    MEMORANDUM REGARDING

    PUBLIC DISCLOSURE

    REQUIREMENTS

    FROM: Dennis Eagle, Director of Legislative and Political Action

    Previous to each session of the Washington State Legislature questions are raisednconcerning the rights of state employees to contact their legislators. This sessions no exception and, in order to clear up any questions, we have prepared the following

    statement that outlines the legal rights of employees in such matters. At the request of several members and staff, we have contacted the PublicDisclosure Commission regarding the obligations of a state employee to reportcontact with legislators.

     A state employee who writes, phones, or in some way contacts his/her ownlegislators, or other legislators on matters of concern to him/her as a constituentand/or citizen is not oblicated to report that contact.

    The only obligation an employee has to report contact with indivudal legislators

    may occur when that employee contacts legislators on an ofcial matter wherethe state employee is acting on behalf of his/her employing agency and on of-cial agency matters, or where a legislator contacts an employee under the cir-cumstances. Where an employee has contact with legislators under these cir-cumstances the employee should check with his/her supervisor on any reportingrequirements.

    It should be clearly understood that a citizen who happens to be employed bythe state is free to express his/her right to contact his/her legislators or other

    legislators, at any level (local/county/state/federal) and express his/her concernsor opinions on legislative matters.

    We remind you that when you contact legislators, you must do it on your owntime and not using any state resources. Phone calls should be from your per-sonal phone. Emails should be from personal devices.

    BUDGET OVERVIEW

    The primary task of the 2016 Legislative Session is to adopt a supplemental budget for the 2015-17

    ennium. The supplemental budget is intended to make necessary changes to the 2015-17 biennium

    esponse to growth in caseloads, enrollments, additional costs required to maintain existing services

    and respond to emergencies. Major changes are uncommon.

    The Governor’s supplemental budget proposes an additional $520.5 million in new spending. Of th

    $150 million is needed to pay for the massive res we had this past summer. Another $180 million

    needed to cover rising Medicaid caseloads and health care costs. DOC costs have increased $23 mi

    ion, and other caseload and cost increases are about $63 million. Beyond that, the Governor make

    few new targeted investments. 1

    t should be noted that the state’s structural budget decit remains a signicant problem. Since the

    Legislature adjourned last June, revenue projections have increased by $245 million while the cost

    maintaining existing programs increased by $700 million. 2

    We aren’t expecting a big ght over the supplemental budget. However, we are expecting a major

    budget battle during the 2017 Legislative Session as lawmakers craft the 2017-19 budget. Several

    cal problems will converge next year, making the task of writing a biennial budget much harder:• The costs to provide existing state services are growing faster than tax collections, resulting in

    structural budget decit for the state.

    • The Legislature is mandated by the Supreme Court to signicantly increase K-12 education

    funding by 2018 in what is known as the “McCleary decision.”

    • Last November voters approved Initiative 1366, which has the potential of reducing state sale

    tax collections by almost $1.4 billion a year.

    We anticipate a tremendous amount of political pressure to further cut state spending in areas other

    han K-12 education (general government and higher education) next year. Even after billions of doars in cuts during the Great Recession, and in spite of inadequate funding levels for most programs

    t is, we could be looking at more reductions in the near future.

    THE STRUCTURAL BUDGET DEFICIT

    n its November 2015 report, Economic and Revenue Forecast Council (ERFC) increased revenue

    projections for the current budget cycle (2015-17) by just over $100 million above its September

    forecast.3  ERFC now estimates the state’s current $38 billion budget will end with a surplus of $35

    million. 4

    However, costs to the state are growing faster than revenue. 5  ERFC is now projecting $500 milliondecit in the 2017-19 biennium. 6

    below pre-recession levels. 7  Personal income in Washington State is higher than the national avera

    and expected to grow even more in the future. However, state revenue has been declining as a shar

    of personal income for more than 20 years.8 

    n 1995, state and local revenue collections were equal to 6.6% of total personal income. By 2014 that ra

    had dropped to 4.9% -- and this downward trend is expected to continue in the future. 9  In fact, Washing

    State has fallen to 35th in the nation in terms of tax collections as a share of personal income.

    Washington’s tax system – what we tax and what we don’t tax – simply isn’t capable of meeting the

    tate’s needs any more. 11  Washington is a wealthy state, but we don’t tax wealth. Instead, we rely

    on the sales tax as our biggest source of revenue. 12  However, the sales tax only applies to goods, n

    ervices, and the purchase of goods is a declining share of today’s service-based economy. 13

    Over-reliance on a sales tax limited only to the purchase of goods is a major reason why studies hav

    hown that Washington has the most regressive tax system in the nation. 14

    There are other signicant structural problems with our state’s tax system. 15  Over the past 100 yea

    he state has enacted well over 600 tax loopholes worth billions of dollars. 16  As a result, small and

    marginal businesses pay far more in business taxes than do large, protable corporations. 17  Furtherhundreds of millions in sales tax revenue is lost to online shopping,18  and the Legislature enacted a

    arbitrary 1% cap on property tax growth that fails to keep up with ination. 19

    At the same time state tax collections as a percent of the overall economy are declining, costs for vi

    public services are growing. 20  Further, those costs will grow exponentially as demographic shifts

    oward an aging population result in even greater demands for health care and public services in the

    future. 21

    The result is the state of Washington has a structural budget decit that will only be resolved by in-

    creasing revenue and/or permanently reducing state spending. We will remain in a state of perpetuaausterity, with budget battles in the Legislature every year, until our structural budget decit is re-

    olved. 22

    THE IMPACT OF THE McCLEARY DECISION

    The McCleary case refers to a lawsuit originally led in 2007, by the Network of Excellence in Washi

    on Schools on behalf of the McCleary and Venema families, arguing the state was failing in its consti

    ional duty to fully fund K-12 education. 23  A trial was held in King County Superior Court in 2009.

