A Letter From The President

This is the fourth edition of the Escambia Medical SocietyMembership Directory. It includes our physicians’ names,specialties, NPI numbers, practice addresses, phone numbers, faxnumbers and email addresses. Additionally, provided are hospitalcontacts, managed care company contacts, and county healthdepartment contacts. There are specifics on CME requirements andlicensure renewal. Ancillary services and pharmacies are listed in theback of the book.

The Escambia County Medical Society encompasses Escambiaand Santa Rosa Counties and we host important CME meetings on:risk management, domestic violence, and medical error, whichprovide our physicians with needed mandatory hours for re-licensure. Annually, we host a doctor’s day celebration where wegive gratitude and thanks to all the physicians and their families inthe community. ECMS members receive many benefits including:DocBookMD at no cost (a phone application with physician’s namesand ease of contacting them), discounted malpractice and workerscompensation insurance, the ability to get free consultation fromThe Florida Health Care Law Firm, and interaction and networkingwith other physicians in the community at our monthly meetings.

Escambia County Medical Society

The Escambia County Medical Society inconjunction with Santa Rosa County[ECMS] is a local professional associationof medical doctors and doctors ofosteopathy (M.D. & D.O.), that addressespolitical, social and economic issues

concerning the level and delivery of healthcare for patients and physicians. Started in 1873, the non-profit ECMS represents over 400 physicians living or

working in Escambia and Santa Rosa counties of Northwest Florida. The ECMSsupports the Florida Medical Association (FMA) and the American MedicalAssociation (AMA).

Mission:The mission of the Escambia County Medical Society is to promote the art andscience of medicine in order to improve the health of our community .

Vision:Tradition – Honoring the history of medical care in Escambia and Santa Rosacounties Service – Serving the needs of our community through the service  of our membersin the practice of medicine.Leadership – Meeting the challenges of the future and safeguarding ourcommunity’s health through organized collaboration on the local, state, and nationallevel.

Functioning as the champions of Healthcare, by:• Nurturing all physicians to seek self-improvement, leadership abilities and

Helping the community:• Physician referral and information service to the public• Sponsorship of the "WE CARE" Program offering free medical specialty care to

those in need. In 2012 approximately $5 million of free care was given toindigent patients in our community, provided by Baptist Health Care, SacredHeart Health System and West Florida Healthcare and the approximate 160physicians who volunteered as providers

The Escambia County Medical Society Foundation is a non-profit organization dedicatedto providing healthcare services on a volunteer and funding basis through its members. TheFoundation was created in 1994.• Primary goal is to assure access to adequate healthcare for the medically indigent

citizens of the area• To study and promote improved methods and facilities for healthcare• To pursue the protection of public health• Implement the means of financing healthcare at reasonable costs• To cooperate with other organizations and institutions interested in pursuing these

goals• Disseminate information concerning healthcare in general• Current Foundation programs include We Care and GoSeniors Voucher

Program, which are a Project of the Foundation• We Care Program: Founded in 1992 and now implemented by the Health

Department, the We Care program assigns medically indigent patients to physicianspecialists who provide in-kind medical care as volunteers.

• GoSeniors! Voucher Program Transportation Program: The ECMS Foundationoperates the GoSeniors! Transportation Program with the financial assistance fromthe Fellows Memorial Fund. The program started in 2011 to benefit healthcarecontinuity and has provided local residents, 60 years of age and older,transportation to physician appointments.

Escambia County Medical Society Foundation has limited funds to support the We CareProgram's patients. In the past, funds have been used for medications, equipment andtransportation to care settings.

You have a right to be proud of the work of the Escambia County Medical Society Foundation. Notevery medical society has a charitable arm. And not all medical society charitable arms are as active asyours. The Escambia County Medical Society Foundation has two major ongoing programs, which, withyour participation, provide real help and care to the citizens of Escambia County. You should be veryproud.

The older of these two programs is the We Care Program. This is the program that was initiated bythe Medical Society Indigent Care committee under the Leadership of Drs. Donna Jacobi, StuartShippey, Reed Bell and others. The work of setting up the processes, of enrolling physicians and gettingthe kinks in the system worked out was enormous. As you know, doctors are masters of hard work. Totheir credit, they got it done. The first patients were seen in March of 1992. The program had a clinic oneday a week. From that clinic, referrals were made to specialists on a rotating basis, as needed.

