ISLAMABAD, MARCH 08 Foreign Secretaries of India and Pakistan could meet again though there was no breakthrough dur- ing Foreign Secretary S Jaishankar's talks here, a top Pakistani official said on Sunday. Advisor to Pakistan Prime Minister on National Security and Foreign Affairs Sartaj Aziz said that his country wants to resolve all outstanding issues with India, includ- ing Kashmir, through dia- logue. He was talking to media here, days after Jaishankar held talks with his Pakistani counterpart Aizaz Chaudhry but the two sides failed to decide the resumption of peace talks. Aziz said despite no breakthrough there was headway for the next meet- ing between two foreign secretaries. He said Pakistan Foreign Secretary will visit India when his counterpart invites him for resumption of dialogue, Radio Pakistan reported. NEW DELHI, MARCH 08In another big revelation exposing

fissures in Aam Aadmi Party (AAP),party leader Ashutosh on Sunday saidthat Prashant Bhushan once threatenedto destroy the party, demanding ArvindKejriwal's resignations as party's con-vener.

Ashutosh said that many questionswere raised on Arvind during a partymeeting earlier, he got up to respond,but broke into tears instead.

“Kejriwal said - I fought againstRobert Vadra, Ambani and NarendraModi, but I can't fight with my ownpeople,” Ashutosh said.

Accusing the party rebels of conspir-ing against Kejriwal, he said, “We did-n't want this issue to go into public, butefforts were being made to removeArvind from convener's post,” adding,“Around August-September Prashantjiwrote to Arvind in strong words that hewill hold a press conference anddestroy the party, if he does not resignand Yogendra Yadav is not made partyconvener.”

NEW DELHI, MARCH 08The State may have multi-

ple health benefits for thepoor under its variousschemes, but the ability ofthe poor man to access theseschemes is limited. TheDelhi High Court this pastweek passed an order askingthe All India Institute ofMedical Sciences, the DelhiGovernment, the Ministry ofHealth and the UnionGovernment to come up witha single-window mechanismthat would allow a poor per-son to access whatever bene-fits were due to him.

This is meant for everypublic hospital in the city.

The case in questioninvolved a daily wage earnerwho required a hip and kneereplacement. He did not havethe requisite finances.

His earlier petitions in theHigh Court had resulted inthe Delhi Government stat-ing that he was entitled to ahealth scheme wherein hewould be able to pay for hissurgery.

He had been forced to takerecourse to the High Courtafter the hospital and othergovernment authorities hadproved unhelpful in thisregard.

“The parties will addressthe court on the way forwardso that a single windowmechanism can be put inplace at each public hospitalfor patients belonging to theeconomically weaker sec-tions of society,” said JusticeRajiv Shakdher, while takingnote of the detailed steps thatthe petitioner, a differently-abled and poor man had to

take to get whatever wasentitled to him.

“We had sent an intern tohelp the poor man with thepaper work, but even withthis help, they faced numer-ous difficulties running frompillar to post,” said advocateAshok Agarwal, explainingthat two months were beenspent trying to get the moneydespite a court order.

“The reason it took overtwo months is because noclear directions have beengiven by the authorities atany level, and instead ofexpediting a one-windowenforcement mechanism, thepetitioner was expected tocoordinate and make multi-ple visits to the offices of thesub-divisional magistrate,AIIMS and the DHS(Directorate of Health

alleged before Delhi High Court thatgoods of roadside sellers were beingseized by police as part of its "anti- sabo-tage measures", which the organisationhas dubbed as a "fresh modus operandi" toharass squatters.

The allegation made by NationalAssociation of Street Vendors of India(NASVI) prompted a bench of justices BD Ahmed and Sanjeev Sachdeva to askDelhi Police why it was "troubling" streetvendors when no survey regarding theirexisting numbers has been conductedaccording to law.

"Why are you (police) troubling them,when you have not conducted any sur-vey?" the bench asked.

NASVI alleged before the court that

goods of the vendors were seized, some-times at night, on the ground that theywere unattended.

It submitted that the seized goods wereonly released after the vendors were madeto fill a form.

NASVI alleged that it was a "freshmodus operandi to harass the vendors" andsaid that it would be filing a response tothe affidavit placed on record by DelhiPolice which has said that no street ven-dors have been evicted by it.

Delhi Police in its affidavit said that anorder has been issued by the AdditionalDeputy Commissioner of Police to carryout, on a weekly basis, anti-sabotagechecking at various sensitive areas and incompliance of the same it has seized anyunattended objects found in such areas,including Jama Masjid here.

first-of-its-kind web-basedapplication through whichDelhiites will be able to regis-ter an FIR of motor vehicletheft online and track progressin investigation until a finalreport is filed in the court. Thismight be done in the next cou-ple of weeks.

The work on the online appli-cation, which will also beavailable in the form of an app,has been going on for the pastseveral months and technicaland legal aspects have beendiscussed with the Delhi Highcourt. “Our ambitious projectfor a totally computerised sys-tem from filing of FIR to sub-mitting of final report in case ofmotor vehicle theft is almostcomplete. We have got thedesired help from the HighCourt. Now, we have to installthe server and software incourts and we will be able tolaunch it very soon,” said DelhiPolice Commissioner B S

seen no let up in crimeagainst women as DelhiPolice has registerednearly 300 cases of rapeand more than 500 casesof molestation in the firsttwo months of this year.

The police, however,termed this rise in num-bers as a good sign sayingthat this means womentoday feel more comfort-able in coming out andreporting the incidentwhich was not the caseearlier.

