IN BRIEF Halsall & Associates has initiated action, on behalf of the adjacent land owner, to acquire a portion of Reserve 43215 for road purposes to allow the extension of Gardiner Road through to the un-named road abutting the subdivision of Lots 1695 and 2194.
This action will require Council support for the excision of the required land for road purposes from Reserve 43215 and the dedication of the land as "road' in accordance with Section 56 of the Land Administration Act 1997 (LAA).

BACKGROUND Halsall & Associates have lodged an application (Application No:148794) with the Western Australian Planning Commission (WAPC) for the proposed subdivision/amalgamation of Locations 1692 and 2194 and Lots 311 and 313 BusseII Hwy/Gardiner Road, Cowaramup. As part of the development they have requested an extension of Gardiner Road across Reserve 41235.

Reserve 43215 was formerly the railway reserve running from Busselton to Flinders Bay. The typical layout of the railway reserve was a 60m wide railway corridor with a 20m wide road reserve running along both sides thus creating a 100m wide corridor.
The extension of Gardiner Road across Reserve 43215 and the construction of a road within the road reserve southwards to serve subdivision/amalgamation will allow for road network connectivity for this subdivision.

DISCUSSION / OFFICER COMMENTS Reserve 43215 is vested with the Shire for the purpose of Heritage Trail and forms part of the Wadandi Track (Busselton to Flinders Bay Rail-Trail).
The extension of Gardiner Road across Reserve 43215 and the construction of road reserve southwards to serve subdivision/amalgamation will allow for road network connectivity for this subdivision.
This will require Council concordance to excise and dedicate as road reserve the portion of Reserve 43215 shown on Attachment 1. This would allow all lots to have road access through to Gardiner Road which then connects through to Bussell Highway.

The proposed extension of Gardiner Road will run across the alignment of the future Wadandi Track. An informal road already exists on this alignment and future traffic volumes and vehicle speeds are likely to be low given the surrounding rural land use and discontinuous road network. The formalisation of the road access across the trail reserve will have minimal impact on the trail as a safe crossing point for walkers and cyclists can be provided.
A site inspection has revealed encroachments into the un-built road reserves and Reserve 41235. The encroachment consists of farm fences and a pile of old farm wire and other rubbish. Shire officers have discussed this matter with the Department of Lands (DoL). DoL require all encroachments to be removed from Crown land at this site and Shire officers have informed the developer of this requirement. In relation to this issue, Mr Ha!sail has advised that the rubbish will be removed shortly and the fencing will be modified once the new road to the lots in the south has been built.
STATUTORY ENVIRONMENT / LEGAL IMPLICATIONS Section 56 of the Land Administration Act 1997 allows a local government to make a request to the Minister of Lands to dedicate land as "road reserve".

The extension of Gardiner Road will improve safety by formalising the existing informal intersection while having minimal clearing requirements.

BACKGROUND Reserve 47049 was formerly the railway reserve running from BusseIton Jetty to Flinders Bay. The typical layout of the railway reserve was a 60m wide railway corridor with a 20m wide road reserve running along both sides thus creating a 100m wide corridor, which is the case between the applicant's two properties.
The owner 50 Latch Rd (Lot 1934) also owns 95 Latch Rd (Lot 3947). These two properties are separated by a 20m wide road reserve (Latch Road), a 60m wide reserve (Wadandi Track) and another 20m wide road reserve, which is un-built and un-named.
Access to Lot 3947 legal access is via the unbuilt road reserve off Stockdill Road. However, current and historical access has been via Latch Road, across the Reserve 47049 into the property.
The owner currently runs stock and machinery across the Reserve 47049 between these two properties.
The owner has requested the creation of a formal road across the reserve, between his two properties. He is of the opinion that the current informal track across the reserve is "affecting the stability of the farm and hindering our succession planning".
CONSULTATION AND ADVICE External Consultation Department of Lands who gave in principle support. This in principle support was for the creation of a road reserve across Reserve 47049 only but did not relate to a specific crossing point.
The Director of Infrastructure discussed the request with the owner.

