VINNIE DIORIO IS OFTEN IMITATED BUT NEVER DUPLICATED
ALWAYS NV’D
They say imitation is the sincerest form of flattery. If that’s true, Vinnie Diorio of Richfield, WI is very flattered. Over the years, his various rigs have started trends that many have tried to imitate, in their own way, but as the catch phrase on the back of his trailer says, “Often Imitated, Never Duplicated.” His latest combination, seen here, is sure to start a few new trends, too. But at only 32 years old, Vinnie has not attained his level of success by being lucky or born into the “right” family – he has worked hard, taken a lot of chances, and, for the sake of not being taken advantage of in a cut-throat industry, been (in his words) a little arrogant and cocky.
Born and raised just outside of Milwaukee, Wisconsin, in a town called Sussex, Vinnie spent a lot of time while growing up at his grandparent’s dairy. Located between two gravel pits, Vinnie loved to watch the trucks roll by. At one point, he even put a CB in his tractor so he could talk to the drivers. At 14 years old, long before he ever got his license, he was driving a tandem axle Ford LN9000 grain truck to Milwaukee every other night to get supplies for the dairy. His grandma would go with him, just in case he got pulled over. Wanting to be cool right from the start, Vinnie
crudely wired up eleven lights down each side of his grain box, but for some reason he did not wire a switch up in the cab. So, whenever he wanted to turn them on or off, he had to pull the cover off the side tool box to get to the switch.
In high school, Vinnie got into wrestling. Over the next four years, he wrestled a lot, and earned a lot of awards. As a freshman, he took 5th place in the state championships; as a sophomore, he ended up in 2nd place; as a junior, he earned 3rd place; and as a senior, he won the state championships.
During his senior year, Vinnie got a job at a local company (Mindemann Trucking) working in the shop. The day he graduated from high school was also his 18th birthday, and that very day he went and took his road test, which he passed with flying colors, earning his CDL. When he got to work later that day, the owner, Ruben Mindemann, took Vinnie down to the local Freightliner dealer and bought him a brand new quad-axle FLD120 straight truck with a dump box to drive. Dropping the truck off at the painter to be lettered over the weekend, Vinnie asked his boss if he could do anything else to the truck. Ruben said, “Sure.” That was a dumb answer. On Monday morning,
Vinnie showed up for work in the new white truck, but now it had a fully-flamed hood!
Always known for keeping his trucks clean, Vinnie hauled sand and gravel for about two years. At 20, he switched over to pulling an end dump for his friend Jeff, bringing sand into various batch plants, all the while, just biding his time, waiting for his 21st birthday so he could really go trucking. As soon as he turned 21, he bought his first truck – an orange and red 1997 Peterbilt 379 extended hood with a 48-inch flattop – formed his company (Rollin Transport), and hit the road. He also bought a brand new MAC end dump and started running between Wisconsin and Illinois. After about a year, he sold the end dump and started pulling a livestock trailer for his friend Troy. Running all over the country, Vinnie loved it, but after almost three years, he got tired of being gone for weeks at a

time. About this time, he also got together with his future wife, Kim, so he had a little “motivation” to be home more often.
Still driving that orange and red Peterbilt, Vinnie bought a MAC flatbed and started hauling building materials locally (to Chicago) for Gary Goeman Trucking. After about a year, Vinnie got tired of the city traffic and switched gears again, buying a new grey and orange 2005 Peterbilt 379 from Clint Moore and yet another new MAC flatbed, but this one had curtain sides. After that, Vinnie’s business started to take off (his customers loved the curtain-side trailer). Before long, he had more work than he could handle, so he brought in his old high school friend, Kevin “Biggs” Pascavis, who drove for someone else, to help out. Pretty soon, as the work increased, Kevin’s boss bought more trucks and Vinnie kept them all busy. Eventually, he parked his truck and went to finding loads and dispatching 100% of the time. It was challenging work – and Vinnie loved that part – but he missed driving. At the peak of business, he was loading 20 or so trucks by himself and it was driving him crazy. When Kevin’s boss told Vinnie that he wanted him to cut his percentage, that was it. Vinnie pulled the plug and walked away, and Kevin went with him.
Buying a truck and trailer for Kevin, and then getting back in his, Vinnie called all of his friends and was able to keep most of that freight moving – and now he was back where he wanted to be – in the driver’s seat. Over the next few years, Vinnie and Kim would get married (2006), and Vinnie would buy several more trucks – and all of them would be ground-breaking and cool. Vinnie told us that he had never made the cover of any American trucking magazine, so this was special, but almost every one of his trucks has been on the Shell Rotella SuperRigs calendar.
His latest rig, the one you see here and on the cover and centerfold, was ordered as a glider kit through Clint Moore at Kansas City Peterbilt. After the truck was delivered in June of 2012,
Clint and his crew spent a month fitting it with a 2003 model C-16 Cat engine and the rest of the drivetrain. From there, Vinnie took the truck to T/A Truck Painting in Pewaukee, WI where it spent two more months being customized, and then he took it to the show in Joplin, MO where it made its debut. That is where we hooked up with Vinnie, shooting the truck in a local quarry. Our thanks go out to Jasper Stone in Jasper, MO and Mischa Gooch from 4 State Trucks for setting it all up.
The truck, which is a 2012 Peterbilt 389 with a 63-inch standup sleeper, is painted Blue Effect and Omaha Orange and has a custom stripe pattern designed by Jim “Higgs” Higgins. Featuring a 325-inch wheelbase, the truck was air-bagged on the front, a 12 Ga. “lift bumper” kit was installed, and the headlights were swapped out with double-squares with shaved blinkers. The cab lights were arranged in the typical “Rollin Transport style” (three in the middle and then one on each side by itself), the air bags behind the sleeper were hidden under the bunk, and 7-inch cab and sleeper panels, with rivets to match the other body panels, were installed.
Everything on Vinnie’s truck was smoothed out. All of the frame bolts were shaved, and a
smooth, painted deck plate was added. The guys at T/A ground down all of the weld beads on the fuel and air tanks, smoothed them out, and then painted them to match. The fuel filler caps, which are totally flush and smooth, are from an airplane. The truck was also fitted with strapless, painted air cleaners, a stainless drop visor, 8-inch Dynaflex pipes, painted half-fenders on hidden brackets, an oval-punched grille, and a painted “I panel” between the fuel tanks. Sitting on top of the deck plate, right behind the sleeper, is a small spoiler with the words “Jake Eilen – Roll On” written on it, in memory of his friend (and ours) that passed away back in 2008.
When the brand new truck arrived at T/A Truck Painting, they tore out the entire cab and sleeper interior and re-did everything. Wanting to remove the texture from the original dash, they took epoxy filler and smoothed it all out. After that, they painted the dash blue, all of the dash panels orange, and the steering wheel orange. The seats were reupholstered in orange and blue, as well as the door panel inserts, sleeper walls and overhead console. A 12 Ga. 2-stick shifter set-up was installed (the second stick is the splitter) with custom stainless sticks and blue glitter knobs. The guys at T/A also installed a

