AAP government on Friday appointed senior lawyersGopal Subramanium and Dayan Krishnan to contest theappeal of Nitish Katara murder case convicts VikasYadav and his cousin Vishal in Supreme Court.

The Arvind Kejriwal government's move comes afterNeelam Katara, mother of Nitish Katara, requested theDelhi government to appoint these two senior lawyersto contest the appeal of convicts who have been sen-tenced to 25 years in jail without any remission by theDelhi High Court.

"On the request of Neelam Katara, Home Departmenthas appointed senior lawyers Gopal Subramanium andDayan Krishnan to contest the appeal of Vikas Yadavand Vishal against their imprisonment in the SupremeCourt," said a senior government official.

The official said that both lawyers will argue in theapex court against the appeal of Vikas and Vishal.

On February 6 this year, Delhi High Court hadenhanced the life imprisonment of Vikas Yadav and hiscousin Vishal to 25 years in jail without any remissionand an additional five years for destruction of evidencein the honour killing of Nitish Katara in 2002.

The court had held that the murder of Katara, whowas in love with Vikas' sister, was an "honour killing"which was done in a very "carefully planned and pre-meditated" manner with "extreme vengeance".

Vikas and Vishal have now moved to the SupremeCourt against the Delhi High Court's verdict.

Trams may roll on the streets of Old Delhi's ChandniChowk with Shahjahanabad RedevelopmentCorporation (SRDC) likely to approve the project in itsupcoming board meeting on Monday.

Representatives of Delhi Metro Rail Corporation,which had earlier submitted a detailed project report,today gave a presentation to the AAP governmentdetailing the specifics of the project.

"SRDC will hold its board meeting on Monday inwhich the project may be cleared," said a senior govern-ment official. According to a DMRC official, they haveproposed a 4.3 km tram-line in the congested ChandniChowk area of which 1.6 km will have to be elevateddue to lack of space.

On July 5, UGC had engaged an officer who visitedthe campus and met the internal complaint committeemembers of the college following directions from HRDministry to it to expedite the probe into the molestationrow which had triggered an outrage on and off the cam-pus. HRD Minister Smriti Irani had on July 23 also metthe St Stephen's College molestation victim and laterasked Delhi University to ensure that the girl gets herstipend and unrestricted access to the lab, and that herresearch supervisor is changed immediately.

Rumours lead to tension in Northeast DelhiNEW DELHI

Tension between two communities has been reportedfrom Northeast Delhi’s Khajuri Khas area on Fridayafternoon. Senior police officers confirmed that therewere attempts to torch vehicles. However, damagescould not be immediately ascertained. Sanjay Beniwal,JCP (Eastern Range), said there were no reports ofinjuries to people in the clash.

Initial reports suggest a mix of reasons contributed tothe tension. A vehicle smuggling cattle that was seizedby police earlier had led to some tensions. However, sit-uation was aggravated when rumours spread on Fridaythat a young boy was killed when hot oil from a panspilled over him. The officer said the boy had only suf-fered some burns. “Rumours caused problems. We arecracking down on the rumourmongers. The situation iscurrently under control,” said another senior officer.

As the Delhi Metro Rail Corporation (DMRC) is hop-ing against hope for a fare revision given the spirallinginput costs, the Ministry of Urban Development(MoUD), too, seems to be looking up to theAppointments Committee of Cabinet (ACC) for thesame.

Having rejected four consecutive proposals of theMoUD for appointing the Chairman of the Fare FixationCommittee (FFC) in the past, the ACC, headed byPrime Minister Narendra Modi, is yet to approve thepanel. Sources said to avoid another such rejection, theMoUD has sent the maximum number of names for theACC to select from.

The court had on July 24sought a clarification fromthe constable as to howKejriwal's alleged 'thulla'remark given during arecent interview has pro-voked breach of peace.

Advocate L N Rao, whoappeared for complainantconstable Harvinder, hadargued before the court thatdue to Kejriwal's 'thulla'remark, the entire DelhiPolice was demoralized.

"...Using a derogatoryand demeaning term like'thulla' to refer to policepersonnel is equivalent to

referring to all Delhi Policeofficials as lethargic andunproductive. This wordhas, therefore, harmed thereputation of the com-plainant in the eyes of gen-eral public including hisfamily, relative andfriends," the complaintsaid.

The complaint claimedthat the 'thulla' remarkgiven by a person of thestature of chief ministerhas demoralised DelhiPolice and it was intendedto provoke breach ofpeace."

The counsel had allegedthat Kejriwal has intention-ally insulted the entirepolice force and causedunnecessary provocationand resentment among thepolicemen here.

The constable had onJuly 22 filed a complaint inwhich he had claimed thathe was insulted byKejriwal's remark.

