ANNEXURE I

Annexure I - Preamble

1. Quotations are invited from those vendors registered with BPCL, with keenness to work in Eastern Region and to whom quotation has been sent. Please quote your best rates.

2. Vendors who have been “Black listed” or have currently been put on “Holiday List”, by virtue of unsatisfactory performance, by any office of BPCL, are not eligible to quote for this tender. Quotations received from such vendors, shall be rejected.

3. The tender document has been uploaded on the BPCL E-Procurement web site http:// bpcleproc.in. All tenderers have to obtain digital signing certificate from any suitable certifying agency.

4. Using the digital signing certificate, vendors have to download the entire document and thoroughly go through the same. All documents have to be uploaded on the appropriate place in the EProcurement web site. After uploading the documents asked for & digitally signing the declarations, tenderers have to place their price bids as well on the E-Procurement portal & encrypt the same with their digital signatures.

5. All the bids shall be evaluated from the inputs made by the tenderers on the E -Procurement portal. Hard copies of the bids need not be submitted to this office, since the same shall not be considered for evaluation.

6. Signed hard copies will have to be submitted to BPCL by the successful bidder and / or by other bidders on demand by BPCL.

7. On opening of the tender vendors will be notified via email and the bids of all bidders can be viewed by logging into the EProcurement web site.

8. It is understood that the tenderers have thoroughly gone through the entire information placed in the tender enquiry & are committed to abide by the same.

9. This is a two Bid Tender. The tender comprises of two steps:

a. Techical bid.

b Price Bid

10. Only those vendors who have agreed to the specifications and the terms and conditions of the tender shall be allowed to bid for the tender. Vendors not agreeing to the terms and conditions stated need not bid.

11. The online bidding process is available in the EProcurement website.

12. Submission of bids by the vendor will construe that all the documents enclosed with the tender has been read , understood and agreed. -If the tenderer has been disqualified from the tender process prior to the award of the contract in accordance with the provisions of the Integrity Pact, BPCL shall be entitled to

demand and recover from Tenderer Price reduction amount by forfeiting the EMD/Performance Guarantee as per provisions of the Integrity Pact. -If the contract has been terminated according to the provisions of the Integrity Pact, or if BPCL is entitled to terminate the contract according to the provisions of the Integrity pact, BPCL shall be entitled to demand and recover from contractor, Price reduction amount by forfeiting the Performance Guarantee amount as per provisions of the Integrity Pact.

14. Bids/instruments will not be allowed to be submitted after the due date and time of closing of tender. BPCL does not take any responsibility for any delay in submission of bid due to connectivity problem or non-availability of site and/ or other documents to be submitted in physical form due to postal delay. No claims on this account shall be entertained.

ANNEXURE II ( special terms & conditions)

PROVIDING CONSUMABLE ITEMS FOR MPDs AT RETAIL OUTLETS/TERRITORY OFFICES IN EASTERN REGION Special Terms & Conditions: 1. COMPLETION TIME AND PERIOD OF CONTRACT: a) The material supplying period of completion will be 30 days from the date of call off letter issued for each site/location. b) Call off will be issued for each location (it will either at depot/territory location or existing Retail outlet in major district headquarter limit.) c) Agreement will be valid for a period of one year from the date of acceptance of tender till the ordered Quantity is completed, whichever is earlier. d) The contract may be extended for the same quantity as mentioned in the bill of quantities on the same rate/terms& conditions, if the same is mutually agreeable. Alternately if the entire quantity is not consumed that extention of time for a further period of one year can also be done of the same is mutually agreeable. 2. RATES, PRICES AND PAYMENT TERMS: a) The rates (inclusive all taxes) should be quoted for all States mentioned below: I. West Bengal. II. Bihar III. Jharkhand IV. Orissa V. North Eastern States (Territory Office at Guwahati) b) Rates quoted should be inclusive of all the taxes, duties, loading, unloading, transportation, octroi, other levies and other incidental chargesif any etc. for supply. c) No advance payment shall be made. d) The call- off letters will be issued by our Territories and payment shall be made by them within 30 days of submission of invoice with supporting documents and after the confirmation of intact receipt of materials from concerned location. The start date of calloff will be the date on which the vendor is intimated. Intimation can be in electronic (date on which the Purchase Order is sent by email) or physical form ( date on which the vendor receives the Purchase Order) e) Any fitting found defective on receipt / installation shall be replaced by the party immediately