"After the December16, 2012 incident, thesociety was forced tothink in this direction andsteps were taken. Womengot a new self confidenceas law was changed;police was sensitized.This caused a spurt of300 to 400 per cent rise incrimes against women in2013. The trend contin-ued in 2014 although itwas not that steep," Delhi

Police Commissioner B SBassi said.

"Now, if we see thosefigures in continuation in2015, we find that theyare almost similar, evenlower. I can say that it is agood thing that wheneverthere is a crime againstwomen, it doesn't remainhidden and that is thegood thing," he noted.

According to DelhiPolice data, nearly 300FIRs of rape were filed inthe first two months of2015 while FIRs regis-

tered under sections of354 and 509 (molestationand outraging modesty ofwomen) of IPC is morethan 500.

In 2014 (up to Dec 15),2,069 rape cases werereported as compared to1,571 cases in the corre-sponding period of 2013.

4,179 cases of molesta-tion of women werereported in 2014 (up toDec 15). Out of these, asmany as 67.17 per centcases have been solved.

The analysis of the data

available with police alsorevealed that nearly 96per cent rapes were com-mitted by those havingacquaintance with thevictim or her familymembers. Only in 4 percent cases, strangers werefound involved.

Talking about the issue,Bassi also emphasised onthe need of teaching selfdefence techniques towomen so that the physi-cal capacity gap betweenthem and men can bebridged. "We want self-defence to be part of girl'scurriculum since earlychildhood so that by thetime she becomes 15-year-old, when shebecomes vulnerable tomisdemeanours, she canfight back. We have set atarget of imparting suchtraining to one lakh girlsthis year and I am happyto inform you that tillMarch 8, we have trainednearly 26,000 girls," hesaid.

After the Dadriwetland, which has become avictim of encroachment, treesin the Surajpur wetland are pur-portedly being felled and soldoff as timber. Environmentalactivist Vikrant Tongad, whohas been raising the issue, saidthe trees are being felled in con-nivance with the employees ofthe Forest Department.Surajpur wetland has the pro-tection status of a reserved for-est area. Falling under the juris-diction of the Greater NoidaDevelopment Authority, it is anurban wetland.

Mr. Tongad raised the issuewith the authorities concernedand wrote to the Centre after hespotted two men carrying atleast 15-20 mature trees fromthe wetland late last year.

Mr. Tongad said he immedi-ately phoned the forest officialsand reported the matter.

PMO seeks...PMO has referred to a similar provision in

the Constitution that provides prohibition ofslaughter of cows and milch animals.

Article 48 of the Constitution states that"the State shall endeavour to organise agri-culture and animal husbandry on modern andscientific lines and shall, in particular, takesteps for preserving and improving thebreeds, and prohibiting the slaughter of cowsand calves and other milch and draught cat-tle."

The letter, sent recently, asked the LawMinistry to "examine and advice" whetherthe Acts enacted by few states can be circu-lated as model bill to other states so that theycan "exercise their choice of consideration tointroduce similar enactments".

The PMO letter also mentions that in 2005the Supreme

Court had upheld the validity of a lawenacted by the Gujarat government prohibit-ing cow slaughter.

Meanwhile, citing past precedents wherelaws on various matters were circulatedamong the states as model bill, sources in thegovernment said there was no bar on theCentre to send such a bill to states.

A draft model bill on flood zone protection,conservation and regulation of groundwaterare some of the measures that have been sentto states recently by the Ministry of WaterResources and Planing Commission andthese have been used by various state govern-ment to enact their own laws.

Several states like Uttar Pradesh,Jharkhand and Gujarat have banned cowslaughter. Maharashtra is the latest state toput in place such a ban.

In the LIBA speech, the former financeminister said Jaitley has pushed the deadlineof curbing fiscal deficit to three per cent ofGDP to 2016-17 by another year to 2017-18.

As against a target of 3.6 per cent fiscaldeficit fixed by the UPA government for2015-16, he has relaxed it to 3.9 per cent ofGDP.

Through this, Chidambaram said, the NDAregime was planning to borrow an additionalRs.42,500 crore which the government wasplanning to spend not on plan expenditurebut on non-plan expenditure.

Replying to questions, Chidambaram saidthere was a need

for a fourth slab in the personal income taxrates.

He recalled that in his budget of 1997 hehad introduced three tax slabs but felt therewas need for a fourth slab since the liberali-sation was giving huge rise in income for cer-tain people.

The former finance minister said the gov-ernment's acceptance of the 14th FinanceCommission report, which increased thestates' share of divisible central taxes to 42per cent from 32 per cent, did not mean stateswere going to get more money. "This callsfor another long debate," he added.

Complete mid-career ...(DoPT) has written to states and central

government ministries to ensure that eligibleIAS officers undergo the training.

"I may also point out that mid-career train-ing is a mandatory training programmelaunched with the objective of improvingtheir next level competencies at specifiedstages of their careers," the DoPT letter said.

Accordingly, suitable directions may beissued to all eligible officers to enroll them-selves online to undergo this (Phase IV) ofmid-career training programme at the earliestso that the officers do not attract the provi-sion of IAS (Pay) Rules, 2007 denying thempromotion, it said.

A list of 211 eligible IAS officers has beensent with the DoPT letter asking the statesand secretaries of central government min-istries to provide them with the names ofother officers eligible to attend the training.

Six months after talks withPakistan were called offForeign Secretary

Subrahmanyam Jaishankarlands in Islamabad today tokick off a new attempt toengage their government.While Indian officials havetaken care to downplay thevisit’s significance, calling it a“SAARC yatra not a Pakyatra”, it seems clear that thetrip has been made with a spe-cial emphasis on Pakistan. Thedecision to re-engage withPakistan, through whichevermeans, signifies two things:one that the decision to canceltalks in July 2014 was only atemporary one for PrimeMinister Narendra Modi, withthe assumption that talks couldbe restarted at a later point, andtwo, that engaging Pakistan isthe norm, rather than an aberra-tion.

