Meeting Date: September 1st, 2015 Submitted By: Justin Heldt, Chief of Police City Council Request Subject: Police Purchase of Police Department Rifles BACKGROUND: The Winsted Police Department serves the citizens of the City of Winsted and our primary responsibilities are life safety and to protect property. In carrying out our duties, various equipment is needed to safely and effectively protect life. The law enforcement rifle has long been used as standard law enforcement equipment in many agencies. To this date, the Winsted Police Department has not routinely carried rifles in the squad cars. In 2010, the Winsted Police Department acquired three (3) Colt Semi-Automatic 9mm rifles from the Glencoe Police Department through Minnesota Surplus Services. Since that time, these rifles have not been placed into commission and have become outdated. The Police Department is currently working with the Minnesota Department of Administration to return/dispose of these rifles. In 2015, staff of the Police Department gathered information on new rifles for the Police Department. Quotes have been obtained for the purchase of three (3) new Colt LE Commando .223/5.56 Model LE6933 rifles. Cost of other items needed to equip the rifles to bring them into commission have also been obtained. This information is attached on the following pages. These rifles would be assigned to each squad car in the Police Department fleet and mounted therein. These rifles are the same make/model that surrounding law enforcement agencies have recently put into commission. Using equipment similar to surrounding agencies, such as our Police Department issued .45 caliber duty handguns, ensures that equipment and ammunition can be used interchangeably in the event of a critical incident. Proposed Timeline:

FINANCIAL/BUDGET: The funds for the purchase of the rifles and equipment for them would come from the Police Department’s forfeiture fund which has an approximate balance of $20,000.00. OPTIONS: 1) Approve the purchase of three (3) - Colt LE Commando .223/5.56 Model LE6933 rifles and

c) Pond Decommissioning – Waste Water Treatment Facility - Final Payment Approve the final payment of $4,382.72 to Fergus Power Pump, Incorporated for the Pond

Decommissioning Project at the Waste Water Treatment Facility.

d) Remediation/Abatement – 121 Baker Avenue East Approve a quote and authorize the City Administrator to execute an agreement with

Kubasch Excavating in an amount not to exceed $6,530.00 to abate the nuisance (i.e. abandoned and dilapidated structures) at 121 Baker Avenue East by the remediation plan provided in Resolution R-15-24 adopted by the City Council on July 7, 2015.

e) Emergency Medical Services Drill – October 19, 2015* Approve an Emergency Services Drill to occur at City Hall on Monday evening, October 19, 2015, and provide notice that there may be a quorum of the City Council present at this drill.

