FARMERS' DEBTS ADJUSTMENT ACT, 1930-1934.NOTICE is hereby given that the following Stay Ordershave been issued in accordance with section 7, sub-section (1) of the Farmers' Debts Adjustment Act,1930-1934, which reads as follows:

WHEREAS an industrial dispute existed between theabovenamed parties: And whereas the said dispute wasreferred into Court for the purpose of hearing and de-termination: And whereas the parties subsequently metand conferred and have arrived at agreement on all mat-ters in difference: And whereas the parties have thisday appeared before the Court by their respective repre-sentatives and requested the Court to declare tile saidAgreement an Award: Now, therefore, the Court, pur-suant to section 63 of the Act and all other powerstherein enabling it, hereby declares the memorandumhereunder written to have the same effect as and bedeemed an Award of the Court:

MEMORANDUM OF AGREEMENT.1.Scope.

This Agreement shall apply to the industries men-tioned in the first column of the Schedule hereunderand to the respondents set out in the second columnof the said Schedule and to other persons, firms, com-panies, carrying on similar businesses in respect of work-ers employed by the said respondents following the voca-tions mentioned herein: Provided that it shall not applyto workers who are at preseit provided for in any Awardof tile Court of Arbitration of Western Australia orin any industrial Agreement registered i.n accordancewith the Industrial Arbitrntion Act, 1912-1935.

2.Area.This Agreement shall be limited in its effect to the

area comprised within a. radius of fifteen (15) milesfrom the Post Office, Albany.

3.Term.The term of this Agreement shall be three (3) years

from the date of its delivery, subject to the right toapply to amend in pursuance of the Act.

4.Definitions.''Shop assistant'' shall mean a worker employed

receiving and/or selling and/or assembling or prepar-ing goods for sale or delivery and shall include cashiers.

''Casual hand'' shall mean a worker engaged bythe hour and who may be put off or leave the employer'sservice at any moment without notice: Provided thata casual hand may be employed for not less than four(4) hours in any one day.

A worker engaged and not permitted to commencework shall receive two (2) hours' pay at the prescribedrate.

''Adult'' shall mean a worker twenty-one (21)years of age and over or a worker who is in receiptof the prescribed adult rate of pay.

The term ''Weekly hand" shall mean a workerengaged by the week and whose employment shall beternnnable by not less than one week's notice on eitherside; such week's notice cannot be continued from weekto week: Provided that any worker employed for notmore than four consecutive weeks shall be classed as acasual hand and paid not less than the minimum rate ofwages herein prescribed for a casual hand, but this pro-viso shall not apply in eases where the services of aworker employed as a weekly hand have been dispensedwith for incompetence or unsuitableness or for any causereferred to in clause 15 hereof.

5.Chemist Shops.Any worker employed in a chemist shop shall be sub-

ject to the terms of this Agreement up to the timelie or she becomes indentured to the profession.

6.Hours.The hours of work shall be as follow:(a) Forty-seven (47) hours shall constitute a week's

work for males sixteen (16) years of age and over:Provided that such weekly working hours shall be re-duced to forty-six (46) and remain at forty-six (46)while the closing time for receiving goods at the Rail-way Goods Sheds at Albany is fixed at 10 a.m. and noearlier.

Forty-four (44) hours shall constitute a week's workfor females and for males under sixteen (16) years ofage.

(b) Except as provided in subclauses (c), (e), and(f) of this clause the hours of work shall be performedas follow:-

Between 8.30 a.m. and 6 p.m., on five (5) daysof the week, excluding Sunday;

Between 8.30 n.m. and 1 p.m., on the day ob-served as a half holiday.

(c) The hours of workers employed in shops com-prised in the Fourth Schedule of the Factories andShops Act shall be worked to suit the convenience ofthe employers; Provided that the workers shall be noti-fied of the half day (which shall be granted to andtaken by the worker on an afternoon in each week)upon which his or her services shall not be required.

(d) The employer of workers in Fourth Scheduleshops shall post or cause to be posted and keep postedup in a conspicuous position in his shop, so as to beeasily accessible to and easily read by every worker inhis employ in such Fourth Schedule shop during work-ing hours on every day, a roster setting out tile follow-ing particulars:-

The name and sex of each worker;The class of work performed;The time at which each worker is required to

commence and finish work on each day ineach week;

The hours in each day during which the workeris entitled to be off duty during each day;

The time allowed for meals on each day;The day in each week allowed as a half holiday

and the time from which such half holiday isallowed.