However, the last six monthshave also seen several signifi-cant shifts inside Pakistanobserved during a recent visitby this writer;the foreign secre-tary may, therefore, find pick-ing up the threads of the talksmore complex than it was per-haps last July.

Shift in power balance

There is an obvious shift inthe power balance at the core ofPakistan: the civil-militaryequation. In recent weeks, it isclear that army chief GeneralRaheel Sharif has a new statureinside Pakistan, with primacyon all issues, not just the ‘Zarb-e-Azb’ operation and effortsagainst terror groups as part ofthe National Action Planannounced after the Peshawarschool massacre. The shift hasbeen acknowledged inWashington, where he wasreceived by the U.S. Secretaryof State John Kerry and inLondon, where he met PrimeMinister David Cameron. OnJanuary 6, the government alsoannounced that military courtswould take over many of theterrorism trials, as civil courts

are too slow, and judges are tooeasily threatened or influencedinto letting militants off.However, it would seem thegovernment of Mr. NawazSharif has come to terms withthe shift, and as a result, hisgovernment is enjoying a rarespell of stability compared tothe tensions with both theopposition and the military ofthe past. At a track-II confer-ence organised by the JinnahInstitute and Centre forDialogue and Reconciliation inIslamabad last week, diplomatswere heard saying the Army’sInter Services Public Relations(ISPR) was now taking overmany of the Foreign Office’sfunctions, and the shift inpower equations is importantfor India. Although the ArmyGHQ in Rawalpindi has alwayshad a veto on India-Pakistanrelations, there is a markedincrease in statements from theISPR wing in recent weeks thatshow a greater involvement inthe process as well. GeneralSharif’s visit to the LoC and theInternational Border just beforeMr. Jaishankar’s visit to accuseIndia of opening “indiscrimi-nate firing” and warn of a“befitting response” cannot beignored.

Related to this shift is the dra-matic change in Afghanistan-Pakistan relations in the pastfew months. Since his swear-ing-in, President Ashraf Ghanihas deviated from his predeces-sor President Hamid Karzai’sstance that Pakistan supportingthe Taliban was the source ofall of Afghanistan’s problems.Instead, Mr. Ghani visitedIslamabad directly after his firsttrip abroad to Beijing, and alsovisited the Army GeneralHeadquarters in Rawalpindi.The bonhomie has been recip-rocated in full measure byPakistan’s military, with visitsby General Sharif, his ISI chiefLieutenant-General RizwanAkhtar, and Corps commandersof Peshawar and the Southerncommand to Afghanistan in thepast month alone. Pakistan’s

military is also assuming a pri-macy in the soon-to-belaunched talks between theAfghan government and theTaliban, which also explainsthe welcome General Sharif has

received in the U.S., the U.K.and China. This dependencecould shift the balance on talkswith India, as Afghanistan hasso far been an important allyfor India on curbing theLashkar-e-Taiba.

Fighting ‘the terror within’

The other obvious turningpoint in the past few months inPakistan is the Peshawar mas-sacre, given the intense anger ithas generated, and the pushfrom Mr. Sharif’s governmentto fight “the terror within”Pakistan. According to the

Pakistan government 19, 272suspects have been arrested in19,789 countrywide operationssince the launch of the NationalAction Plan against terrorism inDecember 2014. Mr. Sharif is

doing this in the teeth of oppo-sition from many within hisown government who are closeto radicalised extremist groupsand from clerics across thecountry who at a conferencethis week of the IttehadulTanzeemat-e-Madaris, con-demned the government for its“unconstitutional steps.”

But despite all the actiontaken so far, no visible stepshave been made against thegroups that India has demand-ed: Hafiz Saeed remains free toaddress rallies, and givesspeeches at leading universities

in the country, while his com-manders on trial for theMumbai attacks live luxurious-ly inside the Adiala jail inRawalpindi, leading the U.S.National Intelligence Chief

James Clapper to conclude dur-ing a testimony last week, thatPakistan’s provision of “safe-havens” to the Lashkar-e-Taibawill remain a major irritant forties with India. It will be Mr.Jaishankar’s task to continue topush for a shift in this part ofPakistan’s policy.

“ There is an increasingacknowledgement in Pakistan’scivil society that the use of “ter-ror as a tool of foreign policy”has hurt Pakistan’s cause bothinternally, as well as in harmingthe cause of Kashmiri sepa-ratists they back. ”

Significantly, there is anincreasing acknowledgement inPakistan’s civil society that theuse of “terror as a tool of for-eign policy” has hurt Pakistan’scause both internally, as well as

in harming the cause ofKashmiri separatists they back.

“Pakistan committed the his-toric blunder of sending intrained and fully-armed non-state actors,” writes formerEditor M. Ziauddin in an edito-rial in The Express Tribune in aview that seems widely held,“we had seemingly succeededin reducing a six-decade-longfreedom struggle into a terroristadventure in the eyes of theworld.” The article also seemsto indicate that even as localsupport for training terrorgroups to attack India dries up,

the government will choose tostep up its attempts to “interna-tionalise” the political problemin Jammu and Kashmir, untilIndia and Pakistan are able torestart talks on the issue.

Finally, Mr. Jaishankar willbe expected to articulate theway forward on the nature ofthe dialogue itself. The twocore issues remain India’s con-cerns on terrorism andPakistan’s concerns onKashmir, and the need of thehour is to move ahead on themin a sustained manner, withoutthe breaks in dialogue that havedelayed them in the process.