The complainant has

sought the court to sum-mon Kejriwal for thealleged offence under sec-tion 500 (defamation) and504 (insult intended to pro-voke breach of peace) ofIPC.

In his recent interview toa TV news channel,Kejriwal had talked aboutAAP government's "con-straints" in ensuring effec-tive functioning of theAnti-Corruption Branch.

Police Commissioner BSBassi had also hinted hisdispleasure over the use ofword 'thulla' by Kejriwal.

Another defamationcomplaint was lodgedagainst Kejriwal on July 23by a constable posted atLajpat Nagar police stationwho had claimed that hewas mentally disturbed andfelt very insulted anddefamed by Kejriwal'sremark.

He had also claimed tohave lodged a complaint atLajpat Nagar police stationunder section 500 (defama-tion) of IPC.

ernment on Thursday noti-fied a policy regarding pro-tection of witnesses withprovisions for a protectionfund and processing ofsuch requests by compe-tent authority.

The AAP governmentsaid that ‘Delhi WitnessProtection Scheme’ willensure protection of wit-nesses in “crucial” cases.”

Delhi becomes the firststate to do that,” ChiefMinister Arvind Kejriwalsaid on Twitter.

Delhi High court in 2013had directed Delhi govern-ment to frame a witnessprotection policy to pro-vide guidelines and princi-ples which the police,prosecution and executiveagencies will have to fol-low for protection of wit-nesses.”

After much deliberation,it was decided to have acomprehensive policy forprotecting witnesses.

The policy envisages –categorisation of witness-es, creation of witness pro-tection fund, types of pro-

tection and procedure forprocessing such request bythe competent authority,”an official statement issuedby the Home Departmentsaid.

According to a govern-ment statement, DelhiHome Department consti-tuted a Sub-Committeecomprising of officers ofLaw Department (Homedepartment), Directorate ofProsecution and DelhiPolice.”

Subsequently, DSLSA(Delhi State Legal Services

Authority) was included inthe process of formulatingof the scheme.

Accordingly, a schemeknown as Delhi WitnessProtection Scheme, 2015was drawn.”

During deliberations, allthe aspects relating to wit-ness protection and prac-tices adopted worldwidewas studied,” the govern-ment said.

The official said that Panwar,Zuber and Khurana had reportedlyfixed a meeting with Kaku inMalviya Nagar but were arrestedonly a few hours earlier. "Kakumanaged to give us the slip thattime, but we expect we`ll arresthim very soon," the official said.

So far, 22 fake admissions havebeen detected in Hindu College,Kirori Mal College, AurobindoCollege (evening), Kamala NehruCollege, Shaheed Bhagat SinghCollege, Dyal Singh College(evening and morning), PGDAV

and Ram Lal Anand colleges.The modus operandi included

preparation of forged documentslike marks-sheets as also migra-tion, degree, character and castecertificates. Police said theaccused also supplied fake degreesof various universities to candi-dates seeking jobs in the privatesector.

"The racketeers used to chargeRs 3-7 lakh from prospective stu-dents for securing them admissionin a college and a course of theirchoice," said the official.

speedy action under theSwachh Bharat Mission,the urban developmentministry has decided toinstall 480 public toiletseats at 80 locations inDelhi in the next threemonths.

The decision was takenat a meeting attended byMadhusudan Prasad,Urban Development sec-retary, chief executives ofNew Delhi MunicipalCorporation, the threeMunicipal Corporationsof Delhi and Delhi UrbanShelter ImprovementBoard (DUSIB), Delhigovernment's special sec-retary, chairman of DelhiUrban Arts Commission(DUAC) and other seniorofficials.

Prasad stressed the needfor speedy action underSwachh Bharat Missionand expressed concernover negative perceptionsabout tardy progress inDelhi.

"Various models ofpublic toilets, includinghugely popular'NAMMA' model beingimplemented in TamilNadu and the onesevolved by DUAC werediscussed in detail in themeeting," a governmentstatement said onThursday.

The NAMMA model ofpublic toilets is based onthe suggestion of A.P.J.Adbul Kalam when hewas principal scientificadvisor to the then primeminister Atal BehariVajpayee in 1998 and is

now being used in TamilNadu.

The NAMMA toiletswere also appreciated byPrime Minister NarendraModi when he saw thecomposite material modelat the exhibition duringthe launch of three newurban missions lastmonth.

"The four urban localbodies of Delhi will iden-tify 20 locations each forinstalling public toiletcomplex with six seatseach. Both the 'NAMMA'and DUAC models willbe used for buildingthem," the statementadded.

The National BuildingsConstruction Corporationwill bear part of theexpenditure underCorporate Social

Responsibility.DUSIB will prepare an

action plan for installingabout 1,000 communitytoilet seats in slum areas.

