5825-U Universal Access Fund (UAF)

This docket involves establishment and implementation of a fund to ensure that universal access to the information highway is available to all Georgian citizens at reasonable rates without excluding those located in rural or remote areas.

As mandated by the Telecom Act of 1995 passed into law by the Georgia General Assembly during its 1995 session, the Georgia Public Service Commission held hearings to establish a Universal Access Fund for the State of Georgia. These hearings were held in the Spring of 1996 with the Commission establishing three phases to

the case. The Commission rendered its first Interim Order in this matter on June 20, 1996. This was followed by the Commission’s initial full Order rendered on August 30, 1996.

As detailed in the above Orders, the Commission established three phases for Docket No. 5825-U designed to establish and administer the Universal Access Fund in Georgia.

Phase I consisted of the submission of affidavits by wire telecommunications companies in Georgia stating each company’s annual gross revenues from sales to end users of telecommunications services pursuant to O.C.G.A. section 46-5-167(b). These affidavits were used by the Commission to develop each potential participant’s revenue relationship to the total revenues of the telecommunications companies providing service in Georgia and to develop the subsequent factor to be applied to the total expected requirements for disbursements from the Universal Access Fund (UAF). By using this factor, the Commission was able to derive the required contribution from each participant.

Phase II consisted of hearings which were held on April 15-17, 1996. This phase was designed to give Local Exchange Companies an opportunity to make application for and demonstrate eligibility from the UAF under O.C.G.A. section 46-5-167. It was also designed to give parties an opportunity to address the issue of what standards should be utilized to determine whether and how contributions and disbursements should be made. At the conclusion of these hearings the Commission was unconvinced that there was a need for an explicit subsidy and subsequent disbursements under Phase II in the near term. Accordingly, the Commission deferred any final decision on Phase II until a later date. The Commission did, however, find that any alternatively regulated local exchange company seeking reimbursement from the UAF under Phase II must submit a total service long run incremental cost study indicating the reasonable economic cost of providing the basic local

service as defined in O.C.G.A. section 46-5-160. The Commission has now determined this phase can be continued and a Procedural and Scheduling Order has been rendered with hearings to take place in March of 2000. This is detailed later in this presentation.

Phase III consisted of the taking of evidence on the proper interpretation of O.C.G.A. section 46-5-166(f)(2). This phase also gave Tier 2 companies an opportunity to propose and support adjustments to other rates as may be necessary to recover revenues lost through the concurrent reduction of intrastate switched access rates mandated in the above cited legislation. The Commission found that any real loss of revenues by Tier 2 companies due to the lowering of access charges as mandated by the General Assembly could be recovered by either changes in rates or through an interim Universal Access Fund (UAF). As this phase was found to be time sensitive, the Commission established the interim UAF for the specific purpose of addressing switched access revenue losses mandated by the legislation. The details of establishing and administering the fund can be found in the Interim Order of June 20, 1996 and the Order of August 30, 1996.

The Commission has retained the authority for administration of the funds associated with the interim UAF. Both the detail of this administration and the current status of the fund will be discussed below.

This UAF, as mentioned above, was established on an interim basis to address certain revenue losses associated with access parity mandated by the General Assembly in The Telcom Act of 1995. Assessment notices were sent to all wire providers of telecommunications service in the State to include: LECs, CLECs, IXCs, Resellers and COCOTs. A lockbox account was established at SouthTrust Bank to receive contributions. Additionally, an account was established at the State Treasury with the Georgia Fund One Account to invest funds until disbursement. Deposits

have been received and disbursements made on a quarterly basis. The Fund is currently disbursing approximately $40 million annually. The expected annual disbursements for the fifth and final year of the interim fund should just under $50 million in aggregate.