The particulars contained in such roster shall be inrespect of the week, Monday to Sunday, inclusive, dur-ing winch it is posted up, and may be altered or variedonly on account of the sickness or absence of a workeror on account of a contingency that the employer couldnot reasonably be expected to foresee.

(e) The hours of workers employed in chemist anddruggist shops shall be in conformity with the provi-sions of tile Factories and Shops Act, 1920-1937.

(f) On the day mutually agreed upon by the partieshereto to be observed as Christmas Eve for the purposeof a late shopping night, the ordinary hours of workmay be extended by agreement between the parties.

(g) The spread of ordinary hours (inclusive of anymeal hour) for all workers bound by this Agreementshall he as under:-

Where a forty-seven (47) hour week is workednine (9) hours thirty (30) minutes in anyone day.

Where a forty-six (40) hour week is workednine (9) hours twenty (20) minutes in anyone clay.

The foregoing spreads of hours will not apply on theclay upon which the Christmas Eve late shopping nightis observed.

7Meal Times.One hour shall be given and taken for all meals.

Lunch hour shall be between 12 noon and 2.15 p.m. Teahour shall start within forty-five (45) minutes of theprescribed finishing time.

Fourtll Schedule Shops: Meal hours shall betaken at the times most convenient to the employer 'sbusiness: Provided that one hour shall be given andtaken for each meal, and that not more than five (5)or less tilan three (3) hours' interval shall be workedwithout an interval for a nieal being given. The mealhours referred to in this clause shall he taken in onecontinuous period.

Notwithstanding anything contained in this clause,the lunch hour for workers, other than those in FourthSchedule shops shall, during the first two days of eachof three sales pci- annum and during Christmas week,be given and taken between the hours of 11.30 n.m. and2.30 p.m.

8.Meal Money.Workers ivho al-c subject to the starting and finishing

times prescribed in clause 6 (b) of tIlls Agreementshah, if required to continue woricing for more than onehalf hour after tile prescribed finishing time, be paidone shilling an(l sixpence (is. Gd.) as meal money.

9.Overtime.Excepting as providing hereunder, all overtime

worked shall be paid for at the rate of time and onehalf for tile first four (4) hours and double time there-after. In the compilation of overtime, each day shallstand by itself.

Where overtime is worked in Fourth Scheduleshops, the woi-ker shall be paid overtime as provided insubelause (a) of this clause, after tile prescribed weeklyhours of woric have been exceeded. Work performed onSundays, tile weekly half-ilolidav, and/or the prescribedholidays, shall he pa for at tile rate of double time.

Wilere workers are required to work continuouslyafter the first four (4) hours of overtime Ilave beenworked, they 111511 lie paid at the rate of double timeup to time time for finishing work: Provided that thathour shall not he later than the prescribed starting tinietile next day.

(0) All time worked in shops other than those re-ferred to in subclause (b) hereof before the prescribedstarting time or after tile prescribed finishing tinie shallbe paid for at overtime rates. Work performed in theafternoon of tile (lay on which tile weekly half holidayis observed, on Sundays and/or tile prescribed holidaysshall he paid for at the rate of double time.

:10.Holidays.The following days or the days observed in lieu

shall be observed as holidays and paid for, namely, NewYear's Day, A]lnivem-sary Day, Good Friday, EasterSaturday, Easter Monday, Labeur Day, Ansac Day,Foundation Day, Christmas Day and Boxing Day.

A holiday of one week on full pay shall begranted to each worker on completion of each year ofservice. A worker not completing a year of service shallhe granted pay in lieu of holidays in tile proportionthat his length of service hears to the full year's em-ployment : Provided that, when a worker is entitled toilohdays under this subclause, he shall receive at leasttwo weeks' notice from Ins employer of the date whenit will be convenient to tile employer that such workershould take his holidays.

(e) A wom-kem who is sumnmarily dismissed for mis-conduct or dereliction of duty, or who illegally severshis contract of service, shall lose all rights under thisclause.

(0) Holiday pay shall not accrue during a worker'sabsence from hi employment for nay cause whatso-ever.

proportion of 0110 to one for the fist five (5) maleadults and thereafter one junior male to every two (2)male adults or fraction thereof.

(h) Where no adult shop assistant is employed, onejunior simop assistant may be employed.

(e) Where one adult feniale assistant is employed,two (21 junior female assistants may be employed.

