Dy. CME/Plant/ICF for and on behalf of President of India invites sealed tenders from eligible tenderers for the said work up to 14.30 hours on 06.04.2018 which will be opened at 15.00 hours on the same day. A sum of Rs.4,68,600/- (Rupees Four Lakhs Sixty Eight Thousand and Six Hundredonly) towards EMD to be deposited in cash with Assistant Chief Cashier of ICF or in the form of Fixed Deposit Receipts/Banker’s cheque/Demand Drafts in favour of Financial Adviser and Chief Accounts Officer, ICF executed by State Bank of India or any of the Nationalized Banks or by a Scheduled Bank. This EMD, which is to be submitted along with the bid, shall be given by the Tenderer against any loss in the event of the tenderer failing to undertake the contract or to furnish the required Security Deposit within the appropriate time after the acceptance of the tender. In case, the tenderer is submitting FDR towards EMD, then the FDR shall be submitted with Auto Renewal Facility. Any other form of EMD viz., Bank Guarantees will be summarily rejected. It is the responsibility of the Tenderer to check any correction or any modifications published subsequently in Web site/news paper and the same shall be taken into account while submitting the tender. Tenderer shall down load corrigendum (if any), print out, sign and attach it with the main tender document. Tender document not accompanied by published corrigendum/s is liable to be rejected. TENDER INTRODUCTION

Sub: Conversion of existing Shot Blasting Plant Inv.No.19000 in Shop 54, Furnishing division

suitable for blasting of stainless steel shells.

Ref: Open Tender No: M/M&P/WC/04/09/conversion of Shot blast plant/19000/2017-18

It is proposed to carry out “Conversion of existing Shot blasting plant bearing the Inventory Number 19000 in Shop 54, Furnishing division,suitable for blasting of stainless steel shells” by reputed firm.

Dy. CME/Plant/ICF for and on behalf of President of India invites sealed tenders from

eligible tenderers for the said work up to 14.30 hours on 06.04.2018 which will be opened at 15.00 hours on the same day.

A sum of Rs.4,68,600/- (Rupees Four Lakhs Sixty Eight Thousand and Six Hundredonly) towards EMD to be deposited in cash with Assistant Chief Cashier of ICF or in the form of Fixed Deposit Receipts/Banker’s cheque/Demand Drafts in favour of Financial Adviser and Chief Accounts Officer, ICF executed by State Bank of India or any of the Nationalized Banks or by a Scheduled Bank. SPECIAL CONDITIONS OF CONTRACT

1. TENDER NO:

1.1 No. M/M&P/WC/04/09/Conversion of Shot blast plant/19000/2017-18

2. NAME OF THE WORK:

2.1 Conversion of existing Shot Blasting Plant Inv.No.19000 in Shop 54, Furnishing division, suitable for blasting of stainless steel shells.

3. BRIEF DESCRIPTION OF WORK:

3.1 One number of Shot blasting Plant Inv No.19000 in shop-54 is now utilised for shot blasting of shells made of CORTEN steel. This existing shot blasting plant has to be converted to blast stainless steel shells as per the scope of work mentioned in Para 9.0 below.

5. VALIDITY OF OFFER SHALL BE FOR MINIMUM 90 DAYS (NINETY DAYS) FROM THE DATE OF OPENING OF THE TENDER.

6. IT IS EMPHASIZED THAT THE TENDERER SHALL GIVE PARA-WISE COMMENTS FOR ALL THE FOLLOWING PARAS, IN THE SAME SEQUENCE TO FACILITATE EARLY FINALISATION OF TENDER.

7. THE CHECKLIST AT ANNEXURE – D SHALL BE TICKED AND SUBMITTED ALONG WITH THE QUOTATION AS A PROOF OF COVERAGE OF ALL ASPECTS IN THE QUOTATION.

8. FOR QUOTING THE RATES, THE PRESCRIBED SCHEDULE OF RATE FORMAT AT ANNEXURE–B SHALL ONLY BE USED BY THE TENDERER WITHOUT FAIL.

9.0 SCOPE OF WORK FOR THE TENDERER

9.1 The scope of work includes design, modification, manufacture, supply and

installation of equipments /components required to convert existing Shot Blasting

Plant bearing the Inventory Number 19000 suitable for blasting of stainless steel

shells.

9.2 Details of existing Shot blasting Plant:

9.3 Mechanical scope of works for the Contractor

9.3.1 The modified plant shall be capable of blasting both side walls, both end walls and

corrugated roof of Stainless steel shells of all types. Blasting time (i.e. Cycle time)

per shell shall be less than or equal to existing time ie 40 minutes. Surface

appearance standard obtained after blasting shall be Sa 2.5 of ISO 8501-1.

9.3.2 After modification of existing shot blasting plant, the plant shall be capable of

blasting the undermentioned important stainless steel shells. Also the modified

plant shall be capable of blasting all other stainless steel shells. The contractor

shall collect the updated versions drawings of other stainless steel shells from ICF.

9.3.3 The Contractor shall study the existing plant and analyse the parent structural for

design modification and strengthen the same if required to with stand added load.

9.3.4 The Contractor shall study the size of the plant and modify the same based on the

stainless steel shells to be blasted.

9.3.5 The Contractor shall study the design of the existing wheelabrators and modify

them to handle suitable blasting media to blast Stainless steel shells and to obtain

surface appearance standard as mentioned in para 9.3.1 above.

9.3.6 The Contractor shall study the design of Longitudinal and cross screw conveyors

and modify them to handle blasting media required for stainless steel blasting.

9.3.7 The Contractor shall study the design of bucket elevators, Rotary filters and Top

hoppers and modify the existing one to handle the suitable blasting media.

9.3.8 The Contractor shall study the design of dust collector system and modify it to suit

Stainless steel blasting. New/Modified dust collector system shall meet the norms

prescribed by TNPCB AIR (Prevention and control of pollution) Act, 1981.

9.3.9 The Contractor shall study the design of winching system and shall carryout any

modification required to meet the specified cycle time. Resiting of winches if

required, shall be done at the cost of contractor.

9.3.10 The Contractor shall ensure effective recycling of blasting media.

9.3.11 The Contractor shall study the existing filtration system and modify to ensure that

the blasting media fed to the wheelabrators should not contain debris or

contaminants. Blasting media of lower sizes shall also be removed from the

system.

9.3.12 The contractor shall design (modify) wheelabrators to take care proper blasting of

the corrugated roof in LHB shell as detailed in para 9.3.2.

9.3.13 Supply of blasting media required for initial filling and for blasting 30 numbers of

stainless steel shells to prove out the performance shall be under the scope of

contractor.

9.3.14 In addition to the quantity referred in para 9.3.13,the Contractor shall also supply

blasting media required for blasting 500 stainless steel shells.

9.3.15 The contractor shall hand over the released material to ICF. If any released

items/components are not required, then the same may be moved to scrap ward at

the cost of contractor.

9.3.16 The contractor shall follow only the updated versions of the drawings followed

for various types of shells that are under production process.

9.3.17 The Contractor has to submit drawings required for masking of all openings such

as windows, vestibules, doorway etc for the respective shells.

9.3.18 The contractor shall supply two sets of all essential maskings as prescribed in

the drawing that are required for each type of shells.

9.3.19 All the new components fitted shall be painted with one coat of ROZ primer and

the entire plant (includes Dust collector pipes, ducts, chimneys, electrical

control panels & winches)shall be painted with two coats of Enamel paint as per

the colour specified by ICF.

9.3.20 All the material handling equipments required for the subject work shall be the

scope of the contractor.

9.3.21 The contractor shall use only the blasting media (Shots/Grits/Cut-wire etc.)

which is always available in themarket for un-interrupted functioning of the

plant.

9.3.22 The Contractor shall furnish the technical details of the blasting media like

description, size & IS specification, etc in the offer to enable the consignee to

procure the same.

