Whereas Shri Mahesh Kumar Sharma and others had filed civil

writ petition No.15735 of 2012 with the prayer that they be promoted as

Headmaster, High School from the date, persons juniors to them have

been promoted as such i.e. 28.08.2009. This civil writ petition was

decided by the Hon'ble Punjab and Haryana High Court vide order dated

17.8.2012, the operative part whereof is reproduced hereunder:-

"Without going into merits of the case or commenting

thereon, the present writ petition is disposed of with a

direction to the Commisioner-cum-Director, Secondary

Education, Haryana, respondent No.2, to consider and

decide the representation of the petitioner dated 10.5.2012

(Annexure P-2), within a period of two months from the date

of receipt of certified copy of this order. The decision, so

taken, be conveyed to the petitioners forthwith.

In case the petitioners are entitled to the claim made by

them through their representation dated 10.5.2012 (Annexure

P-2), the consequential benefits, if any, be released to them,

in accordance with law, within a further period of one

month. If the claim as projected by the petitioners through

their representation dated 10.5.2012 (Annexure P-2) is

rejected, then a speaking and well reasoned order be passed

by the respondents and the same be conveyed to the

petitioners forthwith."

Whereas as per aforesaid directions of the Hon'ble High Court, the

claim of the petitioners for promotion as Headmaster is to be considered

only if any person junior to them would have been promoted as such.

Whereas on 28.08.2009, the department had promoted the masters

upto seniority number 3540 as it stood on 01.01.2006 and the name of

petitioner No.1 (Shri Mahesh Kumar Sharma) is at serial number 3811-A

in the gradation list of masters as it stood on 01.01.2006. Thus, no person

junior to the petitioner No.1 (Shri Mahesh Kumar Sharma) has been

promoted as Headmaster and as such he is not entitled to promotion as

Headmaster. Thus, his claim is liable to be rejected.

Rules-2003 Education Department, Haryana permission is hereby granted to establish a newproposed school on the terms and conditions mentioned below:-

() The Proposed School shall have the required infrastructure regarding land and Buildingi.e.number & size of class rooms with varanda and other rooms for Head ofInstitution/Office, Library, Laboratory, Stairs, Ramp and Toilets etc. as per Rule 30.

(ui) The Management of the school shall have to apply for permanent recognition within thestipulated time in the prescribed form-Ilwith documents asperrule 31.

(rii) The Management shall not make admission beyond Class-HI before the sanction of itsrecognition or in its anticipation.

(Iv) The letter of permission is based on the undertaking given by the applicant as per detailsgiven overleaf. Any violation of the undertaking automatically nullifies the permission.This permission is further subject to 'No Objection certificate' from the 'CompetentAuthority' regarding the land use of the proposed site.

This is only a formal permission to establish a New School or Start Classes and does not enableyour school to get recognition automatically for which physical verification of infrastructure andrecords in this respect shall be made by District Inspection Committee.* The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E.