beautiful aluminum floor, painted blue with orange stripes, to match the truck’s exterior. A stereo, with two large subwoofers mounted under the bed, finished off the inside of this awesome rig.
Always wanting a “catch phrase” on his trucks, Vinnie put “NV’d” (envied) on the back of the sleeper. Kevin is still with Vinnie, and he is the lucky driver of this unit. Since he is the one who drives it every day, he jokes that the “NV’d” really stands for “Not Vinnie Diorio” – which gets a lot of laughs. Vinnie’s other popular catch phrase, “Often Imitated, Never Duplicated” is not only written across the back of his trailer, a 2008 MAC flatbed with a Quick Draw rolling tarp system and a 12-foot spread, but also on the floor inside the cab. Vinnie really likes his catch phrases!
On May 10, 2012 Vinnie and his wife Kim had a life-changing experience – their daughter Francesca was born! Because of that, Vinnie has not done much driving – in fact, his award-winning orange and grey 2005 Peterbilt 379 has been parked for almost a year now, as Vinnie has been focusing on keeping his owner-operators (and his two other trucks) loaded and moving. Vinnie enjoys spending time with his wife and new baby, and hardly misses going out on his custom Harley (since having the baby, Kim won’t even get on it anymore). To make up for that, the couple recently bought a 32-foot Fountain powerboat with twin 502’s that put out over 1,000 total horsepower. They only got it out a few times this year, but can’t wait until next summer (they even bought Francesca her own little life-jacket).
Rollin Transport, in addition to their own three trucks, currently has 14 owner-operators. Vinnie describes his outfit as a specialty flatbed company that primarily hauls steel products and
large machines – and no lumber. In addition to Vinnie’s parked truck and the one you see here driven by Kevin, Vinnie has another truck that is driven by his young friend, Todd Workman (22). Todd’s truck was one of Jake Eilen’s trucks, which Vinnie bought after Jake passed away. It used to be blue and silver with flames, but Vinnie rebuilt it last year and repainted it black, orange and grey (Jake’s favorite colors). The stripes on that truck were also designed by Jim “Higgs” Higgins.
Vinnie wanted to thank Jeff and John at T/A Truck Painting (and their entire crew) for all the hard work they put into this truck. He also wanted to thank Clint Moore and the guys in his shop, Jeff Battler and everyone else at 12 Ga. Customs (including Jim Higgins, who works there), his drivers, Kevin and Todd, and all of his awesome owner-operators who keep him in business. And,
mostly, he wanted to thank his wife Kim for all of the hard work she does, getting the paperwork done in the office, and for being so patient and understanding of his “sickness” for trucks.
Looking forward to showing off Kevin’s truck at many of the 2013 shows, Vinnie can’t rest too long – there is plenty of work to be done, and he just started another new truck project (look for this one to be finished around the end of 2013). It takes guts, determination, and sometimes a little arrogance to succeed in trucking, but that is how you get to a point where people want to copy you. We had a great time with Vinnie and Kevin in Joplin, and look forward to seeing his next ground-breaking rig. And, if history has taught us anything, many will try to imitate it, but none will duplicate it. And, Vinnie Diorio will be NV’d by everyone because of it!

GOLDEN STATE TRUCKING EXPO MAKES A COMEBACK
BEST IN THE WEST Last year, the Golden State Trucking Expo went dark and skipped a year as the show was reorganized under new management. This year, the show came roaring back, with some help from us at 10-4 Magazine. As the title sponsors of the truck beauty show portion of the event, it was very important for us to ensure that the best of the best trucks were there to compete, as well as some hot newcomers, and we were pleased that we were able to accomplish that goal.
Held on October 13-14 at the Fairplex in Pomona, California, this event did not break any records in regards to size or attendance, but it was, honestly, one of the most productive (and fun) shows we participated in all year.
Things got going early on Friday as the vendors moved in and set up their booths and the truckers got their rigs parked and started cleaning. At the end of the day, some vendors and all of the truckers were invited to a Mexican feast hosted by us at 10-4 and put together by the Sandvik Trucking crew and their family and friends. With plenty to eat and fun trivia games, it turned out to be quite a nice evening.
With many well-known companies like PDI, Lincoln Chrome, RoadWorks, Dynaflex, HushMat, Internet Truckstop, Double Coin Tire and more, along with almost a hundred others, there were plenty of booths to visit and people to meet. The show gave away hundreds of free die-cast trucks to CDL holders both days, and there were even some belly dancers entertaining the crowd.
The show’s “Best in the West” truck beauty contest featured some of the finest trucks the
west has to offer. With names like Maggini, Sandvik, Yamko, Brinker, JDT, Vermeer, Silva and PDI, many of the west-coast heavy-hitters (and one from Michigan) were there. In addition to the more well-known names and rigs, Jerry Salinas brought out his nicely-restored 1963 Peterbilt 281, Riddler Trucking and their green Peterbilt Transfer were lookin’ good, and Kelvin Monzon, our pick as the winner of the big and beautiful “Sponsor’s Choice” trophy made by Rockwood, was turning heads all weekend with his flashy Freightliner FLD wrecker.
This may not have been the biggest show of the year, but it has a lot of potential, and we look forward to being a part of it (and helping it to grow) for many years to come. We would like to thank Bud, Tom, Randy & Jona Rebillard, Bill & Marie Sandvik, Carl Carstens at Rockwood, and everyone else who helped put this show together and allowed us to be such a big part of it. We would also like to extend a special “thank you” to James Davis’ daughter Lexi and Steve Vermeer’s son Travis for helping us out in our booth. Next year’s show is sure to be even bigger and better, so don’t miss it (stay tuned for dates).