The initial request for disbursement was made by the Georgia Telephone Association on behalf of Tier 2 ILECs operating in Georgia on 12/18/96 and has been made quarterly, thereafter. Some Georgia ILECs were at parity for access charges and therefore have not experienced revenue losses and subsequently not requested funds. Some ILECs have satisfied revenue losses via rate rebalancing allowed in the Act and approved by the Commission. Some ILECs have recovered access parity related revenue losses via a combination of rate rebalancing and receipts from the UAF, as approved by the Commission. There have been three $1.00 per access line rate increases mandated by action of the Commission, which have reduced the amount of UAF contributions otherwise needed.

Early in the process, Alltel, Inc. filed a petition for review with Fulton County Superior Court relative to the Commission’s authority to net revenue growth against the amount of quarterly UAF disbursements to be made to the Tier 2 ILECs. Fulton County Superior Court ruled in favor of Alltel, Inc. The State Court of Appeals subsequently upheld this Order upon appeal by the Commission. As a result, a true-up disbursement was made to comply with the decisions made by the courts.

A Procedural & Scheduling Order and an Order Requiring Submission of Information by Telecommunication Companies to implement the process referred to above, as mandated by law, was approved and issued providing for the following schedule:

An Order Concerning Universal Access Fund 2nd year Phase-Down was decided on 6/24/97 and it was issued on 6/30/97.

An Amendatory Order concerning Universal Access Fund 2nd Year Phase-Down was decided on 6/24/97 and it was issued on 7/8/97.

An Order on Reconsideration was decided on 7/17/97 and was issued on 7/18/97.

In compliance with the 7/18/97 Commission Order, all Tier 2 LECs participating in the fund filed through the Georgia Telephone Association on 10/1/97, a proposed long-range UAF plan for the remaining revenue losses expected to comply with the access parity mandated by the General Assembly. On 11/3/97 the Consumers’ Utility Counsel and BellSouth filed, with the Commission, comments concerning the 10/1/97 GTA filing. In Administrative Session on 12/16/97, the Commission ordered the parties to attempt a settlement and present a long-range plan to the Commission such that the matter could be resolved by 3/31/98. The initial meeting to accomplish this was held on 12/17/97.

This process was delayed by further meetings and discussions by the parties through the spring of 1998.

On 6/2/98 the Commission approved another Procedural & Scheduling Order. The schedule provided for the following:

The Commission reset the contribution from .5% to .7% for the 2nd quarter of 1998 and subsequently to 1.5% beginning with the 3rd quarter of 1998. This factor has always been applied to the gross Georgia end-user revenues to determine the contribution amount for each contributor. At this time the Commission also approved the first $1.00 increase per access line for R-1 and B-1 lines effective on 7/1/98. The increase of $1.00 per access line for R-1 and B-1 lines on 7/1/99 and 7/1/00 were also approved at this time. These increases contained some exceptions, most notably, the Alltel Companies).

On 9/16/98 a pre-hearing conference was held before Hearing Officer Mark Middleton.

On 10/16/98 Oral Arguments were made by the parties relative to the term of Phase III of the UAF as contemplated by O.C.G.A. 46-5-166 (f)(2). These arguments were made before the full Commission and Briefs were filed by the parties on 10/28/98.

On 10/23/98 and 10/27/98 Oral Arguments were made by the parties relative to the transition from Phase III back to Phase II under O.C.G.A. 46-5-167.

On 12/15/98 the Commission decided in Administrative Session that the term of Phase III and the interim UAF as contemplated by O.C.G.A. 45-5-166 (f)(2) was five years, ending June 30, 2001, and that any claims for disbursement by Tier 2 LECs thereafter should be filed under Phase II as governed by O.C.G.A. 46-5-167 (and should be accompanied by a future looking cost study for alternatively regulated LECs or through a rate filing in the case of traditionally regulated LECs).

Subsequently, many of the smaller ILECs argued that their reliance of any funding from the UAF under O.C.G.A. 46-5-167 would be very small or

even non-existent and that it would not be an efficient use of time or resources to conduct a formal hearing on their cost studies. The Commission Staff, the Consumers’ Utility Counsel Division, the Georgia Telephone Association (representing the interest of the smaller ILECs), and other interested parties met to attempt to resolve these claims by consent. There was some consensus that prospective claims of companies seeking little or no funding from the UAF could be resolved through an informal workshop process.