(g) For the purpose of determining the ratio of jun.iors to senior assistants under this clause, all employersor managers, when actively engaged in conducting thebusiness of the establishment, shall be deemed to besenior assistants.

15.Engagement.One week's notice on either side shall be necessary

to terminate the cugagensent : Provided that an em-ployer may at any time dismiss a worker for refusal osneglect to obey orders, or for misconduct, or if, afterreceiving one week's notice, such worker does not carryout his or her duties in the same manner as he or sh(lid prior to such notice.

16.Time and Wages Record.The employer shall keep and enter up, or cause to be

kept and entered up, a record containing the names ofeach of his workers to whom this Agreement applies,the class of work performed by and the wages paid toeach worker, tlse age of each junior worker and thetime during which each worker lies been employed. Suchrecord shall be open to inspection by a representativeof the union between the hours of 10 a.sn. and 4 p.m. on

17.Usidcr-ratc Workers.(a) Any worker who by reason 0f old age or its-

firinitv is unable to earn the minimum wage may bepaid such lesser wage as may from time to time beagreed upois in writing between the union and the em-ployer.

(h) In the event of no agreement being arrived at,the matter may be referred to the Board of Referencefor determination.

(e) Pending the Board's decision, the worker shall beentitled to work for or he employed at the proposedlesser rate.

18.Board of Reference.(a) The Court appoints, for the purpose of the Agree.

inent, a Board or Boards of Reference. Each Boardshall consist of a chairman and two (2) other repre-sentatives, one to be nonsinated by each of the parties.There are assigned to each such Board, in the event of110 agreement being arrived at between the parties tothe Agreement, the, functions of:-

(i) adjusting any matters of differeisce which cmvarise between the parties from time to time,except such as involve iisterpretations of theprovisions of the Agreement or any of them;

classifying and fixing wages, rates and condi-tions for any occupation or calling not speci-fically mentioned in the Agreement;

deciding any other matter that the Court mayrefer to such Board from time to time.

(b) An appeal shall lie from any deeision of suchBoard, in the manlier and subject to the conditionsprescribed in the Industrial Arbitration Act, 1912-1935,which, for this purpose, are embodied in this Agree-ment.

19..Junior Worker's Certificate..Junior workers shall furnish the employer with a cer-

tificate showing the following particulars:Name in full;Age and date of birth;Length of service with each previous employer.

The certificate shall be signed by the worker.No worker shall have any claim for ndditional wages

ill the event of his age or length of service with a pre-vious employer being wrongly stated on this certificate:Provided that this subelnuse shall operate only for thefirst three (3) months from the date of tIme worker'sfirst engageusent, thereby enabling the employer, if heso desires, to obtain proof of the junior worker's age.

20.Payment for sickness.A worker shall he entitled to payment for non-

attendance, on the ground of personal ill-health, forOne half (1i) day for each completed month of service:Provided that Piyt for absence through sueh ill-health shall he limited to six (6) days in each calendaryear. Payment hereunder may be adjusted at the endof each calendar year or at the time the worker leavestIle service of the employer, in the eveist of the workerbeing entitled by service subsequent to the sickness toa greater allowance titan that made at the time the sick-

iscss occurred. This clause shall not apply where theworker is entitled to compensation under the Workers'Compensation Act.

The worker shall, if required by the employer, produceproof satisfactory to the employer of sickness.

In accordance with the provisions of subclause(a) of this clause, the forty-four (44) hour week shallcommence on the 1st January, 1941, but the provisionsin this clause for a forty-four (44) hour week shallbe deemed to have been complied with if an eighty-eight (88) hour fortnight (namely, one week of forty(40) hours and one week of forty-eight (48) hours)is worked: Provided further, that the eighty-eight (88)hour fortnight referred to herein shall only be appliedafter written permission to work same has been grantedby the union.

Subject to the provisions of subclause (b) of thisclause, each worker shall have one half-day off duty eachweek; such half-day off duty shall be granted on theafternoon of the day considered most suitable by theemployer. Where practicable, the half-day off dutyshall be granted on a Saturday.

5.Overtime.All time worked in excess of the hours prescribed

in clause (4) shall be deemed to be overtime and paidfor at the rate of time and a quarter for the firsttwo (2) hours and time and a half thereafter.

Except as provided in subclause (a) of thisclause, all work performed on Sunday or on a holidayhal1 be paid for at ordinary rates.

