1. THAT AWARE that Coast General Hospital is a critical Level 5
health facility which handles patients from within and outside the
county;
FURTHER AWARE that the ease of access, safety and well-being
of patients, medical staff and pedestrians accessing the facility is
paramount;
CONCERNED that there is a growing tendency for heavy trucks
and other vehicles to carelessly park adjacent to the health facility
thus obstructing patients, medical staff and other pedestrians
from accessing and exiting from the facility.
I therefore urge this county assembly to RESOLVE that:
The county government to establish a no-parking zone around the
Coast General Hospital to enable easy of access by patients,
medical staff and pedestrians.

2. Mapping of tourist attraction sites within the county
That aware that Mombasa is one of the leading tourist
destinations in the world.
Further aware that the fourth Schedule Part II parts 4 (g) and 7
(d) respectively, have devolved museums and local tourism.
Cognisant of the fact that there are numerous historical site and
sites rich in cultural heritage within the county which if fully
exploited can enable the county benefit from income generated in
such sites; Noting that this can be realised by first mapping out, a
process which involves identification and tourist sites within the
county;
Concerned that the County Government has not mapped out
these sites;
I urge the Assembly to resolve that:
i. The Tourism Department carry out a mapping exercise to
enable them benefit from, allocation made to museums.
ii. The Department of Tourism after the mapping out of the
tourist attraction sites, to vibrantly market those sites so as
to add local revenue to our basket.

3. Refurbishment of football pitches in each sub county
and financing of football activities by the County
Government
THAT AWARE THAT there are football pitches within the County
which are used for football activities;
FURHER AWARE THAT football can be a source of livelihood for
the youth; Cognisant that if the football pitches are refurbished,
they will create a conducive environment for football and
subsequently, a minimal amount of money can be charged on the
spectators to watch football matches and these monies can be
used to pay the participating teams and for the maintenance of
the football pitches;
CONCERNED THAT football pitches are currently in deplorable
conditions and thus the football standard is affected.
I urge this Assembly to resolve that:
i. The County Government to refurbish, including putting up
a perimeter wall and a gate, at least one football pitch in
each sub county;
ii. The County Government to sponsor local terms by paying
their subscription to the relevant football bodies.

5. Employment of youth on Commission basis for enforcement of rule on littering the county THAT AWARE THAT the County under the Fourth Schedule Part II (3) has devolved the functions of control of public nuisances; FURTHER AWARE that the process of enacting County Legislation on littering has not been concluded; COGNISANT THAT there are national laws and by laws which prohibit littering the environment; CONCERNED THAT residents continue to litter the environment not because of lack of legislation but because of weak enforcement on the part of the County and one of the major reasons being lack of adequate personnel in the Department of Environment to enforce this rule; I urge this Assembly to resolve that: The County to employ youth to assist in enforcement of cases concerning littering the environment and a 20% of fine paid by a wrongdoer to be paid to the youth on commission basis upon availing the wrongdoer to court and payment of the aforesaid fine.

Promotion of rabbit farming within the county
THAT AWARE THAT agriculture, including crop and livestock
husbandry is a devolved function in the Fourth Schedule, Part II
(1 a) in the Constitution of Kenya, 2010;
FURTHER AWARE THAT there is an increasing demand in both
local and international market brought about by preference for
white meat which includes rabbit meat;
CONCERNED that the issue of unemployment is still rampant
within the county and agribusiness, especially rabbit farming, can
go a long way in alleviating the problem of unemployment; taking
into consideration that rabbit farming does not require a lot of
space for raring;
I therefore urge the House to RESOLVE that the Department for
Agriculture, Livestock and Fisheries to come up with policies that
promote rabbit farming within the County as a measure to
address the problem of unemployment within the County.

4. THAT AWARE that statistics are a necessary tool and component
of effective planning;
FURTHER AWARE that our county government has not collected
statistics on the population of children in the county since it was
installed;
CONCERNED that lack of relevant and timely statistics on
children would hamper effective budgeting and planning for their
immediate and long-term benefit;
I therefore urge the county assembly to RESOLVE that;
The county government to establish a mechanism for the
collection of statistics on children in all wards in the county and
to use them to plan and budget for beneficial projects and
programmes.

5. THAT AWARE that there are many transport companies
providing employment to people as driver, mechanics and other
occupations;
FURTHER AWARE that these transport companies employ locals

CONCERNED that the number of foreign drivers has increased
tremendously to the disadvantage of local job seekers;
I therefore urge the county assembly to RESOLVE that;
The county government to conduct a census of all drivers in
transport companies to determine the ratio of local versus foreign
drivers.

for a period acceptable by law.

