INTRODUCTION The information and statistics contained herein is being presented to the Notre Dame College community in compliance with The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act. The Notre Dame College Annual Fire Safety Report for 2012 is included with this report and also provides information about fire safety procedures, statistics, reports and documentation meeting the fire safety reporting requirements of The Higher Education Opportunity Act (Public Law 110-3125) (HEOA), enacted August 14, 2008, joins this report on the web at http://www.notredamecollege.edu/resources- and-services/campus-safety-and-security/crime-statistics in brochure format. Paper copies of this report are available for individuals to pick up at Safety & Security Office at the main Administration Building of Notre Dame Campus at 4545 College Road, South Euclid, Ohio 44121. REPORTING CRIMES & EMERGENCIES The easiest way to report a crime or emergency on the Notre Dame College campus is to call the Safety & Security Department at 216-373-5212. Your call will go directly to the Safety & Security Department and you will receive an immediate response of a police officer or security guard. You may also report police, fire, or medical emergencies to the City of South Euclid Police & Fire Department by calling 9-1-1 or 216-381-1234. For those who wish to make anonymous reports of crimes or incidents requiring police attention, please go to the Safety & Security webpage of the Notre Dame College website at and go to the “If You are A Victim Tab” (http://www.notredamecollege.edu/ resources-and-services/campus-safety-and-security/if-you-are-a-victim) where you will be able to anonymously communicate to the Notre Dame College Police Department.

POLICY FOR REPORTING TIMELY WARNING NOTICES OF CLERY CRIMES In the event a situation arises, either on or off campus, that, in the judgment of the Dean of Students or the Director of Safety & Security, or Assistant Chief of the Notre Dame College Police Department, constitutes an ongoing or continuing threat, a campus-wide “timely warning” will be issued. The warning will be issued through the college email and/or the CityWatch mass notification systems to students, faculty, and staff. Depending on the particular circumstances of the crime, especially in all circumstances that could pose an immediate threat to the community and individuals, the Safety & Security Department may post a notice on the Notre Dame College Website at http://www.NotreDameCollege.edu. In such instances, a copy of the notice will be posted at the main entrance to each residence hall and campus building, circumstances

permitting. Anyone with information warranting a timely warning should report the circumstances to the Notre Dame College Safety & Security Department by calling 216-373-5212.

MEMORANDUM OF UNDERSTANDING WITH THE SOUTH EUCLID POLICE DEPARTMENT

Though the Notre Dame College Police Department is empowered to enforce all laws of the State of Ohio and the City of South Euclid, the college has entered into a Memorandum of Understanding with the South Euclid Police Department. Under the terms of this M.O.U., the South Euclid Police Department shall be called upon to investigate the following crimes: *All deaths that occur on the Notre Dame College campus *All sexual offenses that occur on the Notre Dame College campus *All arson crimes that occur on the Notre Dame College campus *All crimes involving serious physical harm to a person as defined in the Ohio Revised Code The Notre Dame College Police Department shall provide assistance in investigating the above mentioned crimes as may be requested by the responding South Euclid police officers. The Notre Dame College Police department shall provide copies of all crime reports to the South Euclid Police Department. The South Euclid Police Department shall alert the Notre Dame Police Department within 36 hours when one of the crimes below occurs contiguous to the campus:

A. Murder and Non-negligent Manslaughter B. Forcible Sexual Offenses C. Non-forcible Sex Offenses D. Robbery E. Aggravated Assault F. Burglary G. Motor Vehicle Theft H. Arson I. Arrests or disciplinary referrals for liquor law, drug, or weapons possession law

violations J. Hate Crimes, including the above listed crimes and any other crimes if motivated

by hate, such as theft, assault, criminal damaging, vandalism, and intimidation.