For building communi-ty toilet seats, 40 percentviability gap funding willbe extended while thissupport will not be avail-able for building publictoilet seats, for the use ofwhich nominal usercharges will be levied.

Under Swachh BharatMission in urban areas,1,25,398 individualhousehold toilets, 9,156public toilet seats and1,982 community toiletseats are to be built by2019 besides ensuring100 percent solid wastemanagement. This is esti-mated to cost Rs.350crore.

NEW DELHIThe government today reported that

226,339 patents are pending with it andare being processed at various stages.

According to data furnished by the min-ister of state (MoS) for commerce andindustry Nirmala Sitharaman, Delhitopped the list with 83,291 patent applica-tions, with Mumbai being at the bottom ofthe list with 28,100 patents pending to bepassed.

The minister in a written reply to theLok Sabha informed that to speed-up theprocess additional 252 posts of examinersand 76 posts of controllers (supervisoryofficers) have been created.

"With this, the total sanctioned strengthof examiners and controllers has become589 and 170 respectively. The process ofrecruitment to 459 vacant posts of exam-iners has already been initiated," sheadded.

The minister further informed that as ashort-time measure, 263 posts of contract

examiners of patents have been sanc-tioned.

She elaborated that in order to save timeand increase efficiency of the examinationprocess, the government will ensure com-puterised work-flow, automation and IT(information technology) enablement inthe functioning of patent offices.

With Assam completing construc-tion of 91 per cent of school toiletsunder the "Swachh Vidyalaya" pro-gramme, Chief Minister Tarun Gogoitoday directed the authorities con-cerned to expedite the completion oftoilets in all schools by August 10.

Funds for the construction ofschool toilets were provided by theSarva Shiksha Abhiyan (SSA),Rashtriya Madhyamik ShikshaAbhiyan (RMSA), public sectorundertakings and the corporate sec-tor. Under the Swachh Vidyalayaprogramme, Assam has completedconstruction of 33,154 toilets out of

35,725, and the construction of theremaining 2,571 are going on in fullswing. At the national-level, Assam'srate of completion is 91.84 per centas against Bihar's 72.41 per cent,Haryana's 84.68 per cent andMadhya Pradesh's 88.07 per cent,according to the statement.

Mr Gogoi's directive came at areview meeting in which he said thatto make the state clean and healthy,construction of toilets at schoolsmust be completed at the earliest,according to an official statement.

Today's meeting was attended byEducation Minister Sarat Borkotokyand other senior officials.

In Assam, under SSA and RMSA,26,662 toilets have been constructedout of the targeted 26,809.

Mr Gogoi directed the authoritiesconcerned to complete the construc-tion of the remaining 147 toilets byAugust 10.

Under corporate sector, out of thetotal 79 toilets, construction of 66toilets have been completed and theconstruction of the rest 13 will becompleted "very soon", the statementadded.

In schools under the PSU sector,construction of 642 toilets have beencompleted and the construction workof 2,218 toilets is underway.

In a written reply to a question inLok Sabha, Water ResourcesMinister Uma Bharti said study isbeing carried for Manas-Sankosh-Teesta-Ganga link avoiding ManasTiger Reserve, Buxa TigerReserves and other forests.

The Manas-Sankosh-Teesta-Ganga link canal envisages diver-sion of surplus water of Manas andSankosh rivers with supplementa-tion from the intermediate majorstreams for the benefit of augment-ing the flows of Ganga at Farakka,she said in her reply yesterday.

It aims to further transfer it towater short areas of Krishna,Pennar and Cauvery basins and

providing irrigation facilities to theenroute command areas.

This link will comprise twodams on rivers Manas andSankosh inside Bhutan territory

and a gravity flow canal for divert-ing substantial quantum of waterto river Ganga upstream ofFarakka barrage, she said.

The pre-feasibility report of the

link has already been prepared, theMinister said, while adding thatthe feasibility report could not beprepared as the canal is passingthrough the Manas-Tiger Reserveand Buxa Tiger Reserve and otherforests.

"Considering practical difficul-ties for surveys and investigationin Manas-Sankosh and Sankosh-Teesta reaches, National WaterDevelopment Agency (NWDA)has carried out alternate alignmentstudies for Manas-Sankosh-Teesta-Ganga link avoiding ManasTiger Reserve and Buxa TigerReserves and other forests," MsBharti said.

As an alternative option, almostforest-free Manas-Sankosh-Teesta-Ganga link is under study,she said, adding that preparation offeasibility report of the link isunder progress.

In the wake of reports of malpractices inrecruitment of nurses, the government hasissued an order which requires nurses to takeemigration clearance before taking up over-seas employment in 18 Emigration CheckRequired (ECR) countries.

"In view of reports received regarding largescale malpractices in the recruitment of nurs-es, Ministry of Overseas Indian Affairs hasissued an order requiring nurses to take emi-gration clearance before going for overseasemployment to 18 ECR countries," HealthMinister J P Nadda informed the Lok Sabha.