9. THAT AWARE that article 6(2) of the constitution of Kenya
provides that the national and county governments are distinct
and inter-dependent and shall conduct their mutual relations on
the basis of consultation and cooperation.
FURTHER AWARE that the national government issued titled
deeds to house owners of the former Waitiki area in Likoni as
individual leases for 99-year periods.
CONCERNED that most of the occupiers are either poor or low-
income earners and would not afford to pay the fees/amount
charged by the national government to enable them be the
absolute lawful owners of the plots.
Noting that His Excellency the Governor, formed a county
executive sub-committee to negotiate with the national
government with specific terms of reference as encapsulated in
the resolution hereby.
I urge this county assembly to RESOLVE that:
1. A socio-economic study of the occupiers be undertaken by
Pamoja Trust.
2. The County Government of Mombasa undertakes to pay
Kshs.1.25 billion which is estimated amount payable to the
Settlement Fund Trustees in order for them to release the
land to citizens of Mombasa who are currently occupying the
land.
3. The County Government of Mombasa commits itself to pay
the amount within the statutory maximum period of 23

11 Painting of Tusks adjacent to Uhuru Gardens
THAT AWARE that the famous decorative elephant tusks on Moi
Avenue, Mombasa are an important county landmark and part of
our historical heritage;
FURTHER AWARE that the decorative elephant tusks were
erected way back in 1953 to commemorate the crowning of Her
Majesty Queen Elizabeth II of United Kingdom who was then the
sovereign ruler in Kenya.
CONCERNED that since their construction the metal plates have
been depreciating and there is need to paint them regularly to
maintain them and preserve this important county and national
landmark.
I therefore urge the county assembly to RESOLVE that:
The county government to annually paint the landmark
decorative tusks on Moi Avenue, Mombasa and replace any warn
out metal plates to preserve this important piece of our county
and national heritage.

13 Rescission of Defective Resolutions on Nomination of

THAT AWARE that the County Assembly had on Thursday, 31st
March, 2016, duly approved with amendments, a motion
containing a list of members nominated to select and sectoral
committees;
FURTHER AWARE that subsequently on two other occasions, the
foregoing list was irregularly altered by way of defective motions
which were not in compliance with Standing Order 154(1) and
157;
CONCERNED that the subsequent alterations were done in
undue disregard of the procedures and practices of our legislature
and have set a bad and dangerous precedent.
I therefore urge this County Assembly to RESOLVE that:
i. Pursuant to Standing Order 42(2) (a), this County
Assembly hereby rescinds its decision done irregularly to
alter the list of nomination of Members to Committees;
ii. That necessary modifications and alterations be done to

16 Establishment of a County Diving Unit
THAT AWARE that the County of Mombasa is surrounded by the
Indian Ocean which is used by the public for sea transport and
swimming for entertainment;
FURTHER AWARE THAT the Constitution mandates the County
Government to undertake disaster management and
preparedness as one of its functions;
NOTING that the Mombasa County Fire Brigade had a diving unit
which was later disbanded under unclear circumstances;
CONCERNED that the lack of a diving unit and lack of
contingency plans in the event of accidents and disaster in the sea
could be fatal and lead to high loss of human lives.
I therefore urge this County Assembly to RESOLVE that a County
Diving Unit be established and adequately staffed and facilitated
to train divers and rescue victims of sea accidents and disaster
and assist similar ventures elsewhere.

17 Revocation of Single Business Permits for Unscrupulous
Dealers in Motor Vehicle Spare Parts
THAT AWARE that among the County functions under Part II of
the Fourth Schedule of the Constitution is trade, development
and regulation including business licencing;
FURTHER AWARE that there is an emergence of unscrupulous
business people especially dealing with motor vehicles spare parts
operating without business permits playing cat and mouse games
with the County Inspectorate over availability of business
permits;
CONCERNED that this is detrimental to social and economic
well-being of the people of Mombasa whom we represent, as it
has resulted into losses to the County Government revenue which
in turn affects service delivery;
I urge this County Assembly to RESOLVE that:
i. The County Inspectorate embark on an immediate
crackdown on all businesses operating within the county to
weed out all unscrupulous business operators;
ii. Any person found operating business without having met
the requisite conditions be brought to book and face the
full force of the law.

18 Safety of pedestrians at Likoni Ferry
THAT AWARE that Kenya Ferry Services Limited provides a link
that connects Mombasa to Kwale County and other countries;
FURTHER AWARE that the alley way to the ferry on a daily basis
is used by many pedestrians making human traffic in that area to
be heavy;
CONCERNED that an alley way has been encroached by hawkers
thereby restricting the movements of pedestrians causing
unnecessary overcrowding which poses security and safety threat,

Inspectorate to move with speed to remove hawkers from the
alley way to ease human congestion.

Article 185 vests the legislative and oversight authority in a
county to the County Assembly;

of the same Constitution compels the County Executive
Committee to provide the County Assembly with full and regular
reports on matters related to the County;
CONCERNED that to date, the foregoing Constitutional
requirement has not been constantly complied;

Board from now henceforth to submit regular quarterly reports
on their operations.

