22nd October 2016 MEMORANDUM TO: PROVINCIAL TASK TEAM MEMBERS REGIONAL EXECUTIVE COMMITTEES BRANCH EXECUTIVE COMMITTEE MEMBERS SUBJECT: COURT ORDER UNDER CASE NO. 3760/16.
1. I attach hereto a copy of the order of the High Court relating to the application brought by the department against SADTU.
2. Your attention is drawn to the clause 7 of the order, which requires that the contents of the order be drawn to the attention of members.
3. At a special meeting of the PTT it was resolved that the order be complied with. Members and leaders are therefore asked to ensure compliance with the order and not to interfere with the process of the identification and movement of educators.
4. Your attention is also drawn to the contents of Collective Agreement 4 of 2016 in particular the process that must be followed in the identification and movement of educators. We request that leaders and members monitor these processes to ensure strict compliance with the terms of the collective agreement.
5. It has been decided that we ensure that the department strictly comply with the procedures set out in the collective agreement and that there be no deviation therefrom.
6. Where any irregularities are cited, it has been decided members note such irregularities and instead of not cooperating, immediately notify the relevant structures and that a dispute be declared immediately.
7. I also wish to draw to members’ attention that Clause 2.6 applies only to the Post Provisioning matters. Members remain entitled to protest, strike or picket in respect of all other matters unrelated to post provisioning. Leaders are reminded to obtain the necessary permits should they wish to protest or picket on any other matter other than post provisioning.
8. It has also been decided to institute legal proceedings in respect of all matters related to salary and benefits of members, which have not been processed. These include the rural allowance and the 1% pay progression. Our legal team has commenced this process and you will be kept up to date.
