Master Builder Victoria 1A WORD FROM THE EDITOR

A moment of your time...Behind my desk sit several stacks of extra copies of Master Builder from the past year. Among them is the April-May 2015 edition, the cover lines of which read “The Industry EBA: seeking the strongest possible outcome”. Is it odd to find ourselves focussed so intently on the very same thing nearly a year later?

Yes and no. Back in April, most of us would probably have guessed that by now the details of the Industry EBA would have long since been worked out, in excruciating detail. After all, as we know, the current EBA passed its nominal expiry date last March—ample time, it would seem, to hammer out even the most complicated negotiation. But as our CEO, Radley de Silva, has shared consistently, this particular enterprise bargaining agreement has a lot riding on it for the health of our industry and the quality of life in Victoria; it is not to be taken lightly. To help ensure an outcome that offers the best to all parties involved with this negotiation, we need to be well informed and fully prepared. So even though there has been some delay, it would be a mistake to presume this means there is a lack of action behind the scenes.

To that end, Radley brings us up to speed on what is now orbiting the EBA discussions—what’s going to influence it, what’s important to know and how it may affect you and your business (p.12). And we’re delighted to have a guest foreword from Senator the Hon. Michaelia Cash (p.6), whose official duties include those of Minister for Employment and Minister for Women. Senator Cash has been instrumental in working toward the revival of the Australian Building and Construction Commission (ABCC), which is awaited eagerly by Master Builders.

Also in this issue, Policy and Communications Manager Leanne Edwards provides a detailed brief (p.14) on recent activity with regard to the Building Legislation Amendment (Consumer Protection) Bill 2015, which was presented to Parliament by Premier Andrews last December. And you’ll find contributions from several of the usual (helpful) suspects, too, including MBAIS Victoria State Manager Joe Keiper on professional indemnity insurance, Director of MBA Financial Services Harry Pontikis on the utility of deposit bonds, and Chris from Case Study Construction learns why a free safety audit from the Master Builders OHS team offers such remarkable value to our members.

The high regard in which Master Builders is held by federal and state governments, political parties, the public service and industry agencies is a direct result of the detailed knowledge and authority with which the Association represents the industry when pursuing reform. Master Builders represents all sectors of the building and construction

industry-- general contracting, housing, specialist contractors, country as well as materials, manufacturing and supply.

Master Builders is one many industry bodies with direct contact to the current Victorian government through specifically created channels. The government itself has facilitated this two-way access as they understand we will provide frank advice based upon sound, detailed and practical involvement by parties who know what they are talking about. That means Master Builders offers expertise.

The diversity of that expertise is broad-based and ever-expanding; perhaps one of the most welcome and conspicuous directions our industry is headed is the increasing involvement of women in a range of substantial roles. The perception of our industry as somehow restricted to male involvement is outdated. We are changing, necessarily and correctly, to include the expertise of women in construction. I am delighted to see this participation increasing through our sector committees, and welcome further female involvement in all Master Builders activities.

A fresh start, with continuous improvement

Master Builders is in the process of developing programs to attract more women to careers in building and construction, and you can look forward to updates in the coming months.

Your Association is perpetually on the lookout for members who, irrespective of gender, are experienced in their industry sector, are prepared to work to improve it and are willing to participate in our sector committees or smaller specific-purpose advisory committees.

For our industry to truly prosper, we need the right legislative environment, a condition that is beyond our direct control. We need state and federal governments to create the environment in which builders and participants in the sector are encouraged to create new projects and innovate. We need government to provide surety of demand for private investment and to deliver community facilities throughout the state. Included in their scope must be the obligation to attract significant investment, develop the economic infrastructure which attracts private development and to ensure the maintenance of a culture of fairness and doing the right thing for each other.

It is the continued drive of Master Builders’ Board to lobby, even agitate, for governments and politicians of all persuasions to recognise and deliver on their obligations. The best way for us to achieve this outcome is to provide reasoned and practical advice, as appropriate.

Your Association needs to maintain and robustly pursue a diversity of opinions from our industry sectors and through continued involvement of our female members. Participating in Master Builders’ sector committees is where this process commences, and we would encourage all of our members to seek opportunities to become involved with the organisation.

The Government’s commitment to a strong, modern and effective Building Code

As Minister for Employment I understand the importance of the building and construction industry to Australians and the economy and confirm the Turnbull Government’s commitment to re-establishing the Australian Building and Construction Commission (ABCC). The Government’s goal in re-establishing the ABCC is to address the

fundamental problem of the culture and the mindset that exists within the construction industry and to re-introduce respect for the rule of law.  

You will be aware that the ABCC was successful in starting to change the culture in the industry before Labor irresponsibly abolished it.  When there is an effective regulator who enforces laws with meaningful penalties, people think twice before breaking the law.  As soon as the ABCC was abolished, the improvements in culture were lost almost immediately.

The sustainability and success of the predominantly small and medium businesses in the construction industry cannot be understated. This sector is a key driver of the economy and an important source of jobs growth. For too long, however, this industry has been beset by a culture in which blatant unlawful conduct has been, reluctantly or otherwise, accepted as the industrial norm. This mindset has been allowed to develop

because there has not been a meaningful consequence for doing the wrong thing. This state of affairs cannot be allowed to continue.

If there was anyone who was still honestly in two minds about the extent of unlawful conduct in this industry or what needs to be done to address it, the disturbing case studies examined by the Heydon Royal Commission are further examples that case for the ABCC has been made beyond any reasonable doubt.

As Minister for Employment, my immediate priority for 2016 is to re-establish the ABCC so we can, once again, change the mindset that complying with industrial laws in the construction industry is merely optional. It is not.

I also take this opportunity to reiterate the Government’s commitment to a strong, modern and effective Building Code that will ensure that only those contractors who strictly comply with their legal obligations in respect to workers entitlements and safety, and only those contractors who are not hampered by inefficient and antiquated practices, are able to win taxpayer funded work. It is the responsibility of the Government to ensure that taxpayer- funded construction projects are delivered safely, lawfully and on time and on budget. 

Finally, I commend the efforts of Master Builders and its members to improve safety in your workplaces, and encourage you to continually work towards becoming an ever safer industry.

January 2016 economic profileIn recent months the economic outlook, in the world and especially in Australia, has worsened and, as a result, the outlook for construction has worsened too.

Population growth has been slowing in most states and territories and now seems likely to continue at a slower pace than previously forecast. The slowdown in Victoria, however, has been quite modest; and over the years to 2020, Victoria’s population is still expected to grow more rapidly than in any other state, providing a solid base for future housing demand.

The prospects for engineering construction in Victoria are relatively good

too. Having enjoyed no mining boom, we avoided the crash that continues to depress activity in the resource-rich states.

SOME KEY RECENT TRENDS ARE:• Employment has been growing

relatively strongly in Victoria, which is a positive for housing.

• The recent boom in apartment approvals, especially strong in Victoria, peaked in the March quarter. Approvals have since fallen by 30 per cent and starts and construction activity will follow. The market for apartments is likely to peak soon, slowing increases in prices and rents.

• Housing is less affordable than it was a year ago, both in Victoria and nationally.

• Consumer confidence fell recently and seems likely to stay low, especially given falling share prices and concerns about China.

• Total building and construction activity in Victoria increased by less than one percent in the September quarter and was lower than in the March quarter. Nonetheless, new housing activity increased by four per cent, and remained steady in non-residential building. Engineering construction activity fell by two per cent.

• The trend in Victorian dwelling approvals peaked in the first quarter of 2015. The sharp decline in multi-unit approvals has pulled the total down, but approvals of houses have been well sustained at a rate of around 35,000 a year

State government introduces 10 per cent apprentices policy for government-funded projects over $20 million

On 21 December 2015, Minister for Public Transport and Employment Jacinta Allan, along with the Minister for Industry Lily D’Ambrosio and Minister for Training and Skills Steve Herbert, announced the ‘Major Projects Skills Guarantee’, which mandates minimum apprenticeship requirements for all publicly funded major projects. The details of the policy have also been subsequently released.