All training on the programs written by SafeAssure Consultants, Inc. will meet or exceed State and/or Federal OSHA requirements. These programs/policies and procedures listed on the addendum do not include the cost of hardware such as labels, signs, etc. and will be the responsibility of The City of Winsted to obtain as required to comply with OSHA standards. Our contract year will begin on the signing of this proposal/contract. Classroom training will be accomplished at a time convenient to most employees/management and so selected as to disrupt the workday as little as possible. All documents and classroom training produced by SafeAssure Consultants for The City of Winsted are for the sole and express use by The City of Winsted and its employees and not to be shared, copied, recorded, filmed or used by any division, department, subsidiary, or parent organization or any entity whatsoever, without prior written approval of SafeAssure Consultants. It is always the practice of SafeAssure Consultants to make modifications and/or additions to your program when necessary to comply with changing OSHA standards/statutes. These changes or additions, when made during a contract year, will be made at no additional cost to The City of Winsted. All written programs/services that are produced by SafeAssure Consultants, Inc. are guaranteed to meet the requirements set forth by MNOSHA/OSHA. SafeAssure Consultants, Inc. will reimburse The City of Winsted should MNOSHA/OSHA assess a fine for a deficient or inadequate written program that was produced by SafeAssure Consultants, Inc. Contract/ Agreement THIS AGREEMENT is made this first day of September, 2015 between The City of Winsted, Winsted Minnesota, herein referred to as The City of Winsted and SafeAssure Consultants, Inc. 200 S.W. Fourth Street, Willmar, Minnesota, herein referred to as SafeAssure. SafeAssure agrees to abide by all applicable federal and state laws including, but not limited to, OSHA regulations and local/state/national building codes. Additionally, SafeAssure will practice all reasonable and appropriate safety and loss control practices. SafeAssure agrees to provide, at the time of execution of this contract/agreement, The City of Winsted (upon request) with a current Certificate of Insurance with proper coverage lines and a minimum of $2,000,000.00 in insurance limits of general liability and statutory for workers' compensation insurance. SafeAssure is insured by “The Hartford” insurance companies. SafeAssure further agrees that The City of Winsted will not be held liable for any claims, injuries, or damages of whatever nature due to negligence, alleged negligence, acts or omissions of SafeAssure to third parties. SafeAssure expressly forever releases and discharges The City of Winsted, its agents, members, officers, employees, heirs and assigns from any such claims, injuries, or damages. SafeAssure will also agree to defend, indemnify and hold harmless The City of Winsted, its agents, members and heirs from any and all claims, injuries, or damages of whatever nature pursuant to the provisions of this agreement. SafeAssure and its employees is an independent contractor of The City of Winsted, and nothing in this agreement shall be considered to create the relationship of an employer/employee. In consideration of this signed agreement/contract, for the period of Twelve Months from the signing month, SafeAssure Consultants, Inc. agrees to provide The City of Winsted, the aforementioned features and services. These features and services include but are not limited to OSHA compliance recommendations and consultations, providing scheduled classroom-training sessions, writing and maintaining mandatory OSHA programs. These features and services will be prepared to meet the specific needs of The City of Winsted.

The purpose of this memo is to present the request for final payment of retainage from Fergus Power Pump, Inc. for removal and disposal of biosolids from the wastewater treatment ponds completed in November of 2014.

Discussion

As outlined in the first payment request as part of this construction contract, a 5 percent retainage in the amount of $4,382.72 was withheld from Fergus Power Pump, Inc. to ensure satisfactory completion of all items under the contract for removal and disposal of biosolids from the treatment ponds in 2014. Fergus Power Pump, Inc. has requested that retainage be released as all contract requirements are now complete.

Recommendation

We have reviewed the request for release of retainage and have determined that all requirements of the contract have been met. Therefore, final payment is recommended to Fergus Power Pump, Inc. in the amount of $4,382.72.

BACKGROUND: On July 21, 2015, the City Council (Council) accepted an annexation petition from the Estate of Darleen Gutknecht (Estate) and Tetra Pak Processing Equipment, Inc. (Tetra Pak) (Resolution No. R–15–26). According to the petition, both parties requested the City of Winsted (City) annex approximately 9.99 acres of real estate abutting the current Tetra Pak property.

Upon annexation, the land in question will be acquired by Tetra Pak from the Estate and benefit from access to City utility services, which are necessary for any development activities. While Tetra Pak staff have made no final determinations regarding such development, potential uses could include an additional loading dock and expanded parking. Any new construction will be reviewed by the City as part of the building permit process.

According to Minnesota Statue § 414.033, subdivision 2(b), the City must hold a public hearing regarding the annexation in question and provide a 30 day notice to the affected town(s) and landowner(s). The City provided this notice by certified mail on July 20, 2015 and July 22, 2015, which satisfies the statutory requirement.

After holding the public hearing, the City Council may then consider adoption of Ordinance No. O–15–06. Upon approval of the ordinance, the City will file the appropriate documentation with the Office of Administrative Hearings, which will review and finalize the annexation.

FINANCIAL/BUDGET: Per the 2015 Fee Schedule (Ordinance No. O–15–01), the planning and zoning fee for annexation is $3,000. As with past annexations, the City will waive this fee. Additionally, the Office of Administrative Hearings requires a $25 annexation filing fee.

