May7,2018TheRightHonourableJustinTrudeauPrimeMinisterHouseofCommonsOttawa,ON K1A0G2DearPrimeMinisterTrudeau,WearewritingthisopenlettertoyoutodayonbehalfoftheInternationalCivilLibertiesMonitoringGroup,acoalitionof45civilsocietyorganizationsacrossCanada,tourgeyourgovernmenttoinstateafull,independentandpublicinquiryintothecaseofDr.HassanDiab.WearegreatlydisturbedbytherecentrevelationsthatanofficialintheJusticeDepartmentmayhavenotonlyassistedtheFrenchgovernmentinmakingitscaseforextradition,evenastheexistingcaseagainstDr.Diabwasbeingdiscredited,butisalsoallegedtohavemisledthecourtregardingcommunicationwiththeFrenchgovernmentandthereasonsforlengthyadjournments.Thisisinadditiontogovernmentofficialsapparentlywithholdingimportant,exculpatoryfingerprintevidencefromthecourtandDr.Diab’sdefenselawyers.TheseseriousallegationsonlyaddtothegravelyconcerningcircumstancesofDr.Diab’sextraditiontoFrance.Evenbeforetheselatestallegations,thereweregroundstorequestapublicinvestigationintoDr.Diab’scase,aswehavesignalledtomembersofyourgovernmentinpreviousletters.ThisincludesthefactthatthecaseagainstDr.Diabincludedsecret,unsourcedintelligencefromathirdcountry,thereliabilityandprovenanceofwhichwascompletelyunknown.Thiscontinuestoraiseconcernsthattheintelligencewasderivedundertorture,andquestionsastowhethersuchinformationshouldbeallowedinextraditioncasesinthefirstplace.Membersofthegovernmenthavestatedtheirconcernabouttheserecentrevelations,aswellastheirsupportforaninternalinvestigationattheJusticeDepartment.Whileweappreciatetheseriousnessexpressedinthesestatements,wecannotsupportaninternalinvestigationconductedbythesamedepartmentwhoseofficialsareallegedtohavecarriedouttheactionsinquestion.Forthatreason,weareaskingthatyouestablishanindependent,publicinquiryintoDr.Diab’scase.WewouldechotheletteralreadysharedwithMinisterWilson-RaybouldbyAmnesty

InternationalandtheBCCLAandcallforaninquirytoexamine:

• Canadiangovernmentlawyers’actionsduringtheextraditionprocess,includingtheappropriatenessoftheassistanceprovidedtotheFrenchgovernment,thetruthfulnessofstatementsmadeincourtandthereasonsfordecisionsnottoshareexculpatoryevidencewithDr.Diab’slegalteam.

• TheactionsofgovernmentofficialsduringDr.Diab’sthree-yearimprisonmentwithoutchargeinFrance

• ReformstotheExtraditionActtoaddressweaknessesthatallowedthisextradition,evenasthepresidingjudgedescribedthecaseagainstDr.Diabashighlyproblematic.

• AppropriateredresstoDr.Diabandhisfamily,includinganofficialapologyandappropriatecompensation,foractionsorinactionofCanadianofficialsthatmayhavecontributedtothehumanrightsviolationsandmiscarriageofjusticeheexperienced.

Dr.Diabspentmorethanthreeyearsinnear-solitaryconfinementinFrance,afteryearsofsurveillance,electronicmonitoringandimprisonmentinCanada–despitenochargehavingbeenlaidinFrance.Canada’sextraditionsystemfailedDr.Diab,anditisincumbentonyouasPrimeMinisterandtheCanadiangovernmenttoacttoensurethatDr.Diab,hisfamilyandtheCanadianpublicreceiveanswersastohowthiscameabout,andtosafeguardagainstothersfromsufferingasimilarfate.WeurgeyourGovernmenttosetupthepublicinquirywithoutdelay.Sincerely,
