t y c r i te r ia for appear ing in the
Common Law Admi ss ion Tes t , 2015 i s spec if ied on
the of f ic ia l websi te of CLAT (c la t .ac . in) .A copy of
the same is f i l ed herewi th and marked as Annexure 2.
The age l imi t for admiss ion to Undergradua te
programme to the par t ic ipat ing univers i t ies is
spec if ied as :
“A candidate should be be low 20 years o f age as on
1s t
Ju ly , 2015 (22 years in case o f SC/ST and
Persons wi th Disabi l i ty candidates , as prescr ibed
by the respect ive S ta tu tes o f the par t ic ipat ing
Universi t ies .”
12. That however , t he f ie ld of lega l educa t ion in India is
regulated by the Rules of Lega l Edcuat ion , 20 08
which were formed by Bar Counci l of Ind ia . The
c lause 28 of Schedule I I I of Rules of Lega l Educa t ion ,
2008 prescr ibed the age l imi t for admiss ion in to under
gradua te and post gradua te programmes . I t reads as :
“28. Age on admiss ion:
(a) Subjec t to the condi t ion s t ipula t ed by a
Universi ty on thi s behal f and the high
degree o f pro fess ional commitment
required , the maximum age for seek ing
admiss ion in to a s t ream of in tegrated
Bachelor o f law degree program, i s
l imi ted to twenty years in case o f
general ca tegory o f appl icant s and to
twenty two years in case o f appl icants
f rom SC, ST and o ther Backward
communi t ies .
(b) Subjec t to the condi t ion s t ipula ted by a
Universi ty , and the general soc ia l
condi t ion o f the appl icants seeking
legal educat ion be la ted ly , the
maximum age for seek ing admission
in to a s t ream of Three Year Bachelor
Degree Course in Law, i s l imi ted to
th i r ty years wi th r igh t o f the
Universi ty to give concess ion of 5
fur ther year for the appl icant
be longing to SC or ST or any o ther
Backward Communi ty .”
13. That the aforesa id c lause was wi thdrawn by the
Bar Counci l of Ind ia v ide a Not i f ica t ion da ted
28 .09 .2013. The sa id not i f ica t ion spec if ica l ly
ment ions tha t in v iew of the var ious dec is ions by
the d if fe ren t High Cour ts , the prescr ip t ion of age
l imi t of 20 years for v ide Rule 11 i s
uncons t i tu t iona l and agains t the pr inc ip les of
natural jus t ice and therefore , the sa id ru le is
be ing wi thdrawn. A copy of the Not i f ica t ion i s
f i l ed herewith and marked as Annexure 3 . The
Bar Counci l of Ind ia in the not i f ica t ion a l so

agony due to the impos i t ion of th i s i l l ega l

a) That Cons t i tu t ion of India under Ar t ic le 14

u l t ravi res to the ru les formed by Bar Counci l of

b ) That the Bar Counci l of Ind ia v ide i t s no t i f ica t ion
da ted 23 .09 .2013 has withdrawn the ru les
per ta in ing to age res t r ic t ions for admiss ion to
under gradua te courses of lega l educa t ion and now
there are no such ru les impos ing 20 years of age
res t r ic t ion . However , the CLAT Core Commit tee
has not ac ted in accordance wi th the sa id
not i f ica t ion andt he age res t r ic t ions a re s t i l l be ing
implemented which i s u l t rav i rus to the Rules of
Lega l Edcuat ion , 2008 f ramed by the BCI which i s
the s ta tu tory au thor i t y for regulat ing the legal
educa t ion in India . The BCI in i t s no t i f ica t ion has
i t se l f s ta ted tha t res t r ic t ing the age l imi t for
admiss ion to under -grauda te course i s beyond the
leg is la t ive competence of Bar Counci l of India and
i s u l t ravi res to the provi s ions of Sec t ion 7(1) (h)
and ( i ) and 24(1) (c ) ( i i i ) and ( i i ia ) or Sec t ion 49(1)
(af ) , (ag) and (d) of the Advoca tes Act . Even

