    In 1985, Presidential Dedree No. 1987 entitled An Act Creating the

    Videogram Reglator! "oard# $as enacted $hich ga%e &road 'o$ers to

    the VR" to reglate and s'er%ise the %ideogram indstr!. (he said la$

    soght to minimi)e the economic e*ects o+ 'irac!. (here $as a need to

    reglate the sale o+ %ideograms as it has ad%erse e*ects to the mo%ie

    indstr!. (he 'roli+eration o+ %ideograms has signicantl! lessened the

    re%ene &eing ac-ired +rom the mo%ie indstr!, and that sch loss ma!

    &e reco%ered i+ %ideograms are to &e taed. /ection 10 o+ the PD im'oses a

    02 ta on the gross recei'ts 'a!a&le to the 34s.

    In 1986, Valentin (io assailed the said PD as he a%erred that it is

    nconstittional on the +ollo$ing gronds

    Alge Inc. $as a +amil! cor'oration $here strict &siness 'rocedres

    $ere not a''lied and immediate issance o+ recei'ts $as not re-ired. atthe end o+ the !ear, $hen the &oo=s $ere to &e closed, each 'a!ee made

    an acconting o+ all o+ the +ees recei%ed &! him or her, to ma=e ' the

    total o+ P75,000.00. (his arrangement $as nderstanda&le in %ie$ o+ the

    close relationshi' among the 'ersons in the +amil! cor'oration

    (he amont o+ the 'romotional +ees $as not ecessi%e. (he total

    Inc. $as P15O. A+ter dedcting the said +ees, Alge still had a &alance o+

    P50,000.00 as clear 'rot +rom the transaction. (he amont o+ P75,000.00

    considering that it $as the 'a!ees $ho did 'racticall! e%er!thing, +rom the

    +ormation o+ the Vegeta&le >il In%estment Cor'oration to the actal

    P15,000 and it $as +rom this commission that it 'aid 4e%ara, et. al.

    recei%ed an assessment +rom the Commissioner o+ Internal Re%ene in the

    amont o+ P8,18.85 as delin-enc! income ta +or !ears 1958 amd

    1959. Alge led a 'rotestor re-est +or reconsideration $hich $as not

    acted 'on &! the "rea o+ Internal Re%ene "IRB. (he consel +or Alge