9.3.23 For blasting of shells, the contractor should not use the blasting media which is

prohibited by TNPCB.

9.3.24 To prevent fire accident, welding activities shall be executed outside the shop

to the extent possible. Only essential welding works shall be carried out at site.

9.3.25 Successful tenderer shall arrange for all necessary tools, welding machines,

welding cables, welding rods, gas cutting plant with flash back arrester including

gases (oxygen and acetylene) which are required for the subject work.

9.4 Electrical scope of works for the Contractor

9.4.1 The Tenderer shall replace existing relay logic electrical control panel by PLC

and HMI.

9.4.2 All electrical panels shall be enclosed in a dust proof cabin with air circulation

system to prevent dust accumulation in electrical components. The operator

control panel should be housed inside a framework of poly-carbonate sheet.

9.4.3 Winch speed shall be adjustable both in forward and reverse direction. Separate

speed limit settings to be provided for forward and reverse movement of winch.

9.4.4 Sensors shall be provided at various stages of shell movement to interlink with

shell blasting cycles. Rotary encoder type sensors are provided for ease of

operation.

9.4.5 The control system shall be designed to run the plant automatically as well as

manually for testing and setting purposes.

9.4.6 Blasting media flow control valve shall be adjustable from the operator control

panel also for the ease of operation.

9.4.7 Ammeters for wheelabrator shall be provided near plant so that the loading of

wheelabrator motor shall be visible to operator during blasting media flow

adjustment.

9.4.8 Automatic power factor control panel shall be provided with suitable rating.

9.4.9 Energy efficient star rated motors preferred. LED type light fixtures shall be

used.

9.4.10 All power and control Cables shall be armoured copper cables only and shall run

into fully covered cable trays.

9.4.11 Illumination inside the pit shall be provided with 24V rated LED fixtures.

9.4.12 The tenderer shall provide sufficient illumination inside the blasting chamber.

9.4.13 Zero speed switch with inter lock shall be provided for all screw conveyors to

safe guard the plant from unexpected failures of conveyors.

9.4.14 LED based aviation lights shall be provided.

9.4.15 Audio visual indication to indicate fault in the plant.

9.4.16 Blasting media running indications shall be provided to alert passerby person.

9.4.17 Drawings, manual and tools shall be submitted

9.4.18 Control voltage shall be 110V 50Hz AC.

9.4.19 The contractor shall ensure that the preferred make for critical equipment

should be as per below:

a. Motors : Bharat Bijilee, Siemens, ABB, Crompton.

b. PLC : Allen Bradley, Mitsubishi, Siemens, Fanuc

c. Ampere meter, voltmeter,: Rishabh, AE, imp, Meco

9.5 Acceptance Criteria:

9.5.1 Minimum of 30 numbers of stainless steel shells shall be blasted for proving the

performance of the converted plant.

9.5.2 Surface appearance standard as mentioned in para 9.3.1, shall be proved for 30

numbers of blasted shells. Proving shall be done in presence of authorities

nominated by ICF

9.5.3 Cycle time shall be proved by the tenderer for 30 numbers of stainless steel

shells.

9.5.4 The contractor shall ensure that contaminant level of the exhaust/filtered air

from the outlet of Dust collector should be within limits prescribed by TNPCB as

mentioned in para 9.3.8. Tenderer has to collect the sample and record the

values during proving period.

9.5.5 The contractor shall obtain Safety inspection & certification from a competent

person approved by Director, Industrial Safety And Health, Tamilnadu for the

modified plant as per Rule 95 of Tamil Nadu Factories Rules, 1950.

9.6 The contractor shall engage one qualified graduate Engineer to supervise the works as per clause 26.A.1 of Indian Railways Standard General Conditions of Contract. Failure to engage qualified graduate engineer will result in imposing penalty as per clause 26.A.2 of Indian Railways Standard General Conditions of Contract.

10.0 ICF’s scope:

10.1 ICF shall provide compressed air, Water and Electricity as available for the subject conversion work at free of cost.

11.0 OTHER IMPORTANT CONDITIONS

11.1 The work shall be executed by qualified and skilled technicians under the direct supervision of a qualified engineer/supervisor as specified in para 9.6. Further such engineer/supervisor will be fully responsible for smooth completion of all works detailed above.

11.2 Stipulated minimum wages enforced by Labour Enforcement Officer, applicable for thesubject work shall be ensured to their staff by successful tenderer.

11.3 The tenderer shall quote his rates duly anticipating the revisions either upward or downward that may arise in minimum wages act enforced by the Ministry of Labour and Employment, during the currency of the contract period. It may be noted that as per past experience, the minimum wages are revised upward twice in a year by the Ministry of Labour and Employment.

11.4 The quoted/negotiated and accepted rates are final and will not be revised against any upward or downward revision in minimum wages act enforced by the Ministry of Labour and Employment, during the currency of the contract. If there is any upward or downward revision in minimum wages

during the currency of the contract, the successful tenderer shall bear such revisions from his side only.

11.5 For the labour engaged, the successful tenderer is required to provide a photo identity card and shall comply all the safety provisions as per rules and ensure to wear all the personnel protective equipments like safety shoes, helmet, safety belt etc., (The safety belt shall have the valid competent person certificate) requirement for the safe working of their staff are under the contractor’s scope.

11.6 The successful tenderer must strictly follow the ICF safety regulations such as entry permit, work at height permit, Hot working permit, necessary electrical shut down permit etc.

11.7 The While carrying out the work near open current distribution system, additional care must be exercised by the firm and necessary Power Shut-down to be obtained. No electrical wire shall be cut by the successful tenderer.

11.8 The successful tenderer has to inspect the work area along with contract proposed section in charge SSE/JE before commencing the work and necessary action plan required to be followed including hazards involved and its precautions at work station need to be submitted to the contract executing section.

11.9 The worker engaged for the work at height should be competent enough on safety regulations and knowledgeable regarding the hazards involved and its precautionary measures.

11.10 If the work is planned during the factory working hours the successful tenderer’s supervisor should report to the shop in charge regarding the work planned through proper letter correspondence.

11.11 The first aid kit and emergency rescue plan should be available and known to the successful tenderer’s supervisor and the staff.

11.12 The staff attendance on daily basis and wage register on monthly basis must be brought to the notice of the ICF nominated staff.

11.13 The successful tenderer shall ensure that no unauthorized person works for him inside ICF premises.

11.14 The successful tenderer shall be responsible for the discipline of the men & women engaged by him/her inside the ICF area and ensure that the labourers employed by him are confined to their places of working and shall not go around the workshop.

11.15 The successful tenderer shall ensure that the labour employed by him/her inside the factory comply with all instructions given by the security staff on duty.

11.16 The successful tenderer shall maintain close co-ordination with the engineer in-charge of the work so as to ensure the work is in progress according to the contract schedule, failing which the administration shall take necessary action as per general conditions of contract.

11.17 Labour engaged under this contract should wear distinct uniforms. The uniform shall be with successful tenderer’s name and logo printed on it. The colour of the uniform shall be different from what is used in Railways.

11.18 The successful Tenderer shall be responsible to take necessary precautionary measures in order to ensure the safety against injury, etc., of his personnel while working at the Railway premises and should confirm to the rules and regulations of the Railway. Successful Tenderer must provide adequate insurance coverage (i.e. workman compensation insurance) to their labours.

12.0 Submission of GA drawing, supply of Materials and Completion Period:

12.1 Successful tenderer shall prepare and submit GA drawing with Bill of Materials (BOM) for the proposed conversion of shot blasting plant within 30 (Thirty) days from the date of issue of LOA and get it approved.

12.2 The Tenderer shall supply all the materials required for the subject work as per the BOM specified in the GA drawing within 60 (Sixty) days from the date of approval of GA drawing.

12.3 The Tenderer shall start the work immediately after the supply and verification of the materials by the concerned SSE/Shop-80 & SSE/Shop-85.

