INVITATION FOR EXPRESSION OF INTEREST

Title: Loan 3132: IND- Jammu and Kashmir Urban Sector Development Investment Program, Project 3
Consultancy Services for Capacity Building of Urban Local Bodies of Jammu & Kashmir.
1. India has received a loan from the Asian Development Bank (ADB) towards the cost of Loan 3132-IND: Jammu and Kashmir Urban Sector Development Investment Program, Project 3. Part of this loan proceeds will be used for eligible payments under the Consultancy services.
2. J&K Economic Reconstruction Agency (J&K ERA) is the executing agency for the investment program. The objective of the Investment Program is to ensure that the quality of urban infrastructure and municipal service delivery are improved in a sustainable manner to enhance economic growth of main urban areas of J&K with emphasis on promoting commerce and improvement of livelihoods of the poor. The program will finance urban infrastructure development in the sectors of Expressway Corridor (flyover) , water supply, drainage and Urban transport and other infrastructure in the cities of Jammu and Srinagar
3. Municipal service in the urban areas of Srinagar and Jammu is provided by the Municipal Corporations working under Ministry of Housing & Urban Development, Government of Jammu and Kashmir's (GoJ&K) . GoJ&K intends to improve Municipal services in urban areas of Jammu and Srinagar through ongoing infrastructure investments. It seeks also to bring about improvements in service levels, operational efficiency and financial sustainability of the Municipal services through institutional, financial and IT reforms as well as improvements in the tariff structure and subsidy mechanism.
4. To assist in the capacity building of both Municipal Corporations in the divisions of Jammu and Kashmi r, J&K ERA (herein referred to as the "Employer") now invites services of eligible International Consultancy Firms (hereafter referred to as Consultant) having prior experience in providing similar consulting services on externally financed projects to be procured on the basis of the ' Quality and Cost Based Selection (QCBS) method.

5. 6. Only short listed consu lting firms will be invited to submit their technical and financial proposals subsequently. The consultants shall be selected and engaged in accordance with the Guidelines on the Use of Consultants by ADB and its Borrowers. Firm(s) engaged as DSC or PMC under JKUSDIP will not be eligible to submit proposal and will not be shortlisted for this assignment