THE MAJOR PROJECTS SKILLS GUARANTEE:• Commenced on 1 January 2016• Applies to all government contracts

valued at or over $20 million dollars• Requires that 10 per cent of hours

of all work carried out on those construction projects must be undertaken by apprentices, trainees or engineering cadets

• Applies to all publicly funded building, construction, infrastructure, civil engineering and other capital

project contracts put out for tender after 1 January 2016

The responsibility for meeting the requirement rests with the principal contractor, who must submit a ‘Compliance Plan’ at the shortlist stage for tender. The principal contractor is also required to report the progress towards, and final compliance with, the mandatory requirement. The progress reporting and liaison with the government will be important aspects for builders, as the failure to comply with the requirements may constitute a breach of contract.

A prescribed formula to determine the number of hours required has been published by the government. The estimated total labour hours will be based on the overall or total value of the contract, including all sub-contracting under the principal contract. Separate deemed-hours formulas have been developed for application for building

and construction project contracts, infrastructure/civil engineering project contracts, based on industry data.

Master Builders continues to be concerned that the Andrews Government has not listened to industry about these proposed changes and how they should be administered. In addition Master Builders considers that a range of comprehensive reforms are required to improve apprentice completion rates, including by introducing trades registration to ensure that there is a purposeful career path for trades in our industry. Policies should not be pursued in isolation, and should be capable of practical implementation to ensure their effectiveness.

The government has undertaken to review the policy after 12 months. Master Builders will seek feedback from members regarding the implementation of this policy and ensure that the government is able to incorporate this into its 12-monthly review.

The importance of planning reform

Master Builders Association of Victoria (Master Builders) is the peak body representing employers in the Victorian building and construction industry. Our membership consists of around 9000 builders, subcontractors, manufacturers, suppliers and students.

In a post‐mining boom economy, and with declining investment in infrastructure and commercial construction in Victoria, we need to act now to boost commercial opportunities in the sector. Victoria’s building and construction industry is a central economic pillar of the state, as Victoria’s second largest source of full‐time jobs and generating considerable taxes and output for the economy.

The quality of living standards in Victoria is an important issue for the community. With the population of Melbourne predicted to grow to 7.7 million by 2051, requiring construction of up to 1.6 million new homes (including 480,000 apartments). We should not be afraid to embrace population increases, but we do need to ensure all agencies of government are, and the industry is, working together to ensure growing communities, both new and existing, have access to the appropriate living standards, services and amenities they need as the population grows.

Master Builders has close daily contact with building businesses from large to small, that deliver building and construction activity across Victoria. We are therefore uniquely placed to comment on the issues faced and possible solutions in the planning system. We believe that it is important that any reform proposals to the planning system ensure the continued viability of the building and construction sector – and encourages Victoria as a place for investment, growth and prosperity.

In framing our response to the Plan Melbourne Refresh: Discussion Paper, October 2015 (Plan Melbourne Refresh) our submission more broadly outlines the four key objectives for reform of the planning system which Master Builders sees as necessary to meet our housing and infrastructure objectives for Victoria’s future. 1. Creating a clear planning scheme and

strategic plan2. Planning scheme structures are

capable of delivering State planning policy objectives

3. Consistency of interpretation and application of requirements in planning schemes

4. Scope of objections to planning scheme amendments and permit applications limited to effective and efficient outcomes

WITH THIS IN MIND, OUR KEY RECOMMENDATIONS FOR REFORM OF THE PLANNING SYSTEM ARE TO:• Create a more detailed Housing

Strategy which would preferably include targets for clarity, which would include information on housing mix and affordable housing needs and land supply locations to meet those needs. Local councils would be held to account for this.

• Set up/allocate responsibility for monitoring the implementation of a strategic plan and for planning development assessment, to a specific agency or planning assessment hubs.

• Create responsible ‘as-of-right’ codified processes. This might occur in development zones around principal activity centres and major public transport networks and, more generally, in Neighbourhood Residential & General Residential Zones, to better support the 70/30 target. Depending on the zone, it could include secondary dwellings, dual occupancy, low-rise townhouses, apartments and other forms of medium - high density housing.

EBA NEGOTIATIONSIn August last year we released a report by Deloitte Access Economics, Victorian

Construction – Labour Costs and Productivity, which highlighted that construction industry EBA wages have been growing at unsustainably high rates and costing Victorians jobs and much needed infrastructure.

EBA wage increases have outstripped the construction industry wage price index by more than 27 per cent over the last 14 years, costing Victorians nearly 1500 jobs during that time.

The Deloitte report also highlighted that EBA real unit labour costs have grown by 2.4 per cent per annum more than can be justified by productivity increases. That means that rigidities built into the system, like fixed rostered days off, create wasteful increased costs to the industry and the community when they are not offset by increases in efficiency and productivity.

Victoria has the country’s fastest growing population and therefore faces a dire imperative to produce social infrastructure including roads, rail, schools and hospitals to accommodate these new arrivals. In light of government efforts to increase spending on much-needed social infrastructure to accommodate a burgeoning population, further wage increases for EBA employees, cannot be justified without productivity offsets. The Deloitte report revealed that if EBA wages continue to increase at the same rate of 5 per cent over the next four years, the Victorian government (using taxpayer funds) will have to spend more than $700 million just to meet current commitments made. That is the equivalent of 40 new secondary schools, which would be lost to Victorians in a windfall gain for already highly paid EBA workers. Union EBA carpenters and entry–level labourers already earn far more than nurses, defence force members, fire fighters, police or teachers.

That is why it is disappointing to see that the CFMEU recently sent out bulk correspondence entitled ‘CFMEU Log of Claims: Negotiations for Enterprise Agreement’ to employers currently

holding Industry EBA 2011-2015. The document includes the CFMEU’s ambit ‘Log of Claims’, which consists of (amongst other demands) further wage increases of 6 per cent per annum and unjustifiable restrictions on working arrangements that further reduce flexibility and productivity.

Master Builders continues to call on the CFMEU to engage in direct industry-level negotiations to reach an outcome that serves the best interests of all stakeholders in the Victorian commercial construction industry not to mention the Victorian community – an agreement that provides code compliance certainty to those wishing to do federally-funded work, and provides a sustainable wage increase delivered through meaningful flexibility and productivity improvements. In addition, Master Builders continues to be available to assist members negotiate genuine enterprise-level agreements, tailored to the specific needs of both their business and employees.

In the meantime, we have advised Master Builders members not to provide copies of notice of representational rights to employees unless or until a decision is made to formally commence bargaining.

THE RULE OF LAW IN OUR INDUSTRYThe numerous accounts of lawlessness and thuggery that have been recorded on our worksites have been highlighted during the Royal Commission hearings into Trade Union Governance and Corruption (Heydon Royal Commission). The Heydon Royal Commission report released in December 2015 highlighted that:

“The conduct that has emerged discloses

systemic corruption and unlawful conduct, including corrupt payments, physical

and verbal violence, threats, intimidation, abuse

of right of entry permits, secondary boycotts,

breaches of fiduciary duty and contempt of court.”

This behaviour has unjustifiable social consequences including detrimental emotional and physical turmoil imposed upon individuals and their families. The behaviour undermines the reputation and professionalism of the people working in the sector and of the industry overall. As a central economic pillar of the state delivering more than 200,000 jobs, it is vitally important that a pipeline of skills for Victoria’s building and construction sector is developed and maintained. Young people suffer too; when bad behaviour is allowed to create a negative impression of the industry, they see fewer options for a rewarding career, and the sector misses out on great candidates. Every single Victorian should be concerned about this problem. Intimidation and bullying tactics drain critical construction projects of time and money required for the roads, hospitals, aged care facilities and schools on which our community depends. Every single Victorian loses.

