Federal Constitution of the eSwiss Confederation

of the XX June 2013 (Day 2XXX)

Preamble

The people of eSwitzerland,

conscious of their responsibility towards their country,

resolved to reinforce democracy, independency and peace in a spirit of an opening towards

the rest of the eWorld,

determined to live together in its diversity and in the respect of the other and in equity, andthis under any circumstances,

conscious of their responsibility towards the future generations of players,

adopt the following Constitution1:

Title 1 General dispositions

Art. 1 eSwiss Confederation

1 The regions of Romandie, Deutschschweiz, Svizzera italiana and Graubnden form together

de jure the eSwiss Confederation.

2 Although a united republic under the eRepublik usages, the Confederation is attached to its

real-life roots.

3 The Confederation is a laic state, basing itself on the principal of the respect of all the

religions.

Art. 2 Aim

1 The Confederation protects all the fundamental rights of the people and the security of the

country.

2 It supports the diversity, the plurality, the development and the prosperity of the country.

101.EREP Federal Constitution

Art. 3 Democracy

1 Democracy is the fundamental principal of the Confederation.

2 It is expressed directly by the people by the election of Congress, by the election of the

President and by popular votations.

Art. 4 Languages

1 The official languages of the Confederation are German, French, Italian and Romansch.

2 English is used as working language in all the institutions of the Confederation.

Art. 5 Legality of the action of the Confederation

The federal authorities, the eSwiss citizens that hold eRepublik mandates and the

Confederation officials can only take action in the conditions that are provided by the

Constitution, the laws and the decrees that have been published for its purposes.

Art. 6 Responsibility

Each citizen is responsible of its acts.

Art. 7 Real-life and game

1 At all times, real-life prevails on the game.

2No citizen can be sanctioned for his inactivity if it is proved that his real-life impeached him

to be active.

Title 2 Fundamental rights

Art. 8 Equality

1 All citizens are all equal before law.

2No eSwiss citizen shall be discriminated because of its real-life origin, age, gender, sexual

orientation (declared or not), mother tongue, political opinion or religious opinions.

Art. 9 Communication

Every eSwiss citizen has the right to have access to the official country channel 2 on the

Internet Relay Chat (IRC).

Art. 10 Liberty of and from religion

The liberty of and from religion is guarantied.

Art. 11 Liberty of conscience

The liberty of conscience is guarantied.

Art. 12 Liberty of speech

The liberty of speech is guarantied.

Art. 13 Liberty of language

The liberty of language is guarantied.

Art. 14 Liberty of association

1 The liberty of simple association is guarantied.

2 The liberty of association in an aim to form a military unit (MU) is guarantied.

3 The liberty of association in an aim to form a political party is guarantied.

Art. 15 Education

The right to receive an education is guarantied.

Art. 16 Restriction of fundamental rights

1 The restriction of the fundamental rights is forbidden, unless its use threatens the security of

the Confederation.

2 The essence of the fundamental rights is inviolable.

Title 3 People

Chapter 1 General dispositions

Art. 17 Definition*

The eSwiss that has a minimum strength of 503 or that completed the Become an Adult

mission4 (Adult) citizens that have the right to vote are called the people.

Art. 18 Authority

1 The people are the supreme authority of the Confederation.

2 The people have the ultimate opinion on a decision that regards the Confederation.

3No Confederation administration can act against the will of the people once it expressed

himself.

Art. 19 Political parties

1 The political parties contribute to decision of the will of the people.

2No political party can force a member to vote in favor on a particular decision if its against

its will.

Chapter 2 Popular votationSection 1 General dispositions

Art. 20 Definition

A popular votation allows the people to give its approval or not on a law or constitutional

project or revision.

Art. 21 Acceptation

1

The project or the revision cannot be enacted if the people pronounced itself against it.2 The acceptation of the project or the revision is regulated by the present Constitution.

Section 2 Popular initiative requesting the revision of the Constitution

* with transitional dispositions3 for all the citizens born before day 18224 for all the citizens born after day 1822

Art. 22 Definition

A popular initiative requesting the revision of the Constitution is engaged when 40 Adult

eSwiss citizen made the deposit of their signatures to the Federal Chancellery, showing their

to support the initiative.

