  • I. OVERVIEW

    The Committee on Education, General and Omnibus Affairs held a public hearing on Tuesday, November 25, 2008 at 2:00 p.m. on Bill No. 373 (LS) - E.J.B. Calvo I T.R. Muna-Barnes I R.J. Respicio - An act to authorize I Maga'lahen Guahan to sell the easement known as the "Government Alley"that is bound by the U.S. District Court on the Western Boundary, South O'Brien Drive on the Southern Boundary, and the metes and bounds of the Western Boundary of Lot 239-4-1, all in the municipality of Hagatna with a total area of fifty eight and five hundredths plus or minus square meters (58.5 +-sq. meters) to Mr. and Mrs. Ralph Sablan (Ralph and Janiece) for its appraised fair market value.

    Notices for the public hearings were disseminated to all local media via facsimile in accordance with the requirements of the Open Government Law and are attached herein.

    Senators present at the public hearing were:

    Speaker Judith T. Won Pat, Vice Chair and Acting Chair Senator Edward J.B. Calvo Senator Adolpho Palacios, Sr.

    II. SUMMARY OF TESTIMONY, COMMENTS, AND DISCUSSION

    - Mrs. Janiece Sablan gave oral testimony in support of Bill 373(LS). She stated that her family had purchased the property adjacent to the alley way and at the time was not know that the alley existed. Once, she found out that the alley way existed research was done to purchase the alley way. During the research her husband Ralph discovered that their lot and many other lots in Hagatna were supposed to have been surveyed. With the resurveying of Hagatna the Sablan's found that the alley way would have been included in their property which they've purchased.

    Mr. Ralph Sablan also gave oral testimony in support of Bill 373(LS). Mr. Sablan stated that he had conversations with Attorney Charles Troutman before his passing about the resurveying of Hagatna. According to Mr. Sablan, Mr. Troutman state that the surveying had begun from East O'Brien drive towards the Sablan's property, but due to the lack of funding to complete the surveying the last parcel of property that was surveyed would have been around the Cassidy's building area.

  • Mr. Ernie Santos from the Department of Land Management state that the Department of Land Management has no objections to Bill 373(LS). The Department would like to recommend that the alley way be surveyed and the cost of the surveying and registering be the responsibility of Mr. & Mrs. Sablan and that the proceeds from the sale be deposited into the Department of Land Managements land survey revolving fund.

    Senator Palacios asked if there were any of the other land owners surrounding the alley way requesting to purchase the alley way?

    Mr. Santos stated that Mr. Pangilinan is the owner of the property where the district court is located on now and that before the court was built Mr. Pangelinan had purchased the alley way opposite of the Sablan's property.

    Senator Palacios stated so really nobody else will be adversely affected by the acquisition by the Sablan's.

    Mr. Santos stated that it is true.

    -There being no additional testimony and comments, the hearing for bill 373(LS) was concluded at 2:38 p.m.

    Ill. FINDINGS AND RECOMMENDATION

    The Committee on Education, General and Omnibus Affairs, to which Bill 373 (LS) was referred, finds support for the bill and hereby submit its findings and recommendations to I Mina' Bente Nuebi Na Liheslaturan Guahan TO PASS Bill 373(LS).

    AN ACT TO AUTHORIZE I MAGA'LAHEN GUAHAN TO SELL THE EASEMENTKNOWN AS THE "GOVERNMENT ALLEY" THAT IS BOUND BY THE U.S. DISTRICT COURT ON THE WESTERN BOUNDARY, SOUTH O'BRIEN DRIVE ON THE SOUTHERN BOUNDARY, AND THE METES AND BOUNDS OF THE WESTERN BOUNDARY OF LOT 239-4-1, ALL IN THE MUNICIPALITY OF HAGATNA WITH A TOTAL AREAS OF FIFTY EIGHT AND FIVE HUNDREDTHS PLUS OR MINUS SQUARE METERS (58.5 +/- SQ. METERS) TO MR. AND MRS. RALPH SABLAN (RALPH AND JANIECE) FOR ITS APPRAISED FAIR MARKET VALUE.

    1 BE IT ENACTED BY THE PEOPLE OF GUAM:

    2 Section 1. Legislative Findings and Intent. I Liheslaturan Guahan finds that Mr.

    3 Ralph Gregory and Mrs. Janiece Annette Sablan (the Sablans) are the owners of Lot

    4 239-4-1 (246 +/-sq. m.) in the Municipality of Hagatna. The lot, supra, together with

    5 South O'Brien Drive and the U.S. District Court contiguously border an appurtenant

    6 easement known as the "Government Alley" '(58.5 +/- sq. m.). The properties are

  • 1 marked and designated on Map Drawing No. CC-7807 A (LM#323FY78), dated June

    2 12, 1978 and recorded on July 17, 2000 under Instrument No. 624375.