That is why it is essential that the reforms proposed by the Heydon Royal Commission, particularly the re-introduction of the Australian Building and Construction Commission (ABCC), are implemented for the benefit of our industry. We welcome the commitment by the Federal Government to reintroduce the ABCC and we urge support, especially by independent senators, for the Bill at the next opportunity.

The Heydon Royal Commission makes many recommendations which we consider are vital for our industry and these are outlined in more detail in Daniel Hodges’ update on page 18. Master Builders urges all stakeholders in our industry and the community to seize this moment to achieve reforms that will benefit the building and construction sector.

Master Builders wins critical reforms in building law changes ON THURSDAY 10 DECEMBER 2015 THE ANDREWS GOVERNMENT INTRODUCED THE BUILDING LEGISLATION AMENDMENT (CONSUMER PROTECTION) BILL 2015 INTO PARLIAMENT.

Master Builders has long been calling for crucial reforms to support the Victorian building and construction industry. Master

Builders’ priorities: Building our Future, released before the State Budget in May 2015, called upon the government to introduce a range of reforms including red tape reduction, tougher requirements for owner-builders and trades registration.

The Bill takes a step towards several of the key reforms Master Builders has been advocating.

TOUGHER REQUIREMENTS FOR OWNER BUILDERSHardworking registered builders have faced increased competition from unregistered practitioners and tradespeople, some of whom are inappropriately registered as owner- builders. Building work must be done by skilled, qualified people in order to protect the safety of consumers and the quality of the building industry in Victoria. But the statistics show that these crucial owner-builder reforms can’t come soon enough.

Owner-builder activity in Victoria is alarmingly high compared with both New South Wales and Queensland. In Victoria, 25 per cent of the residential housing work is done by owner- builders, compared to around 3 to 4 per cent NSW and QLD. Given that there were 60,000 residential building permits approved in 2014, then around 15,000 of those residences were worked on by owner-builders.

Owner-builders should use registered tradespeople to do the work. However, in Victoria there are only 2000 registered tradespeople, compared with 40,000 in NSW and 46,000 in QLD. It is difficult to see how, considering the current high rate of owner-builder activity, there could be enough registered tradespeople to do the work for owner-builders.

The new reforms, if passed through Parliament, should reduce the frequency of owner-builder projects, and ensure that appropriately skilled people are doing the work. The reforms specify that owner-builders would be able to complete only one home every five years, would face a competence assessment and must use registered tradespeople for the work done.

These statistics also highlight the urgent need for the introduction of trades registration in Victoria. As the pace of building continues to escalate due to Victoria’s rapidly expanding population, it is essential that tradespeople like carpenters, concreters, waterproofers and bricklayers be appropriately skilled and registered, to protect consumers from poor workmanship.

REFORMED DISPUTE RESOLUTION STRUCTURESUnder the Bill, a new body, called Domestic Building Resolution Victoria, will potentially give parties greater incentives to resolve their disputes more efficiently. Consumers and builders who are doing the right thing must have a dispute resolution system that treats them fairly and with efficiency.

It is hoped that mandatory conciliation will reduce the number of disputes that reach the Victorian Civil and Administrative Tribunal, thereby reducing

wasteful time and expenses that burden the current system. In addition, new cost orders arrangements aim to reduce the number of vexatious claims.

Master Builders calls upon the government, Victorian Building Authority and Consumer Affairs to ensure that the system proposed by these new changes will work efficiently and effectively for the Victorian building industry.

BUILDER REGISTRATION RENEWALAs a key component of the proposed legislation, re-registration of builders every five years would help ensure that their knowledge and skills are kept up-to-date throughout their careers. The full details of the requirements for re-registration have not been specified in the Bill and will be provided in the regulations.

Whilst Master Builders supports the need for builders to update their knowledge and skills over time, these provisions must not place additional burdens on builders or affect their continuing business operations. We will work with the Victorian Building Authority (VBA) to ensure that the requirements for re-registration are not prohibitive for builders and are clear, objective and streamlined.

SUMMARYIf the Bill is passed it is expected that these amendments will come into force on 1 July 2016 (but no later than 1 July 2017). Reforms in the Building Legislation Amendment (Consumer Protection) Bill 2015 include:• The introduction of the requirement

for builders to re-register every five years.

• The introduction of a new body called Domestic Building Resolution Victoria.

• Requirement for a building practitioner who is engaged to carry out building work to ensure that there is a building permit and that the work is carried out in accordance with the law and the building permit.

• Strengthened regulation of owner-builders: owner-builders will be able to complete only one home every five years, will face a competence assessment and must use registered tradespeople for the work done.

• Code of Conduct provisions that enable the VBA to prepare and approve a Code of Conduct in consultation with any prescribed organisation representing building practitioners, or alternatively approve a Code of Conduct prepared and submitted by an organisation representing building practitioners.

• The builder is not able to appoint a building surveyor. Master Builders will work with members to understand the requirements of this provision and ensure that builders’ business operations continue to operate efficiently and effectively.

• Transparency requirements in specific circumstances when Section 37 notices (directions to fix) are issued to builders, also requiring issuance to owners.

Master Builders will monitor the application of provisions such as disciplinary action and renewal of registration requirements, as well as the Code of Conduct provisions, to ensure that builders are treated fairly and appropriately. Master Builders will also continue to advocate for trades registration to be introduced in Victoria in the next round of building law changes in 2016.

Master Builders has continued to call for the ‘rule of law’ to be introduced to the industry through stronger laws and a better

equipped industry regulator. This call was supported in the recommendations – as was the need for those individuals who break the law to be held accountable for their actions.

Consistent with this latter point, rather than calling for the deregistration of unions such as the CFMEU, Justice Heydon favoured a focus on disqualifying the union officials responsible for unlawful conduct from holding office. Recommendations to achieve this important end include a substantial expansion of the grounds that a union official can be disqualified from holding office. In addition to bringing union officials in line with requirements of company directors under the Corporations Act, grounds for disqualification would include instances where the person has at least twice been an officer of a union that has been found to have contravened a provision of the Fair Work Act.

The final report recommendations also serve as strong support for the current Bill to reinstate the ABCC which is likely to go back before the Senate in February. In addition to recommending the need for an industry specific regulator, Justice Heydon called for maximum penalties for coercion, prohibited industrial action and contraventions of right of entry to be increased to 1000 penalty units ($180,000) for a body corporate and 2000 penalty units ($36,000) for an individual;

DRAWING UPON EVIDENCE GATHERED FROM OVER 500 WITNESSES AND 21 MONTHS OF PROCEEDINGS, JUSTICE HEYDON MADE A COMPREHENSIVE SET OF 79 LAW REFORM RECOMMENDATIONS, THE MAJORITY OF WHICH ARE DIRECTLY RELEVANT TO THE CONSTRUCTION INDUSTRY.

and for the definition of industrial action to be expanded to include picketing by employees or unions. In addition to the recommended increase in maximum fines, unions would be prohibited from paying the fines of union officials – meaning those who engage in the unlawful conduct would be held financially accountable for their actions.

Other recommendations of particular relevance to the building and construction industry include providing the Australian Competition and Consumer Commission and the building industry regulator (ABCC) with concurrent power to investigate and enforce secondary boycott conduct; as well as the suggestion that special legislation be enacted to disqualify those officers of the CFMEU whom Parliament considers are not fit and proper persons, from holding office in any union for a specified period. Additional changes to union right of entry laws were also recommended, aimed at both strengthening eligibility requirements for union officials to hold a permit, and directly addressing the

practice amongst unions such as the CFMEU of abusing OHS entry powers.