In 1994 the next big step forward was made. The Escambia County Clinics opened their doors in anew facility on Palafox and the We Care Clinic, being no longer needed, was closed. That same year, thename of The West Florida Medical Foundation, Inc. was changed to The Escambia County MedicalSociety Foundation, Inc and its bylaws were rewritten to cover the mission of the We Care program.Under the new bylaws and incorporation, an agreement was struck with the County Health Departmentto manage the screening of patients and assignment to specialists. The administrative costs were sharedby agreement.

We Care was a very complex operation to set up. It has been running more or less smoothly for solong now, that we may forget all the work that actually still goes on within it. Its service to ourcommunity still depends on your participation. Patients who are seen in the clinics or in privatephysician offices who cannot afford the specialty care or treatments are still processed out to thedoctors and facilities in the community who donate their time on a rotating basis. If not enoughspecialists in one specialty volunteer then the ones who do have a disproportionate burden. The morewho volunteer, the easier it is for the patient to be seen and the less the burden on any one physician.The more of us who volunteer, the better the outcomes for everyone.

Last year between, December 1, 2011 and November 30, 2012, physicians in our communitydonated $1,045,547.68 through the We Care Program. In that same time period hospitals and otherhealth care facilities here donated $3,971,704.87. Those are amazing figures. We are a good communityfull of good people.

The more recent program, begun in May 2011, is called Go Seniors. This is a voucher programfunded by a grant from the Fellows Memorial Fund. The Foundation issues vouchers worth $10 each todoctor’s offices. These vouchers are to be given to selected senior patients to provide cab fare to andfrom medical appointments. After a successful first year in which $30,000 in vouchers was distributed,the program was reviewed and the grant renewed for another year and another $30,000. It worksthrough the doctors’ offices that give the vouchers to the seniors who need them. Without your help forthe seniors, it does not get done.

Over the years the Foundation has initiated and participated in various charitable activities. Atdifferent times the Foundation has sponsored other charitable causes. It has given prizes to winners ofthe local science fairs for students. It provided money for a public service billboard. It piloted a projectdesigned to bridge the gap between hospital and home care for elderly patients living alone. The twocurrent projects are keeping the Foundation fully engaged. It is your participation in the programs andyour tax deductable donations that keep it all going. By the way, if you see a need in our communitythat might fit with the Foundation’s purpose, please let us know..

The money for the Foundation comes largely through tax deductable donations from the membersof the Escambia County Medical Society.

How To Write Your Legislator

1. Know your legislators’ district(s) and the correct spelling of their names.Refer to district maps and directories.

2. Use the following format for addresses:

3. Write on personal stationery, your organization’s letterhead, or on plainpaper. A personal letter is best! Your return address should be on theletter, not just on the envelope. This will enable your legislator to reply.

4. Do not use post cards or form letters except when advised to do so bythe FMA Department of Governmental Affairs.

5. A good rule to follow is one subject per letter. Try to keep your letter toone page no matter how important the issue. This gives your letter moreimpact and makes a reply easier. It also takes up less of the staff’s andlegislator's time.

6. Make clear the position of the issue you are on, and ask the legislator tosupport your position.

7. Refer to exact bill numbers if available and short or popular titles. YourFMA Governm have it.

8. Don't threaten or write in a belligerent tone.9. Don't remind them of broken promises.10. Don't write so often that your letters lose their impact.11. Illustrate your position with a local example.12. Sign your name legibly, and type your name under your signature.

The Escambia County HealthDepartment has placed great emphasis onincreasing accessibility and availability ofimmunizations for children and adults. Allchild and adolescent immunizations inaccordance with the Bureau ofImmunizations Schedule and the FloridaSchool Guidelines are available to eligiblechildren ages 0-18 free of charge. RequirementsLicensed medical doctors are renewed by the department in two groups:Group 1 – current license will expire at midnight, Eastern Time, January 31, 2014Group 2 – current license will expire at midnight, Eastern Time, January 31, 2013

The department will renew your license upon receipt of:1. Completed Renewal application2. Evidence that you have practiced medicine or have been on the active

teaching faculty of an accredited medical school for at least two yearsof the immediately preceding four years*