    n response, the Legislature adopted HB 2261 in 2009 that redened basic education and set a deadlin

    of full implementation by 2018. 24  Despite passage of this legislation, the Superior Court ruled againshe state in 2009, the state appealed, and in 2012 the state Supreme Court ruled in favor of the plaintif

    and ordered the Legislature to comply with HB 2261 and meet its constitutional duty by 2018. 25

    While the Legislature has signicantly increased K-12 education spending in recent sessions, they

    have been unable to agree on a plan to fully fund all of the requirements of the law. As a result, the

    Supreme Court found the Legislature in contempt and issued nes to the state of $100,000 a day un

    compliance is achieved. 26  The ne itself isn’t a problem for the state nancially, but the cost of ful

    mplementing HB 2261 could be as much as $5 billion. 27

    Currently there is no consensus in the Legislature on how to come up with the funding necessary to

    comply with the court order. 28  The challenge in front of the Legislature is complex and controvers

    – and very expensive. 29 

    THE THREAT OF INITIATIVE 1366

    -1366 was the latest ballot measure from professional initiative-promoter Tim Eyman. 30 This initi

    ive, will decrease the state sales tax by one cent (from 6.5% down to 5.5%) unless Legislature vote

    o put a constitutional amendment on the ballot that would permanently and forever require a 2/3 vo

    of Legislature to raise taxes or close loopholes. 31 

    Eyman has run initiatives to require a 2/3 vote of the Legislature to raise taxes or close loopholes foimes in the past, and those initiatives were adopted by voters in 2007, 2010, and 2012.32  The effec

    was pronounced as the 2/3 vote requirement made it unfeasible for the Legislature to raise taxes dur

    ng the Great Recession. Finally, in 2013, the state Supreme Court put an end to the issue by declar

    he 2/3 requirement to be unconstitutional. 33

    The Court’s ruling was premised on the notion that the state Constitution could not be amended by

    nitiative or by statute. Instead, according the Article XXIII, amendments to the state Constitution c

    only happen if 2/3 of the Legislature votes to put the amendment on the ballot and it is then ratied

    voters.34

    -1366 proposes to work around that problem by forcing the Legislature to either forward Eyman’s

    preferred Constitutional amendment to the ballot or face a massive reduction in state revenue. 1-13

    was adopted this past November with 51.5% of the vote. 35  The state would lose $8 billion over six

    years if the sales tax decrease contained in I-1366 were to go into effect. 36

    WHAT WE ARE DOINGOngoing scal austerity has been harmful to all working families. Public sector and educator jobs

    have been lost, public works construction funds have been diverted to other purposes, and vital ser-

    vices have been slashed. Our economy and our communities will continue to suffer until the state o

    Washington creates a sustainable revenue system capable of keeping up with the demand for servic

    WFSE supports the new revenue necessary to stabilize the state budget and end the state’s perpetua

    budget crisis. Fixing the structural budget decit is a priority for WFSE’s lobbying and political ed

    cation efforts.

    WFSE opposes proposals that make the structural budget worse – such as revenue reductions or thecreation of new tax loopholes – at least until the state’s structural budget decit is resolved.

    WFSE will lead the ght politically, by supporting legislation and candidates that support a fair rev

    enue solution that lessens the regressive nature of our tax system and moves our state toward an eco

    omy that works for everyone, not just the wealthy.

    WFSE will educate members about the regressive, outdated nature of Washington’s tax system, iden

    ify working family-friendly ways to x the problem, and engage members in work that supports a

    olution.

    WFSE will work in coalition with other unions, community organizations and partners – providing nancial, messaging, and tactical support – to build as broad a movement as possible for a fair, susta

    able revenue system voters.

    MEMBER LOBBYING

    Tips for Meeting with Lawmakers

    1. Prepare for the meeting 

    Decide what to share and what you want your lawmaker to do.Learn about your elected ofcial by reading biographies and

    what positions s/he has taken on key issues.

    2. Start by introducing yourself  

    Say who you are, where you’re from, and what organization

    you’re with. If your lawmaker has done something positive onyour issue, this is a good time to say thank you.

    3. Be sure your message is short and concise 

    Most meetings with elected ofcials are short – anywhere from 5

    to 15 minutes, depending on their schedule. Before your meeting,

    prepare a few key points from key messages on your issue and

    from your own experience.

    4. Practice 

    It’s always worth the time to practice what you are going to say.

    If you are meeting as a group, practice together so you can use

    your time wisely and each play a role.

    5. Talk about what you know 

    You might get asked questions that you don’t know the answer

    to. It’s ok to say you don’t know. Answer what you do know and

    offer to get more information and follow up.

    6. Make a clear request 

    Ask for a specic commitment, don’t just ask for support.

    7. Listen 

    You can learn what’s important to your elected ofcial, how s/

    he makes decisions, and what questions s/he has. It helps build a

    relationship and makes you a more effective advocate.

    8. Leave information behind It’s good to leave a one-page fact sheet on your issue. Be sure it

    has your contact information.

    9. Meet with ofce staff  

    If your lawmaker isn’t available, it’s very useful to meet with the

    staff. Ofce staff will convey your message.

    10. Follow up 

    Send an email or call the ofce and thank them for their time. Be

    sure to restate your concerns and request, provided any addition-

    al information, and ask for follow up.

    Weekday Service

    Dash currently operates its non-legisltive session schedule: 7 a.m. to 6 p.mMonday through Friday, every 15 min-utes.

    Saturday Service

    Dash is not currently operating on Satdays. In 2015, Dash will operate on S