Art. 23 Deposit of signatures

1 The signatures must be deposited within a period of 30 days after the deposit of the request

to the Federal Chancellery.

2 The text of the initiative is accompanied with the signatures.

3 The Federal Chancellery verifies the validity of the signatures, the juridical and

constitutional validity of the initiative.

If the conditions of the third paragraph of the present article are satisfied, the FederalChancellery publishes the names of the supporters and the text of the initiative.

5No eSwiss Adult citizen can make the deposit its signature more than once in a period of

two months.

Art. 24 Acceptation

The popular initiative requesting the revision of the Constitution is accepted when the

requests provided at Title 6, Section 1 of the present Constitution.

Section 3 Popular referendum

Art. 25 Definition

The popular referendum is engaged when the government presents a project to the people.

Art. 26 Obligation of the government to present a popular referendum

The government is obliged to present the project to the people, by a popular referendum, forthe following situations:

- the adhesion to and the withdrawal from an international organization;

- the acceptation and the resilience of a treaty with one or more countries;

- the partial or total revision of the Constitution proposed by the government.

2 If the first paragraph of the present article isnt respected, the project is null and void and

cannot be applied.

Title 4 Federal authorities


Section 1 Eligibility and suffrage

Art. 27 eRepublik usages*

The eRepublik usages rule eligibility and suffrage of this present section.

Art. 28 Suffrage*

Any Adult eSwiss citizen of both sexes has the right to vote to all elections.

Art. 29 Party President*

Any eSwiss citizen member of a party that has a minimum of 300 Experience Points (EP)(level 15) has the right to candidate to be Party President (PP).

Art. 30 Congress member*

Any eSwiss citizen member of a party that has a minimum of 335 EP (level 16) has the right

to candidate to Congress.

Art. 31 Country President*

Any eSwiss citizen member of a party that has a minimum of 410 EP (level 18) has the rightto candidate to be Country President.

Section 2 eRepublik and Confederation mandates

Art. 32 eRepublik mandates

1 All mandates that are ruled by the eRepublik usages are called eRepublik mandates.

2 The eRepublik mandates are:

- Country President;

- Congress member;

- Party President.

Art. 33 Confederation mandates

1 The mandates and functions that are recognized as necessary to the Confederation are called

Confederation officials.

2 The Confederation officials are:

- Ministers;

- Speaker of Congress;

- Vice-Ministers;

- Federal Chancellor;

- Governor of the eSwiss Confederation Bank;

- Chairman of the Committee on Immigration;

- Members of the Committee on Immigration.

Chapter 2 Congress

Art. 34 Role

Congress is the supreme legislative authority of the Confederation.

Art. 35 Election*

1 Congress is elected on a proportional basis for one month, every 25 th day of each month.

2 It is composed of 10 Congressmen per region under the military control of the

Confederation, on the 24th day of each month at 00:00.

Art. 36 Prerogatives

1 Congress votes all the laws of the Confederation, on a simple majority majority vote.

2 Congress grants citizenship to the applicants to the eSwiss citizenship, on the order of the

Committee on Immigration.

3 Congress is represented to the Committee on Immigration.

4 Congress is entitled to engage, with the Chairman of the Swiss Confederation Bank, a vote

to declare a transaction unlawful; if such declaration is made, an impeachment procedure is

engaged against the President.

Art. 37 Inner communication

Congress members can communicate via an in-game message or on a separate forum.

Art. 38 Vote

1 Quorum for any vote of Congress is of half-plus-one of the elected Congress members.

2 A discussion can be held between Congress and the government at least 24 hours before a

3 If Congress agrees, the government can reduce the delay mentioned on the second paragraph

of the present article to 12 hours.

4 Congress is obliged to take at least 72 hours to discuss the total revision of the Constitution.

5 Congress is obliged to take at least 48 hours to discuss the partial revision of the

Constitution.