He said the Overseas Affairs Ministry hasalso written to all chief ministers to set upstate government owned recruitment agenciesunder license from Protector General ofEmigrants for the recruitment of Indian work-er for overseas employment.

He said the Indian Nursing Council hasconceptualized a computerized live registerfor various categories of nurses wherein eachnurse of a midwife history will be liked witha unique number. "This will enable nurses inintra, inter-state and inter-country movementfor jobs," Mr Nadda said.

Amos Winter, an assistant professor ofmechanical engineering at MassachusettsInstitute of Technology, is developing alow-tech prosthetic knee that performsnearly as well as high-end prosthetics, at afraction of the cost.

Winter and his colleagues have calculat-ed the ideal torque that a prosthetic kneeshould produce, given the mass of the legsegments, in order to induce able-bodiedkinematics, or normal walking.

In a paper published in IEEETransactions on Neural Systems andRehabilitation Engineering, the teamreported that it has built a prototype of aprosthetic knee that generates a torque pro-

file similar to that of able-bodied knees,using only simple mechanical elements likesprings and dampers.

The prototype is being tested in India,where about 230,000 above-knee amputeescurrently live, researchers said. "In placeslike India, there's still stigma associatedwith this disability. They may be less likelyto get a job or get married," Winter said.

The paper's co-authors include graduatestudent Murthy Arlekatti and YashrajNarang, a PhD student at HarvardUniversity. Most amputees in developingcountries wear passive prostheses - simple,cheap designs with no moving parts.

On the other hand,the Attorney General took ashocking position in theSupreme Court of disputing thevery existence of the right to pri-vacy in the Aadhar case.

Undermining decades of evo-lution of this right throughSupreme Court judgments,Mukul Rohatgi argued that it isnecessary to put together a con-stitutional bench to determinewhether the citizens of Indiahave a right to privacy.

He is in the wrong for two rea-sons. The first is technical: he ismistaken in his assertion thatM.P. Sharma v Satish Chandraand Kharak Singh v. the State ofU.P. created legal doctrine that isno constitutional right to privacy.The second reason is political. Alawyer holding the AttorneyGeneral’s office should considerthe appropriateness of using thatoffice and public resources whendenying that Indian citizens haveprivacy rights, which are univer-sally recognised human rights.This is all quite apart from thefact that India has ratified theInternational Covenant on Civiland Political Rights, whichunequivocally supports the exis-tence of the right to privacy. TheUnited Nations has gone so faras to create a Special Rapporteuron the right to privacy this year.In the context of US surveillanceof its citizens, the Indian govern-ment has acknowledged the exis-tence of the right to privacy.

In the Constitution

The two decisions that Mr.Rohatgi references did not raisequestions about the right to pri-

vacy as a whole. Both confinedthemselves to the limited ques-tion of whether principles mir-roring the US FourthAmendment may be read intothe Indian Constitution, which isonly one element of the right toprivacy. The M.P. Sharma casedid this while ascertaining ifthere are any constitutional limi-tations to the government’ssearch and seizure of people’shomes, persons and effects; andthe Kharak Singh case did this inthe context of physical surveil-lance of ‘history sheeters’.

In M.P. Sharma, the judgmentstates, “When the Constitutionmakers have thought fit not tosubject such regulation toConstitutional limitations byrecognition of a fundamentalright to privacy, analogous to theAmerican Fourth Amendment,we have no justification toimport it into a totally differentfundamental right by someprocess of strained construction”(emphasis added).

This makes it clear that it is notthe right to privacy as a wholethat is being referred to. TheAmerican Fourth Amendmentpertains to the “right of the peo-ple to be secure in their persons,houses, papers, and effects,against unreasonable searchesand seizures”, not to the right ofprivacy in its entirety.

The M.P. Sharma judgmentgoes further to say, “It is to beremembered that searches of thekind we are concerned with areunder the authority of aMagistrate… When such judicialfunction is interposed betweenthe individual and the officer’sauthority for search, no circum-vention thereby of the funda-mental right is to be assumed.”This makes it evident that thecourt desisted from interveningbecause it saw the requirementof a Magistrate’s order as safe-

guard enough.

Similarly, although the judg-ment in Kharak Singh containsthe sentence with the ominousbeginning “as already pointedout, the right of privacy is not aguaranteed right under ourConstitution”, this sentence can-not be taken out of context. The‘already pointed out’ refers to anearlier portion of the same judg-ment in which the court quotesthe U.S. Fourth Amendment, andthen declares that ourConstitution does not confer any‘like constitutional guarantee’.This makes it clear that it is theFourth Amendment text specifi-cally that the court was referringto.

