I have owned property at 671 Hollywood Road for 35 years. It has come to my attention that I and a handful ofother properties have been left out of the option to be permitted to put in secondary suites.

I am in Vancouver and cannot attend tonight's meeting addressing this issue. I do not agree with the potentialruling that would prevent me from being permitted to put in a seconday suite should I choose. It is importantthat I and others be fairly considered in this matter, I wish to go on record requesting to be included on the listof property owners that will be permitted secondary suites.

It clearly stated that Future landuse designations could be changed upon you, as the property owners, submitting an application to thetown etc;No where does it mention we would have bylaws being created to change our Rural 1 designation.

However it wasn't long before Bylaw 500 tried to lump us with ALR properties, thus negating our rightsfrom the RDN to subdivide.Once this was brought to council and the Mayor's attention, we were grandfather and permitted tosubdivide.

As you can see we applied to be fill out a Schedule 3A to be excluded from Bylaw 500 on June 16th2006, it took the planner till Jan 2007 to get back to us, by then he had a new bylaw undere way.

The Planner tried to convince us to Strata our land. We decided to pay the DCC's so we wouldn't befaced with future problems.However along came Bylaw 580.42 which lumped us with a strata property and changed our zoning toRural 3 Zone and is now excluding us from the new basement suite legislation.

I don't see this as fair and equitable treatment. We paid our DCC's how are we the same as a strata lotwho didn't and now has 2 residences??It seems like a tax payer has no rights.

Would you please contact the mayor and council members and make them aware before this is finalized.You have our permission to give the Council and Mayor copies of this email.Thank you Rick and Rita Luterbach

We have been the owners of 880 Village Way since 1996. Our property at 880 Village Way is 5,66 acres. Wewere in the process of making inquiries with Nanaimo Regional District, into subdividing our property into 2pieces, when we were told that our land was being amalgamated into the Town of Qualicum with Chartweil area

We made several attempts to try and find out how this would affect our land.I received a letter from T.iw (Twyla) Johnson on January 22, 2004 in response to my inquiries. I will quoteparagraph no.1

'1. Regarding future development plans and the consideration for rezoning to smaller building lots. Please beadvised that presently your property is located outside the Urban Containment Boundary (UCB) and therefore,rules regarding subdivision potential would , even if included into the Town's boundaries, fail under the land useregulations of the Regional District of Nanaimo (RDN). Presently under the RDN zoning bylaw properties in yourarea are subject to a minimum parcel size of 1.0 ha approx. 2.5 acres). Future land use designations ( if yourproperty is incorporated into the Town's boundaries) could be changed upon you, as the property owners,submitting an application to the Town which would be subject to approval of Council of the Town of QualicumBeach, the RDN (because of the UCB) and the subdivision approving officer of the Town of Qualicum Beach!'

Our property is not in the ALR, there are properties on Fern, which are in the ALR and are only 1 acre lots. Theproperty on one side of us has been divided into 2 , 2 1/2 acre lots.

After many attempts, we met with the Planner, last week. We now find our land has a new designation that doesnot allow subdivision at all. It and other properties that were brought into Qualicum have been lumped togetherwith ALR properties as Rural 1.

We feel this contradicts everything we were originally told. We also think that land such as ours is important forfuture growth. We would greatly appreciate your support to regain our subdividability into 2 parcels, or if youwould prefer a higher density, please let us know.

3. Bylaw No. 680.42In general terms, Bylaw No. 580.42 will create a Rural 3 Zone (A3) that is similar to theRural 1 Zone (A1) except that it will allow up to two dwellings on parcels having an area of2.0 hectares or more. The Al zone allows only one dwelling regardless of the parcel size.

Bylaw 580.42 will amend the "Town of Qualicum Beach Land Use and Subdivision Bylaw No. 580,1999" by:(a) Amending "Schedule 6A — Zoning Map" by changing the zoning designation of land not in the

Agricultural Land Reserve, shown outlined in heavy black line on the maps below, from Rural1 Zone (A1) to Rural 3 Zone (A3); and

(b) Amending "Part 6 Land Use Regulations" by adding Section 6.4.13 Rural 3 Zone (A3)

Dear Mr. Brown,We have property at 880 Village Way, that was adversely affected by Bylaw 590.

We spoke to John Marsh on May 8th. He suggested we file a Schedule '3A'

June 16th, 2006 we filled out the Schedule '3A' application, we were told that Paul needed to help us fill in the wording to request anamendment.Paul suggested we leave the application with him, including our cheque for $600.00He said that the fee would probabely be waived, since he was in discussions regarding our property and others affected.

I will be forwarding copies of the emails that showing that we were told by Twalla Johnson that our property even if included inQualicum would still be under RDN zoning bylaws minimum 1 ha.

I will also include emails from January and February 2004 between us and RDN, which Paul said he needed to show our intentionsprior to Bylaw 590.

We were led to believe that there wasn't enough time to proceed with a subdivision of our land into 2 parcels prior to Qualicumbringing Chartwell and our area into the City.