Several Confidence BuildingMeasures need to be bolsterednow. While the LoC ceasefire isin danger of collapse anddemands new mechanisms tokeep it in place, others like anew visa regime, and measuresto facilitate trade and travelneed to be ratified.

A small start on CBMs couldbe made even if the foreign sec-retaries of India and Pakistanjust agree to revise the extreme-ly bellicose closing ceremonyat Wagah every evening. Thiswas requested by the BSF sol-diers themselves in 2010, citingheavy back and knee injuries ,but despite talks on the issue,neither India nor Pakistan havebeen able to give them anyrelief so far. Perhaps a lesson intheir plight is something bothforeign secretaries could drawon for other parts of the India-Pakistan dialogue as well: it isimportant to put one’s footdown firmly, but without dam-aging oneself in the process.

Most judicial systemsundergo periods ofhigh pendency and

delay in dispensation of justicewhich are usually followed by arealisation from within and giverise to widescale legislativereforms. While it was the LordWoolf Report and the ChiefJustice’s Working CommitteeReport that spurred such achange in the U.K. and HongKong, the Justice A.P. Shah-ledLaw Commission Reports num-bered 246 and 253 could poten-tially be what the Indian com-mercial dispute resolution sys-tem has been waiting for. Thesereports suggest widescalereforms by suggesting the enact-ment of an Act to amend theArbitration and ConciliationAct, 1996, and a “CommercialDivision and CommercialAppellate Division of HighCourts and the CommercialCourts Act” (CommercialDivisions Bill/Act), respective-ly.

In pursuance of its ‘ease ofdoing business’ propaganda andan overall attempt to attractinvestors, the Bharatiya JanataParty government is set to intro-duce these two bills in the budg-et session of Parliament. Ifpassed and implemented, theseenactments are likely to changethe face of commercial disputeresolution in India.

Commercial Divisions Bill/Act

The Commercial DivisionsAct introduces a commercialdivision in every high court hav-ing original jurisdiction (i.e.Madras, Delhi, Bombay,Calcutta and Himachal Pradesh)and commercial courts in suchdistricts, as the Central govern-ment, in consultation with theconcerned State government andChief Justice of the concernedHigh Court, may establish.These specialised courts willresolve all “commercial” dis-

putes of value of over Rs. 1crore. Simultaneously, the juris-dictional limits of all high courtswhich have original side juris-diction would be increased toRs. 1 crore across the country.These disputes will be heard byjudges who not only have abackground in commercial lawsbut will also receive specialtraining in this area.

The Act will have wide ramifi-cations as the term “commer-cial” is widely defined andincludes disputes ranging fromintellectual property rights dis-putes to disputes arising out ofjoint venture agreements andproceedings in aid of arbitra-tions. The Bill provides for a fasttrack mechanism with stringenttimelines. And for the first timeit introduces in the Indian sys-tem the concept of a case man-agement conference wherein aprocedural order is passed priorto trial, setting out a time table(including time-bound oral argu-ments supplemented with writ-ten arguments) which has to bestrictly adhered to. The court isgiven wide powers to ensure thatstrict compliance is enforced.Moreover, the court, too, is man-dated to deliver its judgmentwithin a period of 90 days.

The Bill adopts the “carrot andstick” approach and judiciouslyoffers “carrots” for complianceand provides courts the power towield the “stick” in case of delayby one of the parties. The Billalso makes mandatory the ‘costfollow the event’ regime, where-by, as a general rule, the partyagainst whom the order/judg-ment is passed bears the entirecost of litigation, subject toexceptions where delaying par-ties, even if successful, have tobear part of the cost.

While an earlier version of thisbill had been introduced duringthe United Progressive Allianceregime, the Bill, in the words ofthe Law Commission, did “not

make an effort to fundamentallyalter the litigation culture inIndia” and that the changes sug-gested were “cosmetic” innature. The Rajya Sabha hadraised certain valid concernsincluding the unworkability ofsome of the procedural measuressuggested. The LawCommission has carefully scru-tinised these objections andintroduced procedures whichhave been internationally tested(more specifically in the U.K.and Singapore).

Amendments

An attempt is also being madeto encourage arbitration, whichis a form of alternative disputeresolution wherein private par-ties, usually by consent, appointan arbitral tribunal to adjudicateon the dispute outside of the reg-ular court system. One of themajor problems that haveplagued this system is excessivejudicial intervention and the pro-posed amendments are primarilyaimed at reducing such interven-tions.

Today, interventions by courtshappen at all stages — pre-arbi-tration proceedings for appoint-ment of a tribunal and post-arbi-tration challenges to the award.The proposed amendmentsrestrict the scope of pre-arbitra-tion review to a “prima facie”review of the existence of anarbitration agreement and nar-row down the scope of the chal-lenge of an award by prohibitingan analysis on merits.Specifically, the scope of chal-lenge to a foreign award hasbeen greatly narrowed.

Perhaps the biggest shortfallof the present arbitration regime

is the fact that a successful partyin arbitration is not in a positionto enjoy the fruits of its successfor many years as the mere filingof a petition challenging itsvalidity renders the arbitralaward unenforceable. The LawCommission has suggestedamendments to Section 36 of theAct and a losing party willhenceforth have to satisfy aCourt as to why it is a fit case forthe arbitral award to be stayedand the Court will have powersto order the losing party todeposit part of the award suminto Court.