OPTIONS: 1) Adopt Ordinance No. O–15–06 annexing land located in Winsted Township, McLeod County,

Minnesota pursuant to Minnesota Statute §414.033, subdivision 2(3), which permits annexation by ordinance, and waive the Annexation Fee as listed in the 2015 Fee Schedule.

2) Other.

RECOMMENDATION: Adopt Ordinance No. O–15–06 annexing land located in Winsted Township, McLeod County, Minnesota pursuant to Minnesota Statute § 414.033, subdivision 2(3), which permits annexation by ordinance, and waive the Annexation Fee as listed in the 2015 Fee Schedule.

ORDINANCE NO. O-15-06 AN ORDINANCE ANNEXING TO THE CITY OF WINSTED, MINNESOTA CERTAIN LANDS IN WINSTED TOWNSHIP ABUTTING THE CITY OWNED BY THE ESTATE OF DARLENE GUTKNECHT.

THE CITY COUNCIL OF WINSTED DOES ORDAIN:

Section 1. The City of Winsted has received a Petition for annexation by ordinance from the

property owner of the land described on Exhibit "A" (the "Property").

Section 2. The Property abuts the City of Winsted, is 9.99 acres or less, and is not presently

served by public wastewater facilities or public water facilities.

Section 3. The Property is deemed to be urban or suburban in character or about to become so.

Section 4. The City of Winsted held a Public Hearing regarding annexation of the Property and

gave thirty (30) days written notice of the Public Hearing, by certified mail, to Winsted Township and all

landowners within and contiguous to the Property.

Section 5. The Property is appropriate for annexation to the City of Winsted pursuant to

Minnesota Statute § 414.033, Subd. 2(3).

Section 6. The Property is hereby annexed to the City of Winsted.

Section 7. Property taxes payable on the Property shall continue to be paid to Winsted Township

for the year in which this annexation becomes effective. If this annexation becomes effective on or before

August 1, 2015, the City of Winsted shall levy on the Property beginning in 2016. If this annexation

becomes effective after August 1, 2015, the City of Winsted shall levy on the Property beginning in 2016.

Section 8. In the first year following the year when the City of Winsted levies on the Property

pursuant to Section 7 hereinabove, and thereafter, property taxes and special assessments (if any) on the

Property shall be paid to the City of Winsted.

Section 9. The City Clerk shall file this Ordinance with the State of Minnesota, Office of

Administrative Hearings; Winsted Township; the McLeod County Auditor; and the Minnesota Secretary of

State; and a copy of this Ordinance shall be delivered immediately to the McLeod County Auditor.

Section 10. This Annexation Ordinance shall be final on the date the Ordinance is approved by

the State of Minnesota, Office of Administrative Hearings.

Section 11. This Ordinance shall be published in accordance with law.

RE: DiMax Expansion Honorable Mayor, Council Members, and Administrator Tienter: Jim Hasselman of DiMax recently indicated that the company was reviewing the potential to expand their production capabilities through the purchase of additional equipment. They have been evaluating the possibility of expanding their facilities in the community and have previously acquired an adjoining parcel of land. During the course of discussion the company has inquired about the availability of Tax Increment Financing or TIF. An economic development tax increment financing district would enable the City to capture some of the new property tax that would be generated from the new project for a period of up to 9 years. DiMax has requested that the new property taxes from the expansion that can be captured through the creation of a tax increment financing district be reimbursed to them for the 9-year capture period of a new TIF District. If the Council determines that it is appropriate to proceed, a subsidy agreement will be drafted that provides specific terms and conditions for the provision of tax increment assistance. It is anticipated that the proposed terms would include the deadlines for the start and completion of the new facility, job creation provisions, and the requirement that all property tax and public utility payments be made on time and in full. The agreement would also include repayment provisions if DiMax failed to meet the job creation and tax base goals established within the agreement. As we have also been having discussions at staff level regarding the use of tax increment financing for the new industrial park, it is recommended that we include that property in the proposed TIF District if it is determined to be appropriate to proceed. A resolution calling for a public hearing on the creation of a new tax increment financing district is attached for consideration at the September 1, 2015 City Council meeting.