EXHAUST MANIFOLDS Not all exhaust manifolds are created equal. In fact, they aren’t even close. There seems to be some confusion in the industry as to which manifold is the best and where they are manufactured. I can tell you this – if it doesn’t say “Made in the USA” it’s not made here and is usually made in China. It is illegal to say “Made in the USA” if it’s not made here. So, if you have purchased an exhaust manifold that doesn’t say that, then you were taken advantage of. The rest of this article is going to tell you how we build our American-made exhaust manifolds, and it may get a little technical.
WestartoutbyÀow-testingastandardfactoryOEM(overseasmade)manifoldonaSaenzS-600Àowbench.Next,weÀow-testthehead, to seehowmuchair is Àowing through it, to see if the stockmanifoldwillbesuf¿cient.Usually,itdoesnothaveenoughÀowfora500-hp engine, so we design the new manifold on a computer using acomputer-animatedÀowbench tomatch theÀowcoming fromthehead. The computer allows us to simulate the cylinder pulses and measure the velocity of the exhaust. This is why our manifolds allow the turbo to respond quicker to the movement of the throttle.
Oncewehaveestablishedadesign,wethenprint theexhaustmanifoldona3Dprinterthatmakesafunctionalpartoutofplastic(seephoto).WethenputtheplasticmanifoldontheÀowbenchtocon¿rmour¿ndingsonthecomputer.Now,it’sofftothefoundrytomakethe¿rstmoldandpourthe¿rstcasting.Afterthecastironcools,ithastobemachinedandre-testedontheÀowbench.Anychangesthatneedto be made are done at this time. These “Made in the USA” manifolds are made of a high-silica moly that has the correct metal properties to ensure strength and proper elongation so the exhaust manifolds
can expand and contract and still hold their shape without cracking, leakage at the joints, or breaking of the mounting bolts.
Now the manifolds are ready for the heat-treating process, which is a process that lines up the molecules in the high-silica moly cast iron. The overseasmanifoldsareNOTheat-treated,andthatiswhytheybreakbolts and studs. After heat-treating, the manifolds are machined and then hand-ported to guarantee the exhaust is turbulence-free. This also allows the turbo to respond quicker to the input from your right foot.Onceagain,theexhaustmanifoldisinstalledontheÀowbenchtomakesureweobtain thecorrectvelocityand20%(ormore)Àowthanonthestockmanifold.Ata20%increaseinÀow,theexhaustgastemperature(EGT)willbe125degreeslowerandthefuelmileageandhorsepowerwillincreaseby5%.The¿nalstepistheceramiccoating,which is then buffed to a shine. We are the only exhaust manifold manufacturer that can make these claims. Remember to look for the “Made in the USA” logo on the center section of the manifold, because that is an important piece of information.
After 25 manifolds have been poured, a test bar of the cast iron is poured and then the metal properties are checked. A log of all of thebatchesofcastironhasbeenkeptsincewemadeour¿rstexhaustmanifold. Nobody else in the entire world does this, but it helps us to maintain quality and consistency in our products. Jeff Knott (35) of Omaha, Nebraska bought this 1979 Freightliner cabover farm truck for a mere $1,250 so you can imagine what it looked like. While working full-time as a mechanic, he restored this truck, spending over 37 hours alone just on the grille, polishing the original to make it look brand new. Now, he runs it in the evenings, after his full-time job, pulling containers. Basically, in the process of preserving this wonderful piece of history, this young man created a job for himself. PDI HOSTS 3RD ANNUAL EVENT - BY FABIEN CALVET

Once again, for the third year in a row, beautiful St. George, Utah was the site of the annual Customer Appreciation Dyno Event & Pride and Polish Contest hosted by Performance Diesel Inc. (PDI). Held Friday and Saturday, November 2nd and 3rd, this show, which this year was an official stop on the 2012 Pride & Polish truck show tour, featured perfect weather, about 35 trucks, vendors, food and more.
Last year, the folks at PDI added a truck show beauty contest to their dyno competition, and this year, that part of the event got even bigger. Being part of a “national circuit” of truck shows drew in people from all across the country. On Friday, most of the truck beauty competitors spent the day getting parked, cleaning, and just hanging out with friends (or making new ones). After the sun went down, all of the trucks fired up their lights, hoping to impress the judges in the Light Show categories.
Saturday morning came quickly, as the judges began to walk the lot and mark their score sheets, searching for the cleanest trucks. All Pride & Polish events are considered to be “white glove” judged shows – which basically means that you had better clean every nook and cranny. At this particular event, they added a laid-back category for everyday work trucks called the
Wash & Show class. Several trucks opted out of the white glove judging and instead competed in this class. In addition to the competitors and their families, the entire PDI staff, and several vendors (who had set up displays at the show), there were also many people walking around the parking lot who had just came out to see the cool rigs. Everyone in attendance, on both days, was treated to a free lunch, courtesy of PDI.
PDI also had their pink and black “Breast Cancer Awareness” truck parked at the show, which will be raffled off at the big truck show in Louisville, KY this coming March. The folks at PDI have been selling raffle tickets for this truck all year, and all of the proceeds will go to the Breast Cancer Research Foundation. This cool (yes, pink can be cool) 2001 Peterbilt 379, which has been tricked out by a variety of participating sponsors, has an estimated value of $80,000. Like every year, the standout event at this show is the dyno competition. After chaining the trucks down inside the dyno building and hooking the machine up to the truck’s computer, the truck is fired up, and then the dyno proceeds to place a load on the engine. Crowds stood outside the dyno bay and cheered as the trucks blew thick
black smoke and screamed loudly – you could “feel” (as well as hear) the power, for sure. The results were pretty incredible, too. Kurt Murray’s Detroit-powered red Peterbilt logged a whopping 1,529 horsepower, making him the “King of the Hill” at the competition. Another strong finisher this year was Don Ipson (last year’s “King of the Hill” winner), whose Cat-powered rig registered an awesome 1,444 horsepower, putting him at the top of the Caterpillar class.
Some of the notable winners in the beauty contest included Paul Marcotte, who came all the way from Momence, IL to show off his black and red 1999 Peterbilt 379 and polished Heil tanker (he won a ton of big awards), Cody Madsen of American Fork, UT who bagged the 1st Place trophy in the Wash & Show Bobtail class with his yellow 2007 Peterbilt (and “the big trophy” in the Cummins dyno class), and Tommy Larsen of Ryan’s Feed in Santa Ynez, CA. Showing Ryan Hooten’s black cherry 1995 Peterbilt 379 hooked to double hay trailers (our February 2008 cover truck), Tommy took home several trophies for his efforts. Another big winner was Josh Skidmore of Brigham City, UT – his 2007 white and yellow Peterbilt Legacy earned four awards, including Best of Show Working Bobtail. This event was a real success, and I hope to be there again one year from now at the next PDI show and dyno contest. The 2012 winners were:

TIRE CHAIN REQUIREMENTS
Q: What is the law about carrying tire chains on a CMV? I have always believed that the law says that you must carry chains, whether used or not, from October 31 to March 31. I have been all through the FMCSR’s and can ¿nd nothing. My Àeet manager says only certain states require chains to be carried. Who is correct, and where do I ¿nd the info? Thank you – James in Missouri
A: Provided by Senior Trooper Monty Dial (Ret.), Texas Highway Patrol, Commercial Vehicle Enforcement Division, Garland, Texas: You could read the DOT Regulation Handbook again and you will come up with the same answer again. There is no DOT regulation that requires a commercial motor vehicle to be equipped with tire chains. It is, however, a law that some states require CMV’s to carry and use them. LOGBOOK PAGE SEIZED BY TROOPER
Q: One of my co-workers was recently stopped by a Washington State Trooper. After the stop (and a citation issued for a stop sign violation), the driver found that the trooper had torn out the carbon copy of the current day’s log. The trooper never even told my co-worker that he kept the page. Since he was only about 50 miles from his terminal, the driver simply made a photocopy for his records. Is what the trooper did legal? Thanks – Bob in Oregon
A: Provided by Of¿cer Jaime Nunez, California Highway Patrol, Commercial Vehicle Section, Sacramento, California: Section 395.8 of Title 49, Code of Federal Regulations, contains an interpretation that is relative to this issue. In question number nine of the interpretation, it is asked whether a duplicate copy of a record of duty status can be submitted if an original was seized by an enforcement of¿cial. It is clear from the interpretation that enforcement of¿cials may seize documents. In California, case law allows for the seizure of a logbook page by an enforcement of¿cial. Additionally, a driver must prepare a second original record of duty status to replace any page taken. The
driver should note the ¿rst original had been taken by an enforcement of¿cial and the circumstances under which it was taken.
HAZ-MAT RECORD KEEPING
Q: Am I correct that as a haz-mat carrier of explosives, I can destroy bills of lading after just one year of accepting the load? Thank you in advance – Rick in Illinois
A: Provided by Jim Brokaw, formerly a Staff Sergeant with Nebraska State Patrol, Carrier Enforcement Division, Lincoln, Nebraska: Yes, you are correct, except for hazardous waste. You’ll ¿nd your answer in 49 CFR 177.817(f), which states in part: “For hazardous waste, the shipping paper copy must be retained for three years after the material is accepted by the carrier.” For all other hazardous materials, the shipping paper copy must be retained for one year after the material is accepted by the carrier.
UPDATE ON DVIR REQUIREMENTS
Q: Back in your June 2012 column you said that drivers are no longer required to keep a copy of the previous day’s DVIR in the truck. If that is true, why are drivers still getting DVIR violations during roadside inspections? Thanks – Dan in California
A: Provided by Sgt. Pete Camm (Ret.), California Highway Patrol, Sacramento, California: That is a good question. I checked a federal website and found more than 4,000 violations were recorded during this federal ¿scal year (October 1 through September 30). If a DVIR is not required to be carried on a CMV, why are there so many DVIR violations being recorded? The best answer is many motor carriers and/or drivers use and carry paper logbooks that contain a DVIR on the bottom or reverse side of the logbook pages. If the original DVIR is still in a driver’s possession (or on the logbook page), it is still required to be ¿lled out as speci¿ed in Title 49 CFR 396.11 of the regulations.

Weird & Wonderful Old Time Trucks

Sheldon Endy of Walnutport, PA first bought this 1946 Dodge WFM 35 in the early 1970s. All he needed was a right-hand side windshield wiper motor for his 1947 Dodge pickup, but the owner insisted he take the whole truck for $25. He stored the 1946 Dodge in a friend’s barn after he removed the wiper motor – he had no intention of restoring the Dodge because Mack trucks are his first love. A few years later, he sold the Dodge
to a man who never came back to pick it up. Two years later, Sheldon sold it again, but bought it back when that buyer got divorced shortly after and couldn’t keep the truck. Buyer number three purchased the Dodge in 1982, but called Sheldon five years later when he lost the lease on the garage where the truck was stored and offered it back to him at no cost. So, for the fourth time, Sheldon was the owner of the 1946 Dodge. In 1989, he decided to restore the Dodge since he seemed destined to keep it. His favorite hobby is the equipment that moved railroad circuses from the 1920s to the mid-1950s, so he decided to restore the Dodge as a railroad circus water truck. The restoration became a two-year project – Sheldon did the mechanical work with help from a friend who did the body and paint work. The two-ton cabover has a four-speed manual transmission with a single-speed, full floating hypoid rear differential, a six-volt electrical system, and the 7.50 x 20 tires rest on a 107-inch long wheelbase. Since the restoration was completed, Sheldon has displayed his circus truck at many truck and car shows. It appears that this unique old Dodge truck has finally found a permanent home!