Art. 39 Speaker of Congress

1 The Speaker of Congress represents Congress, in its name, in front of the people and the

other federal authorities.

2 If Congress considers the function necessary after its election, it can elect a Speaker.

3 The Speaker is elected, amongst Congress members, on a simple majority majority two-

turns vote.

Chapter 3 Country President

Section 1 General dispositions

Art. 40 Role

The Country President is the chief of state and the supreme executive authority of the

Confederation.

Art. 41 Election*

1 The President is elected by the people on a simple majority vote, for a mandate of one

month, every 5th day of each month.

2 The President takes in office, after the verification by the internal services of eRepublik,

every 6th day of each month at 06:00.

The President appoints and removes from office the ministers.2 The President can appoint and remove from office one or more vice-presidents.

3 The President can appoint and remove from office one or more vice-ministers.

4 The President can create new departments or state administrations at his discretion.

5 The President uses the national funds to maintain the Confederations stability, security and

economical prosperity.

6 The President can use the national funds to maintain the Confederations allies security.

Section 2 Responsibility, censure motion and impeachment

Art. 43 Responsibility

The President is responsible in front of the people and in front of Congress.

Art. 44 Censure motion

1 Congress can launch a vote of a censure motion against the President and its government.

2 Before voting the motion, Congress must debate at least 24 hours.

Art. 45 Impeachment

1 If a censure motion has been voted against the President and its government, Congress canengage an in-game impeachment procedure against the President.*

2 The impeachment is accepted when 67% at least of Congress members voted in favor.

3 The President is dismissed as soon as the impeachment has been accepted.

4 The procedure is automatically engaged without a censure motion in the following

situations:

- high treason pronounced by Congress

- absence of more than three days without preannouncement

- abusive usage of the money present of the Confederation Bank5 Congress debates for 24 hours before voting in case of engagement of the impeachment.

Section 3 Absence

Art. 46 Definition

The absence is the impossibility of the President to communicate directly with the

government and the people.

Art. 47 Declared absence

The declared absence is the announcement of the President to the government of his absence

for a maximum period of 15 days.

Art. 48 Interim period

1 As soon as the President enters in his period of declared absence, the vice-president insures

the interim period and act as President in the period of absence of the President.* with transitional dispositions

2 If there is more than one vice-president, they act as a college to insure the interim period.

Art. 49 Undeclared absence

1 If the President is found absent without any preannouncement, the vice-president act as

President until the President comes back.2 If there is more than one vice-president, they act as a college to act the Presidents

prerogatives.

3 If the undeclared absence doesnt exceed three days in a row, the President cannot be

exposed to an impeachment procedure.

4 An impeachment procedure is engaged when the President doesnt communicate, via in-

game or any other methods, in a period of more than three days.

Chapter 4 Government


Art. 50 Role

1 The government is the executive council of the Confederation.

2 The government is placed under the direction of the President.

Art. 51 Composition

1 The government is composed of the vices presidents, ministers, vice-ministers.

2 The ministers are the chiefs of the different departments of the Confederation.

Section 2 Foreign Affairs

Art. 52 Definition1 The President can delegate to a minister the power to represent the Confederation abroad.

2 In such case, they share the representation of the Confederation.

Art. 53 Mutual Protection Pacts

1 The Mutual Protection Pacts (MPPs) are ruled by the eRepublik usages.*

2 The President, along with the minister in charge of Foreign Affairs and the minister in

charge of Defense, decides of the MPPs policy the Confederation has.

3 The President can present a MPP proposition to foreign countries.

4 Congress votes the propositions of MPPs from and to foreign countries.*

Art. 54 Embargoes

1 The embargoes towards foreign countries are ruled by the eRepublik usages.*

2 The President, along with the minister in charge of Foreign Affairs, decides of the embargo

policy adopted towards foreign countries the Confederation has.

3 Congress votes the propositions of embargo towards foreign countries.*

Art. 55 International organizations

1 The President and the government negotiate the adhesion to and the withdrawal from

international organizations.

