eCDR Process – Livescan

Livescan Fingerprinting must be completed prior to

complaint entry. Refer to Title 53 regarding

fingerprinting.

Livescan will:

• Activate PSA

• Link offenses on a complaint to the defendant

• Allows dispositions to appear on Criminal Case

History (CCH)

• Pre-fill defendant’s information into eCDR

eCDR Process – New Forms

Two new forms:



• The Attorney General is directing law enforcement use

these forms in accordance with Directive No. 2016-6


eCDR Process – Affidavit of Probable Cause

• Detailed description of facts for the judicial officer to

determine probable cause.

Consists of four sections:

1. Description of relevant facts and circumstances to

support Probable Cause

2. Complainant’s knowledge of facts

3. Description of the victim’s injuries

4. Confirmation of oral testimony, if provided; signature

and date

• Purpose: The Affidavit/Certification is to more fully describe the facts of the

alleged offense so that a judge or authorized judicial officer may determine

probable cause.

• Filed electronically within eCDR

Establishing Interim Policies, Practices, and Procedures

to Implement Criminal Justice Reform, encourages pre-

charge screening of criminal complaints as a method to

increase efficiency in the criminal justice process

• Allows police generated complaints to be reviewed

electronically before submission to the court

• System sends email to Senior Officer or Prosecutor

• Run PSA is optional. PSA may be processed before and/or

• Accept: Charge has been accepted.

• Modify: Updated charge must be selected. Statute number or

description may be entered

• Decline: When all charge(s) are declined, system will display

an error message: Complaint must have at least one Active

charge, please correct.

• Save: Saves changes and leaves user on the current screen

• Run PSA: Opens separate window with PSA risk scores.

PSA may be processed before and/or after review.

• Return to Officer: Returns complaint to the officer and

returns user to Home Page. Complaint will be displayed in

officer’s My Cases list.

• Submit to Court: The Complaint may be submitted to the

court when updates have not been applied.

eCDR Process - LE Telephonic Probable Cause

Effective: January 1, 2017

• R. 7:2-1(h) – Electronic CDR-2 Warrant

• Extends the authority to issue telephonic

warrants to authorized Court Administrators

and Deputies

• Replaces the manual telephonic warrant

issuance process with a fully electronic

process


The rule provides two ways to activate the warrant in eCDR:

• Judicial officer accesses eCDR, determines probable

cause and issues the warrant in the system

OR

• If Judicial Officer cannot promptly access eCDR,

s/he authorizes the law enforcement officer to

“activate” the complaint in eCDR

Note: The issuance is still authorized by the Judicial

officer via telephonic authorization.

• Outstanding CDR2 warrants issued prior to 1/1/2017 bail

determination. Law Enforcement may submit

determination based on telephonic authorization by a

judicial officer.

Please note the following:

• Livescan will not populate inchoate crimes into

eCDR (Preparatory Classification field)

• The inchoate charge (ie, attempt, conspiracy) may

need to be entered into eCDR