    3 I Liheslatura further finds that the Sablans desire to develop the property for

    4 mix-use development of commercial and residential space and further find that the

    5 "Government Alley", because of its size, has no significant practical purpose because

    6 it is too small to be used for rights of way. The "Government Alley" is accessible from

    7 South O'Brien Drive but provides no easement of any kind. Upon consolidation of Lot

    8 239-4-1 and the "Government Alley", the property can be developed to its maximum

    9 potential. The "Government Alley" is a substandard umegistered Government of

    10 Guam property. The "Government Alley" does not serve as an access nor utility

    11 easement to any other abutting lot in the area and its sale would not cause any land

    12 owner to be landlocked or without access.

    13 I Liheslatura further finds that the "Government Alley" is located parallel to Lot

    14 239-4-1 and due to the minimum legal setback requirements from the "Government

    15 Alley" it would be impractical for the Sablans to develop their property. Therefore it is

    16 the Sablans' desire to purchase the 58.5 square meter appurtenant easement known as

    17 the "Government Alley" from the Government of Guam for its fair market value.

    18 It is the intent of I Liheslatura to allow the Sablans to purchase the easement known

    19 as the "Government Alley" that is appurtenant to Lot 239-4-1, supra.

    20 Section 2. Authorization to Sell Government Alley Easement. I Maga 'lahen

    21 Guahan is hereby authorized to sell the easement known as the "Government Alley",

    22 currently bound by the U.S. District Court on the western boundary, South O'Brien

    23 Drive on the southern boundary, and the metes and bounds of the western boundary of

    24 Lot 239-4-1, all in the municipality of Hagatfia, that has a total land area of fifty eight

    25 and five hundredths plus/minus square meters (58.5 +!- sq. meters) to Mr. Ralph

    26 Gregory and Mrs. Janiece Annette Sablan for its appraised fair market value. The

    27 Director of the Department of Land Management shall select the appraiser to

    28 determine the fair market value of the "Government Alley. " The cost of the appraisal

  • 1 and all necessary fees shall be paid by the Sablans. The surveying, mapping, and land

    2 registration of the "Government Alley" shall be paid by the Sablans. Proceeds from

    3 the sale of land shall be deposited in the Department of Land Management Land

    Good Afternoon Madame Speaker Judith Won Pat, Senator Calvo and Senator Palacios.

    Testimony on Bill No. 373 (LS), an act to authorize I MAGA'LAHEN GUAHAN to sale the easement known as the "Government Alley" on the western boundary of Lot 239-4-1, Municipality of Hagatna.

    *The Department of Land Management has no objections to Bill No. 373 (LS) to sale the easement known as the "Government Alley" that is bound by the U.S. District Court on the Western Boundary, south O'brien Drive on the Southern Boundary, and the metes and bounds of the Western Boundary of Lot 239-4-1, all in the Municipality of Hagatna with a total area of 58.5_± square meters to Mr. and Mrs. Ralph Sablan. However OLM would like to make the following recommendations:

    1. The "Government Alley" is a substandard unregistered Government of Guam property.

    2. The "Government Alley" does not serve as an access nor utility easement to any other abutting lot in the area and its sale would not cause any land-owner to be landlocked or without access.

    3. Surveying, mapping and land registration of the "Government Alley" shall be paid by the Sablans.

    4. Proceeds from the sale of land shall be deposited in the Department of Land Management Land Survey Revolving Fund.

    Testimony in Support Government Alley Land Purchase R. Gregory and Janiece A. Sablan

    Good morning Speaker Judith Won Pat Borja and Senators of the 29th Guam Legislature. My name is Janiece Sablan and my husband is Greg Sablan. We are submitting this testimony requesting for your favorable consideration and support of Bill 373(LS) that would allow our family to purchase a government alley located in Hagatna adjacent to the Federal District Court and our property Lot 239-4-1.

    My husband and I purchased our property in Hagatna a few years ago near the Federal Court Building on South O'Brien Drive. We have plans to develop the 264 square meters property in the very near future. We have confidence in Guam's economy and the revitalization of Hagatna and would like to contribute to such. In order for us to fully maximize the potential for our property we need to acquire a small piece of property currently owned by the Government of Guam. The property is a narrow pre-war alley that is between our property and the U.S. Federal Court building fence. The size of this small parcel is approximately 7' x 90' or 630 square feet or 59 square meters.

    We would like to build on the property and have several ideas for either commercial or residential uses. We strongly feel that acquiring this property would create a win-win situation for both the government and our family for the following reasons. First, this will alleviate at least one piece of the numerous fragmented and basically useless lots in Hagatna. Second, the sale of the land to us will provide some cash for Government of Guam coffers and value added real property tax. Lastly, a development such as ours will result in a new structure with architectural aesthetic value that will lend itself not only to increased property values for surrounding areas but to support the movement for live, work, and play communities.

    As depicted in Map ClO our property Lot 239-4-1 was to be consolidated to Block 10 Lot 10. Due to a lack of funding only certain areas of Hagatna were consolidated to the new block and Jot system. Unfortunately, the consolidation was not completed in the area that our Jot is located. As is evident with immediate surrounding developments such as the Federal Court building and the Bank of Guam, fractional lots have been made available to allow for these developments to be constructed. We respectfully request that we be given the same favorable consideration.