12.4 The Tenderer has to complete the entire work specified in para 9.0 above in all aspects within 180 (One Hundred Eighty) days from the date of supply of materials.

12.5 Five hard copies of Operation and maintenance manuals (with spare parts List) and the soft copy of the same shall be issued by the Tenderer.

12.6 Entire blasting plant has to be covered under Two years warranty.

12.7 Tenderer shall give spare support till the life of the blasting plant.

12.8 If any unavoidable delays caused in the part of ICF and its associated departments in later stages, extension of completion time will be given subject to the advance approval obtaining from the undersigned by appropriate written request. The successful tenderer shall co-ordinate with the Mechanical maintenance & Electrical maintenance shops of ICF (i.e Shop-80 & Shop-85 in Furnishing division) for early completion.

13. TENDERER MUST VISIT THE SITE, TAKE NOTE OF THE SITE CONDITIONS AND ANALYSE THE CONSTRAINTS BEFORE SUBMITTING THE TENDER. THE WORK SHOULD BE CARRIED OUT IN STRICT ADHERANCE TO THE SCHEDULE AND SHOULD NOT IN ANY WAY DISTURB THE NORMAL PRODUCTION PROCESS OF THE FACTORY.

14. FOLLOWING DETAILS SHALL BE FURNISHED (IRRESPECTIVE OF THE MONETARY VALUE):

14.1 List of Personnel available on hand and proposed to be engaged for the subject work.

14.2 List of Plant & Machinery available on hand (own) and proposed to be inducted (own and hired to be given separately) for the subject work.

14.3 List of works completed in the last three financial years giving description of work, organization for whom executed, approximate values of contract at the time of award, date of award, and date ofscheduled completion of work, Date of actual start, actual completion and final value of contract etc., should also be given in a separate sheet as per the pro-forma given below.

15 WORKING HOURS:

15.1 The works as per scope in Para 9 shall be carried out during the period from 08.00 Hours to 17.00 Hours on Week days including Saturdays.

15.2 If required, the above work shall also be carried out on the Holidays of ICF. (i.e. Sundays, Unpaid Holidays, Paid Holidays and Maintenance holidays).

16 MEASUREMENT, INSPECTION AND CERTIFICATION OF WORK:

16.1 After completion of supply of materials as mentioned in para 12.2 above, the successful tenderer has to submit a letter in this regard to the Engineer in-charge (Works Manager/Plant/Fur). In turn, WM/Plant/Fur will advise the concerned SSE of Shop 80 & Shop 85 to verify the supplied materials and to record the details of the materials supplied as per the tender conditions in the Measurement book.

16.2 After completion of the works, which are mentioned in clause 9 above, the successful tenderer shall submit a Completion Report to the Engineer in-charge. In turn, WM / Plant / Fur will advise the concerned SSE of Shop 80 & Shop 85 to inspect the work jointly with the firm’s representative. The concerned SSE of Shop 80 & Shop 85 will record the actual completed works in the Measurement Book.

16.3 The successful tenderer or his representative should sign in the Measurement Book to acknowledge the above measurements. Further, the completed works recorded in the Measurement Book are to be certified by the concernedofficers of Electrical Maintenance shop & Mechanical Maintenance shop. It shall be the duty of the successful tenderer to follow up with the concerned Officials of ICFin connection with recording and certification of the completed works in the Measurement book.

16.4 Payment for the work shall be made based on the measurements recorded in the measurement book vide clause 16.1 & 16.2 above and based on the certification done by concerned officers vide clause 16.3.

17 WARRANTY PERIOD:

17.1 After completion of works as per the contract, the performance of the modified Blasting Plant shall be proved out for the specified cycle time as per para 9.3.1 above and for the specified surface appearance standard as per para 9.3.1 above for 30 numbers of stainless steel shells. Only after proving out the performance of the modified Blasting Plant as mentioned above, works completion letter (ie. commissioning letter) for modified Blasting Plant will be issued. The warranty for entire blasting plant will be two years from the date of issue of works completion letter i.e. commissioning letter

17.2 If the Blasting Plant is under breakdown due to faulty workmanship or due to defective material, the tenderer shall attend the breakdowns and put the Blasting Plant in working condition within 72 hours or at the earliest possible time.

17.3 Days lost during the warranty periodwill result in extension of the warranty period accordingly. During the warranty period, the tenderer shall attend all breakdown calls only with their man power immediately. The labour charges to be incurred towards attending the above breakdown calls during the warranty period shall be borne by the tenderer.

18 PAYMENT TERMS AND CONDITIONS

18.1 No advance payment will be made to the successful tenderer.

18.2 All the payments will be made through NEFT only. NEFT Form enclosed vide Annexure – E shall be submitted duly filling and submitting all the required details.If Vendor Code is already allotted by ICF, then the Vendor Code alone may be furnished in this form.

18.3 After completion of supply of materials as per the tender conditions and after verification of the above materials by the concerned SSE of Shop 80 & Shop 85 and on the basis of Measurements recorded in the Measurement Book vide para 16.1 above & on the basis of certification for the above Measurements by the Concerned officers of Electrical Maintenance shop & Mechanical Maintenance shop vide para 16.3 above, 50% of the material cost will be paid within one month of supply of the materials.

18.4 Balance 50 % of the material cost and 100 % charges quoted for the work “Installation & commissioning for conversion of Existing Coach blasting plant suitable for blasting of stainless steel shells” will be paid after issue of

commissioning certificate for the works mentioned in Para 9 above and on the basis of Measurements recorded in the Measurement Book vide para 16.2 above & on the basis of certification for the above Measurements by the Concerned Officers of Electrical Maintenance shop & Mechanical Maintenance shop vide para 16.3 above.

18.5 The Security Deposit shall be released as mentioned in Para 22.2 below. The Performance Guarantee shall be released as mentioned in Para 23.5 below.

19 INCOME TAX AND GOODS & SERVICE TAX (GST)

19.1 Income tax and GST will be applicable for this contract as per the applicable rules and regulations prevailing at the time of making the payment.

19.2 Income tax will be deducted at source at appropriate rates and a certificate to that effect will be issued by the Railway to enable to submit the same for Income Tax returns.

19.3 Tenderers will examine the various provisions of The Central Goods and Services Tax Act, 2017(CGST)/Integrated Goods and Services Tax Act, 2017 (IGST) / Union Territory Goods and Services Tax Act, 2017 (UTGST) / respective state’s State Goods and Services Tax Act (SGST) also, as notified by Central/State Govt& as amended from time to time and applicable taxes before bidding. Tenderers will ensure that full benefit of Input Tax Credit (ITC) likely to be availed by them is duly considered while quoting rates.

19.4 The successful Tenderer who is liable to be registered under CGST/IGST/UTGST/SGST Act shall submit GSTIN along with other details required under CGST/IGST/UTGST/SGST Act to Railway immediately after the award of contract, without which no payment shall be released to the contractor. The contractor shall be responsible for deposition of applicable GST to the concerned authority.

19.5 In case the successful Tenderer is not liable to be registered under CGST/IGST/UTGST/SGST Act, the Railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned authority.

19.6 The contractor shall ensure that all the essential details given below are furnished in their Cash Bill / Invoice / Pro-forma Invoice at the time of raising their request for payments:

19.6.1 Name, Address and GST Identification No. (GSTIN) of the successful tenderer for each state.

19.6.2 Date of issue of Cash Bill / Invoice / Pro-forma Invoice.

19.6.3 Name, Address and GSTIN of the recipient (ICF)

19.6.4 Address of delivery.

19.6.5 HSN Code (for goods) or Accounting code of Service.

19.6.9 Taxable value of supply of goods and or services taking into account discount or abatement, if any.

19.6.10 Rate of Tax (Central GST, State GST, Inter State GST, Union Territory GST or Cess).

19.6.11 Amount of tax charges in respect of taxable goods or services (CGST, SGST, IGST, UTGST or Cess).

19.6.12 Place of supply along with name of State (in case of a supply in the course of inter-State trade or commerce).

19.6.13 Whether the tax is payable on reverse charge basis? This field must separately be identified as the recipient of services / goods supplied is liable to pay taxes without adjustments.