Other important recommendations aim at ensuring greater transparency, governance and disclosure within registered organisations. To this end, the establishment of a Registered Organisations Commission to more effectively regulate unions and employer associations was recommended, based on Australian Securities and Investment Commission structure. Stronger penalties for non-compliance are also an important feature, and include making it a criminal office for a person who is disqualified from holding office in a union to continue to hold office. Transparency, governance and disclosure improvements were also recommended in regard to industry funds, with potential implications for enterprise agreement content. Recommendations relating to corrupting benefits were also made, including making it a criminal offence for an employer to provide, offer or promise to provide any illegitimate payment or benefit to a union or its officials – with an equivalent criminal offence for any person soliciting, receiving or agreeing to receive a prohibited payment or benefit.

Whilst we await a detailed policy response from the Turnbull Government on this comprehensive set of recommendations as a whole, in the interim the evidence provided by the final report makes an irrefutable case for passage of the Bill to reinstate the ABCC. Master Builders therefore continues its call for the Senate to approve legislation that is clearly in our national interest.

WorkSafe has funded the OHS Essentials Program, originally referred to as the Small Business Program, since

2002. The Master Builders OHS Unit has delivered more than 1400 consultancies under the program since its inception.

The service, which is available to businesses with fewer than 20 employees and a WorkCover insurance policy, is provided by industry associations and a panel of consultants that are approved by WorkSafe.

I have personally delivered more than 850 consultancies in my nearly nine years with the Master Builders OHS Unit and for four-and-a-half years prior with another industry association (VACC). In that time I have become passionate about small business, and I recognise that managing OHS can present a significant challenge for a small business. Some of the key learnings I have gained over the last thirteen and a half years include:• The three hours of free OHS advice

that WorkSafe funds may be as much ‘OHS training/knowledge’ as a small business owner may ever get. Whilst we recommend Certificate III OHS training during the consultancy (also a pre-requisite for commercial registration) many small business owners may in fact never find the time to attend six days of OHS training.

• The amount of information provided during a consultation can be overwhelming (i.e. information overload), but it is necessary. The construction industry is a regulated industry and small business owners need to know the detail of the laws that apply to them.

• Businesses need resources to help them to manage their business. Master Builders advice is accompanied by an easy-to-follow handbook and action plan which is structured to be consistent with the advice given. The handbook and a range of OHS resources are provided to the business on a USB stick, free of charge.

When we deliver this service we discuss issues such as OHS policies and procedures, legal duties (especially SWMS), subcontractor management, incident notification and the powers and functions of WorkSafe inspectors.

I have seen small businesses that have implemented all of the advice we have provided during a consultancy. One of the benefits for a small business in having their industry association provide the service is that the business’ owner continues to have the association available for further contact and support. I have seen a small builder who started his journey on improving OHS in his business go on to achieve federal government accreditation of his OHS system, enabling him to tender for Commonwealth-funded projects.

I have also seen some small businesses that have implemented only parts of the advice we have given, or tailored the advice, to suit their capabilities and size. We would love all businesses to implement every bit of advice we provide but even businesses that implement just one-tenth of the advice we provide do well in that they improve on where they started.

Last year WorkSafe, in an exceptional move, decided to make their service available again, after three years, to businesses that had previously received the service. Some members have, in the

past, paid the OHS Unit to receive the advice a second time. Sometimes it helps to hear the advice more than once.

Over the years I have seen a number of serious incidents and fatalities in the industry and I have helped a number of small businesses after these events. I know that I would much rather provide the advice and support that is available ahead of time than to have to deal with members in these situations.

The service provides up to three hours of free OHS advice, which we deliver in members’ homes or offices. The service is also available to members (and non-members) across Victoria, irrespective of the location.

I am proud of the service that the OHS Unit provides through the OHS Essentials Program and I am very grateful to WorkSafe for their continued funding of the program.

FIRST-TIME HOME BUYERSA deposit bond can be particularly helpful to home buyers preparing to buy their first property particularly when they may not have the full cash deposit available to them when entering into a contract to purchase. If the vendor requires a full 10 per cent deposit but the buyer does not have immediate access to cash, a deposit bond can help secure the property. This also applies when the home buyer is seeking help from family with their deposit or for family to act as guarantors of a home loan.

Another benefit is for first home buyers who may not be able to afford the deposit without an applicable government grant, which cannot be accessed until settlement. A deposit bond is an effective way to help manage this process.

INVESTMENT PROPERTY PURCHASERSDeposit bonds are a great tool for investors looking to defer payment of the cash deposit until settlement, particularly when they are borrowing 80 to 100 per cent of the purchase price. Investors are able to purchase most types of residential and commercial property using a deposit bond.

NEW HOME AND LAND BUYERSDeposit bonds can be used to purchase new homes and both registered and unregistered vacant land that will be registered in the future. Talk to Master Builders Financial Services to learn more about the terms and conditions associated with unregistered land.

COMMERCIAL PROPERTY PURCHASERSDeposit bonds can be used to buy commercial- or business-use properties such as individual factory units, retail, office and storage space, commercially zoned vacant land and general business premises.

Individuals, companies, trusts or self-managed superannuation funds (SMSFs) can purchase commercial properties up to a deposit guaranteed amount of $200,000.

Commercial property applicants must be able to provide documentary evidence of their ability to complete the

purchase, such as an unconditional loan approval and/or other funds to complete the purchase, such as bank account statements, shares or sale proceeds from another property.

COMPANIES AND TRUSTSAt Master Builders Financial Services, we are well versed in assisting companies and trusts with their property purchase needs using a deposit bond. Beyond some additional documents we require to confirm authority of directors or trustees, the process, cost and requirements are almost identical to those for an individual.

SELF-MANAGED SUPER FUNDS (SMSFS) Deposit bonds can also provide a deposit guarantee for self-managed super funds (SMSFs) who are looking to purchase investment property. Due to SMSF regulations, the property in question must be income-producing and therefore cannot be under construction or vacant land.

The deposit bond can be issued up to 10 per cent of the purchase price to a maximum deposit amount of $500,000. A term of six months or less is standard, however longer terms may be considered on an individual basis (subject to separate acceptance and fee structure).

With regard to the application process, an SMSF-specific application will need to be completed and an acceptable trust deed will need to be provided confirming the trust’s ability to borrow and purchase property as part of its investment strategy. In addition to providing evidence of the funds to complete the purchase, at least one beneficiary/member of the trust must also own existing property.

In the coming six months, some pre-approved customers may have their pre-approval re-assessed by their bank and have their finance rejected, due to tightening lending criteria. Over the last three and a half years the Building Leadership Simulation Centre (BLSC) has delivered simulation

learning to more than 2500 participants ranging from graduates to mid-level managers, senior managers and even company directors. Building Legislation Amendment Bill HOW THE BUILDING LEGISLATION AMENDMENT (CONSUMER PROTECTION) BILL 2015 AFFECTS A BUILDER’S 10 YEAR LIABILITY FOR DEFECTIVE BUILDING WORK

The decision of the Court of Appeal of Supreme Court of Victoria in Brirek Industries Pty Ltd v McKenzie Group

Consulting (Vic) Pty Ltd [2014] VSCA 165 has provided clear authority in Victoria that a building action cannot be brought more than 10 years after the date of issue of the occupancy permit (or certificate of final inspection, as the case may be) in respect of defective building work (see s134 of the Building Act 1993). However, neither Brirek nor s134 provides clarity as to when the 10 year liability period commences for building work which did not require the issuing of an occupancy permit or certificate of final inspection.

Now the Building Legislation Amendment (Consumer Protection) Bill 2015 (“Bill”) proposes to clarify the shortfall provided by s134 (and Brirek), in respect to domestic building work at least. In doing so, the Bill proposes to, amongst other things:• Repeal Part 3A (Conciliation of

Disputes) of the Domestic Building Contracts Act 1995 (“DBCA”), being the current provisions dealing with the conciliation of domestic building disputes

• Replace Part 4 (Inspectors) of the DBCA with a new Part 4 titled “Domestic Building Disputes”. The new Part 4 sets out new provisions such as a definition of what a domestic building work dispute is (see s44) and the requirement for and procedure to refer a domestic building dispute to the chief dispute resolution officer (who is appointed by the Director of Consumer Affairs Victoria) (see Division 2 of Part 4).