Another major area where theproposed amendments wouldmake a significant difference isin relation to neutrality of thearbitral tribunal which is consti-tuted. The Supreme Court ofIndia, in Indian Oil v. RajaTransport, has declared a tribu-nal appointed by a public sectorundertaking comprising its ownemployees to be valid subject tocertain narrowly carved outexceptions. This decision issought to be legislatively over-ruled by incorporating theInternational Bar Associationguidelines on conflict of interestas a schedule to the Act.

Further, the proposed amend-ments suggest a more realisticinterest and costs regime, per-mitting compound interest to beawarded and incorporating the“costs follow the event” rule asthe base rule in relation to arbi-tration.

The investment treaty arbitraltribunal in White Industries v.Union of India has held that theIndian system does not provide“effective means” for a foreigninvestor to enforce its rights.The bills proposed to be intro-duced in the budget session notonly expedite commercial dis-pute resolution but also effec-tively disincentivise initiation offrivolous proceedings.

However, enacting a law isonly part of the solution; imple-menting it effectively by select-ing the right personnel is asimportant. Effective implemen-tation of the Lord Woolf reportresulted in eradicating frivolouscommercial litigation in theU.K. — statistics suggest thatthe number of litigations initiat-ed fell by around 80 per cent.Commercial dispute resolutionin our country is at its crossroads and the enactment of theselaws and their implementationover the next couple of yearswould determine whether inIndia the maxim ‘Ubi jus ibiremedium’, i.e. every right has aremedy, translates into some-thing more than a de jure princi-ple.

Transforming commercial dispute resolution

The Modi government’s decision to engageIslamabad can only be welcomed given the deci-sion to open up to South Asia in a big way.

Several key initiatives of the government are contingenton a peaceful South Asia. And, there is little doubt thata peaceful region will be key to realising India’s owngrowth potential. Even if there has been little change inthe attitude of Pakistan’s permanent establishmenttowards reining in anti-India terror groups, talks held byForeign Secretary S. Jaishankar with his Pakistani coun-terpart Aizaz Chaudhry in Islamabad could hold the keyto the future of the bilateral relationship. The two metafter India abruptly cancelled what were billed as “talksabout talks” between Foreign Secretaries last year fol-lowing a meeting between separatist Hurriyat leadersand the Pakistani envoy in Delhi. As has become thenorm in India-Pakistan relations, the cancellation cameafter Prime Minister Nawaz Sharif, along with otherSAARC leaders, was invited to attend Narendra Modi’sswearing-in ceremony last May, raising hopes for a pos-itive engagement. Since then, Pakistani and Indianforces have been exchanging fire intermittently acrossthe Line of Control and the international border. So, theModi government’s decision to send its new ForeignSecretary is a step in the right direction even as a fullresumption of dialogue between the two countries isawaited. Both sides said little that departed from thecustomary exchange of political rhetoric. The Modigovernment has had enough time to understand theissues at hand and must now take a call on how to moveforward with Pakistan. There are two options before thetwo governments — to pick up the threads of the “twoplus six” structured dialogue agreed to in 1997 whichhas made little or no progress — or agree to a new struc-ture more in line with 21st century realities. But giventhe track record of bilateral negotiations, it is unlikelythat the latter option would be pursued. There is no rea-son the two sides should not try to frame a new structureof negotiations that jettison the past agendas. Sir Creek,Siachen, terrorism and Kashmir are all known and iden-tified issues in bilateral ties; even the resolution of the“easier” issues has proved elusive given the blow-hot,blow-cold nature of the relationship. If the oft-repeatedstatement that countries can’t change their neighbours isto have substance, then both Mr. Modi and Mr. Sharifhave a golden opportunity to take bilateral ties to a newlevel. Mr. Jaishankar’s Islamabad visit is a promisingfirst step.

Minister Om ParkashDhankar on Sunday saidthat the state is all set tointroduce a Bill for "pro-tection and upkeep" ofcows in Budget Session ofthe Assembly beginningtomorrow.

In the proposed 'GovanshSanrakashan and GauSamvardhan (CowProtection and CowConservation andDevelopment) Bill' effortswill be made to ban cowslaughter and for conserva-tion and better care ofindigenous cattle, he said.

"For the scientific testand analysis, governmentis considering to establishlaboratories to differentiatebeef from meat of that ofother animal species. Testreports of these laborato-ries will be valid evidencein the court of law,"Dhankar said adding that

sale of packaged beef hasbeen banned in the state.

The minister noted thatthere were some 3,000cows in the state in 400cow shelters run by NGOs.Besides, some 1.5 lakhcows roam in fields orstreets.

He said that the existingcow sheds will be upgrad-ed and made self-suffi-cient.

"Special efforts will betaken for availability ofBeta ? Carotene and A-2milk protein in the milk ofindigenous cows which arebeneficial for control ofdiabetes and cholesterol inhuman beings and alsoknown for better digestibil-ity.

"The focus will also beon establishing a brand forthe milk of indigenouscows and ensuring A-2milk at remunerativeprices," Dhankar said.

The state will provide

financial and technicalsupport to cow welfareorganisations likeGaushalas, Gau-Grah,Gau-Abhyaranya, Gau-Sadan, Gokul Gram thatare engaged in mainte-nance and care of sick,injured, stray and uneco-nomic cows, he said.

"The government willtake necessary steps to pro-vide incentives for market-ing and processing of milkfrom indigenous cows," headded.

Leadership Summit' atGurgaon between March13 and 15 where Rs 5.70crore will be disbursed toowners of top qualityMurrah buffaloes, Harianaand Sahiwal cows, theminister informed.

From the coming finan-cial year, HaryanaGovernment will provide

subsidy to the tune of 50per cent on establishmentof dairy unit of indigenouscows.