The court also belied its ownposition by finding that unautho-rised intrusion into a person’shome violates the common lawprinciple of “every man’s houseis his castle”. The judgmentexplicitly takes the position thatArticle 21 is a repository forresidual personal liberty rights,leaving it open for future readingof such rights into Article 21.

It is apparent that the two casesdo not rule out a broad constitu-tional right to privacy. It isalmost impossible to considerthe right to privacy in its entiretyin a single case since it is a bun-dle of rights including every-thing from safeguards againstunauthorised collection of per-sonal data to restrictions onintrusion into private spaces. Thecases that have emerged fromthe Supreme Court over theyears make this apparent.

Different elements of privacyrights have been read into ourright to life and our right to freeexpression. We have a rightagainst untrammelled intercep-tion of our communication, andagainst doctors divulging per-sonal medical information. Long

before the Constitution or theConstituent Assembly came intobeing, the right to privacy ofwomen in purdah was acknowl-edged by common law, whichforbade the building of balconiesabove their quarters. We do,therefore, have a rich history ofenforcing the right. Like manyother nations, we called it by dif-ferent names and have found itwithin legal and cultural normsunique to India.

It is common for lawyers touse every strategy they can towin cases but the AttorneyGeneral is no ordinary lawyer.S/he is a constitutional authority.It is inappropriate for someoneof that stature to argue that thepeople of India do not have aright to privacy. Former AttorneyGeneral Niren De was criticisedsharply for telling the SupremeCourt that it could be helped ifthe right to life was violated dur-ing Emergency. Mr. Rohatgi’sargument is comparable.

This is a democracy, and whileopinions may vary about Aadhar,the government is expected toact in the best interests of thepeople. Here, we have theAttorney General stepping awayfrom arguing that the govern-ment’s actions are in the interestsof the people to say that the peo-ple do not have rights in the firstplace.

It is not a case of the govern-ment’s lawyer arguing for theprevalence of the wider commu-nity’s interests over individualrights, or disputing what is in theinterests of the majority of citi-zens. Mr. Rohatgi, on behalf ofthe Indian government, is mak-ing an argument that is blatantlyagainst the rights and interests ofall citizens of India.

Interestingly, the argumentruns contrary also to the Ministerof Communications and

Information Technology’s state-ments recognising citizens’ rightto privacy in the context of bothUS and Indian surveillance.

Time to clarify

This incident is about morethan an argument made in court.It is a serious problem if theUnion government makes state-ments that respect privacy andthen takes actions that attempt todestroy it. It is also inconsistentfor the government to argueinternationally that the U.S. hasviolated Indian citizens’ right toprivacy and then to argue beforethe Supreme Court that Indiancitizens do not have the right toprivacy.

Under the circumstances, it isnecessary for the government toissue a statement clarifying itsstand, which I hope will consistof some form of support for citi-zens’ privacy rights. Once this isclear, perhaps the AttorneyGeneral could continue the argu-ments that take his client’s wish-es into account.

A clear statement from thePrime Minister’s office mightalso enable other ministries toensure that they embed this rightin their policies. This, for exam-ple, might have gone a long wayin ensuring that cast-iron privacysafeguards were added to theDNA Profiling Bill.

Ignoring the right to privacywill not only affect India’s ‘glob-al image’ more than any criticaldocumentary does, it will alsocomplicate international com-mercial relations. Who wouldsend their information oremployees to a country that dis-regards its residents’ right to pri-vacy?

A probe that lost its way

A basic right is in danger

31 days of argument, a five-judgebench of the Supreme Court hasreserved judgment in what will

rank amongst the most significantconstitutional cases before the Courtin recent years. Since the SupremeCourt’s decision in the ‘SecondJudges Case’ in 1993, appointmentsto the Court have been made throughwhat has come to be known as the‘collegium’ system, in which thethree most senior judges of the Courtplay a decisive role in the appoint-ments process. The collegium systemfaced increasing criticism, andParliament attempted to replace itwith an appointments process led bya National Judicial AppointmentsCommission (NJAC) through a con-stitutional amendment, and a statutethat gives effect to the amendment.

The amendment provides that theNJAC will consist of six people —the Chief Justice of India, the twomost senior judges of the SupremeCourt, the Law Minister, and two‘eminent persons’. These eminentpersons are to be nominated for athree-year term by a committee con-sisting of the Chief Justice, the PrimeMinister, and the Leader of theOpposition in the Lok Sabha, and arenot eligible for renomination. TheSupreme Court is now tasked withdeciding the constitutionality of theamendment and the statute.

This piece will not consider the rel-ative merits of the collegium systemand the NJAC. Although that is amost significant matter, it has beendebated extensively. Instead, theremedies available to the SupremeCourt — a different and less studiedaspect of the case — will beexplored.

