    a different type of hard drive. Harvey then stated that they used a hammer or other tool and destroyed thehard drive. Harvey then stated that Petruzzi then took the computer tower and destroyed drive back to the5th floor. Furthermore, Harvey stated that Prichard was the Executive Officer to Lamberti.Mr. Harvey then stated that he recalled that the blue Dell tower was purchased for the Sheriff'sadministration years ago and that he remembered that Lamberti still had the blue computer and he did notbelieve that anyone else had a similar computer. Harvey stated that he never accessed the hard drive.On August 13 2013, I obtained a sworn, recorded statement from Mr. Battista. The following is a synopsisof his statement:Mr. Battista advised that he recalled Mr. Petruzzi requesting assistance to remove, and destroy a harddrive. Battista stated that Petruzzi brought a blue, Dell XPS computer tower to the BSO Computer HelpDesk. Battista stated that Petruzzi informed him that the computer belonged to former Sheriff Lamberti.Battista stated that the drive was removed and destroyed by smashing it with a hammer. Battista statedthat they do not use a data wiping program anymore because the software was unreliable. Battistaconfirmed that while he was destroying the drive, he suffered a laceration to his hand. Battista recalledPetruzzi stating that the task was ordered by Sergeant Prichard. Battista stated that Petruzzi was orderednot to leave my side until the drive was destroyed and put back into his hand.On August 16 2013, Sergeant David Fernandez, CCN 11702, from the Office of Public Corruption and Iobtained a sworn, recorded statement from Sergeant Prichard. The following is a synopsis of hisstatement:During the statement I displayed former Sheriff Lamberti's blue, Dell XPS computer tower. SergeantPrichard confirmed that the computer had been assigned to Lamberti. Prichard stated that he gave thecomputer to Mr. Petruzzi at the end of November, December (2012) maybe. Prichard advised that hedirected Petruzzi to make copies of everything that was on the file, and make COs of emails andeverything that was on the hard drive, and that was put into an archive box up on the 51h floor storage area.Prichard advised that Tony Petruzzi and Courtney Harvey, I think were involved with that. Prichard statedthat he received COs and that he placed the COs in an archive box. Prichard advised that he believed thatthere were four COs that were placed into the archive box. Prichard further explained that Petruzzi, andHarvey were responsible for mirroring Lamberti's hard drive. Prichard stated that they (Petruzzi andHarvey) were supposed to wipe it (the hard drive) clean, that's what I was directed to do. Prichard statedthat Petruzzi left with the computer and returned with the CO's and a hard drive. Prichard further stated hedid not know if the hard drive that Petruzzi returned with belonged to Lamberti's computer, but the harddrive was destroyed. Prichard also recalled the hard drive had a little bit of blood on it. Prichard statedthat he didn't know why they destroyed the drive; it was only supposed to be wiped clean. Prichard advisedthat he was directed by Lamberti to have the drive wiped.     the fifth floor of the BSO Public Safety Building. Prichard advised that he did not have a property receipt ora table of contents for the COs or the contents of the archive box.I asked Sergeant Prichard, What was contained on the hard drive? and Prichard responded, As far as Iknow, just the emails, calendar events, and I never really went into his files to see what was on there. Ithen informed Prichard that emails are contained on network servers, and inquired if he ever accessedLamberti's hard drive. Prichard responded, No, never, alii ever did was his emails and calendar. Prichardstated that when he received the destroyed drive he handed it to Lamberti. Prichard reiterated that hedirected Petruzzi to make copies of the hard drive and to wipe the hard drive. Furthermore, he stated thathe instructed Petruzzi to stand by until the copies were made and until the drive was wiped clean.Prichard concluded by stating that he was 100% sure that he received COs, and he was pretty sure it wasPetruzzi. Prichard verified that he did not access the COs to verify the copies were made.After the conclusion of the statement, Sergeant Prichard offered to escort members of the Division ofInternal Affairs and the Office of Public Corruption to the storage area where he placed the archive box andCOs. Captain Cedeno, Sergeant Fernandez and I, escorted Prichard to a storage room on the 5th floor ofthe Public Safety Building. Prichard pointed to a set of shelving where he left the archive box that hebelieved was labeled Lamberti. No boxes labeled Lamberti were located; however, the Office of PublicCorruption retrieved numerous archive boxes from that storage room on June 7, 2013, and the boxes arecurrently in their possession. The contents of the boxes were reviewed and one CD-R was located. Areview of the CD-R was conducted and email content (approximately 97 emails) was stored on the CD-R.The CD-R is in the possession of the BSO Office of Public Corruption. The additional three CD-Rs werenot located and are unaccounted for.After the interview, Sergeant Prichard contacted me via email, and requested me to contact him. Prichardadvised that he may have made an error in his statement. Prichard stated that Mr. Patrick Giordano, CCN8656, of the BSO Technical Support Unit, may have been the one who made copies of the computer harddrive, and not Mr. Petruzzi.On August 20, 2013, I obtained a sworn recorded statement from Mr. Giordano. The following is asynopsis of his statement:I asked Mr. Giordano, At any time were you directed to obtain or make copies of anything from Sheriff AILamberti? and Giordano replied, Yes. Giordano advised that he was asked by Sergeant Prichard to geta copy of Lamberti's emails and contacts. Giordano stated that he retrieved the information from NetworkAnalyst, Mr. Leighton Peart, CCN 8322. Giordano advised that he requested Peart to provide him a copy ofLamberti's emails and contacts; that are contained on network servers. Giordano advised that Prichardrequested him to retrieve the data, and that he provided Prichard with he believes two COs containing thedata. Giordano stated that he believes that he wrote on the COs and explained, I usually do, I'm not100%, usually I wrote on it, em ails, contacts, I usually put on the COs what I copied.     statement, I displayed a CD-R with handwriting on the disc and Giordano advised that the handwriting onthe D was not his, and he did not recognize the handwriting. Giordano stated that he never accessedLamberti's desktop computer, and he did not make any copies from that machine. Giordano advised thathe does not know what was contained on the computer. Furthermore, Giordano advised that Prichardinformed him that the copies were at the direction of the Sheriff.The investigation revealed that no copies were obtained from former Sheriff Lamberti's computer harddrive.CASE STATUS:At this time this investigation will remain classified as Police Information until which time evidence of acrime exists.