In addition, incentivemoney in the range of Rs10,000 to Rs 20,000 willbe provided to the ownersof top quality indigenouscows, he said.

During the summit, overa lakh farmers will learnthe agriculture productiontechniques, input, directmarketing and other relat-ed intricacies, he said.

"Some constructions like theInternational Museum, ConventionCentre, new building for LegislativeAssembly, new residences for legis-lators were not necessary at all as weare fighting against poverty in thestate. There was no need for thesebuildings," Manjhi said.

The former chief Minister said theold Patna Musuem could have beeneasily expanded to cater to the pres-ent day visitors, but Kumar insteadopted for an International Museum.

"Spending Rs 500 or 700 crore onmuseum or other buildings shouldhave been thought about only after

paying attention to the problemsfaced by our people like teachers,contractual workers, policemen andhome guards," he added.

Manjhi resigned from the ChiefMinister's post on February 20 afterholding it for nine months that werefraught with bickering within the JD(U). Kumar replaced him by embark-ing on his fourth term as the CM.

About decisions taken by him but

subsequently annulled by Kumar,Manjhi claimed these were pro-peo-ple and would have had long-termimpact on the betterment of Bihar.

"I noticed that 10 pre cent of thecost of projects was going to contrac-tors as benefits. This amounted to Rs4,000 crore per annum. I thought ifthis money goes to people from thedeprived sections of the society," hesaid.

A powerful Improvised Explosive Device(IED), weighing about 15 kg, was recoveredand destroyed by the Army in Assam'sChirang district while an activist of MULTAoutfit was nabbed in Dhubri district.

Acting on specific information from thepolice about a suspicious object found onPatiladaha-Panbari Road in the district,troops under the Red Horns Division accom-panied by Army Bomb Disposal personnelcarried out thorough search, a defencespokesman said.

During the search, the IED was foundunder a culvert and was later defused, thespokesman said.

In another incident, a militant of theMuslim United Liberation Tigers of Assam(MULTA) was nabbed in a joint operation bythe Army and police forces from Baijer Algavillage in Dhubri district today, he said.

A 9 mm pistol along with four rounds ofammunition was recovered from his posses-sion.

to make any arrest in connectionwith Thursday`s incident when amob broke into Dimapur`s high-security central jail and killed arape accused in full public view.

A Nagaland Police official inDimapur said efforts were on toidentify those involved in thekilling of Syed Farid Khan and thatthey would be brought to booksoon.

The Nagaland authoritiesSaturday handed over the body ofKhan to his family in Khatkhatiarea on the Assam-Nagaland bor-der. Later, his body was taken to hisnative village in Assam`sKarimganj district.

Tension has gripped Badarpurarea in the district after the arrivalof the body as the people are agitat-

ed over the brutal killing. Therewas, however, no untoward inci-dent reported from the area.

Khan`s brother Jamal UddinKhan, claimed that his brother wasframed in the rape case as the med-ical examination of the girl, whoalleged rape, indicated that therehad been no sexual assault.

Syed Farid Khan, a 35-year-oldsecond hand car dealer, wasaccused of raping a 20-year-oldNaga woman on February 23 and24 at different locations. Policearrested Khan on February 25 and alower court sent him to judicial cus-tody.

Khan was dragged out of the jailby an angry mob, paraded nakedand then thrashed to death onThursday, forcing the authorities toclamp curfew in Dimapur district.

A Nagaland Police official said

"The situation has improved but wehave decided to continue the curfewin Dimapur. There have been ade-quate deployment of forces in andaround the town to ensure that thereis no backlash."

Meanwhile, the Nagaland andAssam governments put the forceson alert to ensure security to all thenon-locals living in both the states.

Assam Chief Minister TarunGogoi asked police and other secu-rity forces to be alert and said nonon-locals should feel insecure dueto what happened in Dimapur.

Gogoi Saturday blamed the cen-tral government for the incident inDimapur and said the security in thejail was under the central forces,who failed to stop the lynching.

"It is the centre which is responsi-ble for ensuring the security of theinmates," he said.

The Assam chief minister has alsowritten to union Home MinisterRajnath Singh to ensure that properaction was taken against thoseresponsible for thelynching.

He also appealed to NagalandGovernor P.B. Acharya (who is alsoholding charge of Assam) to takenecessary action to ensure that theguilty were booked and punished.

Several organisations in Assam,including the All MinorityStudents` Union, Saturday helddemonstrations at different placesin the state to protest against thebrutal killing.

IPS and IFS officers forthe newly-formed state ofTelangana and residuaryAndhra Pradesh has beenfinalised by the Centre.

A total of 133 officers ofIndian AdministrativeService (IAS) have beenallocated Telangana cadre,whereas 161 have beengiven Andhra Pradeshcadre, a gazette notifica-tion issued by the Centresaid.

As many as 95 officersof Indian Police Service(IPS) have been givenTelangana cadre and 116have got Andhra Pradesh.Similarly, 58 officers ofIndian Forest Service(IFS) have got Telanganaand 69 AP cadre, it said.

The allocation of the

three all India servicesofficers is based upon therecommendations of a six-member committee led byformer Central VigilanceCommissioner PratyushSinha.

Earlier, Andhra Pradeshhad a total authorisedstrength of 376 IAS, 258IPS and 149 IFSofficers.

one of the biggest over-hauls in its nearly 70-yearhistory, aimed in part atsharpening its focus oncyber operations andincorporating digital inno-vations, CIA director JohnBrennan said.

Brennan said he is cre-ating new units within theCIA, called "mission cen-tres," intended to concen-trate the agency's focus onspecific challenges orgeographic areas, such asweapons proliferation orAfrica.