19.6.14 Signature or digital signature of the supplier or his authorised representative.

19.7 In case there is any further change in GST Tax structure till the date of completion of work or any error is noticed in the calculation of amount payable/recoverable till the release of final bill amount to the contractor, the same shall be paid by ICF or recovered from the contractor’s bill/Security Deposit or any other dues of contractor with Government of India.

19.8 Recovery, if any, which is required to be done from the contractors may be regulated as per section 171(1) of CGST Act, 2017

20 TENDER DOCUMENT CHARGES:

20.1 The Tender document charges will be Rs. 10,000/- (Rupees Ten Thousand Only) if collected in person (or) downloaded from ICF website. Tenderer shall submit a Demand draft for an amount of Rs.10,000/- (Rupees Ten Thousand Only), drawn in favour of FA & CAO / ICF or a cash receipt for an amount of Rs.10,000/- (Rupees Ten Thousand Only) from Asst. Chief Cashier / ICF towards the above mentioned document charges.

20.2 However, for Service contracts, MSEs registered with District Industries Centres, Khadi& Village Industries commission, Khadi& Village Industries Board, Coir Board, National small Industries Corporation, Directorate of handicraft & Handlooms, any other body specified by Ministry of MSME, shall be supplied such Tender document free of cost on confirmation (Xerox copy) of their evidence to this effect.

21 EARNEST MONEY DEPOSIT (EMD):

21.1 A sum of Rs.4,68,600/- (Rupees Four Lakhs Sixty Eight Thousand Six Hundred only)towards EMD to be deposited in cash with Assistant Chief Cashier of ICF or in the form of Fixed Deposit Receipts/Banker’s cheque/Demand Draft in favour of Financial Adviser and Chief Accounts Officer, ICF.

21.2 The above forms of EMD should be executed by State Bank of India or any of the Nationalized Banks or by a Scheduled Bank.

21.3 Any other form of EMD viz., Bank Guarantees will be summarily rejected along with the tender. Tender without requisite EMD will be summarily rejected. No

interest will be payable upon EMD, SD or on any amount payable to the successful tenderer under the contract.

21.4 In case, the tenderer is submitting FDR towards EMD, then the FDR shall be submitted with Auto Renewal Facility

21.5 However, for Service contracts, MSEs registered with District Industries Centres, Khadi& Village Industries commission, Khadi& Village Industries Board, Coir Board, National small Industries Corporation, Directorate of handicraft &Handlooms, any other body specified by Ministry of MSME, shall be exempted from payment of minimum EMD detailed above.

22 SECURITY DEPOSIT:

22.1 The Security Deposit amount will be 5% of the total contract value. The rate of recovery shall be at the rate of 10% of the bill amount till the full security deposit is recovered. Security deposit will be recovered only from the running bills of the contract and no other mode of collecting SD such as BG, FD etc. shall be accepted towards SD.

22.2 The Security Deposit shall, however be released only after expiry of the maintenance period (i.e. after completion of warranty period) and after passing the final bill based on “No Claim Certificate” from the successful tenderer.

23 PERFORMANCE GUARANTEE:

23.1 The successful bidder shall have to submit a Performance Guarantee (PG) within 30 (Thirty) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 30 (thirty) days and up to 60 (sixty) days from the date of issue of LOA may be given by the Authority, who is competent to sign the contract agreement. However, a penal interest of 15 % per annum shall be charged for the delay beyond 30 (thirty) days, i.e. from 31st day after the date of issue of LOA. In case the successful tenderer fails to submit the requisite PG even after 60 days from the date of issue of LOA, the contract shall be terminated duly forfeiting EMD and other dues, if any payable against that contract. The failed successful tenderer shall be debarred from participating in re-tender for that work.

23.2 The successful bidder shall submit a Performance Guarantee (PG) in any of the following forms, amounting to 5% of the total contract value:

23.2.1 A deposit or cash;

23.2.2 Irrevocable bank guarantee;

23.2.3 Government securities including State Loan Bonds at 5% below the market value;

23.2.4 Deposit Receipts, Pay Orders, Demand Drafts and Guarantee Bonds. These forms of Performance Guarantee could be either of the State Bank of India or of any of the Nationalised Banks;

23.2.5 Guarantee Bonds executed or deposit receipts tendered by all scheduled banks;

23.2.6 A Deposit in the Post Office Savings Bank;

23.2.7 A Deposit in the National Savings Certificates;

23.2.8 Twelve year National Defence Certificates;

23.2.9 Ten Year Defence Deposits;

23.2.10 National Defence Bonds; and

23.2.11 Unit Trust Certificates at 5 percent below market value or at the face value whichever is less.

23.2.12 Also, FDR in favour of FA&CAO/ICF (free from any encumbrance) may be accepted. In case the tenderer is submitting FDR towards PG, then the FDR shall be submitted with Auto Renewal facility.

NOTE: The instruments as listed above will also be acceptable for Guarantees in case of

Mobilization Advance.

23.3 Performance Guarantee should be submitted by the successful bidder after the Letter Of Acceptance (LOA) has been issued, but before signing of the contract agreement. This P.G shall be initially valid up to the stipulated date of completion plus 60 days beyond that. In case, the time for completion of the work gets extended, the successful tenderer shall get the validity of Performance Guarantee extended to cover such extended time for completion of work plus 60 days.

23.4 The value of the PG to be submitted by the successful tenderer will not change for variation up to 25 % (either decrease or increase). In case during the course of contract execution, value of the contract increases by more than 25 % of the original contract value, an additional Performance Guarantee amounting to 5 % (five percent) for the excess value over the original contract value shall be deposited by the successful bidder. On the other hand, if the value of the contract decreases by more than 25 % of the original contract value, Performance Guarantee amounting to 5 % (five percent) of the decrease in the contract value shall be returned to the contractor. The PG amount in excess of required PG for decreased contract value, available with Railways, shall be returned to the contractor as per their request duly safeguarding the interest of Railways.

23.5 Performance Guarantee shall be released after physical completion of the work based on completion certificate issued by the competent authority stating that the successful tenderer has completed the work in all respectssatisfactorily. The Security Deposit shall, however be released only after expiry of the maintenance period and after passing the final bill based on “No Claim Certificate” from the successful tenderer.

23.6 Whenever the contracts are rescinded, the security deposit will be forfeited and the performance guarantee will be encashed. The balance work shall be got done independently without risk & cost of the failed successful tenderer. The failed successful tenderer shall be debarred from participating in the tender for executing the balance work. If the failed successful tenderer is a JV or a Partnership successful tenderer, then every member / partner of such a successful tenderer shall be debarred from participating in the tender for the balance work in his/her individual capacity or as a partner of any other JV / partnership successful tenderer.

23.7 The engineer shall not make a claim under the Performance Guarantee except for amounts to which the President of India is entitled under the contract (not

withstanding and/or without prejudice to any other provisions in the contract agreement) in the event of :

23.7.1 Failure by the successful tenderer to extend the validity of the Performance Guarantee as described herein above, in which event the engineer may claim the full amount of the Performance Guarantee.

23.7.2 Failure by the successful tenderer to pay President of India any amount due, either as agreed by the successful tenderer or determined under any of the Clauses/Conditions of the Agreement, within 30 days of the service notice to this effect by Engineer.