3. Verification of your current status relating to prescribing controlledsubstances for the treatment of chronic nonmalignant pain

4. Required fees (renewal and background screen fees).5. Your current primary place of practice address6. Login to complete Physician Workforce Survey7. Login to verify your practitioner profile8. Complete the financial responsibility form

* If you have not actively practiced medicine for at least two years of theimmediately preceding four years, the board shall require you tosuccessfully complete a board-approved clinical competency examinationprior to renewal of your license. The board has approved the SpecialPurpose Examination of the Federation of State Medical Boards of theUnited States (SPEX) as the board-approved clinical competencyexamination that must be completed prior to renewal of the license. For thepurpose of this section, “actively practiced medicine” means the practice ofmedicine by physicians, including those employed by any governmentalentity in community or public health, as defined in Chapter 458, FloridaStatutes, including physicians practicing administrative medicine.

Any person holding an active license to practice medicine in the statemay convert that license to a limited license for the purpose of providingvolunteer, uncompensated care for low-income Floridians. The applicantmust submit a statement from the employing agency or institution statingthat he or she will not receive compensation for any service involving thepractice of medicine. The application and all licensure fees, includingneurological injury compensation assessments, shall be waived.

To ensure you receive notification from the department regarding therenewal, you must have on file with the department your current mailingaddress. Failure to renew an active or inactive license by the expiration datewill result in the license being placed in delinquent status. Failure by adelinquent licensee to become active or inactive before the expiration ofthe current licensure cycle renders the license null and void without anyfurther action by the board or the department.

A licensee who remains on inactive status for more than two consecutivebiennial licensure cycles and who wishes to reactivate the license may berequired to demonstrate the competency to resume active practice bysitting for a special purpose examination or by completing otherreactivation requirements.

ProcessAt least 90 days before your license expires, the department will mail you

a renewal notification postcard (link to an image of the postcard) to yourlast known address of record. You will have until midnight on the day yourlicense expires to renew. Failure to renew an active or inactive license by theexpiration date will result in the license being placed in delinquent status.Failure by a delinquent licensee to become active or inactive before theexpiration of the current licensure cycle renders the license null and voidwithout any further action by the board or the department.

Group 1 – current license will expire at midnight, Eastern Time, January 31,2014. Delinquent licenses that expired on January 31, 2012 become null andvoid on February 1, 2014.

Group 2 – current license will expire at midnight, Eastern Time, January 31,2013. Delinquent licenses that expired on January 31, 2011 become null andvoid on February 1, 2013.

Domestic Violence Due Date

Your due date to take Domestic Violence for the first time is based on the date you were initially

licensed.

If you were initially licensed prior to 8/1/06 you would follow thechart above because you were licensed prior to the implementationof the statute that requires domestic violence. Once you have takenthe course for the first time, you have 6 years to complete it again.

If you were initially licensed after 8/1/06 you have 3 bienniums (6years) to complete the course. Example: A Physician expiring 1/31/13initially licensed 5/31/08 would not have to complete Domestic Violenceuntil the 13/15 biennium and would not follow the chart above.

Whenever you chose to take Domestic Violence for the first time (withinthe timeframe above) you have 6 years from that date to complete it again.

CME Requirements & Licensure Renewal

• 38 hours of general CME• Up to five credit hours per biennium may be fulfilled by performing

pro bono medical services for entities under the Department ofHealth, Volunteer Health Care provider programs, in an area of criticalneed and in Community and Migrant Health Care Centers.

• Three to six credit hours may be fulfilled by serving as a monitor• Up to five credit hours may be fulfilled by any volunteer expert witness

who is providing expert witness opinions for cases being reviewedpursuant to Chapter 458 or 468, F.S., in the area of risk managementfor each case reviewed up to a maximum of 15 hours per biennium

• Five credit hours in the subject area of risk management or medicalethics may be obtained by attending one full day or eight hours,whichever is more, of disciplinary hearings at a regular meeting of theBoard of Medicine in compliance with the following:

• The licensee must sign in with the Executive Director of the Boardbefore the meeting day begins.