The CIA director saidhe also is establishing anew "Directorate ofDigital Innovation" tolead efforts to track andtake advantage ofadvances in cyber tech-nology to gather intelli-gence.

Historically, electroniceavesdroppers at theNational Security Agencyhave been at the cuttingedge of digital innovationwithin the US govern-ment. But the CIA felt thatit had to reorganize tokeep up with the techno-logical "pace of change,"as one official put it.

Brennan said the newdigital directorate willhave equal status withinthe agency with four otherdirectorates which haveexisted for years.

"Our ability to carry outour responsibilities forhuman intelligence andnational security responsi-bilities has become morechallenging" in today'sdigital world, Brennansaid. "And so what weneed to do as an agency ismake sure we're able tounderstand all of theaspects of that digitalenvironment."

Brennan briefed a smallgroup of reporters on thechanges on Wednesday,on the condition they didnot publish until he toldCIA employees on Friday.

Stepping up the CIA'sexpertise in cyberspacemay help it counter tech-nological innovations andsophisticated use of socialmedia by militant groupssuch as Islamic State. Itcould also mitigate whatU.S. officials have said isdamage to intelligencegathering caused by for-mer NSA and CIA con-tractor Edward Snowden.

The 10 new "missioncentres" will bring togeth-er CIA officers withexpertise from across theagency's range of disci-plines to concentrate onspecific intelligence targetareas or subject matter,Brennan said.

Competition betweenspy agencies and betweenunits within agencies hasled to "stove piping" ofinformation that should

have been widely sharedand to critical informationfalling through bureau-cratic cracks, Brennan andother U.S. intelligenceofficials said.

"I know there are seamsright now, but what we'vetried to do with these mis-sion centres is cover theentire universe, regionallyand functionally, and sosomething that's going onin the world falls into one

of those buckets,"Brennan said.

The CIA currently oper-ates at least two suchinterdisciplinary centres,covering counter-terror-ism and counter-intelli-gence.

Reaction to the CIAreorganization was mostlypositive, although someveterans acknowledged itwill likely prompt bureau-

cratic friction within thespy agency.

"I think that this willstrengthen the CIA signif-icantly over time," formerCIA acting director anddeputy director MichaelMorell said.

"There are short termcosts...A lot of things towork out," Morell added."And there are going tobe...senior people with

heartburn."

Sen. Richard Burr,chairman of the SenateIntelligence Committee,praised Brennan's moves.

"This reorganizationwas driven not by anyinstitutional failure, butby the realization that theworld has changed overthe course of the last 70years. In many ways, theDirector's proposal is long

Self-driving cars could generatebillions of dollars a year in rev-enue from mobile internet serv-

ices and products, even if occupantsspend only a fraction of their freetime on the web, according to a newstudy by McKinsey & Company.

The study, released Thursday, alsoprojects that widespread adoption ofself-driving cars could lead to a 90percent reduction in U.S. vehiclecrashes, with a potential savings ofnearly $200 billion a year from sig-nificantly fewer injuries and deaths.

In addition, the McKinsey studywarns of several risks to establishedcompanies, including vehicle manu-facturers, dealers and even insurancecompanies.

McKinsey projects that future own-ers of self-driving cars could save upto 50 minutes a day, some of which islikely to be spent surfing the web.

The consulting firm estimates theadditional free time in the car couldgenerate about $5.6 billion a year indigital revenue for each additionalminute that vehicle occupants spendon the internet - as much as $140 bil-lion if half their free time in the car,or roughly 25 minutes, is devoted todaily web surfing and shopping.

The revenue may be divided amongthe vehicle manufacturers, theirmajor hardware and software suppli-ers and web-based providers ofgoods, information and services.

In the future, "people will be ableto shop for services or products from

McKinsey said that whiletraditional automakers, especiallypremium brands such as DaimlerAG's Mercedes-Benz andVolkswagen AG's Audi, already arebeginning to implement advanceddriver assistance systems on theircars, they face new challenges infielding fully autonomous cars from"attackers," non-traditional compa-nies that do not have legacy vehicleplatforms or sales and service net-works.

Those outside challengers include

such newcomers as Tesla Motors Inc,as well as tech giants such as AppleInc and Google Inc, both of which arepoised to build self-driving cars.

The gradual shift to self-drivingcars, which may automakers don'texpect to accelerate until after 2025,could trigger other profound changesin the auto industry. Those include ashift among insurers from coveringrisk of human error to risk of techni-cal failure; a shift from franchiseddealer service to independent shopswhere autonomous vehicles can drivethemselves for repairs and mainte-nance, and fewer trips to the shop asmore cars are diagnosed and updatedwirelessly.

Hundreds of millions of Windows PC users arevulnerable to attacks exploiting the recentlyuncovered "FREAK" security vulnerability,

which was initially believed to only threaten mobiledevices and Mac computers, Microsoft Corp warned.

News of the vulnerability surfaced on Tuesdaywhen a group of nine security experts disclosed thatubiquitous Internet encryption technology couldmake devices running Apple Inc's iOS and Mac oper-ating systems, along with Google Inc's Androidbrowser vulnerable to cyber-attacks.

Microsoft released a security advisory on Thursdaywarning customers that their PCs were alsovulnerable to the "FREAK" vulnerability.

The weakness could allow attackson PCs that connect with Webservers configured to use encryptiontechnology intentionally weakened tocomply with U.S. government regulations banningexports of the strongest encryption.

If hackers are successful, they could spy on communi-cations as well as infect PCs with malicious software, theresearchers who uncovered the threat said on Tuesday.

The Washington Post on Tuesday reported that white-house.gov and fbi.gov were among the sites vulnerable tothese attacks, but that the government had secured them.