2 The President or the minister in charge of Foreign Affairs can appoint any eSwiss Adult

citizen to represent the Confederation in international organizations.

Art. 56 International negotiations

Any ministers can be appointed to assist the President during international negotiations.

Art. 57 Embassies

The President or the minister in charge of Foreign Affairs can delegate the administration of

the Confederation embassies abroad to a separate office, governed by the Department of

Foreign Affairs.

Section 3 Defense

Art. 58 Definition

The President can delegate to a minister the military administration of the Confederation.

Art. 59 Chief of the Army

The President is the Chief of the Army.

Art. 60 Daily battle orders

1 The military Daily battle orders (DOs) are the recommendations that the government give to

all eSwiss soldiers.

2 The President or the minister in charge of the Defense publishes the government DOs.

3 The publication of the DOs can be executed each 24 hours, 36 hours or 48 hours.

4 If ever two different orders for the same period have been published by the President and the

minister in charge of Defense, the orders given by the minister in charge of Defense arelegitimate.

Art. 61 Army

1 The Confederation has a militias-based army.

2 The minister in charge of Defense is in charge of the administration of the Army.

3 Any other MU formed by eSwiss soldiers can be created, free to follow its own orders.

Art. 61a Reinforcement of the army

1 If a war has been launched to regain a territory de jure forming the Confederation, the

government can ask the Committee on Immigration to study in emergency the applicants that

are interested of fighting for the Confederation.

2 The Committee on Immigration cannot be forced to approve these applicants.

Art. 62 Resistance Wars

1 The Resistance Wars (RWs) are ruled by the eRepublik usages. *

2 The President, along with the minister in charge of Defense, adopts the Resistance Wars

policy to free the Confederation.

3 If a Resistance War has been launched, the President and the minister in charge of Defense

are authorized to finance, in money, food or weapons, single fighter or entire MUs to fight for

the Confederation.

Section 4 Home Affairs

Art. 63 Definition

The President can delegate to a minister the inner administration of the Confederation.

Art. 64 Immigration

1 The minister in charge of Home Affairs is in charge of the immigration policy of the

Confederation.* with transitional dispositions

2 The minister in charge of Home Affairs collects the citizenship requests and presents them

to the Committee on Immigration.

Art. 65 Representation to the Committee on Immigration

The minister in charge of Home Affairs is one of the government representatives to theCommittee on Immigration.

Section 5 Federal Chancellery

Art. 66 Definition

1 The Federal Chancellery is in charge of the collection of the signatures for popular

initiatives.2 The Federal Chancellery is in charge of the organization of popular votations.

Art. 67 Federal Chancellor

If the President doesnt appoint another eSwiss Adult citizen or minister, the minister in

charge of Home Affairs is automatically the Federal Chancellor.

Section 6 Finances

Art. 68 Definition

The President can delegate to a minister the financial administration of the Confederation.

Art. 69 Duty

The minister in charge of Finances is responsible for the financing of the different

Confederation administrations.

Section 7 Education

Art. 70 Definition

The President can delegate to a minister the educational administration of the Confederation.

Art. 71 Tutorials

1 The minister in charge of Education publishes tutorials for the younger and less experienceseSwiss citizens.

2 There is no time prescription or delay for the publication of the tutorials.

Section 8 Information

Art. 72 Definition

The President can delegate to a minister the information office of the Confederation.

Art. 73 Press releases

1 The minister in charge of Information publishes the different information releases that are

useful to the people.

2

The minister in charge in Information can publish releases for the Presidency or for thegovernment, on its request.

Art. 74 Questions

The minister in charge of Information has to answer the eventual questions of the eSwiss

citizens if the minister concerned or the President cannot respond directly.

Chapter 5 Swiss Confederation Bank


Art. 75 National funds

The Confederation national funds are stocked in the Swiss Confederation Bank (SCB).

Art. 75a External stocking

If the state of Political Take-Over has been declared, the national funds are transferred from

the Swiss Confederation Bank to eSwiss citizen, elected by Congress on a simple majoritymajority, for the period of the Political Take-Over.

