RESOLVED, that pursuant to 6NYCRR Part 617 (SEQR) and Town Code Section 104, as amended, that the requirements of SEQR have been completed and the Town Board issues the attached Negative Declaration, and be it further
RESOLVED, that pursuant to NYS Town Law Sec.272-a, the Town Board concurs with the findings of the Planning Board as stated in their resolution of January 15, 2015 that the proposed General Business (GB) and Multi-Family Residential District Seven (MFR-7) zoning at a portion of 9530 Transit Road is consistent with the adopted Bicentennial Comprehensive Plan, as amended, and be it further
RESOLVED, that to the extent the proposed zoning is not consistent with the adopted Comprehensive Plan, the plan is hereby amended to be consistent with the proposed zoning at this location, and be it further

9530 TRANSIT ROAD FROM SUBURBAN AGRICULTURE (SA) TO GENERAL BUSINESS DISTRICT (GB) AND MULTIFAMILY RESIDENTIAL
DISTRICT SEVEN (MFR-7) AND TO AMEND THE ZONING MAP ACCORDINGLY
Be it enacted by the Town Board of the Town of Amherst as follows: Section 1. Title. This Local Law shall be referred to as, “A Local Law Amending the Zoning of a Portion of 9530 Transit Road.” Section 2. Legislative Findings and Intent. The Town Board of the Town of Amherst finds that an application to rezone a portion of 9530 Transit Road from SA to GB and MFR-7 zoning has been filed and is in proper order. The Town Board further finds that the rezoning is consistent with the Comprehensive Plan. Section 3. Amherst Zoning Map. The Town Board hereby amends its zoning map which is incorporated by reference in the Town zoning code by amending from SA to GB and MFR-7 the zoning of a portion of 9405 Transit Road, subject to any conditions imposed by the authorizing resolution; legally described as follows: PARCEL 1 – REZONING FROM SUBURBAN AGRICULTURE (SA) TO GENERAL BUSINESS (GB): ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Amherst, County of Erie, State of New York, being part of Lot 101, Township 12, Range 7 of the Holland Land Company’s Survey, bounded and described as follows. Alienation of 1047 Campbell Boulevard
WHEREAS, in accordance with Chapter 204, Section 3-9B (Parkland Sites) and as a condition of approval of the Lake Forest Estates Subdivision, Phase IV, the Town of Amherst acquired a portion of 1047 Campbell Boulevard, a 4.9-acre parcel physically located at the eastern end of Penny Lane adjacent to Interstate 990; and
WHEREAS, the parcel is designated as “Parkland” and has remained vacant since acquisition and not scheduled for improvements; and
WHEREAS, the Town of Amherst seeks to “Alienate” this parcel in order to acquire alternative parkland parcels more in keeping with the recommendations of the adopted Bicentennial Comprehensive Plan; and
WHEREAS, the alienation process requires the approval of the New York State Legislature and the designation of alternative parcels as “Parkland” or the improvement of existing recreation facilities in a capital amount equal to the value of the alienated parcel; now, therefore,
BE IT RESOLVED that the Town Board declares that 1047 Campbell Boulevard, currently owned and occupied by the Town of Amherst, be removed as parkland and other land owned by the Town of Amherst of equivalent recreational suitability and value be substituted in its place or that capital improvements to an existing recreation facility in the amount of the parcel’s value be made; and
BE IT FURTHER RESOLVED that one or more substitute parcels or capital projects be identified by the Planning Department and approved by the Town Board as “Substitute Lands” for the alienation of 1047 Campbell Boulevard; and
BE IT FURTHER RESOLVED that the Supervisor with the assistance of the Town Attorney’s office is hereby authorized to take all necessary actions to effect this alienation procedure, including working with the New York State Legislature.