23.8 The contract being determined or rescinded under provision of the GCC, the Performance Guarantee shall be forfeited in full and shall be absolutely at the disposal of President of India

24 VARIATION IN QUANTITIES:

24.1 The procedure detailed below shall be adopted for dealing with variations in quantities during execution of works contracts:

24.2 Individual NS items in contract shall be operated with variation of plus or minus 25 % and payment would be made as per the agreement rate. For this, no finance concurrence would be required.

24.3 In case an increase in quantity of an individual item by more than 25 % of the agreement quantity is considered unavoidable, the same shall be got executed by floating a fresh tender. If floating a fresh tender for operating that item is considered not practicable, quantity of that item may be operated in excess of 125 % of the agreement quantity subject to the following conditions:

24.3.1 Operation of an item by more than 125 % of the agreement quantity needs the approval of an officer of rank not less than S.A. Grade.

24.3.2 Quantities operated in excess of 125 % but up to 140 % of the agreement quantity of the concerned item, shall be paid at 98% of the rate awarded for that item in that particular tender.

24.3.3 Quantities operated in excess of 140 % but up to 150 % of the agreement quantity of the concerned item shall be paid at 96 % of the rate awarded for that item in that particular tender.

24.3.4 Variation in quantities of individual items beyond 150 % will be prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associate finance and shall be paid at 96 % of the rate awarded for that item in that particular tender.

24.4 The variation in quantities as per the above formula will apply only to the Individual items of the contract and not on the overall contract value.

24.5 Execution of quantities beyond 150 % of the overall agreement value should not be permitted and, if found necessary, should be only through fresh tenders or by negotiating with existing successful tenderer, with the prior personal concurrence of PFA and approval of General Manager.

24.6 In cases where decrease is involved during execution of contract:

24.6.1 The contract signing authority can decrease the items up to 25 % of individual item without finance concurrence.

24.6.2 For decrease beyond 25 % for individual items or 25 % of contract agreement value, the approval of an officer not less than rank of S.A. Grade may be taken, after obtaining “No Claim Certificate” from the successful tenderer and with finance concurrence, giving detailed reasons for each such decrease in the quantities.

24.6.3 It should be certified that the work proposed to be reduced will not be required in the same work.

24.7 The limit for varying quantities for minor value items shall be 100 % (as against 25 % prescribed for other items). A minor value item for this purpose is defined as an item whose original agreement value is less than 1 % of the total original agreement value.

24.8 No such quantity variation limit shall apply for foundation items.

24.9 As for as SOR items are concerned, the limit of 25 % would apply to the values of SOR schedule as a whole and not on individual SOR items. However, in case of NS items, the limit of 25 % would apply on the individual items irrespective of the manner of quoting the rate (single percentage rate or individual item rate).

24.10 For the tenders accepted at Zonal Railways level, variations in the quantities will be approved by the authority in whose powers revised value of the agreement lies.

24.11 For tenders accepted by General Manager, variations up to 125 % of the original agreement value may be accepted by General Manager.

24.12 For tenders accepted by Board Members and Railway Ministers, variation up to 110 % of the original agreement value may be accepted by General Manager.

24.13 The aspect of vitiation of tender with respect to variation in quantities should be checked and avoided. In case of vitiation of the tender (both for increase as well as decrease of value of contract agreement), sanction of the competent authority as per single tender should be obtained.

25 WORK PERMIT AND SAFETY

25.1 Once the Letter of Acceptance is issued to the successful tenderer, the tenderer shall apply in a prescribed format to obtain proper work permit for the period of contract for their labourers from CSC/ICF.

25.2 Following conditions are to be complied by the successful tenderer to obtain the work permit.

25.2.1 The display board containing the details of nature of work, maximum number of staff working per shift, period of work, site in charge name and phone number and main office phone numbers is to be placed at prominent place near the area of work.

25.2.2 If total staff engaged on any day of the contract period is 20 or more, tenderer has to register with Central Labour Commissioner Chennai and obtain license from them.

25.2.3 The hand operated electrical tools are to be properly earthed and should not have any livewire.

25.2.4 Only three-way plug supply shall be used for connecting the electrical appliances.

25.2.5 Suitable platform ladders are to be used while performing work at height.

25.2.6 All instrument used for the work is to be complied with IE rules.

25.2.7 The instruments used are to be conformed to IS standard.

25.2.8 The Factories Act – 1948 and Tamil Nadu Factories Rules - 1950 & Contract Labour (Regulation & Abolition) Act, 1970, Minimum wages Act and other acts and legal requirements prevailing are to be followed.

25.2.9 The terms and conditions as laid down by the Tamil Nadu Pollution Control Board are to be strictly followed.

25.2.10 Suitable ladder/scaffolding is to be used for climb up.

25.2.11 Adequate lighting at work place.

25.2.12 Successful tenderer should follow the terms and conditions/instructions of ICF issued from time to time after awarding of contract.

25.2.13 Only 24 Volt supply for lights are recommended to use wherever necessary.

25.2.14 Activities other than the specified activities as per the contract clauses, which are assigned to successful tenderer are not permitted at ICF premises.

25.2.15 Ensure that the Suitable guards are provided to the hand operating machine.

25.2.16 First aid box with adequate medicine are to be provided in the work area.

25.2.17 Adequate first aid trained personnel are to be available at work place.

25.2.18 Protection of staff to be ensured from dust, which is being generated by successful tenderer’s activities.

25.2.19 In case of any accident to the successful tenderer’s staff the successful tenderer should inform to the CSO/Shell in form-18 (Factory Act) within one hour.

25.2.20 Suitable lifting machineries and tackles are to be used to handle the materials.

25.2.21 Any loss incurred to ICF because of successful tenderer’s activities shall be charged on successful tenderer’s account.

25.2.22 ICF owes no responsibility to the materials of successful tenderers stored at ICF premises.

25.2.23 Disobeying and not following of the conditions / precautions / procedures shall be penalized or stopping of the work are empowered by the Factory manager and Occupier.

25.2.24 For fatal accidents occurred to successful tenderer’s staff inside Shell factory, necessary compensation to the relatives of the staff and legal expenditure cost shall be borne by respective successful tenderer alone.

25.2.25 On every day during the currency of contract the successful tenderer / or his supervisor shall report to engineer in charge of the work and also shall obtain clearance from Electrical & Engineering Department (if necessary). At the end of the day, the successful tenderer or his supervisor shall submit a brief report on the day’s work to the respective engineer in charge and other SSE’s in charge of the Electrical & Engineering Department.

25.2.26 Off cuts and wastes scrap generated during the course of contract work must be suitably disposed to the designated dumpsites as directed by the engineer in charge.

25.2.27 The renewal of permit will be issued only on the basis of performance of compliance of the said rules, regulations, conditions and safety norms.

25.2.28 Further the successful tenderer is requested to give an undertaking that all the safety norms mentioned above will be followed by the supervisors and staff of their successful tenderer while working inside ICF.

25.2.29 The successful tenderer shall be responsible to take necessary precautionary measures in order to ensure the safety against injury etc., of his personal when working at the railway premises and should confirm to the rules and regulations of the railway.

26 INDEMNITY:

26.1 In the event of any dispute or difference arising in connection with this contract, the same shall be referred to the sole arbitration of any arbitrator to be appointed by the General Manager/Integral Coach Factory as per Clause 64 of GCC amended from time to time and Arbitration &Concilation (Amendment) Act 2015. The settlement of disputes shall be as per Indian Railway Arbitration Rules mentioned in the GCC. The award of the sole Arbitrator is final and binding on both the parties of the contract. The jurisdiction of the agreement will be in Chennai. The courts in Chennai alone shall have exclusive jurisdiction arising out of this agreement.

27 PROVISIONS OF EMPLOYEES PROVIDENT FUND AND MISCELLANEOUS PROVISIONS ACT 1952.

27.1 The contractorshall comply with the provisions of Para 30 & 36-B of the Employees Provident Fund Scheme, 1952: Para 3 & 4 of Employees Pension Scheme, 1995; and Para 7 & 8 of Employees Deposit Linked Insurance Scheme, 1976; as modified from time to time through enactment of “Employees Provident Fund & Miscellaneous Provisions Act, 1952”, wherever applicable and shall also indemnify the Railway from and against any claims under the aforesaid Act and the Rules.