LAW ENFORCEMENT AUTHORITY Notre Dame College police officers are commissioned as peace officers under Ohio Revised Code Section 1713.50 which provides them with the power to arrest violators of the Ohio Revised Code and the Ordinances of the City of South Euclid, Ohio. Notre Dame College police officers are empowered to issue traffic citations that will ultimately be adjudicated through either the student or employee disciplinary process. Both Notre Dame College police officers and contract security officers from Guardsmark Company are empowered to issue parking tickets that are adjudicated through the student or employee disciplinary process. All law enforcement authority for the Notre Dame College Police Department is limited to the Notre Dame College Campus. The prosecution of all misdemeanor crimes committed on the campus of Notre Dame College will take place in South Euclid Municipal Court. All felony cases shall be prosecuted in Cuyahoga County Common Pleas Court. The City of South Euclid, Ohio Police Department is the primary investigating agency for all death investigations, arson, felonies involving serious physical harm and all sex offenses as set forth in the Memorandum of Understanding. The Notre Dame College Police Department is the primary investigating agency for all other crimes on campus and maintains an excellent working relationship with the South Euclid Police Department such that joint investigations may, on occasion, be conducted and joint assistance rendered upon request. Use of the City of South Euclid Detention Facility is governed by a separate Memorandum of Understanding providing for the housing of prisoners arrested and detained by the Notre Dame College Campus Police Department. The City of South Euclid also assists the Notre Dame College Police Department with non-terminal computer criminal record check resources through use of the Ohio Highway Patrol’s Law Enforcement Assistance Data Base (LEADS) system. The Notre Dame College Police Department and the South Euclid, Ohio Police Department collaborate regularly to share information on local crimes with the objective of protecting the greater local community as well as the Notre Dame College community; through coordination with South Euclid Police and other surrounding law enforcement agencies criminal activity engaged in by students at off-campus locations is monitored and reported to the Dean of Students for any action or follow-up that may be required.

You will also be able to connect to this webpage via the Notre Dame College home page, located at http://NotreDameCollege.edu. This report is prepared in cooperation with the South Euclid Police Department, other surrounding law enforcement agencies, the Office of Residence Life, the Notre Dame College Counseling Center, the Office of Campus Ministry, and the Dean of Student Affairs. Each entity provides updated information on their educational efforts and programs to comply with the Act. Campus crime, arrest, and referral statistics include those reported to the Notre Dame Police Department, designated Campus Security Authorities and other designated campus officials (including but not limited to deans, directors, department heads, faculty advisors to students and student organizations, athletic coaches), and local law enforcement agencies. The Notre Dame Counseling Center and the Office of Campus Ministry staff inform their clients of the procedures to report crime to the Notre Dame Police Department on a voluntary or confidential basis, should they feel it is in the best interest of their client. A procedure is in place to anonymously capture crime statistics disclosed confidentially during such a session. Each year, an email notification is made to all enrolled students, faculty, and staff that provides the website address to access this report. Copies of the report may also be obtained at the Office of Admissions, located on the first floor of the Administration Bldg., at the Notre Dame Police Office, located on the ground floor of the Administration Bldg., or by calling (216) 373-5212. All prospective employees may obtain a copy from the Office of Human Resources, located on the first floor of the Administration Bldg., or by calling (216) 373-5212. The website address describing where this report may be obtained will be attached to Notre Dame College employment applications.

ALWAYS REPORT CAMPUS CRIME TO THE NOTRE DAME COLLEGE POLICE DEPARTMENT

In order to ensure a safe campus that is free of crime and other hazards, it is essential that community members, students, faculty, staff and guests promptly report all crime and public safety related incidents to the Notre Dame College Police Department. All crime or public safety related incidents on the Notre Dame College Campus may be easily reported to the campus police department by calling 216-373-5212. Crimes on the area surrounding the Notre Dame College campus should be called in to the South Euclid Police department by calling 9-1-1 or 216-381-1234. Both the Notre Dame College Police Department and the South Euclid Police Department are greatly aided by their citizen partners who take the time to promptly call in about crimes, public safety concerns or suspicious activity.

CRIME PREVENTION PROGRAMS Crime Prevention Programs on personal safety and theft prevention are sponsored by various campus organizations throughout the year. Notre Dame College personnel facilitate programs for student, parent, faculty, staff, and residents of the greater South Euclid Community. The Director of Counseling, the Dean of Students, the Director of Residence Life and other campus organizations provide a variety of educational strategies and tips of measures that people may take to protect themselves from sexual assault, theft, and other crimes. *The Notre Dame College Police department and the South Euclid Police Department conduct crime prevention seminars on Identity theft. These seminars are designed to help teach members of the campus community on how to avoid being victims of identity theft, steps that need to be taken to report identify theft to the appropriate authorities, and steps that should be taken to repair the damage to a victim’s identity, once it has been stolen and used for fraudulent purposes. In addition, crime prevention literature is made available to all members of the campus community and members of the campus police will do presentations to various classes on different crime prevention topics upon the request of a faculty member. *The Director of Campus Safety & Security publishes periodic articles on crime prevention in the Notre Dame News and the Notre Dame eNewsletter. *During the 2013/2014 school year, the Notre Dame College Police department will continue to conduct Alert-Lockdown-Inform-Counter-Evacuate (ALICE) classes for the entire Notre Dame College Community, as was done during the 2012/2013 school year. ALICE classes provide information and suggest practical techniques to faculty, students and staff regarding options to escape, evade and, as a last resort, counter an active shooter should this situation ever occur on campus.“ Students, faculty, and staff may easily obtain escorts to campus parking lots and buildings by calling 216-373-5212.