Terms of Reference
1 Background
1. Municipal service in the urban areas of Srinagar and Jammu is provided by the Municipal
Corporations working under Ministry of Housing & Urban Development, Government of Jammu and
Kashmir’s (GoJ&K). GoJ&K intends to improve Municipal services in urban areas of Jammu and
Srinagar through ongoing infrastructure investments. It seeks also to bring about improvements in
service levels, operational efficiency and financial sustainability of the Municipal services through
institutional, financial and IT reforms as well as improvements in the tariff structure and subsidy
mechanism.
2. At present, Municipal services in Jammu and Srinagar cities are assigned to Municipal Corporations
of Jammu and Srinagar are only some of the following functions categorized in Twelfth Schedule
(Section 243-W) include .
Urban planning including town planning.
Regulation of land-use and construction of buildings.
Planning for economic and social development.
Roads and bridges.
Water supply for domestic, industrial and commercial purposes.
Public health, sanitation conservancy and solid waste management.
Fire services.
Urban forestry, protection of the environment and promotion of ecological aspects.
Safeguarding the interests of weaker sections of society, including the handicapped and
mentally retarded.
Slum improvement and up gradation.
Urban poverty alleviation.
Provision of urban amenities and facilities such as parks, gardens, playgrounds.
Promotion of cultural, educational and aesthetic aspects.
Burials and burial grounds; cremations, cremation grounds; and electric crematoriums.
Cattle pounds; prevention of cruelty to animals.
Vital statistics including registration of births and deaths.
Public amenities including street lighting, parking lots, bus stops and public conveniences.
Regulation of slaughter houses and tanneries.
3 The 74th Constitutional Amendment Act empowers Urban Local Bodies with appropriate functions and powers in relation with the State Govt., concerning elections and revenue sharing. Besides Urban Local Bodies are entrusted under the Act to play a key role in development activities and programmes. The Act provides for
• Devolution of more functions and taxation powers
• Revenue sharing with State Governments funds
• Regular conduct of elections
• Reservation of seat for SC, ST and Women
• Uniform composition of Urban bodies throughout the country
• Prescription of criteria for categorizing urban local bodies like, Town Panchayat, Municipalities,
City Municipal Corporation
• Restriction on the formation of township only to Industrial areas where the entire municipal
service are provided by the Industries
• Formation of District Planning and Metropolitan Planning Committee
The Act also provides for constitution of State Finance Commission to review the Financial Status of
ULBs and submit recommendations. State legislature can authorize municipality to levy, collect and
appropriate such taxes, duties, tolls and fees within prescribed limits. The Act lays specific stre ss on
urban environment management and integration of rural urban development plans in any district or
metropolitan area.
Empowerment of Urban Local Bodies
Empowerment of urban local bodies, particularly the two corporations, should become the focal
point for policies in the sector. This is a long term issue and the policy will need to evolve in view of
the constraints.
There had been no significant activity relating to urban local bodies in the state before 1947 and
even during the period prior to the 74th Constitutional Amendment in 1994. These proposals of
1992 on decentralization were effected in the state in 2000, political uncertainty and law order
being the factors for the delay. The first elections under the new law have taken place in 2005. While
political aspects have been addressed under the new act, the issues relating to functions and
finances and functionaries not been focused.
Empowerment would imply sharing of powers between the existing political and administrative
institutions of the state with the new functionaries in local bodies.
Despite the provisions in the Act, the Municipal Corporations and The development Authorities
operate with limited staff and capacities. There is a mismatch between the skill sets and the work
assigned and this will need to be rationalized. Currently, capacity enhancement is by deputation of
Staff from PHED or other State Departments. However, the issue is also of providing opportunities
for growth in the ULB's and more importantly in terms of strengthening the cadres within.
Despite the existence of two acts to deal with urban planning, i.e. Town Planning Act, 1963 and J&K
Development Act, 1970, the deficiencies are most prominent in laws relating to urban planning
itself. The following acts require amendments to implement the proposed urban policy.
J&K Development Act, 1970
The act being the principal tool for urban planning and functioning of development authorities in the
state needs extensive changes The issue is of clarity of development and maintenance functi on, and
powers to charge, though the most ideal solution would he In term of A single agency performing all
the functions.
NEED FOR A GREATER ROLE FOR ULBs
Going by the letter and spirit of the 74th Amendment, it is apparent that the ULBs need to be given
the primary role and mandate for basic urban planning and provision of civic amenities to the people
of the respective towns.. There is a need for intensive and extensive training of personnel at
different levels to ensure smooth functioning of this new State Govt-ULB dispensation.
TRAINING
While the 74th Amendment provides a comprehensive framework for Urban Reforms, it also lays
emphasis on training of personnel at various levels to bring about the necessary attitudinal change
and skill up gradation for effective urban governance.
E-Governance in JMC
The corporation has taken up the computerization of the municipal records at the first instance; the
corporation computerized the data of last 17 years pertaining to the death and birth record. The full -
fledged computer section has been installed in the Jammu Municipal Corporation with the
assistance of the NIC where the whole record of the Municipal is being computerized in a phased
manner However E-Governance is yet to be introduced in the offices of the Jammu Municipal
Corporation where the traditional file-of-papers system is still in vogue. Computerization for the
following works has been introduced.
(i) Service Records of employees
(ii) Salary bills
(iii) Receipts and Expenditure records
(iv) Inventory of assets.
2 Objective of the Assignment
4. The main objective of this assignment is to improve service levels, operational efficiency and
financial sustainability of Municipal Corporations in Srinagar and Jammu in line with 74th
Amendment. Specific objectives are:
• Institutional restructuring of Municipal Corporations in urban areas of Srinagar and Jammu
• Improvement of operational efficiency
• Improvement of financial sustainability of operations
• Tariff rationalization plan and design of transparent subsidy mechanism
• Improved service levels and customer responsiveness
• Preparing a comprehensive Organizational Development Plan with clear action plans and
timelines to enhance the restructure, functions and staffing of the municipal corporations in
J&K in order to improve overall efficiency, productivity and effectiveness of service delivery
to citizens;
• Preparing Prescribed Charter of Functions for the municipalities drawing from structure
prescribed in the Municipal Corporation Act (2000) and from the 74th Constitutional
Amendment of Government of India;
• Preparing the recommended organizational chart, with duties and job charts for each
position, for the Corporations;
• Defining the job description for each department and its wings;
• Examining the existing systems, practices & methods of dealing with various issues in each
department; suggesting improvements and developing new methods for each group of
functions and activities;
• Recommending decentralization in administration;
• Conducting training needs assessment and providing on the job training to existing
employees and induction training to direct recruits;
• Preparing tailor made training courses for future usage in the corporations.
• Preparing Human Resource Development Plan for the Corporations;
• Preparing Revenue Improvement Action Plans for the Corporations; and
• Providing hand-holding support to the municipalities in implementation of accrual based
accounting system.
3 Scope of Services:
5. The consultant is expected to work with Municipal Corporations working under Ministry of Housing
& Urban Development, Government of Jammu and Kashmir’s (GoJ&K) in the planning and design of
reforms and improvement plans. For this the consultant should study the existing situation,
including legal, organizational, financial and operational arrangements, and prepare reform options
in consultation with GoJ&K. The consultant will provide implementation and handholding support to
GoJ&K and Municipal Corporations for the implementation of reforms and improvement plans. It is
expected that the consultant will subsequently support GoJ&K and Municipal Corporations in the
implementation of these plans.
Preparation of Business Plan and Reform Strategy: It is envisaged that background studies,
preparation of plans, and the structuring and design of reforms will be completed over a three
month period from the commencement of this assignment.

5. Reporting Requirements and Time Schedule for Deliverables
(i) Inception report within 15 days of commencement of services describing the schedule of
submissions and detailed work program supported by mobilization plan of the experts in
four hard copies and one soft copy
(ii) Preparation of Business Plan and Reform Strategy plan including As is’ Assessment of
Municipal Operations; Business Plan (5-Year Planning Framework); Performance
Improvement Plan; Institutional Development Plan; Financial Management Plan;
Information Technology Plan and Training Plan in 3 months time in four hard copies and
one soft copy
(iii) Design a clearly defined subsidy mechanism for Srinagar and Jammu Municipal
Corporations.
(iv) Preparation of water tariff determination manual with tariff norms and principles.
(v) Preparation of rules and regulations for periodic review of tariff, as may be required in
terms of the Water Resources Act.
(vi) Monthly and quarterly progress reports on the status of delivery of various document and
activities etc
(vii) Additional Reports, as per contract and as required by the Executing Agency and
Implementing Agency
6. Client’s Input and Counterpart Personnel
Services, facilities and property to be made available to the Consultant by the Client:
Office accommodation with furniture, power and water supply facility at Jammu and
Srinagar project cities
(b) Professional and support counterpart personnel to be assigned by the Client to the Consultant’s
team:
Counterpart engineering staff in PMU/PIUs of JKERA
Counterpart staff in Municipal Corporations to provide all institutional related data and
information
7. Client will provide the following inputs, project data and reports to facilitate preparation of the
Proposals:
Data, reports, maps etc as available for Jammu and Srinagar project cities with the
Government, Municipal Corporations and ERA
Institutional audit report prepared by Project consultants