The proposed new s45(3) (contained in Division 2 of Part 4) provides that a domestic building work dispute must be

referred to the chief dispute resolution officer within 10 years:• of the date of issue of the occupancy

permit; or• of the date of issue of the certificate of

final inspection if no occupancy permit was issued; or

• of the date of practical completion of the building work, if no occupancy permit or certificate of final inspection was issued; or

• after the domestic building contract was entered into, if the date of practical completion cannot be ascertained.

Further, the proposed new s45(4) (contained in Division 2 of Part 4) contains a presumption (unless an earlier date of practical completion can be ascertained) as to when the date of practical completion was achieved, which is the earlier of the date on which the builder: • Handed over possession of the work

to the building owner; or

• Last attended the building site to carry out work (other than work to remedy any defect that does not affect practical completion).

For the majority of domestic building disputes where no occupancy permit or certificate of final inspection was issued in respect of the domestic building work, the earliest date from which the 10 year period under s134 commences is the date of practical completion of the domestic building works as provided in the proposed new ss45(3) and (4). Therefore, the new provisions proposed by the Bill will now provide clarity to determine when 10 year liability period under s134 commences in respect of domestic building work.

GREEN LIVING

This year saw another excellent group of entries for the Best Sustainable Home category. Each of these entries was of

an excellent quality and could easily have been selected as the winner in previous years. The houses also represented a broad spectrum of housing types, ranging from small and affordable to high-end architectural designs.

WINNER BEST SUSTAINABLE HOME: VR BUILDERSVR Builders constructed this year’s winner. This 6.8-Star home is completely off-grid, drawing power from 12 Kw of photovoltaic panels on the roof which charge a 48-Kw hour battery bank. A diesel generator is used as back up, but is rarely required. The home features polished concrete floors and rammed earth walls made from locally sourced materials . The passive solar design was especially evident on the day the judges visited as the sun reached well into the home, warming the slab and providing an abundance of natural light. A wood heater connected to a hydronic heating system helps to warm the house in winter. Correctly sized eaves shade the north-facing windows in summer and external blinds shade west-facing windows. Low-emission paints and zero-formaldehyde joinery help to keep indoor air quality at a high level. The house shows that building sustainably can be done without compromising quality and comfort.

FINALISTSThe entry from Small Change Design and Construction demonstrated that sustainability need not be expensive. Designed around the small living concept, the minimal footprint and modular design concepts used in this 56 m2 house means that fewer materials are used and less waste is produced. The use of a polished concrete floor further reduced material use. The 7-Star rating, together with the small size of the house, means that it will require minimal energy to heat and cool.

Positive Footprints again ticked all the sustainable construction boxes with an 8-Star family home. Evacuated tube-gas-boosted solar hot water, clerestory windows allowing hot air to escape, 5-Star appliances and a green switch all work together to keep energy use to a minimum. A 2-Kw photovoltaic panel system further reduces energy use. Other features include recycled aggregate and fly ash to reduce the embodied energy in the slab, polished

concrete floors and rainwater tanks for toilet flushing. The timber used was certified as sustainably grown, and indoor air quality was protected with the use of zero-emission paints, zero-formaldehyde joinery and skirting.

Builder Arch 10 was also able to show what sustainability can add to a high-end product. This beautifully presented 8-Star home features excellent passive solar design that fills the house with light and keeps the sun out in the summer time. Heating and cooling of the home and the hot water is provided by a geothermal system. A large photovoltaic solar system with battery storage also reduces the need to draw electricity from the grid. A modular design is used to reduce the cost of construction and the amount of waste produced.

Chris gets audited for freeChris wanted to get the year off to the best start for Case Study Construction. He’d sat down with his accountant to review his end-

of-year financials, reviewed his plans and inspected his equipment to make sure that it was in good shape for the year ahead.

Chris then called the OHS Unit at Master Builders to arrange for a free site safety audit on his four-storey apartment project. Senior OHS Advisor James Curtin arrived at the site as arranged at 8.00am sharp to meet with Chris’ site foreman Mick.

“Before we start physically walking around the site,” James advised, “we should go into the site office and review the OHS paperwork that is relevant to the project.”

Mick dutifully responded to each of James’ requests for documents, starting with the OHS Coordination Plan, the inductions, evidence of toolbox meetings, plant and hazardous substance registers, Safe Work Method Statements and housekeeping inspections.

“The purpose of going through all of the paperwork is to make sure the company’s OHS system is in place and that legal duties are being met properly,” James explained.

James identified that Mick’s toolbox meetings involved discussions focussed on site-related issues. He also noticed as he entered the site that there were a couple of workers wearing singlets and not using personal protective equipment (PPE).James suggested to Mick that, in addition to discussing site-related issues he should also use the toolbox meetings to re-emphasise the company’s OHS policies.

“Great idea,” Mick agreed. “It is far better to make clear what the expectations are than to have blokes ignoring them.”

In addition to the UV and PPE issues, James’ safety walk also revealed that stepladders that had been put in place on the scaffold had not been properly secured.

“We had WorkSafe out here last week and they did not pick up on that issue,” Mick said.

“WorkSafe does not have the time or resources to spend hours on sites conducting detailed safety audits,”

James said. “They will deal only with the issues at the workplace that they see at the time of their visit. We have more time and come onto the site with fresh eyes.”

Looking at every opportunity to improve his business, Chris read the detailed written report that he received from James a few days later.

“I thought we were doing well with safety on our sites,” Chris said to Mick, “but clearly there are a couple of areas for improvement. That was time well spent!”

Traralgon Golf Club held the 17th Annual Gippsland Golf Day on 23 October. The event was a raging success with 88 players in the field. We had perfect golfing weather to make up for not-so-perfect golfing talent.

It was fantastic to have Kerry Mory play this year. Kerry, who is the previous Gippsland Area Manger and who started this event 17 years ago, had a great time catching up with members and old friends; although we are not sure he enjoyed winning the “foot wedge” novelty prize.

Special thanks to all those who helped run the day including Dom, Danielle, Victoria, Kathleen and David. They all worked hard but managed to have some great fun at the same time.

The best net score went to a team that travelled all the way from Sandy Point. Steve Vuillermin’s team had a wonderful score of 53 net. The very popular Mystery Score was decided by a coin toss with Darren Fletcher calling correctly for his Standing Homes Team.

WOMEN IN BUILDING INDUSTRY GROUPAfter discussions with several enthusiastic, motivated female Master Builder members we created a Women In Building Industry Group. Two meetings were held during the year-- one in Traralgon on Tuesday 16 June and a second at the RACV Resort Inverloch on Tuesday 24 November. We had six attend the first meeting and doubled that to 12 for the second lunch at Inverloch. Special thanks must go to those who travelled quite a distance to support the event.

The goal is for women MBA members to meet, network, discuss topics and support each other via an informal lunch meeting. The topics covered were wide-ranging and interesting, and we had Ingrid Mountford (MBA Assistant Membership Manager) as a guest speaker.

Registration Committee and, eventually, a director and board member for the association. His enjoyment meant he racked up untold hours volunteering his experience and energy, devoting approximately three days of his work week to the cause.

"It had a big impact on my work load," he reflects, "but these are activities for which I am eternally grateful. I was introduced to working with government, for example, which was very interesting.”

Glenn says there are many builders today who aren't familiar with the history of their industry, and how many features that they take for granted actually stemmed from hard work within the

association. He cites home warranty insurance as an example.

"That was an invention of Master Builders Association of Victoria and the Housing Sector group in the 1960s for consumers,” he notes, “and to help provide builders with a marketing edge for their clients."