Adopt a Hydrant
WHEREAS, the Town of Amherst has over 2525.5 fire hydrants that are owned by the Town plus an additional number of fire hydrants that are owned by Erie County Water Authority in the direct service areas of Hutchinson Hose, Snyder and Hutchinson Hose, Eggertsville, and
WHEREAS, the clearing of the fire hydrants during the winter months is imperative to the safety of the properties in the service areas, and
WHEREAS, the clearing of the hydrants, especially along the major roadways in the town, is a monumental task,
NOW, THEREFORE, BE IT RESOLVED, that the Amherst Town Board is looking to create an Adopt a Fire Hydrant Program that would provide assistance to the Fire Districts in keeping the hydrants clear of snow during the winter months, and
BE IT FURTHER RESOLVED, that Emergency Services works in conjunction with the various Fire Districts, schools, youth groups, Engineering, Central Alarm, and other community organizations to develop a program that would:
· Identify for each district a location and map of every hydrant located in their respective service areas
· Communicate thru the various organizations in the town of the Adopt a Fire Hydrant Program such as:· Youth Groups · Scouting Groups· Veterans Groups· Community Organizations (i.e. Lions, Rotary, Zonta)· Homeowners Associations· Schools (for students needing community service hours)· And other related organizations
· A centralized means either through the District or Emergency Services to identify a Fire Hydrant to adopt and have it noted for the respective Fire District
BE IT FURTHER RESOLVED, that while the Town Board realizes that not all Fire Hydrants will be adopted, it will provide some level of relief to the Fire Districts in keeping the fire hydrants clear of snow and also provide a better mapping of hydrants within the District. The Town Board will continue to consider other options to maintain the public safety in our community.

Recognize Women Elected to Amherst Town Government
WHEREAS, March is National Women’s History Month 2015; and
WHEREAS, the theme for National Women’s History Month is “Weaving the Stories of Women’s Lives;” and
WHEREAS, only 12 women have been elected to public office in the entire history of the Town of Amherst; and
WHEREAS, only once in Amherst’s history have women served as a majority of the Amherst Town Board when Lynn Millane, Jane Woodward, Margaret “Peggy” Santillo, and Penny Zeplowitz served together; and
WHEREAS, Lynn Millane was the first woman Amherst Supervisor from 05/20/1996 - 12/31/1996 and first woman in Amherst’s history to be elected Councilmember 1982-1996 and first woman appointed Deputy Supervisor in 1990; and
WHEREAS, Jane Woodward was Amherst Town Councilmember from 10/01/1990 - 12/31/2005; and
WHEREAS, Susan J. Grelick was elected as Amherst’s first woman Town Clerk from 1992-1996 and first woman elected Supervisor from 1997-2005; and

Golf Course Management Negotiations
WHEREAS, the Amherst Public Golf Courses are part of the Recreation Department and requires substantial Town Budget resources to provide services to the general golfing public; and
WHEREAS, the Town Board would like to reduce its financial commitment and secure the long-term success of the golf courses; and
WHEREAS, the Town of Amherst would like to get out of the golfing business entirely and turn the operation over to a suitable company that is committed to the long term success of Amherst golf; and
WHEREAS, the Town issued a Request For Proposal to determine the interest of various companies in entering into an agreement with the Town to license the golf operations of the public courses;
BE IT RESOLVED that the Town Attorney’s Office, with guidance from the Supervisor, Deputy Supervisor and the Executive Director of Youth and Recreation Department, enter into negotiations with representatives from Value Turf LLC, a respondent to the Request For Proposal to create a license for the operation of activities at the public golf courses;
BE IT FURTHER RESOLVED that a tentative agreement be provided to the Town Board for the Board meeting scheduled for March 16, 2015

WNY Stormwater Coalition Cooperating Letter of Commitment
The Western New York Stormwater Coalition (WNYSC) was recently funded for the “Round 11 Water Quality Improvement Project Grant” where the primary focus of the project will be to map storm sewers in the newly designated urbanized areas. By approving this resolution, the Town would be committing to making our current storm sewer maps available, assisting field crews with collecting additional data, and contributing in-kind services to help meet the required local match of 25%.
The Engineering Department is requesting that the Town Board authorize the Town Supervisor to sign the attached cooperating letter of commitment. There is no direct financial commitment associated with this request. This request is contingent upon successful completion of the contract review process.

