Applicant is relocating his business from 227 N. Fed. Hwy. (which he rents) to the subject property which he owns.
Applicant is requesting an additional one (1) year extension of the previously approved site plan and variance.
Previous Actions
On October 28, 2008 the City Commission approved a variance and site plan extension for one (1) year with conditions and a newly introduced two (2) part phasing plan.
On August 22, 2006 the City Commission approved the site plan and variance to provide 9 parking spaces on site.

Land Use Designation: Local Activity Center (LAC).
Vacant built property which includes both Garrison’s Garage (US 1) & the old UMT building (NE 1 Avenue).
Over Lay District:Community Redevelopment Area (CRA) & Principal Arterial Commercial Design Standard Overlay District.

Existing Conditions
Applicant has begun work on the subject property, including interior improvements & installation of exterior doors.
No permits have been obtained for these improvements.
The applicant is aware that he will have to obtain after-the-fact permits for work already done.
The applicant has also begun to move some of his inventoryto the site.
Variance
To allow 7 parking spaces for a showroom/office use; code required 10 parking spaces.
7 spaces are provided on the site plan.
Applicant’s current business is seldom occupied by more than 3 – 4 cars.
Site Plan
Modification of buildings to allow a decorator showroom/office.
Applicant proposes significant changes to the building elevation.
The elevations are generally consistent with Principal Arterial Design (“PAD”) Standards.

In addition, the applicant is proposing to make improvements shown on the site plan in two phases:
PHASE 1: The first phase will consist of all improvements to
the buildings (interior & exterior), landscaping, parking and drainage on the east side of the building (NE 1 Avenue).
PHASE 2: The second phase will include the landscaping, parking, drainage and fence on the west side of the property (Federal Highway).

On August 22, 2006 the City Commission approved the building color, yard exhibits, site plan and variance to provide 9 parking spaces on site, at that time 12 parking spaces were required.
Staff RecommendationApprove of the variance and site plan extension request for one (1) year (to expire on November 10, 2010) with the previous conditions, phasing plan and provided the applicant obtain after-the-fact building permits for work already done.