On 5/17/99 the Commission issued an Order Modifying Amendatory Procedural & Scheduling Order for ILECs with De Minimus Claims. The Commission found that it would not be an efficient use of time and resources to conduct formal hearings for ILECs with minimal claims to determine disbursements for the fiscal year beginning July 1, 2001. The Commission determined that it was appropriate to create a procedure where any ILEC that intends to claim below a certain annual cap amount from the UAF for the fiscal year, might opt out of the formal hearing and instead, proceed under a workshop process.

A hearing was held to determine the proper minimal disbursement level. On 8/3/99 the Commission voted to set the annual disbursement cap amount at $1.5 million. An Order relative to this was issued on 8/31/99.

The Commission Staff has developed and the Commission has approved a Procedural & Scheduling Order for resuming hearings in Phase II of Docket No. 5825-U. This Order provides for the following:

5833-U Interim Tariff Filing Requirements.

This docket established interim rules, pending development of permanent rules, for the general tariff filing requirements by local exchange companies that elect alternative regulation and by newly certificated local exchange service companies.

5840-U Number Portability.

This docket establishes the framework for the implementation and administration of portability of local telephone numbers. Portability is defined as the technical capability that permits a customer to retain the same local telephone number at the same customer location regardless of the provider of the local exchange service.

The Commission has selected Location Routing

Number (LRN) as the permanent long term solution. A Procedural & Scheduling Order on the issue of Cost Recovery was approved at the Commission's 8/9/96 Administrative Session. The Order was signed and issued on 8/12/96. At the request of the parties, the Hearing was continued. The Commission deferred setting the cost for LNP to the FCC, which issued an order deciding cost recovery for long term number portability in CC Docket 95-116, FCC Order 98-92, released 5/12/98.

The Commission issued a Policy Statement to encourage the development of a regional effort with respect to Local Number Portability on 11/8/96. A regional approach is expected to increase the pace and efficiency of a permanent data solution. Lockheed Martin was selected as the vendor to create the number portability software. It was installed in 20 of the Atlanta Area Central Offices in August of 1998. The Georgia Public Service Commission is in compliance with the F.C.C.'s implementation schedule.

5882-U Pricing Guidelines for Telecommunications Services to End Users under S.B. 137 Act.

This docket was established to develop rules regarding pricing guidelines as a part of implementing alternative regulation and competition for local exchange services that will prevent anticompetitive practices, discrimination and protect the consumer from any disadvantage or economic harm. However, pricing issues are being developed on a case by case basis. (See Dkt. 5958-U.)

5958-U Interconnection, Unbundling and Resale. This docket established a process for resolving complaints regarding interconnection and unbundling arrangements and initiates a hearing process to collect evidence to establish rates, terms or conditions regarding the resale of local exchange services.

A Proposed Revised Order is being drafted to reflect the time lines set out in the federal Telecommunications Act of 1996.

The Commission's arbitration decisions regarding the combination of unbundled network elements (UNEs) was affirmed in a landmark interpretation of the Telecommunication Act of 1996 by the United States Court for the Eight Circuit. The

Court agreed with the Commission that requiring the Incumbent Local Exchange Carrier (ILEC) to recombine cost based unbundled elements for Competitive Local Exchange Companies (CLECs) would "obliterate" the distinctions Congress made for the purchasing of unbundled network elements and discounted retail services for resale. The Georgia Commission was one of only five State regulatory bodies in the nation which correctly interpreted this key provision of the Federal Telecommunications Act.

6001-U Privacy Guidelines.

Senate Bill 137 provides that unlisted numbers are protected from commercial use by others without the owner's permission. Any intentional disclosure or use of an unpublished telephone line identification is a violation subject to civil penalty. The Commission shall promulgate rules to further establish privacy guidelines applicable to telecommunications services. The Commission is also resolving issues related to the privacy of customer information in the context of arbitration dockets.