Our land is not ALR and should not have been lumped into the same designation.Lot 12 to one side of us was subdivided into 2 -1 ha parcels May 1988Only Lot 14 to the other side remains over 5 acres.Lots 2,3 and 4 on Fern as also not ALR and they are 1 acre parcels

The months drag by and we are no closer to a resolution. As far as we are concerned, our property value has been adversely affectedby this Bylaw. We don't think there should be an issue here. We want the same right to subdivide as we had previous to being madepart of Qualicum.

SUBJECT: Qualicum Beach Farmers' Market - Community Hall

RECOMMENDATION:THAT Council grants permission to the Qualicum Beach Farmers' Market to locate their winterfarmers' market at the Community Hall from 9:00 a.m. to 1:00 p.m. on October 31, November14 & 21, and December 5, 2009 at the rental rate of $17 per hour.

PURPOSE:To obtain Council authorization to allow the Qualicum Beach Farmers' Market to use theCommunity Hall to hold a winter market on a pilot project basis for this year.

BACKGROUND:At the September 14, 2009 Regular Meeting, Kris Chand, on behalf of the Qualicum Beach FarmersMarket requested approval in principle for use of the Community Hall to hold a winter market,including a reduction in the hall rental. The Market is treating the winter market idea like a pilotproject and due to the late notice; the Market has concerns with the financial viability unless asubsidized rental rate is used. The dates being requested are the following Saturday's: October 31,November 14 & 21, and December 5, 2009. The Market is looking at a 10:00 a.m. to noon openingtime with about 1 hour to both set up and to take down. This would necessitate a 9:00 a.m. to 1:00p.m., rental period. The Community Hall hourly rate structure is as follows:

Commercial Private Non ProfitPrime time $46.00 $33.00 $23.00Non prime time $33.00 $20.00 $17.00

The Saturday rental request is technically considered prime time. However, due to the pilot projectnature of the request, and the Town's support for Farmers' Markets from a sustainabilitystandpoint, the Town may want to consider using a lower rate. The success of the pilot projectcould then form the basis of a rental rate review for 2010.

Drawbacks of approving this request could include setting a precedent for other potentialcommunity hall users, and that by allowing the Market on the dates noted, it may be more difficultto rent the facility during the evenings of the winter market due to reduced set up time. A differentday of the week could be considered if the pilot is successful.

Staff supports the concept of a winter market. Due to the pilot project nature of the request, shortnotice and the limited time period of the request, staff recommends a reduced rate such as thelowest rate available $17 per hour. At his rate, the Town should be able to cover the Town's directcosts of cleaning up the Community Hall after the market ends.

THAT Council gives first reading to "Town of Qualicum Beach Financial Plan (2010-2014) BylawNo. 647, 2009".

BACKGROUND

The 2010 - 2014 Financial Plan is scheduled to be reviewed as follows (please note that this timetablecould be extended as the deadline for adoption is May 15, 2010).

Adoption

In addition to the above schedule, the Financial Plan is normally revisited by Council in the SpringMarch/April time frame. New initiatives by Council and/or up to date information (such as projectscarried over from 2009 and new costing estimates for projects) could necessitate revisions to theFinancial Plan. A tax rate bylaw is also presented in the spring when information from othergovernment agencies, for example the Regional District of Nanaimo, is usually provided.

The Town's Financial Plan bylaw is for a five year period with the previously adopted bylawcovering the period 2009 to 2013. The new bylaw will cover the years 2010 to 2014.

REPORT ANALYSIS

This memorandum is basically intended to set the road map for the financial plan review process.Detailed budget information including operating revenues and expenditures, and capital projects willbe presented at the November 2, 2009 regular meeting of Council. A formal opportunity for publicinput and participation will also be available at that time. Staff will also provide an overview ofstudies and/or reviews currently taking place that could have budget implications.

The Town's previous 2009 to 2013 Financial Plan was based on the Town's portion of property taxesincreasing 3.5% in 2010 comprised of 2.5% for service changes and inflation, plus 1% for buildingimprovements. New construction taxes were budgeted to increase 1.5%; however, based on reducedconstruction activity that has occurred in 2009, this 1.5% amount may have to be reduced. Thisfinancial information will be expanded upon in the detailed information to be provided at theNovember 2, 2009 meeting.

TOWN OF QUALICUM BEACHBYLAW NO. 647

The Council of the Town of Qualicum Beach, in open meeting assembled, enacts as follows:

1. Schedule "A" attached hereto and forming part of this Bylaw is hereby adopted and is theFinancial Plan of the Town of Qualicum Beach for the five-year period from January 1, 2010to December 31, 2014.

2. "Town of Qualicum Beach Financial Plan 2009-2013 Bylaw No. 640, 2009" is herebyrepealed.

3. This Bylaw may be cited for all purposes as "Town of Qualicum Beach Financial Plan 2010 -2014 Bylaw No. 647, 2009" and shall become effective upon adoption.
