DEVELOPMENTS AFTER THE 2013 UNGA RESOLUTION
The Burmese authorities have failed to implement most ofthe recommendations from previous United Nations GeneralAssembly (UNGA) resolutions, in particular Resolution6!"#", adopted in "$%&' n some areas, the situation hasdeteriorated as a result of deliberate actions by theauthorities' This briefer summaries developments on the*round +ith direct reference to ey para*raphs of theresolution'
The authorities have either failed or refused to protect
vulnerable populations from serious human ri*hts violations,or pursued essential le*islative and institutional reforms,effectively blocin* Burma-s pro*ress to+ards *enuinedemocracy and national reconciliation' This has been partlydue to an assumption that the UNGA resolution +ill either becanceled or severely +atered do+n as a trade.off for smallerconcessions'

Appendix IIContradictory ceasefire talks between the regime and ethnic armed groups
Peace talks for a nationwide ceasefire agreement have encountered several stumbling blocks since talks began in
November 2013, following the formation of a 16-member coalition of ethnic armed groups:
1. Federalism is not on the table: The regime and the Tatmadaw have continuously resisted the demand for a
federal union and federal army, which would allow some autonomy and fair representation in the military.1
2. The Tatmadaws unreasonable demands: The Tatmadaw has put forward their own prerequisites for
coming to the negotiation table. These demands, first voiced in April 2014, include:
To abide by existing laws: This requires the ethnic armed groups to disarm, putting them in a vulnerableposition, as there is no guarantee to stop attacks by the regime and the Tatmadaw. The Tatmadaw has
violated nearly all prior ceasefire agreements, including those signed during under President Thein Sein.2In
Mon and Chin States where there is no active conflict, troops have attacked civilians, including children.3
To abide by the 2008 constitution: Reforming the 2008 constitution is essential to allow for the ethnicarmed groups central demand for a federal union, as the charter gives the central government full decision-
making power over all states and divisions. Other crucial issues are the provision that grants 25% ofparliamentary seats to the military (effective veto over constitutional amendments), and the provision that
allows the regime to claim and make decisions over natural resources and power-sharing in Burma.4
3. Exclusion of ethnic groups: In August 2014, the regime indicated that it would only sign the ceasefireagreement with 15 out of 16 members of the ethnic armed groups peacemaking team, and with two non-
member ethnic groups. Ethnic groups have compared this decision to the 1947 Panglong Agreement, which
also excluded several ethnic groups, and preceded the civil war that has continued until today.5
4. Contradictions with the Tatmadaw: When the Tatmadaw put forward their six demands [See below, table]in April, many of the ethnic armed groups said it would be impossible to negotiate further. Talks resumed at theend of May after assurances that disarmament and acceptance of the 2008 constitution would not be necessary.
Yet, in August, Tatmadaw Commander-in-Chief Sr Gen Min Aung Hlaing reiterated the six demands to ethnic
leaders from Shan State, and declared the Tatmadaw would defend the 2008 constitution at all costs.6