POLICY STATEMENT ADDRESSING SUBSTANCE ABUSE EDUCATION Prevention Programs The College has developed a program to prevent the illicit use of drugs and the abuse of alcohol by students. The program provides services related to drug use and abuse including dissemination of informational materials, educational programs, counseling services, referrals and college disciplinary actions. Notre Dame College’s Residence Life Office and Counseling Center provides an overall coordination of the Drug-Free School Program. However, many services are the responsibility of other areas of the institution. These include:

Alcohol and Drug Education: Residence Life, Counseling Center, Dean of Students, Department of Athletics, Campus Safety & Security, and the Committee on Personal Responsibility. Counseling Services: Counseling services are provided by the Counseling Center. Referral Services: The Counseling Center, Residence Life, the Dean of Students. College Disciplinary Actions: The Dean of Students, and Residence Life Office. Criminal Sanctions: In Ohio, Underage Consumption of Alcohol is covered by Ohio Revised Code 4301.69 (E) (1) which sets age 21 as the minimum age for consumption of Alcoholic beverages. Violation of this statute is a Misdemeanor of the First Degree which is punishable by a maximum of 6 months in jail and /or a fine of up to $1,000.00.

POLICY STATEMENT ADDRESSING DISCLOSURES TO ALLEGED VICTIMS OF CRIMES OF VIOLENCE OR NON-FORCIBLE SEX OFFENSES

Notre Dame College will, upon written request, disclose to the alleged victim of a crime of violence, or a non-forcible sex offense, the results of any Student Conduct proceeding conducted by the college with the student who is the alleged perpetrator of the crime or offense. If the alleged victim is deceased as a result of the crime or offense, Notre Dame College will provide the results of the Student Conduct proceeding to the victim’s next of kin, if so requested. POLICY STATEMENT ADDRESSING PREVENTING AND RESPONDING TO SEX OFFENSES

Notre Dame College educates the student community about sexual assaults and date rape through a number of programs and education materials throughout the year. Some of these programs include a program for first year students at orientation each fall as well as through residence hall and athletic department programs during the year. The College also has a helpful website addressing prevention and response on-line at: http://www.notredamecollege.edu/student-life/student-life-resources/Title-IX. Campus Safety & Security offers sexual assault education and information programs to Notre Dame students and employees upon request. Literature on education, risk reduction, and the College’s response is available through the Residence Life Office, the Counseling Center and the Dean of Students. If you are a victim of a sexual assault at this institution, your first priority should be to get to a place of safety. You should then obtain necessary medical treatment. The College

strongly advocates that a victim of sexual assault report the incident in a timely manner. Time is a critical factor for evidence collection and preservation. An assault should be reported directly to a College official in Residence Life, the Dean of Students Office, or to a Police Officer. Filing a police report with a campus Police officer will not obligate the victim to prosecute, nor will it subject the victim to scrutiny or judgmental opinions from officers. Filing a report with a College official or police officer will:

Assist a victim of sexual assault in receiving the necessary medical treatment and tests, at no expense to the victim;

Provide the opportunity for collection of evidence helpful in prosecution, which cannot be obtained later (ideally a victim of sexual assault should not wash, douche, use the toilet, or change clothing prior to a medical/legal exam);

Assist the victim with access to free confidential counseling from counselors specifically trained in the area of sexual assault crisis intervention.

When a sexual assault victim contacts a College official outside of the Counseling Center of Campus Ministry that Campus official must report the incident and take further action. Further action includes notifying the Campus Safety & Security office. All investigations of sexual crimes that occur on-campus will be conducted by the South Euclid Police Department. The victim of a sexual assault may choose for the investigation to be pursued through the criminal justice system and the College’s Title IX Grievance Procedure (which includes the Conduct System). A College representative from the Police Department or Student Affairs staff will guide the victim through the available options and support the victim in his or her decision. Counseling options are available from the College through the Counseling Center. Counseling and support services outside the University system can be obtained through the Cleveland Rape Crisis Center. College Conduct proceedings, as well as special guidelines for cases involving sexual misconduct, are detailed in the Title IX Policy: Discrimination on the Basis of Sex & Sexual Misconduct, found on-line at: http://www.notredamecollege.edu/student-life/student-life-resources/Title-IX. The policy provides, in part, that the accused and the victim will each be allowed to choose a person to assist them through the process. Both the victim and accused will be informed of the outcome of the hearing. A student found responsible for violating the College’s sexual misconduct policy could be criminally prosecuted and may be suspended or dismissed from the College for the first offense. Student victims have the option to change their academic and/or on-campus living situations after an alleged sexual assault, if such changes are reasonably available. CRIME STATISTICS