Words of Wisdom From SharLeigh
Over the years, I have written about the various holidays in December and the many ways to enjoy your family and friends during these festive times (and how to avoid holiday woes). But, this year, I want to express my heartfelt views by sharing with you a poignant Christmas carol that was written over 1,000 years ago called “The Holly and the Ivy.” The author of the lyrics and composer of the song are long forgotten, but the reason it has survived for centuries is the way the song’s lyrics convey the true meaning of Christmas:
The holly and the ivy, when they are both full grown; of all the trees that are in the wood, the holly bears the crown (Christ’s love for us). Household movers and brokers that try to hold customer shipments hostage will now face stiff penalties and lengthy suspensions under a new policy issued by the FMCSA. The policy was announced earlier last month just weeks after a Senate probe denounced a portion of the household goods brokerage industry for intentionally deceiving some of their consumers. FMCSA said it could ¿ne them up to $10,000 per day, per violation, and suspend those exhibiting “patterns of violations” for up to three years. The policy applies to carriers and brokers that knowingly break a contract and fail to deliver a shipment that has been paid for, FMCSA said.
Paul Oakley, senior vice president of government affairs for the American Moving & Storage Association (AMSA), said that his organization supports FMCSA’s actions. “More and more people go to the Internet, ¿nd a nice website, and then get somebody on the telephone who asks how many rooms are in the house,” Oakley said. The broker then quotes a price, based on the number of rooms, for say $1,800. The customer then sends the broker or mover the $1,800. When the mover shows up, he might say he can’t move the load for $1,800 or he might wait until the truck is loaded and then tell the customer that the price is now going to be $4,500. Then the mover says, “I’ve got your stuff, what are you going to do?” Oakley said, “Unfortunately, it happens all the time.”
The Senate investigation, made public at a September 19 hearing of the Senate Commerce Committee, concluded that it’s common for brokers to leave consumers with bills from carriers that do not match estimates. “Committee staff found multiple examples of price increases for thousands of dollars with very little justi¿cation for the increases,” the Senate report said. Oakley said the new transportation funding law gives FMCSA the power to require that hostage goods be returned to the shipper, but that power is not speci¿cally included in this new policy. “This policy is just about suspending the carrier that’s inappropriately holding the goods hostage and ¿ning them.”
Another provision AMSA was pushing for in this latest transportation bill included establishing a consumer assistance program, a joint federal-AMSA project to give real-time advice and counseling to victims of rogue movers. AMSA also wanted FMCSA to hire more inspectors. Oakley said at one time there were 70 to 100 inspectors dogging bad household goods operators, but that number has now dwindled to only about 10.

VIOLATION HISTORY
In a recent case before the Occupation-al Safety and Health Review Commission (OSHRC), the issue of whether or not an employer’s legal identity precludes the Secretary of Labor from attributing violation history to the successor company was addressed. Speci¿cally, OSHRC ruled that although the companies may have distinct legal identities, the successor company can be cited for a repeat violation if the predeces-sor company had been issued a citation for the same violation in the past.
This issue was raised shortly after a contractor – one that provides a variety of construction services such as roo¿ng and painting – was installing a metal roof on a town maintenance building without using proper fall protection and one of the workers was injured when he fell off the roof.
Following an inspection of the work site, OSHA issued two citations to the successor company under the Occupational Safety and Health Act of 1970, one alleging a willful violation of 29 CFR 1926.501(b)(11) and the other a repeat violation of 29 CFR 1926.503(a)(2). OSHA based the repeat violation on previous violations of the same standard by the predecessor company, which was owned by a sole proprietor who had ceased operations just six weeks prior to the formation of the new company.
OSHRC concluded that the statutory language in section 17(a) of the OSH Act is most reasonably read to permit, in the appropriate circumstances, the Secretary’s application of a “repeat” characterization to cases where the cited employer has altered
its legal identity from that of the predecessor employer whose citation history forms the basis of that characterization. Such an inter-pretation is not only consistent with the Act’s purpose, but also ensures the effectiveness of its enforcement scheme.

RADAR UNVEILED
Indiana State Police have demonstrated a new weapon to help reduce crashes caused by drivers who speed, follow too closely, and change lanes unsafely. What looks like a traditional hand-held speed monitor, the LTI 20/20 Lidar has brand new “distance between cars” software that can measure and record both how fast a vehicle is traveling and exactly how close it is to the vehicles around it. Even in a big group, this device can clock one speci¿c vehicle.
The laser beam bounces off the car, semi or motorcycle and returns to the device. As the information processes instantly in the Lidar device, a photo of the vehicle is taken, along with a video that records the exact time and distance. The images in the still photos and video are so sharp that the face of the driver is readily identi¿able. The information on the vehicle is immediately forwarded to another ISP unit to make the traf¿c stop.
Although it’s not required, the state trooper can show the still photos and video to the driver on a computer. The images are downloaded within seconds to the troopers’ onboard computer, making it hard to contest the violation. It’s quite impressive in court, too, because people can’t say, “That was my car, but I wasn’t driving it,” or, “Someone took my car.” The units only cost $5,500 each and I would imagine that if the Indiana State Police have good results with them, you will be seeing these used all over very soon.

This month’s cool “creation” was built for Ron Stokes of Prince George, BC (Canada). Needing to comply with Canada’s modest length laws but still wanting a good-looking standup truck, Ron and Clint figured out how to make it happen, but it wasn’t easy. But if someone wants something a certain way bad enough, and they are willing to be patient, anything is possible!
Ron Stokes (43), the son of an electrician and welder, did not grow up in a trucking family. He was always interested in trucks, but there was no family connection. Apparently, Ron was not very savvy with the ladies growing up, so his mom told him that he had better learn how to cook so he didn’t starve to death. After high school, Ron went to culinary school and became a certified red-sealed chef, but he hated being inside all of the time (he also came to the realization that he was only qualified to earn minimum wage).
Wanting a better life, and to be outside more, Ron went out on road, hauling logs with his friend Roger Grieve, in the woods north of Prince George. Roger taught him the ropes (and how to drive), and then he got his license. Ron hauled logs for six or seven years and then bought his first truck in 2003 - an orange 2000 KW W900L.
This truck ended up being your typical “used” truck, which tested him repeatedly but taught him a lot, too. He drove that truck until he bought a new Legacy Edition Peterbilt 379 in 2007.
Being a bit of a truck picture junkie on the Internet, Ron found pictures of some trucks Clint had built and decided to order his next one from him. Ron wanted a “classic-looking” truck with a standup sleeper, but he didn’t want it to look stubby and short, because of Canada’s modest length laws. Clint had the idea of ordering a 388 Peterbilt with the car-hauler setup (everything is lowered to accommodate the roof rack), but the factory did not want to put a standup sleeper on one of these trucks - so Clint built it himself.
Ordering a standard Peterbilt 388 with a 63-inch standup sleeper, the guys at KC Peterbilt replaced all the mounts and lowered the cab and sleeper about four inches. Clint then ordered a new car-hauler hood, which is shorter and lower, and not sloped - it is flat. In the end, they had a perfectly-proportioned truck that looks like a regular 389 with a long hood, but it isn’t. It’s a 388 with a short hood and a modest wheelbase, but everything looks just right - which is where the name “Mistaken Identity” came from.
MISTAKEN IDENTITYTHE LATEST PROJECT FROM CLINT MOORE
The brown truck was painted with a classic “swoop” paint scheme using gold and orange colors that Clint picked out, and was then fitted with one of Clint’s visors with a chrome strip on the bottom. They also installed flush cab lights, painted body drop panels, Shift rear fenders, dummy pipes (it has a weed-burner exhaust), extra lights, and a custom rear light bar. Clint’s dad chopped the air cleaner screens, and then the guys in the shop painted the fuel tanks, hid the urea tank, and painted the dash panels.
Happily married since 1991, Ron and his wife Filomena have two kids - a daughter named Izabella (15) and a son named Nathan (13). Ron still enjoys cooking and is meticulous about how he presents his culinary creations, so he and Clint really hit it off. As you can see here, Clint is pretty particular about his “creations” too!