6403-U Revision of Existing Commission Rules for Dis-

connection.

The Commission is considering revising the existing disconnection rules to increase subscribership on the public switched network for those subscribers who have been disconnected for nonpayment of bills. The FCC has issued a Notice Of Proposed Rulemaking with respect to this matter.

Progress is pending promulgation of Federal

Communication Commission Disconnection Rule. 6863-U Section 271 of the Telecommunications Act of 1996.

Pursuant to Section 271 of the federal Telecommunication Act of 1996, the FCC has 90 days after receiving an application to provide

InterLATA services to issue a written determination approving or denying the application. The Act further directs the FCC to consult with the applicable state commission before making the determination. This docket was initiated to explore BellSouth's compliance with the "14-Point Check List" contained in Section 271 of the Act.

The Commission opened this docket and issued a

Procedural and Scheduling Order on 8/23/96. Procedural orders were issued and an all-parties meeting was held on 12/13/96. The first round of hearings was held 3/3-7/97. A second round of hearings was held 7/14-17/97 and 7/24/97.

By Commission Order, approved 9/18/97 and issued 9/30/97, BellSouth is to provide the Commission with 30 days notice in advance of the date it files its application to the FCC for InterLATA entry pursuant to Section 271 of the Telecommunication Act of 1996. As of 12/31/98, BellSouth has not initiated a 271 filing with the FCC for the state of Georgia.

BellSouth, pursuant to the Telecom Act filed with this Commission it's notice of intent and motions for it's anticipated Section 271 Application for in-region long distance service on 5/27/98. The Commission, in its consultative role as outlined in the Telecom Act, will continue to review and offer it's opinion to the FCC (the approving authority for BellSouth's Section 271 Application) regarding any filings by BellSouth for in-region long distance service.

BellSouth Statement of Generally Available Terms

and Conditions ("SGATC") [See Dkt. No. 7253-U] is often referred to when in connection with BellSouth's anticipated Section 271 Application for in-region long distance service.

The Commission approved a 3rd Party Test Plan to

evaluate the functionality of BellSouth,s network using an independent 3rd Party. The results of this test plan will be made a part of

any filing submitted by BellSouth for InterLATA authority under Section 271.

The Commission Staff issued a Report and Opinion on October 15, 198 referring certain deficiencies cited in Georgia along with deficiencies cited by the FCC in its report to BellSouth 271 Application in Louisiana and South Carolina.

7061-U Review of Cost Studies, Methodologies, and Cost-

Based Rates for Interconnection and Unbundling of BellSouth Telecommunications Services.

This is the generic proceeding to review BellSouth's TELRIC cost studies and any other relevant cost studies or methodologies, and to set cost-based rates for interconnection, unbundled network elements, collocation, and access to poles, ducts, conduits, and rights-of-way. Both the federal Act and the Georgia Telecommunications and Competition Development Act apply to this docket.

Procedural and Scheduling Order approved 12/3/96, issued 12/5/96.

A pre-hearing conference was held 5/14/97. Discovery was conducted and various pre-hearing disputes were resolved. The Commission sponsored several information discovery workshops.

Hearings were held 9/15-19/97. Following briefs and proposed orders, the Commission issued its Order on 12/16/97, resolving the issues and including a detailed price list for all unbundled network elements.

This review was established to determine appropriate performance measurements for BellSouth and its competitors under the federal and state Acts.

8354-U Investigation into Development of Electronic

Interfaces for BellSouth's Operational Support Systems.

This docket was opened to facilitate a non-adversarial, in-depth technical review of BellSouth's operations support systems ("OSS"), including the electronic interfaces for use by competitive local exchange carriers ("CLECs").

The Commission established this docket pursuant to it's 10/30/97 Order in Docket No. 7253-U.The Commission took comments, and Staff developed an agenda and issues matrix from these filed comments. This helped set the stage and tone of the Technical Workshop. The Workshop was conducted 12/9-10/97. Staff issued a report to the Commission on 12/23/97 with a matrix of contested technical issues, proposed solutions, and proposed schedule for progress reports.