This portion of Reserve 47049 is identified as an Environmentally Sensitive Area. Therefore this will need to be considered when planning and road construction.
The owner of Lot 3947 is also the owner of Lot 1934 Latch Road, which is located directly across the reserve from Lot 3947.
Under Infrastructure Policy 2 Road Closure of Gazetted Roads & Unconstructed Road Reserves, the cost to build this road would be at the cost of the applicant

FINANCIAL IMPLICATIONS Under Shire Infrastructure Policy 2 — Unconstructed Road Reserves. The cost to construct a new road will not be funded by the Shire. The cost will be the cost of engaging a licenced surveyor for surveying services for the creation of a new road over Reserve 47049. In this regard, the Shire has engaged Survey South for $2,980 to complete this stage of the development. The cost will be paid from TYA12 - Licensed Survey for Land Administration
SUSTAINABILITY IMPLICATIONS Environmental There are no current plans to build a road within the proposed road reserve. If the road were to be built, then all relevant environmental approvals would need to be obtained prior to any works commencing.
Social Gazettal of the access to the property would provide the owner consistency of access.
Economic The direct access to the property would allow continuation of current farming practises.

BACKGROUND Rowe Road West is a rural road located in the locality of Witchcliffe. The gazetted road reserve runs from Bussell Highway through to Redgate Road. However, the mid-section remains unbuilt. The recent subdivision along Rowe Road West required the road to be upgraded to a sealed surface, west of Bussell Highway for 1.45 km. The approved alignment resulted in a small portion of built road encroaching into Reserve 47049.

DISCUSSION / OFFICER COMMENTS Officer recommends supporting this proposal because;
a. During pre-construction phase of the subdivision the portions of Reserve 47049, as identified as Lot 302 on Deposited Plan 408681 and Lot 304 on Deposited Plan 411352 were required for road purposes to meet Main Roads W A standards. The dedication of these two lots will formalise the constructed road alignment which has previously been endorsed by the Shire (refer to attachment 3).
b. The road widening does not affect the functionality of the Wadandi Track, which is located within Reserve 47049.
STATUTORY ENVIRONMENT / LEGAL IMPLICATIONS All dedicated road reserves belong to the State and are governed by the Land Administration Act 1997. Section 56 of the Act deals with road dedication and would apply to the portion of Reserve 47049 that is to be excised and dedicated as road reserve.

IN BRIEF Main Roads WA (MRWA) is initiating action to acquire land to improve the alignment of the intersection of Caves Road with Grosse Road and is now seeking Council concurrence to the dedication of the land as "road' in accordance with Section 56 of the Land Administration Act 1997 (LAA). MRWA identified the need for upgrading the intersection when assessing an application for subdivision of Lot 60 Grosse Road.
RECOMMENDATION That Council supports the Minister of Lands dedicating under Section 56 of the Land Administration Act 1997, the land being acquired by Main Roads WA for road purposes as shown on the Main Roads drawing numbered 201 302 - 0654

BACKGROUND In September 2010, the Western Australian Planning Commission (WAPC) had approved a subdivision application for Lot 60 Grosse Road, Hamelin Bay subject to certain conditions being fulfilled. One of these conditions required "arrangements being made with Main Roads WA for the upgrading and/or construction of the Caves and Grosse Road intersection". This condition was

imposed by the WAPC at the request of MRWA. Grosse Road intersects Caves Road at an oblique angle on a bend and MRWA sought to improve the geometry of the intersection.
MRWA has since progressed the land acquisition on the south-east corner of Grosse Road and Caves Road and is now seeking Council concurrence to the dedication of the land as "road' in accordance with Section 56 of the Land Administration Act (refer to Attachment 1). It should be noted that the land required for the intersection upgrade is not part of the subdivision (Lot 60), but a separate lot (Lot 27) that is note connected with the subdivision.
External consultation MRWA has consulted extensively with the following stakeholders: • relevant government departments; • Shire of Augusta Margaret River; and • directly affected landowners.

