Left shoulder and ArD: Around the shoulder, about a dozen of gr~zing or penetrating injuries. The left arQ bone (hu~erus) is severely destroyed by several larot cali­ber penetrations. the arr.t is shortened and swollen, deformed.

Internal Exoujnation: .

The blood is clotted in all blood vessels and chambers of the heart, after the complete injection.

The skull is unusually thin, 2 to 4 rum. Over the hemi­spheres of the brain, there is no change, howev e r, on the left deep te~poral region and in the anterior and median thirds of the base of the skull, 'there are numerous lines of fractures. The lower half of the temporal 'bone is splintered; the frontal, temporal and sphenoidal bones o~er ~he eyes show a 'network' of fracture lines. - Under the outer covering membran e of the brain is an extensive bleeding,originating from ruptured venous sinuses and arteries. The brain is symmetrically developed! . without anomali es. TIle left frontal and temporal lobes are partially destroyed by penctrriting bon e pieces, some of those reach the posterior regions. 'ihe cerebrospinal fluid is mixed with blood. The veptricles are symmetrical. In ~he middle part of the brain, above the red nucleus, in the white matter below the gray center thalamus~ ·is a fairly well out~ lined tumor about 2xl.5xl em in dimensions, grayish-yellow, with peripheral areas of red as blood.

The organs of the neck, besides injuries in tho region, are unchanged. The level of the diaphragm is at the 6th rib on the right and above the 4th rib on the left side.

Circulatory Organs: The covering membranes of the heart are smooth, the cavity is filled with ' blood, originating from a pebetrating wound into the right ventricle, around which the hea~t muscle is hemorrhagic. The heart is collapsed, its in­ner membrane and valves are smooth, the coronary arteries, aorta and large arteries arc unchanged. .

Respiratory Organs: 'The lining membrane of the right chest cavity is smooth, there is no fluid. The lung contains a di­minished 3QOunt of blood; the tracheo-bronchial channels are filled with frothy blood. The left chest cavity contains some 50 ml of blood and a considerable alllount.of air, originating from the later a l aspect of the lobes . which were penetrated by projectiles. Several areas of b~th lobes are hemorrhagic, so are all the air channels. -

Abdome~: The lining membrane is smootll, the cavity con­tains embalming fluid mixed with blood and gastrointestinal contents, after cavity embalming. Besides perforations by the embalming instrument, the stomach and intestines show no change. The splcen is of average size. the capsule is corrugated, due ~o SOQC loss of blood. The liver is proportionally large, Its capsule is smooth, its inner matter js pale brownish-yellow, with decreased a~ount of blood. The gall bladder is uncha~ged.

The pancreas and suprarenal glands are unchanged. - The kidneys are relatively large, their surface is smooth, both cortex and ~edulla arc wide, 'with some congestion along the borderline of tho two layers. The bladder and reproductive otgans show no patholonica]. ~

Histological Fin d ic\Cjs: The tumor of the 'brain ,is comp<?sed of elements of the conn ect.ivo tissue of the brain (glia) and of blood vessels of enL':H'ged calibers. Some of these blood

' vessels have thick walls, others thin ' ones, with defective con­struction of the layers and microscopically small bleedings into the surrounding intercellular sp aces, however, only a dozc~ or less red blood cells cnteres those spaces around. The ccll~ arc rather sf-Iall, round or elol1<]ated, with a small amount of ' cytoplasr:1 and mostly we ll staining nucleus. The chromatin sub­stance of the nucleus is well organized, round or ' somewhat elong~~ed Or~ in sorue places, vesicular. Cell divisions occur only very exceptionally, indicating a mlriimual level of activity, ju~t on the borderline to mali gnant formations. There are areas of cell death (necrosis), surrounded by a fence-like arrangement (pali­sade formation) of elongated cells.

Diagnosis: Fatal injurjes to the head and to the heart. Additional finding: a small brain tumor in the

white matter above the brain stem T composed of connective tissue elements of the brairi, mixed with numerous enlarged ' blood vessels; no evidence of malignantly fast growth, but that of partial tissue death, necrosis. (Astrocytom~). No . correlation to psychosis or perman~nt pains.

Regarding this offense, proceeded to the University area and tried to obtain &high powered rifle. Obtained two rifles on two different occasions and obtained three boxes at 30.06 ammunition and one box of 30.30 ammunition from EVERETT HARDwaRE ~ANY 2820 Guadalupe. This hardwared company has not been .relmburs~the ammunition. After attemempting to shoot the subject from several locations, ascertained that I was too shakey to do any good and gave the weapons back to their owners.

On hearing from the radio eispatcher that officers were needed at the University of Police Security Office, to go up In the University Tower, proceeded to that location where 1 was met by Sgt. Barr of the U.T. Police. While at the security offIce, saw Officers Moe, Conner, Shoqulst and Shepard drive up and told them to follow Sgt. Barr in a U.T. Unit.

MR. W1LL~ M. WILCOX. 3109 Beverly. escorted these officers through tunn~l • . Into the .U. T. Tower . where MR. FRANK HOLDEN 6917 Langston took these officers up on the elevator to the. 21th floor where Officer Jerry Day and MR. W. A. COWAN of DPS, told these officers that Officer M. MartineZ and . a~. ALLAN .CRUMP of the University CoOp, were up inSide the room which is surrQu~ed by the Tower observatory, where the .0 iper was.

Officer J. Day and this officer proceeded up the stairs to Where Officer Uartinex and CRUMP were while the other officer. removed two wounded and two dead civilians subjects at the bottom of the stairs.

Atter entering the room, this officer followed Officer Martinez out of the room onto the observatory walk around, going through a door on the south s ide. Officer Mart1nez with th is office following, crawled on the south prt of the walk around to the south east corner and started crawling nor thward on the east part of the walk around. MR. ALLAN CRUMP and Officer J. Day guarded the south part of the walk around to make certain the sniper did not come behind this officer and Officer Martlnez.

At the northeast corner, this officer saw Officer Martlnex level his 38 special and commence firing. this officer heard a shot come from the area Where he later saw the sniper. This officer stepped around

the corner and commended firing this 12 guage shotgun, APD 1t2, firing off two rounds, both of Wblch are believed to have hit the sniper In the m ad. The sniper was first observed In a sitting position wIth 8 Carbine rifle pointIng In the direction ot this officer and Otflcer Martlnex. The weapon seemed to be falling and the subject seemed to be sl1ding Into a laying, on his back position. After this officer had fired two rounds, efflcer Martlne£ grabbed this officerls shotgun and fued one round at the subject.

Proceeded to the subject and ascertained that he was dead, Whereupon Officer Martinex waved a light green towel that was laying nearby the subject, so as to notify police and vlcll1ans to cease firing at the Tower. J ' .. . :

Officer Martinex then proceeded to find a telephone or radio to notify the APD to notify radio stations to announce for everyone to cease f 11'e. .

This officer stayed by the sniperts body until ClD help arrive ••