Section 2 Chairman of the Swiss Confederation Bank

Art. 76 Definition

The Swiss Confederation Bank is run by a Chairman.

Art. 77 Duties and access

1 The Chairman of the SCB is in charge of the monitoring of the governments spending.

2 The Chairman of the SCB is in charge of the monetary transactions of the Confederation and

their recording.

3 The Chairman of the SCB has access to the national funds to ensure the regularity of the

transactions.


The Chairman of the SCB has the right to appeal to Congress a transaction that seems, to his

discretion, unlawful or unjustified.

Section 3 Election and removal

Art. 79 Election

1 The President or the Congress presents to Congress a list of candidates to the chair of the

SCB.

2 Congress debates during 48 hours before voting the candidates.

3 The Chairman of the SCB is elected on a half-plus-majority.

4 The President can veto the choice of Congress.

5 If the President has vetoed the first choice of Congress, Congress votes between the

remaining candidates.

6 The President cannot veto the second choice of Congress.

Art. 80 Removal

1 If either the President or Congress has the intention to remove the Chairman of the SCB,

discussions are held.

2 The President can remove the Chairman of the SCB if Congress voted its agreement with

simple majority majority.

3 The Congress can remove by itself the Chairman of the SCB with a 67% majority vote.

Section 4 Deputy Chairman

Art. 81 Deputy

1 The Chairman of the SCB can appoint a Deputy, with the approval of the President.

2 If the President and the Chairman of the SCB cannot come to an agreement, the Deputy is

elected following the procedure fixed by article 79 of the present chapter.


The Deputy has the same rights of access as the Chairman of the SCB.

Section 5 National funds

Art. 83 QuantityThe national funds are made of a minimum of 50000 Swiss Francs (CHF) at all times.

Art. 84 Aim of use

1 The national funds are used to insure the military security of the Confederation.

2 The national fund are used, if necessary, to insure the economic security of the

Confederation.

Chapter 6 Committee on Immigration

Section 1 General disposition

Art. 85 Definition

The Committee on Immigration (CoI) is the authority of the Confederation in charge of the

study, debate, vote and approval or refusal of the citizenship release to foreign citizens.

Art. 86 Independence

1 The members of the Committee do not respond of their votes.

2 The Committee is responsible in front of the people of the approval of the applicants.

3 The Committee cannot be constrained by the President or the government to accept an

application.


1 The Committee can approve or refuse the release of the eSwiss citizenship to foreign

citizens (applicants).

2 The Committee can declare Political Take-Over threat an applicant that has applied to the

eSwiss citizen.

Art. 88 Composition

1 The Committee is composed of four members and the Coordinator.2 The Committee receives two members that are nominated by the government, in which one

of them is the minister in charge of Home Affairs.

3 The Committee receives three members that are elected by Congress.

4 The minister in charge of Home Affairs publishes a decree making official the nominations

of the members of the Committee.

Art. 89 Duration

1 The members from the government sit for two months.2 The members from Congress sit for one month.

3 There is not limit for the number of consecutive mandates a member can have.

4 Each session of the Committee is renewed every 27 th day of each month.

Section 2 Coordinator

Art. 90 Definition

The Committee is presided by a Coordinator.

Art. 91 Election

1 The Coordinator is elected by the members of the Committee amongst themselves.

2 The vote is held in camera.

Art. 92 Prerogatives1 Apart from coordinating the deliberation of the Committee, the Coordinator doesnt have a

preponderant vote over the other members of the Committee.

2 If the Coordinator is in the incapacity of completing his prerogatives, the Coordinator may

transfer them to another member of the Committee.

Section 3 Procedure

Art. 93 Vote

1 Each member has one vote and can only vote once.

2No member can change his vote after voting.

3 Voting is executed in camera.

4No member can communicate the votes if the Committee didnt unanimously give its

approval.

Art. 94 Deliberation

1 The members can seek the information present on a separate form to which the applicant has

responded.

2 The Coordinator opens the votes for a period of 24 hours.

3 The Coordinator, on the request of the President or the government, can reduce the period to

12 hours.