Eventually, Glenn left the board to pursue consulting full time and direct his talents to more profitable expenditures of his time and energy. Now trading as Boston Group, he works full time with his own staff "developing products to help builders and consumers across the full spectrum of the industry", an example of which is the well-known MBAV Major Domestic Building Specifications.

"Today, we're more of a 'Topgun' training program for builders," explains Glenn. "Building companies have various administrative programs and systems; we make them better. We provide specially designed e-tools for problem-solving, but if that's not enough we roll up our sleeves and assist. I always remain conscious of the relationship between builder and client so it doesn't become unnecessarily costly for either of them."

Conflicts here and there may be inevitable, he acknowledges, “But a soft landing for all parties is a good outcome.”

With 31 years of membership under his belt, Glenn has had time to see and test the full spectrum of what it can offer, and his endorsement is emphatic.

"In my view, the value of a Master Builders membership is still highly underrated," he says. "To get full value, you need to use the facilities Master Builders has built for you. If you get involved, it can lead to the development of relationships that are really good for your business.”

He adds a friendly warning, though: "You have to be balanced about the time you put in. Me, I couldn't drink enough of it."

The act of receiving an award is often a fast track to being profiled in this magazine, and many others. But less obvious achievements are equally deserving of a moment in the spotlight, and even more enjoyable to research. Probing the careers of long-time members reveals the surprising degree to which they have influenced and enriched the organization, and Glenn Jones provides a vivid example.

Glenn began his long career with Master Builders in 1983 with full-throttle eagerness. His father, Barney, had already enjoyed a long career with the association, and Glenn was eager to get started on his own. Enjoyment of the home building trade was total for Glenn, who describes the elation associated with planning, building a delivering a project as akin to addiction.

"Nothing is more satisfying than being outside, building a building," he says matter-of-factly. "That's the ultimate."

But such was Glenn's fascination for the process of building, and not just the execution of it, that within a few years he'd embarked on his own extracurricular career with Master Builders. Beginning in the early 1990s, Glenn became active as a participant on the Housing Sector Committee, as an MBAV delegate and Deputy Chairman to the Building

Select your work for recognition THE 2016 MASTER BUILDERS AWARD PROGRAMS ARE NOW OPEN AND CALLING FOR ENTRIES.

The Master Builders Association of Victoria produces three highly regarded Industry Award Programs – Excellence in Housing Awards, Excellence in Construction Awards and Regional Building Awards. Each awards program offers Master Builders members with the opportunity to showcase quality workmanship, be recognised for their achievements and gain a valuable marketing tool.

The benefits of entering the awards are considerable, with all winners gaining extensive exposure and publicity across magazines, Master Builders website and the wider media. Winning an award is a valuable self-promotion tool and can have a huge influence on how you are viewed within the industry and the client community. The evening awards presentation also provides you with the opportunity to thank and recognise the hard work of your staff and contractors and to show appreciation to your clients by treating them to a prestigious gala event and night out.

REGIONAL BUILDING AWARDSThe Regional Building Awards recognises regionally based members of the Association in both residential and commercial construction. With the state divided into four regions – South East, North East, South West and North West.

Eligible entries for the Regional Building Awards are restricted to regional building projects that have been constructed by regionally based builders who are financial members of Master Builders Association of Victoria. Members who have reciprocal membership (i.e. VIC/NSW) are also eligible to enter.

The region in which projects are entered is based on the location of the project, not the builder. Projects are judged on the same criteria as set out for Construction and Housing Awards. All projects entered are physically inspected by a team of judges, with one team per region.

Entries for the 2016 Regional Building Awards close on Friday 4 March, with

on-site judging taking place 30 March to 22 April 2016.

Note: Regional members are also eligible to enter either the Excellence in Construction Awards or the Excellence in Housing Awards.

EXCELLENCE IN CONSTRUCTION AWARDSThe Construction Awards recognises the commercial/industrial sector of the industry and encourages members throughout Victoria (both metropolitan and regional) to showcase their quality workmanship.

Entries for the 2016 Excellence in Construction Awards close on Friday 18 March, with on-site judging taking place 20 April to 27 May 2016.

EXCELLENCE IN HOUSING AWARDSThe Housing Awards recognises the residential sector of the industry and encourages members throughout Victoria (both metropolitan and regional) to showcase their quality workmanship.

Entries for the 2016 Excellence in Housing Awards close on Friday 15 April, with on-site judging taking place 25 May to 1 July 2016.

A Windows ChecklistAT THE AUSTRALIAN WINDOW ASSOCIATION WE GET MANY QUESTIONS EACH WEEK FROM CONSUMERS, BUILDERS, CERTIFIERS, THERMAL PERFORMANCE ASSESSORS, ARCHITECTS AND DESIGNERS ABOUT A WHOLE RANGE OF THINGS THAT ARE NOT CLEARLY UNDERSTOOD ABOUT WINDOWS.

When I started in the industry around 30 years ago, things were very simple, there were no real performance requirements for windows and doors. Provided they opened, closed and had 3 mm float glass in them, everything was fine. In fact I even remember people not being too worried about a bit of water coming through them into the home.

Things have changed now when it comes to windows and doors; they have to meet multiple performance requirements. This has added complexity to what was once a simple choice.

Through the continued evolution of standards and regulations, improvement to construction methods and greater consumer expectations, windows are a totally different beast from those I first encountered when starting in the industry.

Today’s high performance windows have to meet not only the client’s aesthetic needs, but be able to:• withstand wind and rain• be energy efficient• offer sound attenuation• survive bushfires• provide safety and security• comply with the Building Code of

Australia and Standards, and• adapt to emerging sustainability trends.

This quick reference checklist ensures window and door products meet today’s requirements when specifying, supplying, selecting, purchasing, certifying and installing:• Wind load requirements satisfied• Site conditions satisfied• Thermal comfort requirements satisfied• Energy values met• Bush fire attack level assigned and requirements met• Materials meet all requirements• NCC provisions satisfied• Validation documents available• Installation requirements satisfied

It is important to have an understanding of what these items mean and how to ensure windows meet all the requirements.

1. CORRECT WIND LOADS FOR THE SITE AND CONSTRUCTION TYPEWind loads – Every site for every building in Australia should be assessed for wind load requirements according to AS/NZS 1170.2 Wind Actions or AS 4055 Wind Loads for Housing (a simplified document for housing). The wind loads are a deciding factor for the type of window and door system that will be used as they need to structurally withstand the loads that are present on the site. The two loads are Serviceability Limit State (SLS) and Ultimate Limit State (ULS). They are given in AS 2047 or calculated from AS/NZS 1170.2 or, if the construction is housing, AS 4055 can be used to obtain the N or C ratings. These site ratings should be calculated and supplied by the site engineer for the project or the architect, designer or builder.

2. SELECTED WINDOWS MEET THE SITE REQUIREMENTSNow that the site requirements have been determined we must make sure the windows being selected meet these requirements. Windows need to be tested to find out the SLS pressure, the ULS pressure and the level of Water Penetration Resistance (WPR) they meet.

Windows are tested in accordance with the requirements of AS 2047, the tests completed are:• Structural - Measures deflection of the window (SLS)• Operating Force – Confirms opening force is within

the set limits• Air Infiltration – Measures air leakage through

the window or door• Water Penetration – Measures water penetration resistance• Ultimate Strength – Confirms the window meets

ULS requirements

Windows are tested for combinations of wind loads (SLS & ULS) and WPR for all three classes of building types. The performance results dictate where the windows and doors can be used based on the requirements for the type of construction and site.

3. THERMAL COMFORT REQUIREMENTSThe BCA has technical provisions that relate to energy efficiency for all classes of buildings and there can be some state variations to these requirements. The energy efficiency provisions have a significant impact on the window requirements. Compliance is achieved by the prescriptive measures found in the BCA, or through performance based solutions using simulation tools such as AccuRate, FirstRate, BERS Pro and BASIX.