The Town of Amherst, in cooperation with the Western New York Stormwater Coalition, is a project partner on the Erie County Department of Environment and Planning’s Round 11 Water Quality Improvement Project – 2013 WQI-11046. The primary focus of the project, entitled Western NY Stormwater Coalition: Newly Designated Urbanized Area Project, is to map storm sewer outfalls and conveyance systems including: catchbasin and manhole locations; number and size of connections (inlets/outlets); direction of flow; and delineation of storm sewer sheds in Newly Designated Urbanized Areas within MS4 communities in Erie and Niagara County. The Town of Amherst agrees to the following roles and responsibilities as a project partner:
1. Town of Amherst will provide any existing storm sewer maps and assist a field crew during the data collection component of the project in their respective MS4.
2. Town of Amherst will work with the Project Manager to extend its Stormwater Management Program throughout its Newly Designated Urbanized Areas, specifically addressing Public Education and Outreach, Illicit Discharge Detection and Elimination and Pollution Prevention/Good Housekeeping requirements.
3. Town of Amherst will contribute in-kind services to help meet the required local match of 25%. The in-kind services will be salary and fringe for municipal staff participating in the data collection component of the field work conducted in their respective MS4.

BEST Service Contract 2015 - 2018 & Oven Repair Estimate
We respectfully request authorization for the Supervisor to sign the Service Contract between the Town of Amherst (Senior Services Dept.) and Buffalo's Expert Service Technicians (BEST), Inc., for the years 2015 - 2018, pending successful completion/approval of the Contract Review Process.
The Contract does not include annual increases in service rates or service charges; only for manufacturers' published prices for parts.
We also request permission to repair our convection oven, and obtained an estimate during the time of our Town Board-approved 2014 contract relationship. (Attempts were made to obtain additional estimates, but we found that this type of kitchen service repair work is almost exclusive/proprietary to BEST, Inc. Further, we confirmed that BEST will honor their estimate despite the lapse of 30 days.)

Re: Travel to USA Hockey Annual Congress
The USA Hockey Annual Congress will be held in Colorado Springs, CO from June 3- 7, 2015. This is an annual meeting for 500 of the top volunteers and employees of USA Hockey. I am requesting travel to allow the ice center management staff to meet with representatives of the disabled hockey and youth hockey sections to promote the Northtown Center and to explore bringing additional tournaments to the facility. Our ability to speak with USA Hockey representatives and promote the Northtown Center has landed us several national tournaments in the past.
The funding will be reimbursed by Coca-Cola through its pouring rights commitment which provides for a $2.00 per case rebate or an estimated $5,900.00 for promotion of ice events.
I am requesting approval for Eric Guzdek and Brad Waltz to attend at a cost not to exceed $2,545.00, including contingency.

But you do your job very well with all that happens in town Good and Bad. Your department(s) staff are also as well not much appreciated I feel by others out side of Town hall and so little is known as to how much they have to go through as I have learned. At tonight's Planning Board meeting (it has been brought to my attention) that amendment to local law ZTA-2015-01 Change of side walk width is to change from 5 feet down to 4 feet. It has been also brought to my attention that this may be to accommodate the local project at 80 Meyer Road to benefit local contractor / developer to any one or more of the following parcels and or addresses 1459 Niagara Falls Blvd,1551 Niagara falls Blvd, 6000, 6020, 6040 Bailey Ave or others. If any part or portion of this is true please inform me in letter form on Town Of Amherst Letterhead what is true and what is false mailed to my home address. What has been described to me is that the change would make way for a connector street or Road between Meyer Road and a paper street possible known as one of the following Romney, Romney Street, Romney Avenue, Romney Drive as that being a paper street running between 1459 Niagara Falls Blvd and 1551 Niagara Falls Blvd running in a east west direction between Nia. Falls Blvd and Bailey Ave. This new street would it run parallel between myself and the 30 foot no build zone next to me and 80 Meyer Road. Lot size of 80 Meyer rd. 100 x 686 ft. approx. Mr. Sean Hopkins had commented the 50 Foot no build zone at north end of property was not needed during a meeting awhile back. Is this why? This is a condition(s) 50 and 30 foot no build zones that the Amherst Town board voted on and approved and agreed to keep in place. 30 ft from 100 leave 70 ft wide enough for new law possible helping Developer. Is this because as being told recently my land was too expansive, while back being told Savaino did not respond, someone kept me from selling and my father telling me they never wanted my land. So what story should I believe. In 2012 Miss. Paula Chomko the exec tress to estate to 80 Meyer Road had informed me that Mr. Savarino wanted the land for a driveway to the rear portion of Flanigans for trucks going to loading dock and I would have a 100 foot barrier between myself and it would be nicely