4No decision can be taken if more than three members do not vote.5 The members of the Committee vote by Yes, No or Abstain.

6 An application is approved or refused on a simple majority vote.

7 If a majority of Abstain is voted, the application is accepted if more Yes are voted.

Art. 95 Communication

1 The Coordinator, when the decision has been taken, communicates to the applicant the

decision of the Committee.

2 If the refusal has been pronounced, the Coordinator isn't constrained to give a reason to the

applicant why the Committee refused the application.

3 The Coordinator communicates to the government the decision of the Committee.

Title 5 Political Take-Over


Art. 96 Definition

1 The Political Take-Over (PTO) is the act to overthrow the legitimate authorities of a

country.

2 For the particular case of Confederation, the PTO is the act to overthrow the federal

authorities:

- in the aim to take national funds and to transfer them out of the Confederation;

- in the aim to let foreign countries conquer the controlled regions of the

Confederation;

- in the aim to cause an economic crisis of the Confederation.

Art. 97 Foreign countries and foreign groups

1 The definition of PTO can be applied to a foreign country, a foreign group of citizens or a

political party that is composed of citizens that come from the same country.

2 The groups of foreign citizens that are considered as enemies of State and are de jure striped

of the eSwiss citizenship and are deprived de facto of their rights.

Chapter 2 State of emergency

Art. 98 Definition

1 The state of emergency to the Confederation is the state of imminent PTO risk.

2 The state of emergency can be declared if the situation is similar to the ones mentioned in

art. 96 of the present Constitution.

Art. 99 Preventive imposition

1 The state of emergency can be called by the government.

2 If Congress doesn't express itself explicitly against the call within three days, it enters in

application three days after the call.

Art. 100 Effects

1 If the preventive imposition is voted by Congress, the effects stated by the present article

enter in application.

2 The government can ask Congress to undertake a preventive transfer a part of the national

funds.3 The Committee on Immigration can refuse citizens that seem to have links with the group of

citizens that has been declared to be PTO threat.

Chapter 3 State of Political Take-Over


Art. 101 Definition

1 The state of Political Take-Over to the Confederation is the state of current emergency that

can be imposed in the Confederation.

2 The state of Political Take-Over can be declared if the situation is similar to the ones

mentioned in art. 95 of the present Constitution.

Art. 102 Imposition

1 The state of PTO can be called by the government or the President.

2 The state of PTO is defined for an entire country, a specific group of foreign citizens or a

political party.

3 The government transmits to Congress the request of the imposition of the state of PTO.

4 Congress votes the imposition within 24 hours of the reception of the request.

5 The state of PTO is declared if at least 67% of the Congress members votes in favor of the

imposition.

Art. 103 Effects

1 If the state of PTO has been declared and approved by Congress, the effects stated on the

present article enter in application.

2 The President can ask Congress to transfer the totality of the national funds to eSwiss

citizens that have been approved by Congress.

3 The Committee on Immigration can refuse the applications from citizens coming from the

country that has undertaken a PTO against the Confederation or against any other countries.

4 The name of the foreign country, the foreign group or political party that defined as PTO is

mentioned in the transitional dispositions of the present Constitution, without passing by theobligations of a partial revision of the Constitution.

Section 2 Resistance government

Art. 104 Definition

1 The Resistance government is installed when the legitimate authorities of the Confederation

have been overthrown, by a foreign country, at a Presidential election.

2 The legitimate authorities are the authorities that do not have, explicitly or implicitly, theaim to undertake a PTO in the Confederation.

Art. 105 Composition

1 The Resistance government may have the same structure as stated at Title 4, Chapter 4 of

the present Constitution.

2 Foreign citizens that do not have been declared as PTO can be Confederation officials.

Art. 106 Sphere of activity1 The Resistance government is authorized to act, by the present Constitution, to avoid the

extension of the PTO.

2 The Resistance government is authorized to ask foreign countries to invade the regions

previously controlled by the Confederation to avoid the election of a new Congress.

