1. Legal and regulatory texts

• Interoperability Directive 2008/57, and its transposition into Belgian law (concerning the putting into service of rolling stock)

• Safety Directive 2004/49 modified among others by Directive 2008/110, and its transposition into Belgian law (concerning primarily the entities in charge of maintenance - ECM)

Technical standards

• TSI Freight Wagon of 2006 (decision 2006/861), modified on 23/01/2009 (decision 2009/107)

• TSI Noise of 2005 (decision 2006/66)• TSI Operations (decision 2006/920, modified by

2009/107 and 2010/640)• Ministerial Decree of 30/07/2010 adopting the

requirements applicable to rolling stock using train paths (National regulations applicable to rolling stock when the TSIs are not applicable)

2. Registration of freight wagons in the NVR

• Authorized freight wagons are registered in the NVR of the authorizing country

• Any change to NVR data is to be communicated to the NSA (for Belgium: www.mobilit.fgov.be - Rail - Informations pratiques pour les détenteurs de véhicules)

• ECM (certified or otherwise): obligatory data.

3. Mutual acceptance of freight wagons

• RIV: The previous system - still authorized to operate under the same conditions

• Directive 2001/16 modified by 2004/50: authorization per country

• Multilateral agreements: TEN RIV

• TSI Freight Wagon 2006 modified on 23/01/2009: TEN G1

• New TSI (2011) - Annex C voluntary

4.1 Construction of a freight wagon

• Designation of a NoBo by the applicant• It is advisable to consult with the NSA BE at the

start of the project.• Meeting with all project actors in the event of any

particularities• Project handled in accordance with the

Interoperability Directive - Authorizing the putting into service (including use of freight wagons) and registration in the NVR

4.2 Transformation of a freight wagon

• Submission of the project to the NSA BE for a decision regarding the putting into service

• If the brake performances are to be modified, the TSI Noise must be applied. In case of retrofitting only (K blocks), the noise levels as set in the TSI Noise are supposed to be respected.

• Decision taken, if necessary, according to the indications of the TSI Wagon.

• Project to be evaluated by a DeBo or NoBo, and authorization of putting into service by the NSA BE.

4.3 Sale of a freight wagon – Change of keeper.

- Keeper must consult with the future (foreign) NSA for registration of the wagon

- Keeper must inform the NSA BE of the registration in the other country

- NSA BE updates the NVR and stops the follow-up.

4.4 Withdrawal of a freight wagon

- The keeper must inform the NSA BE of the withdrawal

4.5 Registration of an existing foreign freight wagon

• If the wagon is suitable for international traffic and RIV or TEN marked (with probative documents): technical examination of the freight wagon, Belgian number, and registration in the NVR (including the ECM).

• If the wagon conforms to the TSIs but not cross-accepted: file presented and non-conformities examined. If examination is favourable, authorization of its putting into service in Belgium and possible inclusion of the B mark in the box listing the countries in which the wagon is authorized. Registration in the NVR (including the ECM).

5. Invoicing of NSA BE’s fees (for rolling stock)

(fees 2010)

• EUR 2 per year and per vehicle recorded in the NVR BE on 1 January.

• Issuing the authorization of putting into service: EUR 750.

• NSA BE’s fee for examining putting into service files: EUR 750 per day.