A report or requirement from either of these compliance solutions will specify both the window performance for total window U Value (Uw) and total window Solar heat Gain Co-efficient (SHGCw).

Uw Value is the measure of heat transfer due to different temperature inside and out

SHGCw is a measure of solar radiation entering through the window system

4. SELECTED WINDOWS MEET ENERGY VALUESThis is a key step to ensure that the products you are installing meet the BCA requirements. Energy efficiency provisions state that external glazing performance (total window system performance) data must be determined in accordance with the guidelines of the AFRC (Australian Fenestration Rating Council). The Window Energy Rating Scheme (WERS) follows the guidelines of the AFRC which means that WERS ratings are compliant to the BCA. Performance requirements from energy efficiency reports are given to the window supplier, who will match or exceed the requirements with their WERS rated products. In some cases, it will be easier to select the windows first then supply the performance data to whoever is rating the building. Warning - ensure window ratings have been done in accordance with the guidelines of the AFRC, if it hasn’t been done to those protocols then it does not comply. 5. BUSH FIRE ATTACK LEVEL (BAL) ASSIGNEDMany construction sites now fall within bush fire-prone areas. This will have a significant impact on the types of windows and glass that must be used. AS 3959 is the standard that specifies the requirements to assess the site, then specifies building requirements. It is important to give the BAL rating to the window supplier so they can ensure they are providing you with a compliant product.

The AWA provide a guide to windows and doors in bush fire areas.

6. SELECTED MATERIALS MEET ALL REQUIREMENTSThere is a necessity to comply with all of the standards and regulations when designing, manufacturing and selecting windows and doors.

Once all of the window specific requirements including the finishes and hardware, have been determined your window fabricator will be able to provide options.

The more information that is provided the more fit for purpose (and cost effective) the product will be.

7. NCC PROVISIONS MET FOR VOLUMES 1 & 2 FOR WINDOWS AND DOORSMake sure you can tick off that your windows and doors meet all of these BCA provisions:• Section 3.6 and Section B. Products are structurally

adequate to meet site requirements for SLS and ULS. (window manufactures must be capable of verifying performance claims)

• Section 3.6.4.6. Manifestation required to glass doors and panels that could be mistaken for a door or unimpeded path of travel.

• Section 3.7.4.7 and Section G. Bush fire requirements• Section 3.9.2.2 and Section D. Balustrades and barriers, this

includes restricted and protected openings.• Section 3.12.2 and Section J. Energy Efficiency

8. VERIFICATION / VALIDATION DOCUMENTS ON FILEA range of items should be supplied by window companies to verify performance claims and enable validation of compliance to standards and regulations. These items should be requested and kept on file.

They include:• Performance labels attached to windows (a requirement in

housing and residential buildings)• Compliance certificates. These should only be deemed

acceptable if the company providing the certificate is a part of some type of accreditation scheme such as the AWA independent 3rd party NATA accreditation scheme

• Test reports should be requested if there is any doubt about the validity of labels or certificates supplied

• Website listings can be a useful source of information to confirm if the company is a member of an industry association that implements an accreditation scheme.

9. INSTALLATION REQUIREMENTS NOTEDFour key steps to installation of windows and doors:1. Square and plumb. This will ensure the functionality of

the system2. Packing. Packing between the window and building frame

ensures that the frame remains square and plumb and adds strength to the nail or screw fixing

3. Fixing. The window or door needs to be fixed to enable the system to withstand the wind loads applicable to the site

4. Flashing. Windows and doors should be flashed to stop water penetration around the outside of the system. This is the responsibility of the installer.

Problems such as no flashings, smothered or missing weep holes or loss of continuity in the water barrier are prime causes of leaks in window assemblies.

Particular care must be taken when flashing windows for light weight construction. Consult the window manufacturer and the walling system supplier for details of how to correctly treat penetrations.

There is not one particular detail which is applicable to all lightweight wall cladding materials. However, there are some simple principles which, if followed, should provide a good performing installation that will stand the test of time.

1. A ‘Z’ shaped metal head flashing extending beyond the width of the window - minimum 25mm; ideal 50mm

2. The window to be fitted with poly flashing to jambs and sill. Jamb flashing should extend 100mm above and below the window jamb height. The sill flashing to extend to the outside width of the jamb flashings

3. All flashings must offer weathering overlap i.e. the sarking above the window must overlap the metal head flashing; the head flashing must overlap the window jamb poly flash. The jamb poly flash must overlap the sill poly flash and both jamb and sill poly flash must overlap the wall sarking

4. There must be provision for drainage below the window and ideally along the bottom of the sheeting for the full length of the wall

There are many different types of window designs which make it very difficult to create generic installation details to cover all window systems. In most cases, the walling system suppliers provide details for window installation. However, not all cladding manufacturers’ details are suited to window weathering and drainage, nor are they aligned with window manufacturers’ installation details.

A lot of these wall cladding materials are used in residential applications where traditional finned windows are used. With this window type, the waterproof line of the window is the fin and not the front face of the window. Sealing or attempting to seal to the front face of the window is destined for failure.

Severity of exposure to wind is the most important factor in specification and installation. Practices for sheltered

situations may fail quickly when exposed to the full force of the wind and rain.• Top hung products such as bifold doors require structural

assessment to minimise deflection• Packing is crucial to avoid distortion through settlement• Adequate fixings should be used• Follow the window manufacturer’s installation specification

for the appropriate Terrain Category and height of building.

Probably the biggest change of all was the acceptance in the termite standard that a concrete slab itself could form part of a termite barrier. At the same time, the long lasting ‘organo-chlorine’ chemicals being used were withdrawn and replaced with the safer termiticides that we have today- but these are registered with a service life of about 10 years only. This raised concerns about the lack of termite protection beyond 10 years in non-accessible building parts such as under slabs.

An additional concern has been the indication that the traditional system of “free-hand spraying” of termiticide had a poor track record of performance. Where was the evidence? In 2005 the CSIRO produced a termite risk map of Melbourne, based on a limited survey by Termite Action Victoria. The map and tables clearly showed that the council areas where pre-construction termite protection was mandatory were also those that suffered the highest rates of termite infestation. In fact 25 per cent of all termite infestations occurred within four council areas, all of which requiring pre-construction termite protection. Perhaps the protection helped- but it certainly did not bring home the bacon.

What was behind this poor performance is not clear, but most experienced termite specialists will tell you that the chemicals used are effective when applied fully and correctly. The blame is more likely to be the invisible nature of sprays, and the difficulty in inspecting and certifying that an application has been made to

all stages of an often-complex building. Parts of buildings were probably not treated. Furthermore, treated areas such as garden beds and pathways, were liable to be compromised by the subsequent landscaping and paving works that often follow a hand spray termiticide application.

We are fortunate that the dismal landscape painted above has been brightened by a new way of doing things. There is a growing range of termite protection products that can be seen, touched and inspected and the builder is spoilt for choice in picking a method that suits the building design, the building coordination and the builder’s back pocket.

THESE PRODUCTS HAVE SOME COMMON FEATURES:• They often integrate with part of the

building structure such as a concrete slab, which together with the product, form a ‘termite management system’.

• These systems are ‘built-in’, and can at some stage be inspected, confirmed

to be complete, signed off and certified. In an imperfect world, this is a big advantage over the invisible ‘spray’ method.

• A ‘built-in’ system is generally not as easily compromised when a new home-owner makes new garden beds or lays new paving around the home.

• They provide longer term protection, often with an expectation of 50 years of service.

• They typically come with a warranty which is subject to the building being inspected annually by a termite specialist. This is in line with the termite standard, and apart from inspecting for termites, it provides an excellent opportunity for home owners to be informed by the inspector about maintenance of things such as landscaping levels, ventilation and replenishment of chemical in reticulation systems (where fitted).

