tant violation of Jammu andKashmir Civil Services(Classification, Control andAppeal) Rules, 1956 andJammu and KashmirGovernment Employees(Conduct) Rules, 1971, severalGovernment departmentshave failed to initiate depart-mental proceedings againstlarge number of officersagainst whom FIRs underPrevention of Corruption Acthave been registered by theAnti-Corruption Bureau (for-merly State VigilanceOrganization).

This is notwithstanding thefact that the GeneralAdministration Department onthe instructions of ChiefSecretary BVR Subrahmanyamhas already made it clear to allthe departments that there is nolegal bar to the holding of disci-plinary proceedings and thecriminal trial simultaneously.

The Rule 3 of Jammu and

Kashmir GovernmentEmployees (Conduct) Rules,1971 states: Every Governmentemployee shall at all timesmaintain absolute integrity,devotion to duty and do nothingwhich is unbecoming of aGovernment employee.

If any Governmentemployee violates this Ruleand his/her act amounts tomisconduct then he/she isrequired to be dealt withunder the provisions ofJammu and Kashmir CivilServices (Classification,Control and Appeal) Rules,1956.

Moreover, the SupremeCourt in the cases titled "State ofRajasthan Verus B K Meena andOthers" and "State Bank of Indiaand Others Versus Neelam Nag"has held that approach and theobjective in the criminal pro-ceedings and the disciplinary

proceedings is altogether dis-tinct and different.

"In the disciplinary pro-ceedings, the question iswhether the respondent isguilty of such conduct aswould merit his removal fromservice or a lesser punishmentwhereas in the criminal pro-ceedings the question iswhether offences registeredagainst him under thePrevention of Corruption Actand the Indian Penal Code(Ranbir Penal Code in case ofJammu and Kashmir) areestablished and if establishedwhat sentence should beimposed", the Supreme Courthas mentioned in the judg-ment of these cases.

today foiled a major BorderAction Team (BAT) strike at aforward post along the Line ofControl in Nowgam Sectorand killed two Pakistani sol-diers.

A senior Army officer saidthat a group of Pakistani troopsunder the cover of thick forestsand assisted by high caliberweapons firing, mortars androckets, from Pakistani posts,attempted to carry out a majorstrike on an army post inNowgam sector.

He said that the Armydeployed along the LoC detect-ed the movement of thePakistani BAT. He said thatArmy strongly retaliated and theexchange of fire continued thewhole night.

The officer said Army con-ducted prolonged search oper-ations in thick forests and dif-ficult terrain to ascertain the

situation. He said that duringthe searches, two bodies ofPakistani troops were foundand large cache of warlikestores were recovered.

"The search operations arestill underway in the sector tosanitise the area. A few other

intruders managed to escapeacross the LoC, taking advan-tage of the Pakistani firing andadverse weather and visibilityconditions", the officer said.

He said that the intruderswere wearing combat dresseslike Pakistani Regulars and werecarrying stores with Pakistanimarkings. "Some intruders werealso seen in BSF and old patternIA dresses as part of deception",he said.

The officer said that they hadintruded well equipped withIEDs, incendiary materials,explosives, and a plethora ofarms and ammunition. "From

the recovery, it was estimatedthat they intended to carry out agruesome attack on the IndianArmy forward post in Nowgamsector. The alertness andresilience of the own troops,who engaged and neutralised theintruders, thus eliminated a like-ly treacherous attack on theArmy forward posts along theLine of Control on the eve ofNew Year", he said.

The Defence spokesmansaid: "Army applauded thecourage and perseverance ofthe alert troops. Army'sresolve to keep a strict vigilalong the LoC and defeat allsuch nefarious designs ofPakistan will continue toremain firm and consistent.".

2018 witnessed several of ceasefire violations byPakistan both on LoC as well as along the InternationalBorder which resulted in the martyrdom of our manybrave hearts. While 'Excelsior' remained in the forefrontin highlighting the supreme sacrifices of the martyrs, theplight of border dwellers as a result of intermittentshelling etc from across the border too was prominentlyhighlighted. Unprecedented delays in several develop-mental projects took place surprisingly due to non sub-mission of Utilization Certificates. We played our part asa constituent of responsible media in bringing into lime-light peoples' grievances during Governor's rule and toour satisfaction got them addressed.

The State witnessed a turning leaf in the democraticactivities at the grass root levels by conducting of longdue Local Bodies and Panchayat elections in which not asolitary incident of violence took place, the credit ofwhich undoubtedly goes to the administration under theGovernor's rule. ‘Excelsior’ not only led from the front ingiving wide coverage to these elections but also con-tributed towards ensuring peoples’ participation in theseelections.