27.2 The contractor is required to comply with the provisions of EPF & M &P Act, 1952 and obtain code number from the concerned authorities whenever workmen employed by him are 20 or more. He shall also indemnify Railways from and against any claim, penalties, recoveries under the above Act and Rules. The contractorshould get the code number under the EPF so as to enable the PF Commissioners to extend the social security benefits to the workmen engaged by the Railway contractors.

28 ARBITRATION:

29 MINIMUM ELIGIBILITY CRITERIA FOR PARTICIPATING IN THE TENDER:

29.1. Tenderer should have physically completed at least one single similar nature of work as defined in Para 29.5 below, for a minimum value of 35% of the advertised tender value of work either in the current year or duringthree previous financial years.

29.2. Total Contract amount received by the tenderer during the last 3 financial years should be a minimum of 150 % of the advertised tender value of the work.

29.3. Tenderer shall produce an attested certificate from the employer/client, audited balance sheet duly certified by the Chartered Accountant [and / or attested certificates from the Central / State govt. / public sectors undertakings organization/department from where the tenderer received the payment for the work done.]

29.4. The tenderer shall positively meet the requirements mentioned at para 29.1 and 29.2 Otherwise, the tenderers will become ineligible for the Tender and their offers will not be considered for the subject work.

29.5. The tenderer shall be a Shot blasting plant manufacturer for a period of minimum five years and should have supplied their Shot blasting plant in any State Government / Central Government / Public Sector / Private owned Workshops / factories / Industrial Organisations”

The Tenderer (if not a Shot blasting plant manufacturer) should have executed conversion / retro-fitment of shot blasting plant in any State Government/ Central Government / Public Sector/ Private owned Workshops/ factories/ Industrial Organisations”.

29.6. Documents to be submitted to prove Eligibility Criteria:

29.6.1. For the purpose of similar single work, the Experience certificate shall be

attached to the tender document. The certified copies of the relevant

Experience Certificates are also to be enclosed.

29.6.2. For Turn over with respect to Railways, the experience certificate should

have been issued by at least a JA grade officer. With respect to other

Government Departments and PSU’s the certificate issued at the level of

Executive Engineer and above only can be taken as valid. Certificates

issued by private individuals for the completion of the work will not be

considered

29.6.3. Documentary evidence duly certified by a Chartered

Accountant/Company Auditor, audited balance sheet duly attested by

Notary Public, or certificate issued by Railway Officers not below the rank

of JA Grade shall be submitted along with the offer for the total contract

amount received.

29.6.4. All documents to support fulfillment of eligibility criteria should be

furnished along with the tender and should be available at the time of

tender opening. Tenders not accompanied by documentary evidence in

support of eligibility criteria will be rejected. No post tender

communication, in any form will be made or entertained, after opening of

tenders, in this regard.

29.6.5. Tender Committee may at their discretion call for the originals of the

credentials for verification from the tenderers or any

clarifications/confirmations on the contents of the documents submitted.

29.6.6. In case the Certificates/Documents produced are proved to be

false/fabricated, the entire amount of earnest money is liable to be

forfeited in addition to banning their business with the organisation for a

specific period of not less than six months at the discretion of the

Railways.

29.6.7. The tenderer should avoid over writings and erasures. If there are any

alterations, they should be attested. The tenderer should sign at the foot

of each page of the tender documents. Should a tenderer find

discrepancies in, or omissions in the tender form, or should be in doubt as

to their meaning, he should at once notify the authority inviting tender. It

shall be understood that every endeavour has been made to avoid any

error which can materially affect the basis of the tender and the tenderer

shall take upon himself and provide for the risk of any error which may

subsequently be discovered and shall make no subsequent claim on

account thereof.

29.6.8. Before submitting a tender, the tenderer will be deemed to have satisfied himself by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rate he enter in the tender forms are adequate and all-inclusive to accordance with the provisions in clause 37 of the General Conditions of Contract for the completion of works to the entire satisfaction of the General Manager/ICF.

30 GENERAL TERMS & CONDITIONS:

30.1 This special condition of contract shall be read in conjunction with General Conditions of Contract and specifications of Indian Railways as amended from time to time. The General Conditions of Contract for works will be made available on demand. All the clauses in the General Conditions of Contracts for Works of Indian Railways are applicable for this contract. 30.2 If the tenderer is not able to complete the work within the due date of completion, the contract will be terminated by giving 7 days & 48 hours notices as per the L.D. Clause of the general conditions of contract applicable for Indian Railways.

30.3 The successful Tenderer shall be required to execute an agreement with the President of India acting through the Works Manager/Plant for carrying out the work according to General Conditions of Contract and specifications of Indian Railways.

30.4 If there is any variation between description in the tender schedules and actual site work, Dy.CME/Plant will review and authorize correct description in writing and his decision is final and binding on the successful Tenderer.

30.5 The unit rates quoted in item wise break-up estimate shall be unaltered and there shall not be any variation of the rates during the currency of the contract.

30.6 The Tenderer may inspect the site on any working day between 8.00 Hrs. to 16.30 Hrs. from Monday to Friday before submission of quotation and contact the undersigned for any technical clarifications.

30.7 No freight charge is admissible.

ANNEXURE - C

REGULATIONS FOR TENDERS AND CONTRACTS AND CONDITIONS OF TENDER

(For the guidance of contractors for Mechanical Engineering Works.)

MEANING OF TERMS.

1 Definitions:

1.1 In these Regulations for Tenders and Contracts and conditions of Tender the following terms shall have the meanings assigned hereunder except where the context otherwise requires:-

1.1.1 "Railway” shall mean the President of the Republic of India or the administrative Officers of the Integral Coach Factory or of the Successor Railway authorized to deal with any matters, which these presents are concerned on his behalf.

1.1.2 "General Manager" shall mean the officer in administrative charge of the whole of the Integral Coach Factory and shall mean and include the General Manager of the successor Railway.

1.1.3 "Chief Mechanical Engineer" shall mean the Officer in charge of the Mechanical Engineering Department of the Integral Coach Factory.

1.1.4 "Engineer” shall mean Senior Mechanical Engineer, Assistant Mechanical Engineer in executive charge of the works and shall include the superior officers of the Mechanical Engineering Department of the Integral Coach Factory, (i.e.) Deputy Chief Mechanical Engineer/Chief Workshop Engineer/ Chief Mechanical Engineer and shall mean and include the Engineers of the successor Railway.

1.1.5 "Successor Railway" shall mean and include such other Railway to which for Administrative or other reasons this contract may during its pendency be transferred.

1.1.6 "Contractor" shall mean the person, the firm or company who tenders for the works with a view to execute the works on the contract with the Railway and shall include their personal representatives, successors and permitted assigns.

1.1.7 "Limited Tenders" shall mean Tenders invited from all or some contractors on the approved list of contractors with Railway.

1.1.8 "Open Tenders" shall mean Tenders invited in open and public manner and with adequate notice.

1.1.9 "Works" shall mean the works contemplated in the drawings and schedules set forth in the tender forms and required to be executed according to specifications.

1.1.10 "Specifications" shall mean specifications for materials and works, current on the Integral Coach Factory or as amplified, added to or

superseded by special specifications if any appended to the Tender forms.

1.1.11 "Drawings" shall mean the drawings, plans and tracing or prints there of annexed to the Tender Forms.

1.1.12 "General Conditions of Contract" shall mean the General Conditions of contract for works in the Integral Coach Factory Mechanical Engineering Department, issued under the authority of the Chief Mechanical Engineer.