The Department of Campus Safety and Security prepares an annual report in compliance with Crime Awareness and Campus Security Act of 1990. This report is prepared in cooperation with South Euclid Police Department, the Associate Dean of Students and the Director of Residence Life. Campus crime, arrest and referral statistics include those reported to NDC Campus Security, campus officials (including but not limited to directors, deans, faculty, staff, and coaches) and local law enforcement. Ohio law requires the prompt reporting to the local law enforcement by health care practitioners when they provide medical services to a person they know or reasonably suspect is suffering from wounds inflicted by a firearm or is a result of assaultive or abusive conduct. Notre Dame’s counseling office informs their clients of the procedures to report crime to Campus Security on a voluntary or confidential basis, should they feel it is in the best interest of the client. A procedure is in place to anonymously capture crime statistics disclosed confidentially during such a session.

Each year, an email notification is made to all enrolled students, staff and faculty that provide the web site access to this report. In addition to the web site, this report is available to current and prospective students through the Office of Admissions and the Department of Safety and Security.

The following statistics are obtained directly from reports made to the Notre Dame College Police/Security Department and South Euclid Police Department. Crime information is also obtained from other campus offices with security authority including, but not limited to, Student Affairs, Residence Life, College Counseling Services, and other college officials.

Crime is reported in the following categories:

On-Campus: Crimes reported and investigated by Notre Dame Police.

Residential Facilities: Crimes occurring in Notre Dame College Residence Halls. (This is a sub-total of On-Campus reports).

Non-Campus: Crimes reported to and investigated by the City of South Euclid Police that occur on private property owned and occupied by student organizations recognized by Notre Dame College.

Public Property: Public streets and sidewalks that are adjacent to Notre Dame College.

Disciplinary Referrals: Incidents that could be classified crimes that are referred to Judicial Affairs for adjudication. The Notre Dame College Police refers some arrests to Judicial Affairs. Those numbers include arrests referred by the police to Judicial Affairs. These numbers may also include policy violations that are not criminal offenses.

Per the Higher Education Act of 2008, signed into law on August 14, 2008, four new categories will be added under the “Hate Offenses” title for the 2008 criminal statistics.

Larceny-Theft – A person, with purpose to deprive the owner of property or services, knowingly obtaining or exerting control over either the property or services without the consent of the owner or person authorized to give consent; beyond the scope of the express or implied consent of the owner or person authorized to give consent; by deception, threat, or intimidation.

Simple Assault – A person knowingly causing physical harm to another or to another’s unborn.

Destruction, Damage to property, Vandalism – A person, knowingly or recklessly, causing or creating a substantial risk of physical harm or serious physical harm to any property of another without the other person’s consent.

Intimidation – A person knowingly causing another to believe that the offender will cause physical harm or serious physical harm to the person, the property of the person, the person’s unborn, or the person’s immediate family.

Per the Violence Against Women Act of 2013, signed into law on March 7, 2013, the Clery Act was amended to reflect the addition of new hate crime categories to be reported, beginning in CY 2013. These categories are National Origin, Gender Identity, Domestic Violence, Dating Violence, and Stalking.

Any incidents of sexual assault will be investigated in accordance with the Memorandum of Understanding with the South Euclid Police Department that was discussed earlier in this report. All other offenses described above will be investigated by the Notre Dame Police Department and the Dean of Student Affairs, and if appropriate, criminal charges may be filed and/or student disciplinary action may be taken against the perpetrator. Notre Dame College will also take all other steps reasonably necessary to protect the victim and the campus community.

FIRE SAFETY AND STATISTICS

Fires on college campuses have become all too common. Many of these fires occur in residence halls due to a number of factors: smoking, improper use of appliances such as microwaves and hot plates, plugging multiple items into a single electrical outlet, candles, etc. All resident students should check the Student Handbook for a list of approved appliances in residence halls.

Because of these fires, Notre Dame College will be conducting fire drills in the residence halls at least once per semester and at least once per academic year in the Administration Building. These drills will be performed on undisclosed dates and times. It is important that all members of the College Community treat these drills as if an actual fire is burning. The campus police department will be assessing each of these drills to better prepare everyone in the event of a fire.

All fire systems on campus have been installed and are maintained by Paladin Protective Services. All systems are in compliance with the appropriate local, state, and federal fire codes. Notre Dame College is continuously seeking improved technology to better warn the community of fires and potential fire situations. In accordance with the Higher Education Act of 2008, below are the statistics on fires in residence halls for the calendar year of 2012. A log of all fires occurring on or after August 14, 2008, is on file in the police station, located on the Ground Floor of the Administration Building, and may be viewed by any member of the public at large during normal business hours.