without any extra charges. f) Vendors will have to enclosed EMD amount of Rs 100000/- for quoting in the tender. The Tender amount should be in the form of a DD in favour of “Bharat Petroleum Corporation Limited” payable at Kolkata. The EMD DD is to be sent physically with a covering letter mentioning the tender number on official letterhead to the undernoted address. The EMD amount should reach the address above before the due date and time, failing which the bid is likely to be rejected. In case the tenderer is registered with BPCL and has a valid registration letter from any office of BPCL, the vendor is exempt from EMD. For such vendors, please tick the exempt button in eproc EMD page and thereafter upload the registration letter. Bids without payment of EMD or without the uploaded Registration letter are liable to be rejected. Please note that having a vendor code in BPCL is not registration. Registration is only valid when the vendor possesses a valid letter of registration. g) This is an E-Tender and no documents are to be sent in physical form (except the EMD). The prices quoted shall remain firm for entire contract period irrespective of any reason whatsoever including increase in taxes indicated to arrive at a final rate during the contract period. h) Warranty period for material will be of one year from date of material received at BPCL locations.

i) The requirement indicated in the schedule is our consolidated approximate The quantities indicated are tentative and there can be upward or downward variation. j) BPCL reserves the right to call for negotiation if need is felt for the same to finalise the rates. k) Orders in the form of PO / Call-off letters will be issued by the Sales Officers /Territories. The rates quoted shall be valid for one year and they will remain firm till the supply is effected in all respects for the PO / Call-off issued prior to the closure of the contract period. The validity may be extended for one more year subject to mutual review / agreement.

l) Statewise VAT/CST details to be given separately. In case of change in tax during the contract

period, additional tax will be paid extra.

m) The final orders shall be placed only after submission of all statutory approval copies.

n) No mobilization advance will be given. Similarly, part payment towards materials supplied and price escalation will not be entertained. o) Payment Terms: Payments will be released as per the actual measurements within 30 days from the date of completion of work and submission of the final bill after deducting 10% retention money, and any other statutory levies if any, as applicable in the respective States. p) The 10% retention money will be released after one year provided measurement as per design criteria enclosed is demonstrated and no material defects in the supplied items. q) You have the option of submitting the bank guarantee (as per BPCL format) valid for 18 months (inclusive of 6 months of Lodgment period) from the date of completion of work in lieu of 10% retention money to be retained by us for 12 months. The value of the bank guarantee will be equivalent to 10% of the bill value and the same should be submitted to the respective Territory / Construction. Engineers. r) The stipulated time period for completion of each site would be maximum 30 days from the individual PO’s or Call off placed on you or as stipulated in PO or handing over of the site. s) If the successful tenderer does not complete the work in the stipulated time, the Company reserves the right to recover liquidated damages at the rate of 0.5% of the total PO or calloff value for every week of delay or part thereof subject to maximum of 5% of the total PO or calloff value until the work is satisfactorily completed and handed over. However delay in completion of a specific urgent job the maximum Compensation will be increased to 15% of the total PO or calloff value. Such damages may be deducted by the Company from any money due to the tenderer and further amount due from the tenderer shall be paid by the tenderer to the Company forthwith. t) BPCL reserves its rights to award / cancel jobs against these rates at its discretion. u) In case of any discrepancy between the general conditions of Tender and Special Conditions of Tender (as mentioned above), the Special Terms and Conditions of Tender shall prevail. v) Based on the actual requirements, BPC will be placing the call-offs (also called PO or allocations) from time to time. The successful tenderer shall be bound to accept call-offs up to 120% of the contract quantity. In case BPCL requires additional supplies (over and above the said 120% pro-rata level) during any period, then it can place call-offs for such additional quantities after getting a written confirmation from the successful renderer. w) MSME vendors have to upload related documents.

x) The tender is to be decided on item wise basis i.e Contract will be awarded to separate

vendors as per Item Wise L1 total financial outflow ( i.e, basic + taxes).

