The Fair Work Commission considered that a “provision with a minimum ‘floor’ of a 3 hour minimum engagement is necessary to achieve the modern awards objective”. The Fair Work Commission has given the parties the right to make further submissions by 2 August 2017. In a recent decision, part of the 4-year review of modern awards, the Fair Work Commission rejected the ACTU claim for 10 days paid family violence leave.

However, they determined that all employees should have access to unpaid family and domestic violence leave and be able to access paid personal/carer’s leave for the purpose of taking family and domestic violence leave.

The Fair Work Commission now wants to convene to hear submissions on unpaid leave and accessing personal/carer’s leave for family violence reasons.

FWC rejects paid family violence leave

A new wages guide reflecting the 3.3% increase in adult award rates and allowances granted by the

Fair Work Commission has been posted to all members.

High income thresholdThe income and compensation caps for unfair dismissal claims under the Fair Work Act will increase on 1 July 2017 to $142,000 and $71,000 respectively.

The high income threshold for unfair dismissal applications rises from $138,900 to $142,000, while the maximum compensation increases from $69,450 to $71,000 for post 1 July dismissal claims.

Vale Geoff LongVACC is deeply saddened to announce that our Area Manager and long standing employee, Mr Geoffrey Eric Long, following illness, passed away on 17 June 2017.

Prior to Geoff’s passing he conveyed that it had been an honour and privilege to have worked for the VACC for 16 years and that he valued the support and joy he experienced in working alongside his VACC colleagues, while directly serving our members.

Geoff was an automotive man through and through, commencing his career as an apprentice, working in the trade and in his own business. He then joined VACC in the technical department and went on to become our Area Manager.

Geoff will be sorely missed. He is survived by his loving wife, Maureen, and sons, James and David.

Roadside Service

Chains and slings are commonly used in automotive businesses to tie up

and secure heavy items that need to be moved using a lifting device. The VACC OHSE Unit have recently been alarmed at the state of some of the chains and slings being used in some of our member businesses.

A damaged chain or sling can result in losing a load, which can mean severe injuries to workers, damage to the item being lifted and the surrounding work area.

It is important for members to ensure the integrity of chains and slings prior to, during and after use.

What can you do?• Instruct your staff to check chains

and slings prior to each use

• Test chains and slings at least annually

• Use a competent company if outsourcing your testing

• Instruct workers and management to look out for any damage to the chain or sling including nicks, cuts, grazes, burns or build-up of oil and grease

• Develop a lifting register to keep track of when your chains and slings were purchased and the date of each integrity check

• Ensure you have at least one person trained in rigging and dogging

• Reward and retain your customers with a low cost product• Add value to your brand and provide a competitive edge to your business• Your customer is towed back to you - work you may have missed out on

• Replace damaged chains and slings immediately and attach danger tags on the old chains and slings to prevent re-use

VACC recommends that members consider replacing slings annually instead of the annual testing. The cost of testing the sling is the same or at times more than purchasing a new one. In most cases, slings take on more damage as they are made from fabric and fibre, and rarely make it to a year old without being damaged. Members should retain invoices and track the age of the replacement slings on the lifting register.

‘Keeping in touch’ days are available to an employee absent on unpaid

parental leave (with an employer’s agreement) but the taking of such days is not mandatory. An employee is entitled to a maximum of 10 keeping in touch days. If a period of unpaid parental leave is extended beyond 12 months, an employee may take up to another 10 keeping in touch days.

According to the Department of Human Services, a paid work activity of one hour or more on a day counts as one keeping in touch day in the 10-day limit.

Accessing a keeping in touch day does not affect an employee’s period of unpaid parental leave.

What is a keeping in touch day?This is a day on which an employee performs work for an employer during a period of unpaid parental leave if:

• the purpose of performing the work is to enable the employee to keep in touch with his/her employment in order to facilitate a return to that employment after the end of a period of leave, and

• both the employee and the employer consent to the employee performing work for the employer on that day.

What restrictions apply?A keeping in touch day is usually worked at least 42 days after the birth of the child although it can be earlier if requested by the employee. It cannot however be worked earlier than 14 days after the birth.

Taking keeping in touch daysThe duration of work an employee performs on that day is not relevant. This means a ‘keeping in touch day’ can be worked:

• as part of a day

• on separate days

• several days at a time, or

• in one continuous period.

It should be noted an employer will be obliged, under the relevant contract of employment or industrial instrument, to pay an employee for performing work on a keeping in touch day.

A recent decision of the Fair Work Commission reaffirmed

that when a business restructures, and as a consequence needs fewer employees, this constitutes a redundancy.

The employer in this case needed to merge three administrative jobs into one. The new position was to be a combination of duties from the previous three jobs, with other duties transferred either to existing positions or a different site.

The employer held meetings with the relevant employees to discuss the proposed changes. One of the three employees then resigned, leaving the

two remaining to apply for the new position. Only one of the employees met the selection criteria for the new role and was successful in gaining the position. The other employee, although she was encouraged to apply for other roles within the company, chose not to do so and was made redundant. That employee then made an application for unfair dismissal.

The Fair Work Commission found that the business had developed a fair and appropriate selection process for the vacant position and that they had met the “reasonableness test” Further, the employer had consulted with the employees prior to making the

decision on making the employee. It was held that there was a genuine redundancy and no unfair dismissal had taken place.

‘Keeping in touch’ days during parental leave

What work can be performed on a keeping in touch day?According to the Fair Work Ombudsman, suitable activities on a keeping in touch day include:

• participating in a planning meeting

• performing on the job training

• performing work to become familiar with the workplace or the employee’s role before returning to work.

Government paid parental leave schemePerformance of work on keeping in touch days is also dealt with, for the purposes of parental leave pay, in the Paid Parental Leave Act.

Both the timing and taking of keeping in touch days during a period of unpaid parental leave is subject to mutual agreement of the employer and the employee.

25Many employers think that an injured

worker must be off work until they are fully recovered.

Fact:Early return to work coordination and planning is an important first step.

Fact:An injured worker does not need to be 100% recovered or have to finish their medical treatment before returning to work.

Fact:Following a doctor’s medical assessment, an injured worker may have some capacity to return to work and perform light duties.

Fact:The longer an injured worker is away from work, the less chance they have of successfully returning.

Return to work can be challenging for all parties involved, however there is well researched evidence that work is generally beneficial for health and wellbeing. On the other hand, being away from work for a long time, work-related disability and long-term unemployment have negative impacts on a person’s health and well-being.

Supporting employees to return to work

It is a team effort to achieve a speedy return to work after an injury. The employer, injured worker, treating medical team and insurance company also have a legal obligation to return an injured worker back to work.

What must members do?• Establish open communication

channels and maintain regular contact with the injured person

• Make every reasonable effort to accommodate and support the worker’s injury for 52 weeks

• Find light duties the injured worker is medically capable of performing

• Regularly discuss and review return to work planning and progress with the injured worker and treating medical team

• Manage issues as soon as they arise and talk through it with the injured worker, treating medical team and insurance company

• Seek specialised return to work assistance from a work rehabilitation provider if required

When an employee moves from part-time to full-time, it is not

uncommon for an employer to have difficulty working out what happens to their annual leave and sick leave entitlements.

When an employee changes the basis of their employment, there

is no change to their accrued leave. Leave is still payable at the base rate of pay. However in the future, the rate of accrual will be different based on the employee’s increased number of hours.

This means a part-time employee going to full-time employment may

not have enough annual leave or sick leave to cover leave for which they have applied. It will depend on the amount of leave available at the time the employee seeks to take leave.