• The licensee must remain in continuous attendance.• The licensee must sign out with the Executive Director of the Board at

the end of the meeting day or at such other earlier time asaffirmatively authorized by the Board. A licensee may receive CMEcredit in risk management or medical ethics for attending thedisciplinary portion of a Board meeting only if he or she is attendingon that date solely for that purpose; he or she may not receive suchcredit if appearing at the Board meeting for another purpose

NOTE: Up to 5 hours, per biennium, of continuing education credit may befulfilled by performing pro bono medical services, for an entity serving theindigent or underserved populations or in areas of critical need within thestate where the licensee practices. Department of Health, MedicalQuality Assurance will verify apractitioner’s continuing education recordin the electronic tracking system at thetime of renewal. Practitioners will be ableto view their course history in thecontinuing education tracking system freeof charge. The course history will showall the courses that have been reportedfor the practitioner.

If the practitioner’s continuingeducation records are complete, they willbe able to renew their license withoutinterruption.

If the practitioner’s continuingeducation records are not complete, theywill be prompted to enter their remainingcontinuing education hours beforeproceeding with their license renewal.

Why is continuing education beingverified at renewal?Continuing Education is a requirement torenew a professional license.Section 456.025(7), F.S. requires theDepartment to implement an electroniccontinuing education tracking system foreach biennial renewal cycle and tointegrate such system into the licensureand renewal system. The two systems are now integrated.

When will this change becomeeffective?Beginning with licenses expiring May 31,2013, practitioners will be prompted toreport continuing education creditsduring the renewal process.

Can I create an account in thetracking system prior to beinglicensed?No, you will not be able to create anaccount until you receive a licensenumber from the Department of Health.Students need to know this informationand once they are licensed beginreporting their continuing education.

What will happen if I do not havethe required continuing education forrenewal?Beginning in 2015 you will not be able torenew a license without having yourcontinuing education reported into thecontinuing education tracking system. Ifyou do not have the hours to report,your license will move to a delinquentstatus at expiration. In order to renew adelinquent license you will be requiredto complete the continuing educationrequirements. Additional fees mayapply.

Do I have to wait until licenserenewal to report my continuingeducation credits to the electronictracking system?No, you can report your hours free ofcharge anytime during the biennium byregistering for the Free Basic Account.The Department encourages you toreport early to avoid a delay in thelicense renewal process. The Department of Health will now verify a practitioner’s continuingeducation record at the time of license renewal. If a practitioner’s continuingeducation record is incomplete they will be prompted to report their hours.

The project will be implemented in two phases. The first phase (optionalphase) will prompt practitioner’s to input required continuing educationhours, but will not prevent licensure renewal. The second phase (mandatory)will require reporting of all required continuing education hours in order toproceed with license renewal. LABORATORY LICENSEIf you will be performing any laboratoryservices in your practice, you mustcomply with the Clinical Laboratory Act(CLIA) of 1998 and state licensurerequirements. Please refer to the FMAarticle on laboratory licensure foradditional information.

TAX IDENTIFICATION NUMBERAs an employer, you will need anEmployer Identification Number (EIN)from the IRS. To apply for an EIN, youmust fill out Form SS-4. It Helps to Review Stark Reg Issues

The Stark Regs (1) forbid doctors and their immediate family members fromreferring their patients to businesses they own which provide Adesignated healthservices,@ and (2) contains a long list of permitted financial relationships betweenhealth care providers. The list of what constitutes a “designated health service” (DHS)includes PT, rehab, diagnostic imaging, clinical lab, DME, and home health. A“physician” means an M.D., D.O., chiropractor, podiatrist, optometrist or dentist. An“immediate family member” is a husband or wife; birth or adoptive parent, child, orsibling; stepparent, stepchild, stepbrother, or stepsister; father-in-law, mother-in-law,son-in-law, daughter-in-law, brother-in-law, or sister-in-law; grandparent or grandchild;and spouse of a grandparent or grandchild. In short, if you or your family memberowns a DHS, don’t refer to it. Unless of course your situation falls within one or moreof the gazillion exceptions.

A few key changes from the third set of revisions (so called Stark III) which affectphysicians are helpful to keep in mind. For instance, the way fair market value ofphysician compensation is determined in the Stark II regs has been simplified andnow depends on an amorphous consideration of the transaction, its location andother factors. The clear formulas contained in Stark II was dropped and this makesthe need for an expert FMV study even more compelling.