When a worker, without being notified on the pre-vious day, is required to continue working after theusual knock-off time for more than two (2) hours, heshall be provided with the meal required, or shall bepaid one shilling and sixpeace (is. 6d.) in lieu thereof.

6.Holidays.All workers, except casual workers, shall be en-

titled to two (2) weeks' annual leave on full pay, atthe expiration of each twelve (12) months' service:Provided that, if the contract of service is terminatedduring the year, the worker shall be entitled to holidaypay in the proportion that his length of service bears tothe full year's employment.

Where a worker is dismissed for misconduct, orwhere the worker illegally severs his contract of ser-vice, he shall lose all rights under this clause.

Holiday pay shall not accrue during a worker'sabsence erom his employment for any cause whatever.

7.Higher Duties.Any worker who is required to do work which is en-

titled to a higher rate under this Agreement than thatwhiih be usualy performs shall be entitled to pamentat the higher rate whilst so employed.

8.Absence through Sickness.A worker, other than a casual worker, shall be en-

titled to payment for non-attendance, on the groundof personal ill-health, for one half day for each com-pleted month of service: Provided that payment forabsence through such ill-health shall be limited to six(6) days in each calendar year. Payment hereundermay be adjusted at tIme end of each calendar year, orat the time th worker leaves the service of the em-ployer, in the event of the worker being entitled byservice subsequent to the sickness to a greater allow-ance than that made at the time the sickness occurred.This clause shall not apply where the worker is entitledto compensation under the Workers' Compensation Act.A worker shall not be entitled to receive any wages fromhis employer for any time lost through the result of anaccident not arising out of or in the course of his em-ployment, or for any accident, wherever sustained, aris-ing out of his own wilful default.

No worker shall be entitled to the benefits of thisclause, unless lie produces satisfactory proof to hisemployer of sickness, but the employer shall not be en-titled to a medical certificate unless the absence is forthree (3) days or more.

9.Time and Wages Record.The employer shall keep or cause to be kept at the

Factory Office a record, in which shall be entered:the name of each worker to whom this Agree-

nsent applies;the nature of tIme work he is doing;

(e the hours worked each day.the amount of wages and overtime (if any)

received by each worker each week;the ages of junior workers.

The said record shall be open to the inspection of anaccredited representative of the union at any time dur-ing time ordinai-y working hours, and he shall be al-lowed to take necessary extracts therefrom.

10.Representative Interviewing Workers.In tile case of a disagreement existing or anticipated

concerning any of the provisions of this Agreement, anaccredited representative of the union shall be permittedto interview the workers during the recognised mealhour, on the business premises of the employer, butthis permission, without the consent of the employer,shall not be exercised more than once in any one week.

11.Uniforms and Overalls.If the worker is required to wear a uniform or over-

all, the employer shah provide same free for use bythe worker.

12.Contract of Service.A casual worker shall mean a worker employed

for less than six consecutive working days and who maybe discharged or leave the employer 's service withoutnotice.

The contract of service of workers, other thancasual workers, shall be terminable by one week's noticegiven on either side: Provided that such notice shallnot apply iii the case of a worker summarily dismissedfor misconduct or dereliction of duty.

13.No Reduction.Nothing herein contained shall entitle an employem

to reduce the wage of any worker who at the date ofthis Agreement is being paid higher rate of wage thanthe minimum prescribed in this Agreement for his classof work.

14.Junior Worker's Certificate.Junior workers shall furnish the employer with a ser-

tificate showing the following:Name in full;Age and date of birth;Name of each previous employer;Periods of employment with each previoui

employer.

This certificate shall be signed. by the worker. Noworker shall have- uy claim upon the employer for ad-ditional wages, in the event of 1,15 age or period of em-ployment with a previous employer being wrongly statedon time certificate.

17.Aged and Infirm Workers.(a) Any worker who by reason of old age or in

firmity is unable to earn the minimum wage, may b5paid such lesser wage, as may from time to time bagreed upon in writiug between the union and the emit-player.

(h) In the event of no agreement being arrived at,the matter may be referred to the Board of Referencefor determination.

(e) After application has been made to the Board,pending the Board's decision, the worker shall be en-titled to work for or be employed at the proposed lesserrate.