DISCUSSION / OFFICER COMMENTS The current alignment of Grosse Road with Caves Road is dangerous as the road intersects with Caves Road on a sharp angle as shown on the aerial photo below. This has resulted in some users of Grosse Road cutting through Lot 27 to allow for a safer entry onto Caves Road.

As a result of the subdivision of lot 60 Grosse Road, MRWA sought to improve the alignment of this intersection by altering the intersection from a Y-junction to a T-junction. This would not only improve the safety of this intersection but formalise the current informal road alignment through the northern corner of Lot 27.
Therefore, MRWA has initiated action to acquire land to accommodate the realignment of the intersection of Grosse Road with Caves Road and is now seeking Council concurrence to the dedication of the land as "road" in accordance with Section 56 of the Land Administration Act 1997.

STATUTORY ENVIRONMENT / LEGAL IMPLICATIONS MRWA can compulsory acquire the land under the Land Administration Act 1997, but need Council's support to dedicate it as "road reserve".
Section 56 of the Land Administration Act 1997 allows a local government to make a request to the Minister of Lands to dedicate land as "road".
STRATEGIC PLAN / POLICY IMPLICATIONS Community Strategic Plan 2033 (CSP) Corporate Business Plan 2014-2018 Goal 1: Managing Growth Sustainably Community Outcome 1 : Connected and Safe Transport Network
The upgrading of this intersection will be completed to Shire standards but funded by the applicant, being the developer of Lot 60. These improvements to Caves Road are within the Shire of Augusta Margaret River and will deliver a safer and more serviceable road network.
FINANCIAL IMPLICATIONS The cost for purchasing the land and constructing a sealed intersection to the Shire's standard will be covered by the developer of Lot 60 Grosse Road. MRWA and the applicant will bear all costs associated with the land acquisition process.
SUSTAINABILITY IMPLICATIONS Environmental The upgrade of this intersection will improve safety at the existing intersection while having minimal clearing requirements.
Social The realigning and sealing of this intersection will have a positive social impact by delivering a safer and more serviceable intersection of Caves and Grosse Roads.
Economic Improving the safety of the access roads within the Shire will contribute to ongoing economic growth in the region.

This policy was adopted by Council to set governing principles in place that align the strategic direction of the organisation with [insert relevant strategic goal from Corporate Plan].
Objectives To ensure that due consideration is given to any request for closure of or construction of a road within an unconstructed road reserve.
Policy Closure of a gazetted road. 1. Applications to close a gazetted road shall be made on the form titled "Application to
Close a Public Road "and accompanied by payment of a non-refundable fee. 2. No gazetted road shall be closed except by resolution of Council. 3. The closure of a road would not be considered:
a. If there is a long term merit for retention of the road reserve. b. If there is remnant vegetation of value. c. If there is an existing or potential wildlife corridor. d. If the Application to Close a Public Road form has not been completed. e. If all required fees associated with requests for a road closure have not been
received in full. f. If there is any likelihood that the action of the road closure shall create any
property to loose direct frontage to dedicated road thus resulting in the property becoming "land locked".
g. Without first considering any objections made against the proposal within the required 35 day period of notice.
Construction in unconstructed road reserve 4. All requests for the construction of roads on unbuilt road reserves, or the extension of
roads onto unbuilt portions of existing road reserves shall require approval by the Shire. 5. Construction in unconstructed road reserve, resulting from a request by a landowner(s),
shall not be funded from Shire funds but be funded by the applicant and/or Government grants or groups of land owners served by such roads.
Application Responsibility for the implementation of this policy rests with the Chief Executive Officer. The Policy is to be reviewed every three years.