1.1.13 Words importing the singular number shall also include the plural and vice versa where the context requires.

2 REGULATIONS FOR TENDERS AND CONTRACTS

2.1 Regulations for Tenders and Contracts subject to Modifications: These regulations for tenders and contracts shall be read in conjunction with General Conditions of the Contract and shall be subject to modifications, additions or super session by special conditions of contract and/ or special specifications, if any, annexed to the Tender forms.

2.2 Issue of Tender Forms: Tender forms shall be issued to the contractors on payment of the prescribed fees. At the time of submission of Tender, the Contractor shall submit evidence regarding their financial status, previous experience and ability to execute the works and authorized copy of the Income Tax Clearance Certificate without which their Tenders shall not be considered.

2.3 Tender forms not transferable: The transfer of Tender forms purchased by one Contractor to another Contractor is not permissible.

2.4 Use of official Tender Form: No Tender shall be considered which is not submitted in the official tender form attached here to along with the tender documents issued to the contractor.

2.5 Omissions and discrepancies: Should a contractor find discrepancies in or omissions from the drawings or any of the tender forms or should be he in doubt as to their meaning, he should at once notify the authority inviting tenders who may send a written instruction to all contractors. It shall be understood that every endeavor has been made to avoid any error which can materially affect the basis of the tender and the successful contractor shall take upon himself and provide for the risk of any error which may subsequently be discovered and shall make no subsequent claim on account thereof.

2.6 Prohibition of separate communication: No separate communication bearing on the tender shall be addressed by the contractor to the General Manager, Integral Coach Factory, Madras 600 038 or any other persons, but all explanatory qualifying remarks which the contractor may desire to make must be recorded on page and hereof or submitted in a covering letter along with the tender.

2.7 Signature of Contractors on Tender: The contractor should sign on each and every page of the tender documents and at the end of each specification and schedule at places provided for the purpose.

2.8 Amount and Method of deposit of Earnest Money: The tender should be accompanied by a cash receipt for a sum as mentioned in Special Conditions of Contract as Earnest Money deposited in cash with Assistant Chief Cashier of the Integral Coach Factory or in the form of Deposit receipts, Pay order, Demand Drafts, in favour of Financial Advisor and Chief Accounts Officer, Integral Coach Factory, provided-The contractor shall hold the offer open for a period of 90 days from the date of fixed for opening the same, it being understood that the Tender documents have been sold/issued to the Contractor and the contractor is been permitted to tender in consideration of stipulation on his part that after submission his tender he will not resile from his offer or modify the terms and conditions thereof in a manner not acceptable to the ENGINEER of the Integral Coach factory. Should the contractor withdraw his offer within validity date of the offer or fails to undertake the contract after acceptance of his tender the full earnest money should be forfeited.

2.9 The Earnest Money of the uncontractors shall, save as, herein before provided, be returned to them, but the Railway shall not be responsible for any loss or depreciation that may happen thereto while in their possession, nor be liable to pay interest thereon.

2.10 Tender unaccompanied by the requisite Earnest Money in the prescribed form under no circumstances will be entertained and will be summarily rejected.

2.11 Security Deposit and Performance Guarantee bond: Please refer relevant para of the special condition of contract.

3 Care in submission of Tenders:

3.1 Before submitting a tender, The Contractor will be deemed to have satisfied himself by actual inspection of the site and locality of the works that all conditions liable to be encountered during the execution of the works are taken into account and that the rates he enters in the tender forms are adequate for the completion of works to the entire satisfaction of the Engineer.

3.2 When work is tendered for by a firm or Company of Contractors, the tender shall be signed by the individual legally authorised to enter into commitments on their behalf. The Railway will not be bound by any power of attorney granted by the contractor or by changes in the composition of the firm made subsequent to the execution of the contract. It may, however, recognize such power of attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the contractor.

3.3 Opening of Tenders: At the advertised time and place, tenders received for a contract shall be opened by the Tender Committee and where practicable, the names of tenders and the rates tendered by them read out in the presence of such of the intending contractors or their agents as may attend.

4 Right of Railway to deal with Tenders:

4.1 The Railway reserves the right of not to invite tenders for any work or works or invite open or limited tenders and when tenders are called to accept a tender in whole or in part or reject any tender or all tenders without assigning reasons for any such action.

4.2 Ordinarily the lowest tender may be accepted by ICF/ Railway unless such acceptance would not be to the public interest. The acceptance or rejection of any tender is left entirely to the discretion of the authority empowered to deal with the matter and no explanation can be demanded of the cause of rejection of his tender by any contractor.

5 EXECUTION OF CONTRACT DOCUMENTS:

5.1 Execution of contract Documents: The contractor whose tender is accepted shall be required to appeared at the Office of the General Manager, Chief Mechanical Engineer, Chief Workshop Engineer, Deputy Chief Mechanical Engineer, Senior Mechanical Engineer as the case may be in person or if a firm or a corporation, a duly authorised representative shall so appear and to execute the contract documents within prescribed time after notice that the contract has been awarded to him. Failure to do so shall constitute a breach of the agreement effected by the acceptance of the tender in which case the full value of the Earnest Money accompanying the tender shall stand forfeited without prejudice to any other rights or remedies In the event of any contractor whose tender is accepted shall refuse to execute the contract documents as herein before provided, the ICF/Railway may determine that such contractor has abandoned the contract and there upon his tender and the acceptance thereof shall be treated as cancelled and the ICF/ Railway shall be entitled to forfeit the full amount of Earnest Money and to recover the liquidated damages for such default.

6 CONDITIONS OF TENDER

6.1 Tender / Drawings: The drawings for the works and relevant specifications can be seen in the Office of Deputy Chief Mechanical Engineer/Plant, Integral Coach Factory, Chennai 600 038 at any time during office hours.

6.2 Filling up of Schedule of Rates: The contractor/contractors shall quote his/their rates with reference to each item and must tender for all the items shown in attached schedule. Both rate and amount columns of the schedule should be filled in by the contractor/contractors both in figures and words. The quantities shown in the attached schedule are given as a guide and are approximate only and are subject to variation according to the needs of the Railway. The Railway accepts no responsibility for their accuracy. The Railway does not guarantee work under each item of the schedule.

6.3 Erasure and alterations: Tenders containing erasures and alterations of the tender documents are liable to be rejected any corrections made by the contractors in his/ her entries must be attested him/them.

6.4 Completion Time: The works are required to be completed within a period as mentioned in the Special Conditions of Contract from the date of award of contract.

6.5 Right of Railway to reject tender: It shall not be obligatory on the Railway to accept the lowest tender and no tender/ contractors shall demand any explanation for the cause of rejection of his/their tender.

6.6 Furnishing wrong information: If the contractor/contractors deliberately gives/ give wrong information in his/their tender or creates/create circumstances for the acceptance of his/their tender, the Railway reserves the right to reject such tender at any stage.

6.7 If a contractor expires after submission of his tender or the acceptance of his tender, the Railway shall deem such tender as cancelled. If a partner of a firm expires after submission of their tender or after the acceptance of their tender, the Railway shall deem such tender as cancelled unless the firm retains its character.

6.8 Income Tax Clearance Certificate: The contractor/contractors is /are required to produce along with his/their tender an authorised copy the Income Tax Clearance Certificate or a sworn affidavit duly countersigned by the Income Tax Officer to the effect that he/ they has/have no taxable income. Documents testifying to the contractor’s previous experience and financial status should be produced when desired by the Railway.

6.9 List of Credentials in support of the contractor’s successful and timely completion of similar works shall be submitted without fail.

7 The contractor/contractor shall ensure all safety measures.

8 No freight is admissible.

9 The contractor/ contractor shall be responsible to take necessary precautionary measures in order to ensure the safety against injury etc. of his personnel when working in the Railway premises and should confirm to the Rules and Regulations of the Railway.

10 If there is any variation between description in the Tender Schedules and actual site work, Engineer will review and authorise correct description in working and his decision is final and binding on the contractor.