16.Board of Reference.Time Court appoints, for time purpose of the Agree

ment, a Board or Boards of Reference. Each Boardshall consist of a chairman and two (2) other repre-sentatives, one to be nominated by each of time parties.There are assigned to each such Board, in time event ofno agreement being arrived at between the parties totime Agreement, time functions of:

adjusting any matters of difference which mayarise between the parties from time to time,except such as iavohvc interpretations of timeprovisions of time Agreement or any of them;

classifying and fixing Wages, rates, and condi-tions for any occupation or calling in cheesemanufacturing not specifically mentioned inthe Agreement;

deciding any other matter that the Court mayrefer to sods Board from time to time.

Au appeal shall lie from ally decision of such Board,in the manner and subject to the conditions prescribedill the industrial Arbitration Act, 1912-1935, which, forthis purpose, are embodied in this Agreenment.

17.Breakdowns, etc.The employer shall be entitled to deduct payment

for any day or portion of a day upon which tile workercannot be usefully employed, because of any strike bythe union or unions affiliated with it, or by any otherassociation or union, or through the breakdown of theemployer's machinery, or any stoppage of work by anycause which time employer cannot reasonably prevent.

6.Overtime,For all time worked on week days outside time pre-

Provided that, where in case (c) the re-lieving man fails for more thau two hoursto come on duty, any such time worked afterthe said period of two hours shall be paid atovertime rates.

7.Holidays.All employees shall be entitled to three holidays, here-

inafter mentioned, without pay, viz. :Cluistmas Day,Easter Monday, and Labour Day. All work performedon those days shall he paid for at the rate of doubletime.

8.Annual Leave.Annual leave shall he taken at the convenience of the

Management, between the months of September andApril, workers to receive four (4) weeks' notice of thedate on whieli the holiday is to commence. A commit-tee of three (3) to 1)0 appomteil to assist the Manage-mnent in time arrangeme]lt f a suitable roster.

All emuploees shall be granted, once hi each year,fourteen consecutive days' holiday, which shall includetwelve (12) working days, for wInch the employee shallhe paid two weeks' wages. Ti the employment is do-tci-miued before the holiday is due, the employee shallbe emititleci to one day's pay in lieu of holidays forevery complete month of his service or portion of anionth.

In the case of a continuous process where workersace relieved on week days, each shift so relieved shallbe counted as having been worked, for the purpose ofcomputing annual holidays.

A piecewoi-ker shall be entitled to be paid, when onholiday, the minimum rate for his gi-ade.

Workers shall not be entitled to receive their holidaypay until the last pay preceding tIme date on whelm theholiday is to be taken.

9.Payment of Wages.(a) The paymnemit for shift work, overtime, Sundays,

amid holidays shall be computed on the hourly basis oh-tahied by dividing the weekly wage by the wekly houis.

(h) Any worker leaving or being discharged shall bepaid the full amount of wages (inc to him within onehour of ceasing work, or within one hour of the open-ing of the Company's office, if such office was closedat the time of his ceasing.

Payment of wages shall he fortnightly on Fridays.

10.Obange Room.A suitable change room, supplied with heating ap-

pliance, wash basins, hot mmd cold showers, shall beprovided for the employees.

11.Union Official.A duly accredited official of the union shall be allowed

to collect union fees at time office on pay days, and lieshall be allowed to inspect the time sheets and paysheets i-elating to any worker affected by this Agree-imient, and make extracts therefrom.

12.Breakdowns, etc.For the purpose of setting out plainly the exact

method of procedure under this clause, it shall be mutu-ally understood that, wheze it becomes necessary fortime Company to deduct payment when any member ofthe organisation cannot be usually employed, it is herebyniutuahhi- agm-ecd that:

(a) No deduction will be made where the break-down or stoppage of work for any cause oftIme Company cannot reasonably be held re-sponsible for, only affects one employee mem-ber for not more than two consecutive days;or,

(h) alternatively, affects only two employees for notmole than one day; thus making a total ofsix shifts in either alternative as a maximumto be paid by the Company.

(e) Should time breakdown or stoppage affect theCompany to a greater extent than as abovespecified in (a) and (b), then the Companyagrees to stand dow]i the employee members

of the organisation in i-easonable rotation, soas to give as far as possible equal work forall employees, always excepting tIme leadingfiremen, whose services the Company rescivcstime right to retain at its discretion.

13.Relieving.Relieving hands, whemi not engaged at relieving, shall

be found suitable voi-k to cake up full time.

14.Mixed Functions.Any worker who is employed toi- more thni two hours

on a higher elassiticatiomi shall be paid the rates ofsuch classification Tom- the whole of the shift, and if enm-ployed on a lower classification lie shall he paid Insordimmarm- iates.