This docket was heard by the Commission 3/18-20/98 to resolve certain matters pertaining to the provision by BellSouth of access to its Operations Support Systems for CLECs, and specifically, whether to adopt the recommendations presented in the Staff Report. The Commission adopted the Staff Report and ordered BellSouth to fully comply with the

Report. The order was signed 6/3/98 and issued 6/4/98 along with the Staff Report.

The Commission issued an Order in this docket on 6/12/96. On 6/21/96, BellSouth filed a Motion for Reconsideration and Clarification. Several Motions in Opposition to the BellSouth Motion for Reconsideration were also filed.

On 7/11/96, the Commission issued an Order

clarifying and granting deadline extensions with respect to the operational interface issue only. In that Order, the Commission specified that all costs incurred by BellSouth to implement the operational interfaces shall be recovered from the industry.

The Commission also required AT&T and BellSouth to file a joint report on the provision of operator services, which was filed on 7/12/96. The Commission's decision on the amount of

discount levels and other issues were the subject of a judicial review filed by Bellsouth. The Commission Order was upheld by the Fulton County Superior Court. The FCC issued an Order adopting similar discount levels on 8/1/96.

BellSouth filed a wholesale tariff as required

by the Order, However, on 8/13/96, MCI and AT&T filed a Joint Motion to Enforce the Order. Similar complaints have been filed claiming that BellSouth's tariff is contrary to the Commission's Order.

AT&T and MCI's Joint Motion for enforcement of this Order, along with MultiTechnology and Shared Technologies -Fairchild's Petition, were heard by oral argument on 10/24/96. The matter was heard by Hearing Officer Philip Smith, who will issue a recommendation for consideration by the Commission.

The Commission reviewed BellSouth's Statement of Generally Available Terms and Conditions ("SGAT") according to the standards and requirements of Sections 251 and 252 of the federal Telecommunications Act of 1996. The SGAT is intended to make available the general rates, terms, and conditions for resale, interconnection, unbundled network elements, and access to rights-of-way for all interested competitive local exchange carriers ("CLECs").

BellSouth filed its initial SGAT 1/22/97 as a part of Docket No. 6863-U (the Commission's proceeding regarding Section 271 of the federal Telecom Act.). The Commission opened this Docket No. 7253-U on 3/5/97 to review the SGAT on a combined record with Docket No. 6863-U. The first round of hearings was held 3/3-7/97. An

Order rejecting the SGAT was issued 3/21/97, on the basis that certain portions were premature or incomplete and thus did not meet all of the standards and requirements of Sections 251 and 252; The docket was kept open for review of any revised SGAT BellSouth might file.

The Commission issued an Order scheduling the continued review of BellSouth's SGAT on 5/6/97. The Commission also issued an Order clarifying it's Decision in in regards to the SGAT on 6/25/97.

BellSouth filed it's Revised SGAT on 6/6/97. A second round of hearings was set for 7/14-17/97 and 7/24/97. Continuance decided 7/15/97, issued 7/16/97 as follows: the 7/14-17/97 hearing continued 7/28-29/97; rebuttal rescheduled for 7/30/97 and 8/1/97. The hearing was held in accordance with the continued schedule.

The Commission issued an Interim Order on 10/30/97, permitting the Revised SGAT to take effect and establishing related matters, including a technical workshop in Docket No. 8354-U. The Commission issued it's full order to BellSouth's Revised SGAT on 1/15/98.This Order does not decide or prejudge the Commission's review or consultation to the FCC regarding any Section 271 application by BellSouth for InterLATA (long-distance) authority in Georgia. Permitting the Revised SGAT to take effect allows CLECs to take its rates, terms, and conditions, while affording Commission further opportunity to review as necessary pursuant to Sections 251 and 252 of the federal Act.

7/7/98 the Commission approved BellSouth's SGAT, with certain conditional modifications. BellSouth refiled it's SGAT on 8/6/98, reflecting the modifications outlined in the Commission's order.