landscaped this being said at the same time land would be used for Senior Housing. 2 different uses for land. Mr Savarino also noted that the large parcel behind 60-74-80 Meyer Rd owned be Flanigans was not able to be bought, they would not sell. Mr. Tomas Wilcox 70 Meyer Road told me that Mr. Savarino wanted to change the wording and contents or terms of contract, Mr Wilcox refused and I believe Mr. Savarino to purchase, Mrs Candice Wilcox told me that the land next to them would be used for a project only on 80 Meyer Road. She also informed me of more than one building leading to more than 80 -90 units to be built. Would this be the cause of rebuilding left station by same. Is that to be a street or road that I have been told about. Curb cut is at 80 Meyer Road Now the work has be gone but that are only scrapping land that is 100 feet wide by approximately 350 - 400 foot area known as the old 80 Meyer Road and no other (East side of project land). I was informed that the clearing is for the building of the garages for storage while they build the main building. Why would you need that large of land cleared just for garages and that would not include the building layout. It has been my idea all along that there would be a need to have road going from Meyer Road to 1551 Niagara Falls Blvd. and not that being of Housing. As being told comments by my neighbors now moved and those currently living on Meyer Road, Those in the Construction industry and Design, Architects, Construction Development, Local industry and those at my Employment (work), and my own attorney saying that (1st) they are building around me and then changed to Building next to me. In 2012 I was told that my land was worth $1,200,000 by someone in the construction industry and had mentioned about Benderson Development and 60,000 sq. feet of vacant warehouse space. While a short time later that 1551 and 1459 Niagara Falls Blvd had out lived the life span and would be better torn down and build as new by someone in the construction field. Mr. Guy Marlette Town of Amherst Deputy Supervisor had told me to meet with Sean Hopkins and my Attorney to get as much of a barrier between myself and the project they did not want to meet. WHY?. Is Barrier needed from road, from housing, from commercial Plaza. Mr. Barry Weinstein and meetings with Frank P. regarding the sale of Meyer road and as told by Frank P. possible sale of his home on Sweet Home next door to the school within a few years, was Mr. Weinstein personally involved in getting this transaction done. I was told it was a personal matter and did not concern me, I believe it would if it effects my land value and way of life. It has also been brought to my attention by Town Employees that RAS Development has the contract for the lift station on Meyer Road in front of my home to start in April and new piping from station to Niagara Falls Blvd. A place had been put in at the time of the planning for Prime Wines on Maple Rd. in 2011. I had been told by a few persons of project maybe taking 7-8 yrs, 3 buildings and more, is all of this tied together? Does Benderson plan on building a new plaza or development other than Housing using all or a portion of land from Niagara falls Blvd and Bailey Ave and Meyer Rd to 1551 Niagara falls Blvd? The Amherst IDA have been involved with getting tax breaks for 70-74-80 Meyer Road what is the true nature of the use for the land? Do you see why there are so many not trusting in what the Town is doing. I am told about what includes the possible land for sale near Millersport, Smith Road, New Roads for new Student Housing for SUNY Amherst Campus that I am told the town now owns, just bought 2013-2014 to resell. Is this true as well or is it false?
