9. Invoice Copy - Should be sent in triplicate on the Name of Managing Director, HafTkine BioPharmaceulical Corporation Ltd.( Procurement Cell), Mumbai. along rvith Bill of Entry and

Country of Origin Certificate ofthe consignment.10. Other Terms:

a. Warranty: The warranly period shall be for 2 years from the date of commissioning ofallequipment supplied as certified by the consignee. Replacement of spares parts thereofdue to manufacturing defects during warranly period will be entirely at the supplier'scost.The successful lenderer must ensure 95oZ uptime during warranty period. In case

ofdowntime, warranty period will be extended for period ofdowntime. Ifthe equipmentis not atlended within 24 hours for Mumbai and 48 hours for other places the supplierwill be liable to pay a penalty of 0.07%o of purchase cosl for every day of delay. Suchpenalty will be recovered from the amount of security deposit. Certificate of such uptime/ downtime issued by the end user will be binding for the supplier. Replacement ofsparesparts thereofdue to manufacluring defects during warranty period will be entirely at thesupplier's cost.

b. The user inslitution will enter to the Comprehensive Maintenance Contract with supplieragency @ 5% of the order value of the equipment per year for Eight years aftercompletion of warranty period. In case of non-compliance of CMC the supplier will be

liable to pay penalty or for appropriate action. Payment ofCMC on yearly basis will be

made by the user's institution, at the end ofthe year after satisfactory performance report

from the end user.

ll. Contract Agreement: Bidder should submit Contract Agreement on non-judicial stamp paper ofrequisite value.Fall Clauselt is a condition of the contract that all lhrough the cunency thereof, the price at

rvhich you will the supply stores should nol exceed lhe lowest price charged by you to any

cuslomer during the currency oflhe contracl and that in the event ofthe prices going down below

this contract prices you shall promptly fumish such informalion to us to enable 1o amend the

contract rates for subsequent supplies.