As with the NJAC case, on mostoccasions when the law is challengedon the basis that it is unconstitution-al, the challenge is conceived of interms of a binary, whether to strikedown or not strike down the law.

Matrix of remedies

However, the matrix of remediesavailable to the court is far morecomplex than this. The SupremeCourt has, on several occasions,described striking down as a ‘gravestep’ and a ‘measure of last resort’.Therefore, the most commonresponse to a finding of unconstitu-tionality is not to strike down theunconstitutional law, but to interpretit in a way that is consistent with con-stitutional requirements.

In the NJAC case, the SupremeCourt has several intermediateoptions falling short of the strike-down power. This piece will considerfour interpretive possibilities, whichcan be distinguished based onwhether they address the composi-tion or the functioning of the NJAC.

Composition of the NJAC

Defining ‘eminent persons’ morenarrowly: Amongst the argumentsthat the petitioners have made is thatthe constitutional amendment makesno attempt to define who the twoeminent persons on the NJAC willbe. This, it is argued, can give rise toconcerns about the nomination ofpeople with favourable political lean-ings or people who clearly lack thecredentials to judge the performance

of candidates. The Supreme Courtcould seek to remove these concernsby specifying a set of criteria — orqualifications — that the eminentpersons would need to hold. Thesecriteria could include a degree in lawor allied disciplines, a minimumnumber of years of practice beforethe Supreme Court, or a designationof seniority by the Supreme Court orHigh Courts. Conversely, the Courtcould prescribe a set of disqualifica-tions — for instance, that those who

are charged with serious criminaloffences will not be considered ‘emi-nent’.

Modifying the ‘eminent persons’appointments process: The constitu-tional amendment provides that theeminent persons on the NJAC are tobe appointed by a Committee consist-ing of the Chief Justice, the PrimeMinister, and the Leader of theOpposition in the Lok Sabha. Theargument here is that the politicianscould collude to nominate a personwho, in the opinion of the ChiefJustice, lacks the credentials to bepart of the NJAC. The SupremeCourt may seek to avoid this situationby interpreting the provisions to theeffect that the Chief Justice has a vetopower in the appointment of eminentpersons. This would mean that the

Chief Justice would always need tobe in the majority, and a 2-1 decision,with a dissenting note from the ChiefJustice, would not result in anappointment.

Functioning of the NJAC

An exclusive veto power for thejudges: Neither the constitutionalamendment nor the statute givingeffect to the amendment make it clearhow the six-member NJAC is expect-

ed to take its decisions. Presumably,the ideal scenario is for decisions tobe made by consensus. But whereconsensus is not possible, the alterna-tive is likely to be a majority deci-sion-making procedure.

The statute specifies that no personshall be recommended for appoint-ment to the Supreme Court if any twomembers disagree with the appoint-ment. The argument against thisrequirement is that both sides — thejudges and the non-judges — have aveto power over appointments.Arguably, the Law Minister togetherwith one or more of the eminent per-sons could exercise their veto againstindependent-minded candidates.

In order to grant the judges adegree of primacy in the process, the

Supreme Court could interpret thisprovision as applying only to thejudges. This would, in other words,mean that assuming that all six mem-bers of the NJAC participate andvote, a successful appointment wouldrequire the concurrence of at leasttwo of the three judges on theCommission.

Standard operating procedures forappointments: Once again, neitherthe constitutional amendment nor thestatute specifies the procedures thatthe NJAC is expected to follow whilemaking decisions on appointments.Instead, important issues such as thelevel of publicity to be given toreports of the Commission, the quo-rum for Commission meetings, andwhether the rejection of candidatesrequires reasoned explanation, hasbeen left to the domain of rules andregulations.

The argument that is often madeagainst the NJAC is that it engendersthe same kind of opacity that the col-legium is often criticised for. TheSupreme Court could seek to addressthese concerns by prescribing a set ofstandard operating procedures thatthe NJAC would need to follow inorder to comply with constitutionalrequirements. The procedures could,for example, include the requirementthat those candidates who are consid-ered (but not appointed) be providedwith a full set of reasons for theirnon-appointment.

In prescribing these procedures, theSupreme Court would have to bal-ance the competing considerations ofensuring an open and transparent sys-tem of appointments on the one hand,and protecting the integrity andstanding of candidates on the other.

Middle path

There are many reasons for whichthe middle road - interpretation con-sistent with constitutional require-ments — seems intuitively appealingin this case. It would probably enableall sides to claim victory. The govern-ment could claim that its amendment

secured the Court’s stamp of endorse-ment, the petitioners could claim thatthey succeeded in having importantsafeguards infused into the appoint-ments process, and the Court couldsend the message that it has effective-ly protected constitutional rightswithout thwarting the democraticwill.