DON’T BE SAD!BY “DOCNURSE” NORMA STEPHENS HANNIGAN
~ Dr. Norma Stephens Hannigan is a Doctor of Nursing Practice who teaches at Columbia University in New York, NY. Dr. Norma has treated many truck drivers at the various clinics she has worked in over the years. She currently writes for 10-4 Magazine from her home in Newburgh, New York.
Hurricane Sandy has come and gone, leaving huge devastation in its wake. Today, there is another Nor’easter predicted on the east coast. Last weekend, our clocks “fell back” to standard time so it won’t be so dark when we get up in the morning (but now it’s darker earlier at the end of the day). Hurricanes, snowstorms and changing the clocks are seasonal events we can expect each year. Winter is fast approaching and, with it, about a half million people may experience some new sadness or depression. This is a very real phenomenon associated with the seasons called Seasonal Affective Disorder, or SAD. Because it’s seasonal, you can expect that it will happen every year around the same time (sort of like the World Series, but not nearly as much fun.)
According to Mental Health America, an advocacy group for people with mental health issues, and the Mayo Clinic, SAD is caused by a lack of light. Light affects our normal daily body rhythms (circadian rhythms) such as sleep, production of hormones and metabolism – when there is less light, it may affect the way we feel since these rhythms are a little out of sync. The brain produces a chemical called melatonin which is related to sleep. This chemical can also be related to depression. When there is less light in the environment – that is, the darker it is – the more melatonin is produced, which may increase feelings of depression.
A person with SAD may find that he or she feels a lack of energy to do things, feels hopeless, worried about everyday things, and just wants to sleep (almost like animals who hibernate). They also may find that they are eating more, especially starchy carbohydrate foods, and, in general, don’t enjoy doing the things he or she usually enjoys. These are symptoms of the same depression a person might suffer any time of the year. The difference with SAD is that, for most people, it is at its worst during the winter months and tends to get better during spring and summer, when there is more sunlight. However, some people actually have SAD symptoms more in the summer – much of the way an individual reacts to light is what determines when that person will have worse symptoms.
It is more likely if you are a woman that you will be affected by SAD, but men and children of both genders can also have it. The typical age range for the onset of SAD is between 18 and 30 years old. Also, people with SAD are more likely to have a close relative who has some kind of a depressive disorder or alcoholism.
Since lack of light is what seems to cause the problem, exposure to increased amounts of light can help you feel better. Some people can relieve their symptoms by just turning on more lights in their house and/or making sure the blinds or curtains are open to allow more natural light into
the room. There is some evidence that walking for an hour per day is as effective as spending some time in phototherapy (light therapy) – these are special lights used for treating SAD. Some of these might even be paid for by your health insurance (if you’re fortunate enough to have some), since it is a treatment, just like a medication or a brace. If not, they can be bought without a prescription.
The fluorescent therapeutic lights for treating people with SAD are usually housed in a metal box with a plastic shield that diffuses the light rays. The light should be near eye-level because it is the light falling on the retina inside the eye that helps to relieve the depression. According to NAMI, the National Alliance for Mental Illness: 1) a light box should be capable of delivering 10,000 lux at eye level; 2) daily sessions of 20 to 60 minutes may be needed. At 10,000 lux – the current standard – 30-minute sessions are most typical. If your light is 5,000 lux, you will need 60 minute sessions; and 3) most people with winter depression benefit by resetting their internal clocks earlier, which is achieved specifically with morning light exposure. But, the optimum time of light exposure can differ greatly with people. The Center for Environmental Therapeutics, a professional nonprofit agency, offers an online questionnaire on its website (www.cet.org) which can be used to calculate a recommended treatment time for you.
You need not imagine yourself sitting and staring blankly at a light box. You can do the things you would normally do, like reading, sewing, playing cards or watching TV while sitting near the light. Most people do not have any side effects from the light therapy, but, if they do, they are usually mild, such as headache, nausea and/or irritability.
There is one very important caution about using phototherapy (light therapy) for SAD – if you have bipolar disorder (sometimes you are over the top active and happy and other times you are so depressed you can’t get out of bed), light therapy can increase the possibility of your switching between mania and depression. If you think you might have bipolar disorder, please don’t use light therapy and see a mental health professional who can help you get it under control with medications and counseling.
Other things you can do to fight off depression are exercising, eating more vegetables and high fiber foods, and laughing. If you still have the same symptoms, in spite of increasing your exposure to light and trying these other suggestions, consider seeing your regular health care provider or a mental health provider. Together you can decide if your symptoms are severe enough to need medications during the times of year when you are most affected.
Remember, if you are feeling SAD, consider lighting up your own life. And be sure to enjoy the various festivals of light to come in these winter months (see photo) – even if you’re not feeling blue! Happy Holidays!!

