“First Haul” 168.013 Sub 3 (d) 3

“First Haul” means

• The first, continuous transportation of unprocessed or raw farm products from the place of production or on-farm storage site to any other location within 100 (changed from 50) miles of the place of production or on-farm storage site.

First Haul – Forest Products

• The continuous or non-continuous transportation of unfinished forest products from the place of production to the place of final processing or manufacture located within 200 miles of the place of production

169.871 (Civil Weight Law)• Subd. 1b.Civil penalty for first two violations.• Notwithstanding subdivision 1, paragraph (a),

clauses (1) to (5), a civil penalty under subdivision 1 for a violation in a motor vehicle in the course of a first haul as defined in section 168.013, subdivision 3, paragraph (d)(3), of a weight limit imposed under sections 169.823 to 169.829, 169.84 to 169.851, and 169.87 that is not preceded by two or more violations of the gross weight limits in those sections in that motor vehicle within the previous 12 months, may not exceed $150.

Penalty Examples (169.871)

• 100,000 pound load on 9 or 10 ton road.• 20,000 pound gross overweight• $150. “civil” penalty if “first haul” for the first

two loads. (must be the same vehicle).• $3210. for the third load.

• First haul penalty exemptions apply to civil prosecutions only….”not” criminal (roadside) weight enforcement