11 The contractor should ensure that no unauthorised careless or inadvertent operation shall be carried out in Railway premises when which may result in damage of Railway property.

12 The successful Contractor/Contractor shall indemnify ICF against accidents, suits, claims, demands, cost charges, expenses arising in connection with any accidents causing injury or death to person/persons within ICF premises or damage sustained due to act of omissions of the contract and this is liable under Workmen Compensation Act or any other statute in force from time to time.

13 Non-compliance with any of the conditions set forth herein above is liable to result in tender being rejected.

14 The authority for the acceptance of this tender will rest with the Engineer, Integral Coach Factory, Chennai 600038, who does not bind himself to accept the

lowest or any other tender nor does he undertaken to assign reasons for declining to consider any particular tender or tenders.

15 The contractor/contractors shall be required to execute an Agreement in the form annexed hereto (Page ) duly stamped with the President of India acting through the Engineer, Integral Coach Factory, Chennai 600 038 of the Railway for carrying out the work according to the General Conditions of Contract and Specifications. The cost of the stamps will be borne by the Contractor.

16 The contractor shall keep the offer open for a minimum period of 90 days from the date of opening of the tender, within which period the contractor cannot withdraw his offer, subject to the period being extended further if required, by mutual agreement from time to time. Any contravention of the above condition will make the contractor liable for forfeiture of his "Earnest Money".

17 Should a contractor be a retired engineer or the gazetted rank or any other gazetted officer working before his retirement, whether in the executive or administrative capacity or whether holding a pensionable post or not, in the Mechanical Department of any of the Railways owned and administered by the President of India for the time being, or should a contractor being partnership firm have as one of its partners a retired engineer or a retired gazetted office as aforesaid, or should a contractor being an incorporated company have any such retired engineer or retired officer as one of its directors, or should a contractor have in his employment any retired engineer or retired gazetted officer as aforesaid the full information as to the date of retirement of such engineer or retired gazetted officer from the said service and in cases where such engineer or officer had not retired from government service at least two years prior to the date of submission of the tender as to whether permission for taking such contract or if the contract be a partnership firm or an incorporated company to become a partner or director as the case may be or to take employment under the contractor has been obtained by the contractor or the engineer or the officer as the case may be from the President of India or any officer duly authorised by him, in this behalf, shall be clearly stated in writing at the time of submitting the tender. Tenders without the information above referred to or a statement to the effect that no such retired engineer or retired gazetted officer is so associated with the contractor, as the case may be shall be rejected.

18 Should a contractor or contractor being an individual on the list of approved Contractors, have a relative employed in gazetted capacity in the Integral Coach Factory Chennai 600 038, or in the case of a Partnership firm or Company incorporated under the Indian Company Law should a Partner or a relative of the Partner or a Shareholder or relative of a Shareholder be employed in gazetted capacity in the Integral Coach Factory, Chennai 600 038, the authority inviting tenders shall be informed of the fact at the time of submission of tenders, failing which the tender may be rejected or if such subsequently comes to light, the contract may be rescinded in accordance with the provisions in Clause 62 of the General Conditions of Contract.

19 In the event of any dispute or difference arising in connection with contract after finalization the same shall be referred to the sole arbitration of any arbitrator to be appointed by the General Manager/ Integral Coach Factory,

the award of the arbitrator shall be final and binding on the parties to the contract.

20 Tenders must be enclosed in sealed covers, must be sent by registered post to address of Deputy Chief Mechanical Engineer/ Plant, Integral Coach Factory, Chennai 600 038, so as to reach this office, or drop in a Special Box exclusively kept for the said purpose in Deputy Chief Mechanical Engineer /Plant's office as mentioned in the Special Conditions of Contract.

21 The contractor shall comply with the provisions of the Factories Act, 1948 or the modifications thereof or any other laws relating thereto and rules made there under from time to time.

ANNEXURE –F

SAFETY, HEALTH AND ENVIRONMENTAL INSTRUCTIONS

SAFETY & HEALTH

1.1 The Factories Act – 1948 and Tamil Nadu Factories Rules - 1950 & Contract Labour (Regulation & Abolition) Act, 1970 are to be followed.

1.2 Adequate and appropriate tools shall be issued.

1.3 All instrument used for the work is to be complied with Indian Electricity rules.

1.4 The instruments are used to be conformed to Indian Standards.

1.5 Staffs under your control should wear the personal protective equipment as per working condition to prevent injuries.

1.6 Suitable ladders/scaffoldings are to be used for climb up and working at height.

1.7 Ensure adequate lighting at work place.

1.8 Contractor should follow the terms and conditions/instructions of ICF from time to time.

1.9 Activities other than the specified activities as per the contract clauses, which are assigned to you, are not permitted at our premises.

1.10 Ensure the Suitable guards are provided to the hand operating machine.

1.11 Suitable lifting machineries and tackles are to be used to handle the materials.

1.12 Any loss incurred to ICF because of your activities shall be charged on your account.

1.13 The equipment & materials stored at our premises are on your own risk.

1.14 Before start of work, proper shut down (if necessary) is to be undertaken for safety.

1.15 Before start of any work, appropriate Work Permits shall be obtained.

1.16 Off cuts and wastes generated during the course of your work, must be suitably disposed identified areas.

1.17 The renewal of permit will be issued only on the basis of performance of compliance of the said rules, regulations, conditions and safety norms.

1.18 The contractor shall engage qualified supervisors at the work site whenever men are engaged for work.

1.19 First aid box with adequate medicine are to be provided in the work area.

1.20 In case of any accident to the contract staff, the contractor should inform to the CSO/Shell & CSO/Fur., through department concerned within one hour.

1.21 Disobeying or not following the conditions / precautions / procedures shall result in penalty. In serious cases, stoppage of work or cancellation of permits may be done. Stopping of the work are empowered by the Safety Officer, Chief Safety Officer, Factory manager and Occupier.

1.22 For accidents involving to your staff inside Shell factory, necessary compensation to the dependents of the staff and legal expenditure cost shall be borne on your account.

1.23 The display board containing the details of nature of work, maximum number of staff working per shift, period of work, site in charge name and phone number and main office phone numbers is to be placed at prominent place.

1.24 If total staff engaged by you on any day of the contract period is 20 or more, you have to register with Central Labour Commissioner at ShastriBhavan and obtain license.

1.25 Staffs under your control are to be insured during the work period.

1.26 Registers in Form XIII, XVI, XIX, and XVII as per contract labour act shall be maintained.

1.27 Employment card in Form XIV should be issued to all work men by the contractor.

1.28 The payment of wages shall be made as per Minimum wages Act, and shall be witnessed by ICF nominated Supervisors.

1.29 Usage of LPG cylinder in the factories (both Shell & Fur) is prohibited for industrial activities. Industrial LPG cylinders shall only be allowed if accompanied by a certificate from gas companies about the end use for which it is issued.

ENVIRONMENT

2.1 ICF is an ISO 14001/2004 certified Factory. All activities shall be carried out as per the Environment Protection Act & Rules.

2.2 Handling, storage & use of any chemicals and Hazardous waste shall be carried out as per conditions laid down by TNPCB (Tamil Nadu Pollution control Board). Any clarification shall be made with contract executing officer & Safety Cell.

2.3 Spillage of Hazardous materials, chemicals and oil shall be strictly avoided; in case of any leakage /spillage, it should be cleaned immediately.

2.4 Any waste materials should not be burnt inside the Factory.

PENALTY

3.1 In case any Unsafe conditions noticed that could have led to grievous injury to the contract labour, a minimum penalty of ` 5,000/- per person shall be imposed by ICF administration to the contractor. However if multiple violation of Safety instructions are noticed, the amount could be higher.

3.2 Recurrence on third occasion for the same contract would result in penalty of Rs.50,000/-(Fifty thousands) and termination of contract.