For B-D Oil of Idaho Falls, Idaho, trucking isn’t just business – it’s a family affair. Driver and family member Jason Morton is seen here with the Àagship unit of their three-truck Àeet – a 2007 Peterbilt 379 pulling a beautiful (and matching) Heil tanker which, together, makes for one colorful combination that is truly a unique and very cool ride!
We ¿rst met the Mortons at a truck show held in Nampa, Idaho. Impressed with their rig, we decided to set up a full photo shoot after the Great Salt Lake Kidney Kamp Truck Show, held outside of Salt Lake City, Utah, the following month. We enjoyed spending time with the Mortons at the Salt Lake truck show, swapping driving stories and talking about the truck. They’re a great family to spend time with, and are always willing to help those around them. After a strong performance at the show, we cruised out to a local steel mill to take our pictures (special thanks go out to Cody Madsen
for letting us know about and getting us into the steel mill) – its dark, industrial atmosphere was a perfect backdrop to the polished-out B-D Oil tanker.
Born and raised in Idaho Falls, ID, Jason Morton (37) is the son of B-D Oil’s owner, Terry Morton (57), who has been operating the company for over 20 years and has owned it for the past seven years. Jason has driven trucks professionally since he was 18 years old, following in his father’s footsteps, who has been a driver for his entire life (by the age of 20 Terry already owned two trucks).
Jason’s driving career had humble beginnings, learning to drive from his father in a 1979 Kenworth cabover and conventional, hauling liquid fertilizer. Following this, Jason went on to drive trucks for drag racing legend John Force for 10 years. After spending a decade traveling across the country to races, Jason returned home to drive for his father at B-D Oil. With a Àeet of three
bright orange rigs, B-D primarily hauls gas, diesel fuel, and motor oil in Idaho, Utah, Nevada, Montana, Wyoming and Colorado. Occasionally, when the trucks aren’t hauling fuel or oil, they sometimes pull Àatbeds and grain haulers.
In an industry where image plays a big role in your interaction with your customers, B-D Oil has nailed it with their bright orange Àagship 379 Peterbilt. Motivated by a turned-up, 590-hp ISX Cummins (thanks to PDI in St. George, Utah), the truck is also equipped with a 13-speed Eaton transmission routed to 3.70 rear gears. Stretched-out to a very tasteful 270-inch wheelbase, the truck sits on 22.5 low-pro tires all around.
If the color alone isn’t enough to grab your attention, plenty of other things on the truck will. Featuring a 13-inch painted visor, the truck also has a 22-inch stainless American Eagle front bumper, as well as stainless 8-inch stovepipe exhaust stacks and polished stainless steel Vortox air cleaners. Other stainless equipment on the truck includes a Peterbilt oval-punched grille, full rear fenders, and a homemade rear light bar. With an aluminum diamond plate deck plate, the truck also has cab and sleeper drop panels, as well as Fibertech drop front fenders. The truck, wrapped in a color that Jason describes as just orange, also has 42 LED lights. Interior features include orange dash panels and polished gauges, as well as carbon-¿ber accents. Kept simple and spotless, the interior is neither gaudy nor boring.

The Mortons are big fans of the Denver Broncos football team, especially Lisa, Terry’s wife, which accounts for the bright orange color on all of their rigs. Their support for the Denver Broncos goes even further on their rigs, which feature a large Denver Broncos logo on the back of each sleeper. Ironically, however, Jason’s wife, also named Lisa, is a former Dallas Cowboy’s cheerleader. As we were told, game-day can be quite an interesting event at their house, with the family’s support split over the Broncos and the Cowboys.
The truck has a very squat and stout appearance, which is appropriate considering the 12,000-gallon 2010 Heil four-axle tanker the truck pulls. Painted to match, the polished tanker sits on 22.5 low-pro¿le tires covered with polished aluminum fenders. Kept as clean as the truck, the trailer is an equally-impressive unit. Keeping things in the family, B-D Oil is proud that all of the work (except for the paint) was handled in-house.
The trucking, however, doesn’t end at father and son, as Terry’s wife Lisa drove trucks for many years, as well. With Jason’s 2-year old son, Landon, who already loves trucks, trucking will certainly remain in the Morton family blood for more generations. When the family isn’t driving, handling the B-D of¿ce or working on their trucks, they enjoy RZR riding (a type of all-terrain vehicle), camping, and, not surprisingly, going to drag races.
Jason would like to thank his wife, Lisa Morton, for all of her patience and support with trucking. Jason would also like to thank his father, Terry, and mother, Lisa, as well as Dennis at Classic Truck Collision Center and Chris at Idaho Falls Peterbilt. And don’t think for a moment that the truck featured here is just a show piece that doesn’t get out and work. Since the Salt Lake show, their rig has been making the rounds, hauling fuel, motor oil, and even hauling grain in and out of the ¿elds, on a daily basis. Their rig gets as dirty as any other when it’s out working, but the Mortons never allow it to stay that way for long. Their rigs are their image, and in trucking, image is who you are and what your company is all about. And with an image as good as B-D Oil, we are happy to feature them in 10-4.

When “Superstorm Sandy” hit the east coast it was called a “Perfect Storm” because of its powerful combination of the hurricane, a full moon, high tide, and a cold front coming in from the west, all at the same time. Hurricane Sandy caused an estimated $52 billion in damage (second only to Hurricane Katrina) and killed 209 people in seven countries along her path. When Sandy hit New Jersey and New York on October 29, she was classi¿ed as a “post-tropical cyclone” with hurricane-force winds that left devastation up and down the eastern seaboard. But, no matter how many photos you see, it’s not the same as standing there and looking at the damage ¿rst-hand, which I had the opportunity to do less than a week after Sandy hit. That is when you realize the true power that “Mother Nature” really has.
The severe cold front and snow that came in with the storm made things even worse, as many had no electricity (or heat). Entire cities were still without power, which quickly became an ugly reminder as to just how dependent we are of electricity. With power being so important, generators instantly became a hot commodity. Pete was called to take a generator from Mankato, MN to Long Beach, NY – a city on the south side of Long Island. It was a power-only job (no trailer was needed as the large
generator was on wheels), but the load required a team, so I went with Pete. We left home on Friday afternoon and by Saturday night we were already rolling into the most surreal place I think I have ever been in all my years on the road.
While we were picking up the generator, I found out that it was going to a pharmaceutical company that ¿lls prescriptions for in-home care patients. As of that Friday, they were over 30,000 prescriptions behind. I had never even thought about people needing to get their prescriptions, but since many companies only let you get a monthly supply of medications now (instead of several months), I could see how this could become a big problem – quickly.
As we got closer to New York City, things still looked relatively normal, with the exception of a few street lights out on a couple of ramps. There were signs saying that the Lincoln Tunnel was only open to buses and the Battery Tunnel was still completely closed. The Battery Tunnel was one of the hardest hit from the storm surge (both have since been reopened). We had to go around JFK airport, and planes were taking off and landing normally. But, once we started driving on Highway 27 along the southern coast of Long Island, we started seeing the signs of what had happened.
Arriving on Long Island around 9:00 pm, we saw lines of cars waiting to get gas. Police of¿cers were standing in the streets, directing the people in when it was their turn. There were also people standing in lines with two or three gas cans. I thought about how heavy ¿ve gallons of gas is and how hard it would be to carry two cans at all (never mind how far they might have to take them). About that time, Pete got a call that there had been a shooting at a gas station near where we had to deliver.
Before delivering the generator, we were ¿rst supposed to go to the local bus garage to ¿ll it up with fuel (they always ship them empty, but in this case I really wondered why). When we turned south on South Beach Street, we were in the dark. It was really eerie – the streets were completely dark except for the occasional place that obviously had a generator and fuel to run it. The street lights just hung there – no red, no yellow, and no green. After we went through a police barricade, we started to see boats just lying in the street. It was so dark.