Art. 107 Legitimacy

1 The Resistance government is authorized to declare itself as the only legitimate

representative of the eSwiss people.

2 The Resistance government is authorized to act consequently to maintain diplomatic and

military relationships with foreign countries.

Title 6 Revision of the Constitution


Art. 108 Principal

1 The revision of the Constitution can be done partially or entirely, under all circumstances.

2No revision of the Constitution can happen if the people and Congress didnt vote in favor

of the revision.

Art. 109 Presentation

Any revision of the Constitution must be accompanied by a message explaining the purpose

of the revision.

Art. 110 Recurrence

1No revision of the Constitution can be made within three months after the submission of the

precedent revision.

2 The present article is applied even if the precedent revision has been refused.

Chapter 2 Procedure

Art. 111 Submission

The Federal Chancellery submits the revision to Congress and to the people simultaneously.

Art. 112 Popular acceptation

1 The revision is presented to the people under the form a popular votation.

2 The votation is held for a period of 48 hours following the submission.

3 The Federal Chancellery records the votes and publishes the results after the votation.

4 The votes are secret, only the Federal Chancellery is allowed to see them.

5 The Federal Chancellery publishes all the invalid votes, with the name of the voter, the

reason why it has been invalided and the vote, casted during the votation.

6 A vote is declared invalid if:

- the voter doesnt fulfilling entirely the requirements to be an eSwiss citizen;

- the voter comes for a country or is or has been in a group or a political party

declared to be as a PTO or a PTO risk;

- the voter has voted two or more times, in which case all the votes that the voter

casted are invalided;- the voter has been punished by a temporary or a permanent ban by the eRepublik

moderation*;

- the voter casted his vote before or after the opening of the votation;

- the voter casted a different vote after the first one, in which case both votes are

considered as invalid.

7 The people have accepted the revision if it expressed itself in favor of the revision with asimple majority of the valid votes.

Art. 113 Congress solemn vote

1 The revision is presented to Congress under the form an extraordinary law.

2 The vote is realized in camera.

3 The voted is opened for a period of 48 hours following the submission.

4 The Congress members are authorized as members of Congress to vote the revision inside

Congress and to vote as citizens the popular votation.5 A vote is considered invalid if:

- a Congress member is or has been member of a political party declared to be as a

PTO or a PTO risk;

- a Congress member has voted two or more times, in which case all the votes are

considered as invalid;

- a Congress member casted a different vote after the first one, in which case both

votes are considered as invalid.

6 The Congress has accepted the revision if it expressed itself in favor with at least two-thirds

of the valid votes.

Art. 114 Transitional dispositions due to the ruling of eRepublik usages on the

game mechanics

1 The articles provided with by a transitional disposition due to the fact that they directlydepend of the game mechanics or usages of eRepublik are the following:

- art. 17 (Definition of Adult citizen);

- Title 4, Chapter 1, Section 1 (Eligibility and suffrage);

- art. 36 (Election of Congress);

- art. 42 (Election of the President);

- art. 46 (Impeachment of the President);

- art. 54 (Mutual Protection Pacts);

- art. 55 (Embargoes);

- art. 63 (Resistance Wars).

- art. 111 (Temporary and permanent ban)

2 The approvals of Congress necessary at art. 46, 54 and 55 are made through specific laws

that are made in-game.

3 The temporary and permanent ban as stated at art. 111 are pronounced at the discretion of

the eRepublik moderation.

4 In the case that any articles mentioned in the present article are changed by the game

mechanics, the Constitution is modified subsequently without the obligation of passing by theprocedure of a revision of the Constitution.

Art. 115 Transitional dispositions due to the declaration of Political Take-Over

The following foreign countries, foreign groups and political parties are considered as a PTO

risk:

- The Others (political party).

Art. 116 RetroactivityThe Constitution of the eSwiss Confederation is not retroactive.

Art. 117 Entrance in application

1 Once the present Constitution has been approved following the requests provided by the

constitutional law of 29 May 2013 (day 2017)5, the present Constitution enters immediately

in application.

2 The precedent Constitution of eSwitzerland is abrogated.