Security experts said the vulnerability was relativelydifficult to exploit because hackers would need to usehours of computer time to crack the encryption beforelaunching an attack.

"I don't think this is a terribly big issue, but onlybecause you have to have many ducks in a row," said IvanRistic, director of engineering for cyber-security firmQualys Inc .

That includes finding avulnerable web server, breaking the key,finding a vulnerable PC or mobile device, then gainingaccess to that device.

Microsoft advised system administrators to employ aworkaround to disable settings on Windows servers thatallow use of the weaker encryption. It said it was investi-gating the threat and had not yet developed a securityupdate that would automatically protect Windows PCusers from the threat.

Apple said it had developed a software update toaddress the vulnerability, which would be pushed out tocustomers next week.

Google said it had also developed a patch, which it pro-vided to partners that make and distribute Androiddevices.

The holders wrapped up theTamil Nadu first-innings in62.4 overs, just 28 minutesafter the tea session.

He’s been missing in action.We haven’t seen Abhay Deolon or off screen for quite awhile. Has he moved to theUS permanently? Deol whoseunderstated performances inDev D, Shanghai and ZindagiNa Milegi Dobaara made himone of the most natural actorsseems to have cut loose fromthe film industry. In an aninterview from the USA,Abhay clears the air about hisfuture.

It’s been a while since wesaw you on screen. Whereare you? Have you migratedto the US?

(Laughs) I haven’t migratedto the US!

Your last Bollywood outingOne By Two proved to bedamaging on many counts.In hindsight, do you think itwas premature for you toturn producer?

Nope, I learnt a lot in myouting as a producer and it hasopened many new doors forme. In life you only learn bytaking chances.

You also took on the musicmafia in Bollywood. Is therea sense of vinidication sincenow Zee Music has openedup as a feasible alternativeroute for movie producersto release their sound-tracks?

It’s good that Zee hasopened up their own compa-ny. I hope in the future, film-makers have more than one ortwo choices. For a market tothrive, there has to be a levelplaying field for all profes-sionals.

In spite of such thoughtfulperformances in recentfilms like Shanghai andChakrvayuha why do wesee so little of you onscreen?

It’s a media-driven worldand I guess I need to be moremedia savvy. I’m also verypicky with my films. It’s hardto find the right fit. After somany years I still need to fitin! I’ve heard many peoplesay that to me. Maybe that istrue maybe or maybe that isnot, I believe if a filmmakerwants to work with you and

use you for what you havethen he/she will do it. That’show both Oye Lucky andDev.D happened.

Do you think Americanfilmmakers take Bollywoodseriously?

American filmmakers. as Ihave understood, look atBollywood with an amusedcuriosity. Musicals, tradition-ally, are rare in Hollywood, sothat automatically puts all ofBollywood into one genre.Bollywood also relies muchmore on spectacle thanHollywood barring the super-hero movies. Bollywood forthem is a genre by itself. Theword brings up images ofbright colours, music, specta-cle, beautiful women andmuscular men. Funnilyenough, most of them haven’tseen any Bollywood film butthe name is something theyare aware of. Oxford diction-ary, zindabad!

Which films so far havebeen the most satisfying andmost unfulfilling for you?

Most satisfying would beDev.D, Shanghai andManorama Six Feet Under.They were heavily driven bythe characters. Least satisfy-ing would be the ones where Ididn’t have much to do. Ileave that to you to decide!

You’ve always been a bit ofa maverick. I remember youdid a course in welding?

Ups and downs come and

go, the important thing is tolive them fully and under-stand them. The more experi-ences you have, the more youunderstand as long as youremain open.

Any chances of turningdirector in the near future?

Right now, most of myfocus is on the acting and pro-ducing front. All my energiesare concentrated on makingthe next film that will breakthe mold. I have no plans toturn director, I wouldn’t gothere until I feel sure that I amready.

When do we see you andPreeti Desai tie the knot?How would you define your

relationship with her?

(Laughs) I’m often askedthis question! Not anytimesoon. I don’t define relation-ships that can’t be. It’s every-thing and nothing at the sametime. The kind that that makesyou learn how to live and howto be.

When do you return toIndia?

I will return soon. I’m hav-ing too much fun here in theUS! I have two confirmedprojects back at home, a bigcommercial film and a smalloff beat radical one. I mayhave found the perfect bal-ance.Subscribe to me onYouTube

According to the latestreport, DeepikaPadukone is going to

wear 20 kg armour for SanjayLeela Bhansali’s upcoming peri-od drama ‘Bajirao Mastani’. Thefilm brings together the on andoff screen couple, Ranveer Singhand Deepika Padukone secondtime after ‘Ram Leela’.

Throwing light on the newproject, Deepika will playMastani in the film and she willbe seen performing few actionsequences. To make the characterlook more authentic, the actresswill be wearing heavy armourweighing around 20 kg.

A source reveals, “She is cur-rently preparing for one of hertoughest shoots. For certain partsof the film, she will have to wearan armour weighing over 20 kg.”

Deepika will also have to per-form action scenes in it. “It is anintense war sequence and she hasbeen learning sword fighting,among other things, for the same.She has now begun wearing thecostume and practising her stuntsas she will have to look effortlesson screen,” adds the source.

Earlier, Deepika had worn a

ghagra weighing 30 kgs in 'Ram-Leela'. For the character ofMastani, Deepika is also takinglessons in martial arts and swordfighting. Meanwhile, the shoot-ing of the movie has alreadystarted with Ranveer Singh andPriyanka Chopra who is playingKashibai, the great Maratha war-rior Bajirao’s first wife.
