An application for a Basic Assessment was sent to the Department of Environmental Affairs and Development Planning (DEA&DP) in April 2012 and the following reference number was received: DEA&DP ref: 16/3/1/1/-A1/22-3028/12. However, in terms of Regulation 67 of the EIA Regulations (GN 543, 2010), as amended, the Basic Assessment Report was not submitted to DEA&DP within the allocated timeframe and as such, the application lapsed. Consequently, the application was resubmitted and a new reference number has been received: DEA&DP ref: 16/3/1/1/-A1/22-3081/12. As the Project description and the Project title has remained unchanged, the initial activites undertaken under the previous reference number have been included in this record of public participation activities. All public participation activities for the release of the Draft Basic Assessment Report (BAR), will be undertaken using the new reference number, and proof there of will be included in the Final BAR.

F2 NEWSPAPER ADVERTISEMENT
A newspaper advert will be placed in the TableTalk Community Newspaper to advertise the release of the Draft BAR for comment and inform stakeholders where they can access the Draft BAR. Proof of advert placement and a copy of the ad that was placed, will be included in the Final BAR. A newspaper advert was placed in TableTalk Community Newspaper on the 30 May 2012 to notify stakeholders of the Basic Assessment for the proposed Shell Parklands Filling Station and to invite them to register as an Interested and Affected Party (I&AP). A copy of the advert, as well as proof of advert placement is found below.

F3 BACKGROUND INFORMATION DOCUMENT
A Background Information Document (BID) was distributed to potential stakeholders and neighbouring landowners within a 200 m radius of the site (see Figure 3.1), to inform them of the Basic Assessment for the proposed filling station, the associated public participation process and to invite them to register as I&APs. A copy of the BID, as well as proof of delivery can be found on the following pages.

A portion of the land is zoned ‘residential’ and a portion of the land is not currently zoned. A rezoning application is currently underway, but falls out of the scope of this Basic Assessment. All comments, questions and concerns raised during the process will be taking into considering by DEA&DP during their decision making process.

In the event of a spill or leak, which could result in soil and/ or groundwater contamination, the polluter would be responsible for the clean-up of the spill and the rehabilitation of contaminated land. The potential for soil and/ or groundwater contamination, as well as the relevant mitigation measures, will be discussed in the BAR. Potential noise impacts as well as appropriate mitigation measures will be discussed in the BAR. The stakeholder will have access to all Impact Assessment Documents, including the Environmental, Visual and Traffic specialist reports when the Draft BAR is released for public comment.
Request to register as an I & AP. The stakeholder stated that she had a number of concerns and asked if there will be a public meeting.

Concern was expressed as insurance companies do not pay out for contamination and clarity was requested regarding who will compensate them if their land becomes contaminated. Stakeholder commented that he does not approve of the building of the filling station. The following is an adaption from the stakeholders insurance policy which was sent through: What is not covered under your facility: This facility does not cover any loss, damage, liability or injury directly or indirectly arising from any of the following: -Pollution, contamination or seepage, radioactive or nuclear material. -Your Outsured possessions which are more specifically covered elsewhere.