4. SPECIFICATIONS: a. The specification of the respective consumable items is as per enclosed details. b. Any deviations in our technical specifications will not be accepted. c. Material make required in case of all items other than hose pipes i.e. nozzles, nozzle spout, nozzle flap, swivel, breakaway & shear valve must be of OPW/ TATSUNO/ ZVA/ CATLOW make and in case of Hose pipe with couplings, it must be of Gates (Black snake - wired)/ Goodyear (Flexsteel Futura) make only. For the item Heavy Duty Nozzle Spout with Steel tip vendor has the option of supplying any other make apart from the ones specified above. d. The tender shall be evaluated on the basis of item wise quote. BPCL may decide not to award the contract for some or all of the items tendered. The rate quoted shall exclusive all taxes. Taxes will be payable as applicable. However, present tax details for each states to be uploaded ina separate sheet. 5. BILL OF QUANTITIES; a. The requirement indicated in the schedule is consolidated requirement of Eastern Region. b. The quantity indicated is only approximate and can vary downward. ANNEXURE III

TECHNICAL SPECIFICATIONS

Material make required in case of all items other than hose pipes i.e. nozzles, nozzle spout, nozzle flap, swivel, breakaway & shear valve must be of OPW/ TATSUNO/ ZVA make and in case of Hose pipe with couplings, it must be of Gates (Black snake - wired)/ Goodyear (Flexsteel Futura) make only. For the item Heavy Duty Nozzle Spout with Steel tip vendor has the option of supplying any other make apart from the ones specified above.

Specification for Auto Cut Nozzle Automatic Cut Off Nozzle pressure sensitive for Preset Pumps should have the following;-

1. Size of Spout 13/ 16" for Standard Duty,15/16” to 19/16" for Heavy Duty. ( PLEASE DO NOT QUOTE STANDARD DUTY NOZZLE WITH HOSE ADAPTER FOR THE ITEM MARKED ‘HEAVY DUTY’ )

2. Size of Inlet should be ¾” for Standard Duty and 1” for Heavy Duty. 3. Thread NPT threads suitable for hose coupling 4. Flow rate Standard duty 40 LPM , Heavy Duty 80 LPM 5. Material of Construction Die cast Aluminum body and Spout.

Internal parts shall be made of corrosion proof material. All'O' rings and gaskets should be of 'VITON' make only Nozzle should be light weight and easy to operate Nozzle shall be suitable for ethanol gasoline 15% Nozzle shall have UL/ATEX/KHK approval Nozzle shall have replaceable two piece spout Nozzle main valve should open against the flow of fluid. Nozzle should have a Flow lock design A copy of manufacture's batch test certificate for each batch of Nozzles that will be put to use must be made available Manufacturer should have facility in India to take care of after Sales Service Party quoting should be Authorized Distributor of Manufacture. ANNEXURE IV

GENERAL CONDITIONS: a. The road permits will be issued by BPCL. b. Liquidated damages shall be levied for delays, if any @ 0.5% of the value of the call off letters per week, subject to a maximum of 5% of the PO value. c. Performance bank guarantee is to be submitted by successful bidder not having valid registration in BPCL at the rate of 10% of the contract value, for the period of 18 months from the date of contract. Vendors would have the option of submitting DD of the amount also in place of bank guarantee. The EMD amount deposited can be also adjusted against the security deposit required to be submitted by successful bidder. d. The orders in the form of call off letters shall be issued by respective const. Group Managers/ Engineers situated at state headquarters/ Territory office of BPCL.(List shall be provided to the successful tenderer) e. The manufacturers test certificates/ all manuals should be provided by the party along with the material supplied.