A legislative sequel or push-backfrom Parliament would be much lesslikely in the event of an interpretivesolution than if the constitutionalamendment were struck down. Afterall, if the amendment is struck down,it is possible that the Court’s judg-ment will indicate the sort ofCommission that would have passedconstitutional muster, givingParliament the opportunity to make asecond attempt at amending theConstitution with greater informationat its disposal.

Nevertheless, the Court should beconscious of the risks associated withradically modifying the effect of theconstitutional amendment. Radicalinterpretive exercises tread the thinline between judicial interpretationand legislative amendment. A fairlyrecent attempt at modifying the effectof a law (in which the provisions forappointment of InformationCommissioners under the Right toInformation Act 2005 were recast)came under severe criticism, follow-ing which the Supreme Court steppedback from its judgment in a reviewpetition.

Most importantly, some of theinterpretive possibilities articulatedhere may produce an appointmentsprocess that closely resembles theexisting collegium system. Thus, theNJAC could become the collegium indisguise — in which case, theSupreme Court would have success-fully struck down the amendmentwithout being transparent aboutdoing so.

The Delhi Police deserve credit for unearthing cor-ruption in cricket, not once but twice in the last 15years. In 2000, they stumbled upon sensational

tapes indicating a deep bookie-player nexus; and in 2013they detected spot-fixing during that year’s Indian PremierLeague tournament. If the earlier probe led to SouthAfrican captain Hansie Cronje making a contrite admis-sion, two years ago, three players — S. Sreesanth, AjitChandila and Ankeet Chavan — were among those arrest-ed in a dramatic swoop. It was seen as the beginning of acleansing process. Unfortunately, these achievementswere not built upon by the Delhi Police. A sessions courtin Delhi has now discharged all the 36 suspects arraignedfor cheating, conspiracy and organised crime. The probeseems to have been so shoddy that there was not enoughevidence even to frame charges. The move to invoke theMaharashtra Control of Organised Crime Act to strength-en the case seems to have failed. The link with theDawood Ibrahim crime syndicate was quite tenuous andlimited to a few suspicious phone calls. The judge threwout the charge of organised crime and conspiracy easily.She concluded that even if the charges of receiving moneyfrom bookies and concealing it were true, these did notamount to cheating; what was caused to spectators wasjust disgust, and not wrongful loss. That sporting corrup-tion can be identified but allowed to slip through the defi-nition of any law is disturbing. In similar circumstances, aBritish court had little difficulty in convicting Pakistanicricketers and sending them off to prison. The match-fix-ing phenomenon has been crying for a systemic responsesince the turn of the century, but there has been no effortso far to come up with a legal framework and a set ofappropriate punishments to deal with it. The latest out-come is a big setback to efforts to deal with corruption incricket. As far as the players are concerned, their dischargehas understandably raised their hopes of getting the lifeban on them revoked. They have reason to be aggrievedthat they were put through the humiliation of arrest,imprisonment and judicial process that kept them out ofthe game and tainted their reputation, for two years.However, the BCCI has not yet agreed to lift the ban, say-ing the action against them was based on an internal disci-plinary hearing and not linked to the criminal case. In this,the Board is right, as the standard of evidence for a crimi-nal trial is substantively different from what it is in disci-plinary proceedings. The BCCI must wait to see if theDelhi Police seek revision of the court order before con-sidering a revocation of the ban.

Water Scarcity...scarce by the year 2025.According to the minister, the average

annual water availability for the country hasbeen assessed by the Central WaterCommission to be at 1,869-billion cubicmetres (BCM).

But due to topographical, hydrological andother constraints, the utilisable water hasbeen estimated to be about 1,123 BCM, headded.

The National Commission for IntegratedWater Resources Development, in a 1999report, had said that the annual water require-ment by 2025 and 2050 will be about 843BCM and 1,180 BCM, respectively, Mr Jatfurther said.

Noting that several steps for augmentation,conservation and efficient management ofwater resources are undertaken by state gov-ernments, he said that the Centre providestechnical and financial assistance in order tosupplement their efforts.

"All responsible stake-holders should takethese warnings very seriously. Reforms arevery necessary," he said, urging Congress toreconsider its stand and allow normal func-tioning of Parliament.

Noting that land and GST bills were sent toparliamentary committees due to theOpposition's demands, he said the govern-ment has "walked the extra mile" to meettheir demands, especially those of Congressand recalled that it had given assurance that itwould help the passage of GST bill in themonsoon session.

He, however, insisted that the governmentwas confident that the GST bill would bepassed in this session.

Astronomers saidThursday they hadfound a planetary

system with three super-Earths orbiting a bright,dwarf star one of themlikely a volcanic world ofmolten rock.

The four-planet systemhad been hiding out in theM-shaped, northern hemi-sphere constellationCassiopeia, "just" 21 lightyears from Earth, a teamreported in the journalAstronomy &Astrophysics.

