Dear Judge Michael Spitzer:

Instant request, pursuant to the Freedom of Information Act (1988) is filed directly with you,since response on a previous request uncovered that Ms Sharon Saban-Safrai holds nolawful appointment, pursuant to the Regulations of State Service, as “Freedom of InformationOfficer” of the Administration of Courts.

Additionally, instant request is filed directly with you, as a Request to Inspect, pursuant to Regulations of the Courts, Inspection of Court Files (2003), Article 5, which authorizes theDirector of the Courts to permit inspection of court files.

Therefore, I request a response on instant request on paper, by mail, to my mailing address,provided above, under your hand-signature. Alternatively – under the hand-signature of aduly appointed “Freedom of Information Officer” of the Administration of Courts, together

with a copy of a record, documenting his/her lawful appointment, pursuant to the Regulations of State Service.

FOIA Request fee was paid through the government payment portal, payment certificate#66815098.

A. I herein request any record (paper, electronic, or in any other media), relative tothe right of the public, or parties in a case, to access, alternatively – relative toprohibition of access, to judges' electronic signatures (certified electronic

signatures, as defined in the Electronic Signature Act) and their control data ondecision and judgment records in Net-HaMishpat – IT system of the district and

magistrate courts.

To this date, in all cases, when I requested to inspect the electronic signature control dataon decision and judgment records, which I was permitted to inspect, access was denied tosuch data, including but not limited to user's name, date and time of signature, and codeindicating the execution of a certified electronic signature.

Net-HaMishpat system includes the capabilities for the execution of electronic signatures by judges on decisions and judgment records. However, the public and parties in the cases areonly provided in Net-HaMishpat access to records that are the products of rendition, and which do not permit access to data that would ascertain that an electronic signature indeedexists and/or its control data.

Net-HaMishpat also includes the capability for the insertion of graphic signatures (images of signatures, which are not certified electronic signatures) by judges on decision and judgment records. However, the public and parties in the cases are only provided in Net-

HaMishpat access to records that are the products of rendition, and which do not allow todistguish between a graphic signature and an electronic signature.

In this regard, significant information is provided in the case of Judge Varda AlSheikh, who was caught perverting/falsifying a protocol record. [1] Judge AlSheikh claimed that she hadonly affixed a graphic signatures on the protocol record, which was provided to the counselin that case, and that she did not consider such graphic signature valid, or indicatingfinality. She claimed that she affixed an electronic signature on that protocol record only

later on, after it was altered. The State Ombudsman of the Judiciary indicated that only agraphic signature was affixed on that protocol record, and that at no time was an electronicsignature affixed on it at all...
