3 Motion to Strike Portions of the First Amended Complaint ("Motion to Strike") .in the above-entitled

4 action came on for hearing on December 15, 2015 at 9:30 a.m. in Department 302 of the San Francisco

5 Superior Court, the Honorable Harold E. Kahn presiding. Plaintiffs CITY AND COUNTY OF ~AN

16 Inspection ("DBI") records, Defendants are not entitled to have any portions of the First Amended

17 Complaint stricken. All of the portions of the first amended complaint that Defendants seek to strike

18 are evidentiary facts which have independent relevance apart from the DBI records.

19 3. The doctrines of res judicata and collateral estoppel apply only to claims or issues that

20 have been fully adjudicated. Neither of these doctrines apply to the allegations of evidentiary or facts.