c ) Because even Bar Counci l of Ind ia , which i s the
only au thor i ty for regula t ing legal educa t ion in
India , as per the powers g iven to them under
Sec t ion 49 (1) (c ) of Advoca tes Act , 1961 does not
have leg is la t ive competence to make such ru les ,
which a re in vio la t ion of the provis ions of
Advoca te Act ,1961. CLAT o rganis ing commit tee
which is a non -s ta tu tory body es tab l i shed under a
Memorandum of Unders tanding s igned be tween 16
Nat ional Law Univers i t ies cannot impose such age
l imi t for the admiss ion in to inst i tut ions impar t ing
lega l educa t ion . The Legal profess ion i n India i s
regulated by the Advoca te Act and any ru le which
i s in v io l i t ion of the provis ions of the Advoca te
Act i s agains t the spi r i t of lega l profess ion .
Therefore , CLAT does not have any leg is la t ive
competence to make such ru les . This age e l ig ibi l i t y
c r i te r ia i su l t rav ires to the Rules of lega l Educat ion,
2008 .
d ) That h igh court s of d if fe rent ju r i sd ict ions a re
a l lowing those candida tes who are f i l ing wri t
pet i t ions before them to f i le a phys ica l copy of
appl ica ton to the CLAT organiz ing commit tee . As a
resu l t of which only those asp i ran ts , having
knowledge and access to the cour t s , a re ab le to f i l l
th i s appl icat ion form. Hence , despi te of having a
chance of be ing e l ig ible for CLAT, they a re not
be ing al lowed to s i t for CLAT because of the lack
of knowledge and resources . This has resu l ted in a
whole new class of asp i ran ts whose r igh ts are be ing
v io la ted .
e ) That the sa id age res t r ic t ion i s v io la t iveof
fundamenta l r igh t guaran teed under Ar t ic le 14 of
Cont i tu t ion of Ind ia . Al l those asp i ran ts who are
above 20 years of age , and want to appear in CLAT
examina t ion but a re unaware about f i l lng of the
wr i t pe t i t ion a re los ing on the ir car re r because of
the sa id age res t r ic t ion.The asp i rants a re under the
impress ion tha t s ince the i r appl icat ion forms a re
not accep ted on the CLAT webs i te , they a re not
e l ig ible for appear ing in the sa id exam. This i s not
on ly d ishear ten ing for these asp i ran ts , bu t i s a l so
af f ec t ing thei r p repara t ion and thus , a f fec t ing l ives
and careers of many young asp i ran ts .
f ) That applying for CLAT is cheaper for those
candidates who come s wi th in the age l imi t s as
compared to those s tudents who does not fu lf i l the
e l ig ibi l i t y c r i te r ia because of the fac t tha t those
who are wi th in the age l imi t s can f i le an
appl ica t ion via the in te rne t , whereas t hose who are
overagedincure mul t ip le expenses such as l i t iga t ion
cos t , pos tal expenses e tc . This d if fe rence be tween
the cost of applying for CLAT is subs tan t ia l and i t
v io la tes r igh ts of tha t sec t ion of the asp i ran ts who
a re not e l ig ible because of the ag e res t r ic i ton se t
ou t by the CLAT organizing commit t ee .
g ) That Ar t ic le 19(1) (g) provides every c i t izen of
India a r ight to prac t i se any profession , or to car ry
on any occupat ion , t rade or bus iness . The sa id
e l ig ibi l i t y c r i te r ia of age for admiss ion into leg al
educa t ion v iola t es the fundament r igh t under
Ar t ic le 19(1)(g) of Cons t i tu t ion of India as those
law asp iran ts who want to under take thei r l ega l
educa t ion in the NLU’s but a re unable to take
admiss ion because of the i l l ega l age res t r ic t ion se t
by the CLAT commit tee thus , u l t imate ly a f f ec t ing
them in pursu ing the i r lega l car re r and thei r r igh t
to en te r into lega l profess ion .
h ) That wi th the es tab l i shment of the Nat ional Law
Univers i t ies , the s tandard of lega l educa t ion in
Ind ia has been improved mani fo ld t imes and wi th
the passage of t ime , the NLU have made thei r own
pres t ige . Al l the law s tudents asp i re to take
admiss ion in the NLU’s because of the NLU brand
name and more so because of the s tandard of lega l
educa t ion provided by the NLU’S. I t i s submi t ted
tha t as a l l the NLU’S except Delh i take admiss ions
th rough the CLAT and those asp i ran ts who do not
qua l i f y for f i l l ing the admiss ion form because of
the age res t r ic t ion a re denied admiss ion in the
NLU’S which i s v io la i tve the ir fundamenta l r igh ts
guaranteed under Ar t ic le 14 , 19(1)g and 21.
i ) That the BCI be ing the s ta tu tory bod y for
regulat ing the lega l educat ion in ind ia , a l l the law
col leges have to be recognised by i t and should act
in accordance with the ru les f ramed by the B CI . I t
i s submi t ted that whi le o ther law col leges in India
have not prescr ibed any age l imi t for taking
admiss ion in the undergraduate law course , the
NLU’s have prescr ibed the age res t r ic t ion which i s
ul t ra v i rus to the ru les f ramed by the BCI and is
v ia lo t ive to the fundamental r igh ts guaranteed
under the cons t i t iu t ion of India .

CLAT upper age limit to remain unchangeddespite Allahabad HC judgment
The 20year age limit to appear in the Common Law Admission Test (CLAT) remainsunaffected by the Allahabad high court judgment of May 2014, in which the court hadnoted that there can be no such restriction since the Bar Council of India (BCI) hadalready scrapped the maximum age limit on undergraduates.
CLAT 2015 convenor RMLNLU’s vice chancellor Prof Gurdip Singh commented: “In thecore committee meeting we discussed this issue. It was pointed out that [the judgment]was applicable to only those [two candidates who had filed the petition before theAllahabad HC]. There is no high court judgment coming in the way [of the presently fixedeligibility criteria].”
When asked about the effect of the high court’s observation that a BCI notification haddeclared the age limit criteria unconstitutional, Singh said: “The core committee has thepower to independently decide eligibility criteria. The order doesn’t affect the authority ofthe CLAT core committee as such.”
The Allahabad high court had in May directed CLAT 2014 convenor GNLU Gandhinagar toallow two 21yearold CLAT aspirants to appear in the entrance test.
This year’s age limit relaxation has been granted to candidates from the personswithdisabilities (PwD) category, from which candidates up to 22 years of age can now appear,as reported by Legally India. Until CLAT 2015, only candidates from the scheduledcategories (SC/ST) were granted this relaxation.

There is no high court judgment coming in the way (of the presently fixedeligibility criteria).''
On the BCI notification that declared the age limit criteria unconstitutional, Singh said, "The corecommittee has the power to independently decide eligibility criteria.''
Singh, who had a meeting with the vicechancellors of National Law University Raipur andJodhpur, said the online application process for admissions to 15 NLU's would begin fromJanuary 1. Ram Manohar Lohiya National Law University which is conducting (CLAT) 2015 hasissued a notification on Tuesday. The last date for filling online applications is March 31.
On reservation policy, Singh said, "There is no common reservation policy for admissions to theNLUs. The reservation details would be followed as per the statutes of respective participatinguniversities. A comparative study of reservation would be put on the CLAT website soon.''
Besides, merit listcumpreference will be the basic principle of admission for CLAT2015 andallotment of candidates to various NLUs will be based on the same.