It comprises four planetsone giant and three super-Earths orbiting a stardubbed HD219134.

Super-Earths have amass higher than Earth'sbut are lighter than gasgiants like Neptune,Saturn or Jupiter. They canbe made of gas, rock, orboth. The planet with theshortest orbit,HD219134b, zips aroundevery three days, and hasnow been observed transit-ing across the face of itsstar as seen from the van-tage point of Earth.

Measurements from theground and with Nasa'sSpitzer space telescopeshowed its mass was 4.5times higher than Earth's,and that it was 1.6 timeslarger.

"Its mean density isclose to the density ofEarth, suggesting a possi-

bly similar composition aswell," said a press state-ment from the Universityof Geneva, whoseastronomers took part inthe research.

"It's very close to thestar. The temperature isabout 700 degrees" Kelvin(427 Celsius, 800Fahrenheit), study co-author Stephane Udry toldAFP. "Probably the surfaceis melting... kind of a melt-ed lava world with volca-noes... not good for life."

It was not in the so-called "habitable zone" ofits star, and would nothave liquid water neces-sary for life.

But HD219134b is excit-ing for another reason: it isthe closest transiting plan-et known to scientists, andthus offers a rare opportu-nity for further study of itscomposition and atmos-phere against the backdropof its star.

"These transiting sys-tems are especially inter-esting in that they allowcharacterisation of theatmosphere of the planet(by studying) the light ofthe star going through theatmosphere," Udry said.

And the system is rela-tively near at a distance of21 light years from Earth.By comparison, the closeststar to our Sun is threelight years away, and thesecond six light years.

Uber Technologies Inc isset to invest $1 billion

(roughly Rs. 6,404 crores) inIndia, which will bring its invest-ment on par with that in China,the Financial Times reported.

Uber said that this move wouldhelp its service reach 1 milliondaily rides by March 2016, thefirst time the company has setsuch target for India, FT said.

Amit Jain, president of UberIndia, said the company was

"extremely bullish" on the Indianmarket and that it continues tosee a 40 percent monthly growth,FT reported.

Jain also added that the compa-ny will expand service beyondthe 18 cities in which it operates,the largest number in any countryoutside of the United States.

Uber was not immediatelyavailable for comment.

On Wednesday, Uber launchedits own auto leasing subsidiary inan effort to sign up more drivers,

injecting the fast-growing rideservices company directly intothe financial services sector forthe first time.

Earlier this month, a Delhicourt revoked a government banimposed on Uber, clearing theway for the company to operatein the capital city and reapply fora licence.

India asked unregistered Web-based taxi services to halt opera-tions in December after a drivercontracted with Uber was

accused of rape. Uber applied forlicences in New Delhi but keptoperating while approvals werepending.

One of the fastest-growingsharing-economy companies,Uber operates in 57 countries,with an estimated value of morethan $40 billion. It has also tan-gled with transportation authori-ties across the globe, along withattorneys seeking to deem Uberdrivers employees entitled tobenefits.

makers have asked theInternational BasketballFederation (FIBA) tochange a policy requiringSikhs and other players toremove their articles offaith, such as turbans, ininternational competition.

The call was reiteratedin a letter sent onThursday by the lawmak-ers led by Ami Bera, theonly Indian-Americanmember of Congress, andJoe Crowley, Vice Chairof the DemocraticCaucus.

The Congress membersalso requested an updateon FIBA's review of thepolicy and on the statusof the organization's two-year testing phaseannounced last autumn.

Last summer, Bera andCrowley led 22 membersof Congress in a letter toFIBA's president urging

the board to end its dis-criminatory policyagainst Sikh basketballplayers who wear tur-bans, an important articleof faith.

The letter followed anoutcry over an incidentinvolving two Sikh play-ers who were told by ref-erees that they mustremove their turbans ifthey were to play inFIBA's Asia Cup.

The players, who havealways played in turbans,were told that they werein violation of one ofFIBA's official rules,which states, "Playersshall not wear equipment(objects) that may causeinjury to other players".

In response to the mem-bers' letter and strongpublic pressure, FIBAannounced that it wouldreview the issue andbegin a two-year testingphase that would allow

players to wear head cov-erings starting in summer2015, with an ultimateeye toward a final deci-sion after the 2016Olympics.

However, despiteFIBA's promises aboutaction this summer, todate, there has been noupdate on the status of thetesting phase, the law-makers said.

"We have seen time andagain that sports have thepower to unite - basket-ball included. The sporthas gained in internation-al stature in recentdecades and is increas-ingly popular in countrieswhere the use of a turbanis commonplace," thelawmakers wrote.

"We urge you to amendyour policies to ensurethat people all around theworld have an equalopportunity to play thegame," they wrote.