We crossed a draw bridge and found the bus garage, but they decided that we should wait until the morning to get the generator fueled and parked.
When the sun came up, it was a beautiful morning. Will Foster, who was the supervisor on the job site we were delivering to, was kind enough to take me for a ride around the city to see the damage and get some pictures. The ¿rst thing I noticed was all of the sand in the streets – by now, much of it had been pushed into piles, but there were piles everywhere. Cars were sitting atop drifts of sand in underground parking garages and playgrounds were covered with piles of debris. People’s entire lives were just sitting on the curb, waiting to be picked up by garbage trucks. I also saw a lot of mattresses on the street and wondered where all of these people had to sleep now. One hopeful sign that I saw, which seems to be planted at the scene of every disaster, was an American Àag. The Àag, in all its glory, was stuck in a pile of sand littered with cement blocks and debris in the middle of the main street of town.
On our way out of town, we stopped to get a cup of coffee and there was a beautiful cocker spaniel named Al¿e. We had left our babies at home with a sitter, so I was really missing them. It made me feel good to see so many pets. I give Mayor Bloomberg big praise for his stand on pets – the taxi drivers were not allowed to refuse a ride to anyone who had a pet, as long as they were on a leash or in a carrier. To the people who love their pets, I’m sure there was some comfort in this fact. I can’t imagine going through something like this and then being told that I had to leave my pets behind, too. I think a lot was learned from Hurricane Katrina in regards to this issue. There was an animal rescue across the street from where we delivered the generator, and a sign on the fence said that all of the animals were safe and listed an address as to where they had been taken.
Once back in New Jersey, we had lunch with friends who told us about how people were going to the malls to charge their cell phones and computers in special areas that were set up for folks to plug in their various electronic devices. The malls had generators, and it gave people a warm place to go. Out
in the communities hardest hit, some people who had power strung extension cords out to the street with a note telling neighbors that they could use them for charging their phones and computers. You just don’t realize how important electricity is until you don’t have it!
Talking with our friends at High Wide & Heavy Escorts, John & Kim Incontrera, they told me that they were lucky and that their house hadn’t got much damage. But the area around them was pretty devastated. Looking to help, working with the Deputy Mayor and Emergency Management teams, they were able to volunteer their services and use their escort vehicles to deliver food, hot coffee, blankets, water, and anything else they could load up with at the staging area. Driving up and down the streets and announcing what they had to offer on their PA systems, they were able to provide a little relief to people who really needed it. Having worked with John, Kim, Paul, and several of their other escorts before this happened, I don’t think there are too many people that know these areas any better than they do – the police and ¿re¿ghters only
work one area, but High Wide & Heavy works the entire city and all of the islands. I want to thank them for talking to me – I know that these great people and this great company will be playing a vital role in the recovery and rebuilding of the entire area. I also want to thank Anthony Merillo, who just recently got engaged, for sharing pictures.
When I asked John if there were any railroads on the island, he told me that there is only commuter rails – there are no cargo trains at all – so it will take trucks (and plenty of them) to bring in all the supplies needed to rebuild in these areas (and to remove all of the sand and debris, as well). I hope that the east coast has a very mild winter to at least help with the rebuilding, because the last thing they need now is a hard winter and piles of snow to deal with. And with the Holidays upon us, I’m sure many people will be celebrating much differently than how they had originally planned them just weeks ago.
The east coast’s road to recovery is going to be long, hard and ¿lled with trucks. The roads out there are full of trucks on a “normal” day, but with all that has happened there will have to be even more. Sadly, for some people, it will be a very long time before anything is “normal” again – and for others, it will never be “normal” again, the way it was before the storm. But for those who are merely happy to be alive and safe, it just might be their most honest and sincere Holiday Season yet. I hope that all of you out there, no matter where you are, have a Merry Christmas and a safe and prosperous New Year!

The houses were covered, with holiday light,With trees in their windows, and families in sight.My Kenworth sang songs, in the chill of the air,The temperature gauge, said it’s dropping out there.
When out on the road, there arose such a clatter,A cross-link had broke, and a drag chain had shattered.The road was so slick, that I started to slide,I turned on the flashers, and pulled to the side.
I muttered some syllables, then gritted my teeth.Not looking forward, to crawling beneath.When what to my wondering eyes, should appear, But a big bellied man, with a snowy white beard.
“Have you ever hung chains, on a trailer this big?”I asked unaware, of the size of his rig.He looked kind of strange, in a suit mostly red,But I was relieved, at the words that he said.

December, already? Yikes! Christmas is quickly approaching, and I look forward to being home with my wife and our families to celebrate the holiday together (not just a holiday, but the day we celebrate the birth of our Lord and Savior, Jesus Christ). Christmas is very important to me, and it’s defnitely more than just gifts and fairy tales. I don’t mean to cram my beliefs down the throats of others, but I am very excited about my relationship with Jesus, and what He has done for us, purely because He loves us! I would love for everyone to enjoy the blessings and peace that comes from really knowing who He is. I admit, though, that I do like the cartoon specials, the decorations, and the whole vibe that comes with the Christmas holiday. Without taking my focus of of the true meaning of Christmas, I dig the typical American traditions we all remember – Santa Claus, reindeer, elves and such, are not what Christmas is all about, but they are fun to indulge in during the season. I love the songs, the stories, the poems, the gifts, and the warmth of being home with friends and family. I sincerely hope that you can be home for this Christmas, as well. This poem is clearly a loose parody of a very well-known Christmas poem known as “The Night Before Christmas” – I hope you enjoy it!