25 Familiarization with Ward Administrators
THAT AWARE that the Office of the Ward Administrator is
established pursuant to Section 51(1) of the County Governments
Act 2012;
FURTHER AWARE that they are employed by the County Public
Service;
RECOGNISING that they play a critical role in service delivery in
the wards and hence the need for peaceable coexistence with the
MCAs within the ward;
CONCERNED that since the ward administrators were employed,
they have not been formally introduced to the Members of the
County Assembly and this may undermine the working relations;
I urge this Assembly to RESOLVE that The County Secretary
together with the County Public Service Board to arrange for a
forum where the Ward Administrators will be formally
introduced to the MCAs to enhance service delivery within the
Wards.

Control of Misuse of County Government Vehicles
THAT AWARE that there is a standard of conduct that prohibits a
public officer or employee from using any government property
for other than official purposes;
FURTHER AWARE that use of government-owned or leased
vehicles is restricted to official purposes and must never be used
for private purpose such as personal business, errands or leisure;
CONCERNED that some county government vehicles are being
spotted in odd hours at awkward places such as bars; NOTING
that it is the responsibility of the chief officer to ensure that
government vehicles are properly used.
This Assembly resolves and urges the county government to;
1. Create a special unit within the county government
inspectorate tasked with the mandate of monitoring the use of all
county government vehicles.

2. Ensure that no government vehicle is on the road
especially outside office hours (8.00am – 5.00pm) unless on
official use or carrying out an emergency. In such an instance, the
authority for use of the vehicle shall be in writing by the officer-
in-charge of the station where the vehicle is attached.
3. Ensure that all government vehicles are branded with the
name of the respective county department so as to ease
identification as well as curb misuse of such vehicles.
4. Sensitize county officers or members of the public to report
in detail to the chief officer any government vehicle suspected of

26 Purchase of Welfare Buses for the County Assembly
THAT AWARE that the county assembly annually incurs
tremendous expenditure on transport and travelling expenses for
members and staff.
FURTHER AWARE that members and staff of the county
assembly travel frequently officially within and outside the county
in discharge of their duties and responsibilities.
CONCERNED that these expenses could be significantly reduced
if the county assembly had welfare buses for transport and travel.
I therefore urge the county assembly to RESOLVE that:
The County Assembly Service Board to plan, budget and purchase
welfare buses for official travel and transport of members and
staff of the county assembly in order to minimize expenditure on
the same and for prudent use of financial resources.

THAT AWARE that the United Nations Educational, Scientific
and Cultural Organization (UNESCO) seeks to encourage the
identification, protection and preservation of cultural and natural
heritage around the world considered to be of outstanding value
to humanity. This is embodied in an international treaty called
the Convention concerning the Protection of the World Cultural
and Natural Heritage, adopted by UNESCO in 1972;

FURTHER AWARE that the National Government has ratified
the above convention;
NOTING THAT old town was officially recognized as a heritage
site on the 26th of June 1997 under the cultural category by
UNESCO;
CONCERNED THAT the owners of the heritage sites in old town
Mombasa County are not involved in the preservation of their
cultural and natural heritage nor do they get any technical or
financial support to ensure that the sites are well protected.
I therefore urge the county assembly to RESOLVE that:
1. The National and county governments to come up with
mechanisms to compensate property owners in Old Town to
ensure that the heritage sites are well preserved.
2. The compensation be between 5 to 10 per cent of the value
of the property to be paid on an annual basis.
3. The county government to provide discount for land rates
of the heritage sites with a view to ensure conservation of their
cultural and natural heritage in line with the UNESCO goals.
4. The National Museums of Kenya and UNESCO be
compelled to comply with the foregoing resolutions contained
hereabove.

38 Replacement of Asbestors Roofing in Public Primary
Schools
THAT AWARE that asbestors is hazardous material causing
several incurable diseases including cancer and was banned by
the World Health Organization;
FURTHER AWARE that the National Environment Management
Authority(NEMA) through Legal Notice No. 121 of the
Environmental Management and Coordination ( Waste
Management) Regulations 2006 waste containing asbestors was
classified as hazardous waste whose disposal was subject to
regulated mode by NEMA.
CONCERNED that many public primary schools have asbestors
roofing which could harm students, teachers and the general
public using school premises for various activities.
I therefore urge the county Assembly to RESOLVE that:
The County Government to replace asbestors roofing in the public
primary schools to forestall its potentially harmful effects to
students, teachers and the general public.

THAT AWARE that unemployment is rife and rampant among
the youth within the county;
FURTHER AWARE that the Standard Training Watch-keeping
Certificate is a requirement for employment and practice under
the International Maritime Organization regulations.
CONCERNED that many unemployed youth miss employment
opportunities as seafarers due to lack of training as seafarers
while existing seafarers stand to be penalized for lack of
certification.
I therefore urge the county assembly to RESOLVE that:
The county government to sponsor unemployed youth and
existing seafarers to the Standard Training Watch-keeping
Certificate at Bandari College.