Perhaps the most impactful change for physicians deals with marked up servicefees. Under the Stark III regs, the technical and professional components ofdiagnostic testing may not be marked up unless the party providing the technical orprofessional service is a full time W-2 employee of the billing entity. Any physicianwith a component billing arrangement or time share arrangement will need to havethem reexamined in light of the new regs.

Another significant change deals with group practice physician bonuscompensation, which now prohibits diagnostic x-rays, diagnostic lab tests and otherdiagnostic test revenues from being billed incident to the physician service and frombeing figured into a physician bonus calculation unless the group practice physicianpersonally performed the test.

Some of the other provisions that impact physicians include:• Independent contractor physicians have to provide their services directly (not

through employee leasing organizations), via a contract and in the grouppractice’s facilities

• Productivity bonus compensation may be based on services personallyperformed by a group doctor and incident thereto (e.g., PT and prescriptiondrugs, but not a diagnostic test or hospital admissions)

• Parties to rental arrangements who want to change the rental rate of a rentalagreement after the initial 12 month period must terminate the rental agreementand enter into a new agreement with the different rental rate

• Clarification that space and equipment leases must provide for the exclusive useof such space and equipment during the leased periods

• There may be certain restrictions placed on physicians recruited by hospitals togroup practices, which can include prohibition on soliciting patients andemployees, requiring the recruit to pay for losses above any hospitalrecruitment payments, reasonable liquidated damages if the physician ceases towork for the practice but remains in the community

• Each physician in a group practice is deemed to have the same compensationarrangements with the same parties that the group practice has

• The rules regarding hospital recruitment have been loosened up with respect torural hospitals

The so called “75% Rule” continues to be confusing to doctors. As most physiciansknow by now, there is a mechanism in the Stark regs that allows them to refer theirown patients for DHS provided by their own practices. That so called Agrouppractice@ exception is key for the provision by practices to a multitude of ancillaryservices and is quite complex. It is only pertinent if the practice wants to provide DHSto its patients.

Being a group practice requires, among other things, a single legal entity, a taxidentification number, a Medicare group number, billing and collecting everythingthrough the tax identification number and Medicare group number. It also requiresthat the doctors who are part of the group practice to devote substantially all of theirprofessional time to the group practice. They could not, for instance, be in fivedifferent groups.

So what does Asubstantially all@ mean? Under Stark, it means that the doctors inthe practice devote, on average, 75% of their total professional time working throughthat particular group practice (that provides the designated health service to itspatients). As such, if there are two physicians in the practice, and if one of themspend 100% of his total professional time working through the group, but the otherspends only 25% of her total professional time working through the group, they failthe group practice test because they do not spend, on average, 75% of their totalprofessional time working through that practice. They spend only 62.5% (125% dividedby 2Bthe number of doctors).

Florida confuses the issue. While it has a law like Stark, it has not clearly said whatAsubstantially all@ means, though at least one declaratory statement from the Boardof Medicine opines that the federal definitions will be applied (at least by thatlicensure board). Florida law further confuses the issues by doing two tricky things:(1) not allowing a practice that provides DHS to its patients to provide DHS to anyonewho is not a patient of the practice, and (2) making one small exception for diagnosticimaging services. Moreover, if the practice obtains the exception that allows it to takein outside patients for diagnostic imaging, then EACH DOCTOR in the practice has tocomply with the 75% Rule!

Generally speaking, a Florida medical practice that provides, for instance MRI,clinical lab or physical therapy services to its patients, may not provide those servicesto people who are not patients of the medical practice. Those Aoutside patients@cannot receive designated health services from the group practice. As mentioned,however, the state exception that applies to diagnostic imaging services (which doesnot apply to any designated health service other than diagnostic imaging) allows upto 15% of a practice’s diagnostic imaging services to be performed on Aoutsidepatients@ if the practice registers to do so through Florida’s Agency for HealthcareAdministration (AAHCA@).

So, to rehash:

1. A Agroup practice@ or solo practitioner can provide designated health servicesto their own patients;

2. One of the requirements of the Agroup practice@ exception is the 75% Rule,which applies on average to the physicians in the practice; and

3. If the practice also provides diagnostic imaging services to Aoutside patients@via registration with AHCA, EACH doctor in the practice must devote at least75% of his or her total professional time working through the practice.