Generally, ‘built-in’ products are applied so as to integrate with building parts to form a single termite barrier. It would

be unusual in Victoria today to underlay a termite protection product under the entire building. Instead, the design of the building must be understood, building plans provided, and the qualities of structures such as a concrete slabs and sub-floor clearances must be specified prior to planning a termite protection system that will utilise the building components as part of the termite barrier.

FOR EXAMPLE:Concrete slabs• must be designed and constructed so

as not to have a 1mm crack through the slab. AS 2870 and AS 3600 are ‘deemed to satisfy’.

• Slabs with abutments to other structure, such as ‘in-fill slabs’, require protection at those margins.

• Potential holes / joins / and gaps in the slab should be independently protected.

• The external perimeter, typically at the edge rebate, should be independently protected.

Suspended floors• must be 400mm clear of the ground

to permit local barriers such as stump capping

• to comply, and to allow for future termite inspections.

• Concrete /steel stumps require no further protection. Masonry footings and timber stumps require protection, such as with capping / strip shielding.

Examples of products types

NON-CHEMICALThese were the first of the new wave of ‘built-in’ products after the old chemicals were withdrawn, and include the well established stainless steel mesh and graded stone methods. The companies providing these products did not just supply the material, but they established for the first time a comprehensive system behind the product, and trained their people to install it, inspect it and warranty it. They undertook extensive research and testing and developed a range of adhesives, sealants and fixing methods that became part of their ‘systems’ . They also had to coax the building industry away from treating

termite protection as an afterthought and ‘quick spray’, and into a scheduled stage of the building process, and they provided industry training and seminars accordingly. These methods remain available today, and have the advantage of being well known throughout Victoria as well as being chemical free.

RETICULATIONThis is a method of convenient re-application of liquid termiticide via an irrigation system similar to water irrigation. Some of these systems were developed as the old chemicals were going and have become very well established with a big market share. They are cost effective and simple to install and simple for the builder to schedule - in. They are an improvement on hand-spraying chemical, and are particularly useful to enable re-application where concrete / tiled paths / patios surround a building. They require replenishment every few years, typically by the supplier, who may also provide an on-going warranty.

IMPREGNATED MEMBRANESThese are typically plastic strips that have been loaded in some way with an insecticide. Brands vary in technology- some membranes sandwich a treated textile material between two thin plastic sheets, and another brand actually includes insecticide within the plastic itself during manufacture. The result is a range of products that are generally expected to last the lifetime of a building, can be readily inspected and can be installed into buildings in a range of convenient ways. They are cost effective to supply and once installed they can be left undisturbed to do their job for the long haul without any service requirements. Impregnated membranes are repellent to termites - which cannot contact or explore the membrane. This provides a feeling of confidence that if a membrane is inadvertently damaged

during the building process, termites may not be able to find the breach. An additional security is the range of adhesives and sealants that come with most brands, which are mostly today ‘active’, meaning that they also contain insecticide, and increase the flexibility and security of these systems.

Not all the newer systems rely on insecticide. For instance, there is now a ‘spray-on’ liquid which physically increases the hardness of the mortar between bricks, and prevents termites from chewing their way through the cement of a brick wall. It is easy to apply and cost effective as well as being free of insecticide.

There are many other methods available, and their number is increasing continually.

So what should a builder do?

• Provide proper building plans including those for elevations and footings.

• Include termite work into the building schedule and give plenty of notice to the termite product installer.

• Respect the termite product work, and ensure that following trades do the same.

• Once the termite system is installed, ensure that the provider fixes a ‘durable notice’ in the SEC box (or sub-floor frame) and that the certificate of installation is handed over to the purchaser. This will allow the new owner to contact the termite company and register for annual inspections and warranty. Once this is done, you can sleep easy knowing that someone else’s phone will ring if termites rear their ugly heads over the long years ahead.

– it’s worth getting it right the first time

Moisture can be the arch nemesis of any building structure. Rain or water ingress during construction can cause lengthy delays and add unforeseen and unbudgeted costs. However, it's crucial to asset owners that structures are equipped to deal with the threat of moisture damage over the longer term, and not just for the bare minimum of defect warranty period.

Water ingress is the most significant root cause of building remediation

costs. Aside from the immediate damage to contents, repairing defective waterproofing can be a particularly intrusive, labour-intensive and costly process. Spending on remediation can skyrocket the longer the damage is left unaddressed, as the structural integrity of the building can be compromised.

Moisture can enter structures in a variety of ways so it’s necessary to comprehensively safeguard against all possible circumstances.

All building structures, from residential properties to world-class commercial high rise developments require effective waterproofing systems that have been specified and installed to meet the particular demands of the structure.

Waterproofing system technologies for balconies, decks, and roofs can all have differing requirements depending upon their intended use. Will areas be subject to constant direct foot or vehicular traffic? Are they directly exposed to UV?

Successful design and installation of waterproofing technologies within all buildings is critical. Buildings incorporating living and green roof technologies are becoming more commonplace in Australia with shining examples like Forest Lodge Eco House, which received multiple accolades in the New South Wales Master Builder Excellence in Housing Awards and was featured on the popular Grand Designs TV show.

The relatively recent trend in Australia towards ‘transport-oriented development’ inner city living, along with building requirements for sustainable, energy efficient buildings has helped to promote the demand of green roofs and walls. These buildings help to reduce demand on infrastructure through storm water capture and reuse systems, as well as act to reduce the Urban Heat Island affect that is associated with urbanised lifestyles. People now have a higher expectation of their ‘living space’ requirements where the outside and inside environments merge.

Collaboration between all stakeholders regarding waterproofing systems is particularly important in designs that incorporate natural materials and technologies as well. Forest Lodge House Eco is an exceptional example of all players implementing best practice design to achieve this.

Design guidelines and standards, such as those found within the Building Code of Australia and appropriate AS/NZ Standard provide direction to design and installation of appropriate waterproofing systems. AS 3740 2010 and AS/NZS 4588-2004 provide guidance on the waterproofing requirements for domestic wet areas and wet area membranes respectively.

The AS4654.2 regulation on waterproofing membrane systems for aboveground design and installation provides direction in the appropriate design and installation methodologies of waterproofing systems. While some damage to waterproofing does occur during construction, a large proportion of waterproofing failures

can be attributed to either incorrect or insufficient attention to detailing.

Belowground waterproofing presents its own unique set of parameters. Consideration of external factors such as soil geology, hydrological conditions, environmental factors and intended use of the space will aid in determining which of the various waterproofing technologies can be required for belowground parts of structures such as basements, and cellars, as well as retaining walls.

Waterproofing structures that are water retaining or subject to hydrostatic pressure require careful design, shrewd selection of materials, as well as skilled workmanship. Onsite quality control has a big part to play in ensuring optimal waterproofing results.

Careful attention must be given to concrete mix design with consideration for use of hydrophobic pore blocking or crystalline growth type admixtures. Joint design is also critical, as consideration must be made for construction realities

such as occurrences of poor concrete placement, as well as geological factors.

Interestingly, Australian standards don’t cover all facets of waterproofing requirements. Given that some elements remain unregulated, there exists no clearly defined standard for below ground waterproofing.

British Standard [BS] 8102:2009 is a code of practice for protection of belowground structures against water from the ground.

This code of practice promotes a holistic approach to achieving successful waterproofing outcomes, which involves all stakeholders working together to develop a strategy and robust specification during the design stage, which is followed right through the construction process.

During the requirements analysis phase it is recommended to assess geological

conditions of the site for presence of contaminants that may compromise the integrity of the concrete as well as for the presence of hydrostatic pressure.

Consideration should also be given to future developments, which may impact on the waterproofing requirements of the structure.

BS8102 further states that typically waterproofing failures are due to construction issues and lacking attention to detail. Due to these factors, secondary and even tertiary levels of redundancy are recommended to be included during the specification stage for areas within the structure that have higher levels of requirement.

As previously stated, the cost of remediation far outstrip those of new installation so any savings in time and budget made during construction are quickly lost by not correctly assessing
