Issued last August 8, 2016, pre-scribing to exempt all taxpayers who are applying, including those who have already applied for the issuance of tax credit/refund based on a Writ of Execution issued by the
Court of Tax Appeals or the Supreme Court from the re-quirement of Certifications on Outstanding Tax Liabilities Delinquency Verification Slips prescribed under all existing revenue regulations, rules and procedures.
Issued last August 12, 2016 for the information and guidance of all concerned to further clarify certain issues concerning sus-pension of audit pursuant to Revenue Memorandum Circular (RMC) No. 70-2016, as supplemented by RMC No. 75-2016. Q1. Is the processing of request/application for tax refund/
tax credit certificate (TCC) covered by the suspension of investigation under RMC No. 75-2016?
A1. No. The processing of all requests/application for Tax
Refund/TCC regardless of Tax Type is not covered by the suspension of investigation. However, the subject of the Letter of Authority (LOA) to be issued shall cov-er only the specific Tax Type which is the subject of the request/application for refund/TCC.
Q2. Is the verification/evaluation of issued Letter Notices
(LNs) covering taxable year 2013 covered by the sus-pension of investigation under RMC No. 70-2016?
A2. Yes. The verification/evaluation of issued LNs covering
taxable year 2013 is suspended under RMC 70-2016. However, LNs covering taxable year 2013 with corre-sponding “open” LOAs issued prior to July 1, 2016 are not covered by the suspension of investigation.

Clarification of RMC 70-2016
Issued last August 15, 2016 to clarify the RMC 70-2016, the
Philippines, being the member of the Global Forum on
Transparency and Exchange of Information (EOI) for Tax
Purposes, adheres to the international standard of timely
responding to an EOI request within 90 days through the
EOI Section of the International Tax Affairs Division. An EOI
request is essentially not aimed at domestic tax liabilities.
Consequently, EOI processes, including access to infor-
mation of taxpayers’ records as provided under RMO No. 2-
2013 and RMC No. 70-2016.
Issued last August 12, 2016 for the information and guidance of all concerned publishing the full text of the Joint Adminis-trative Order No. 1-2016 dated June 23, 2016 – Rules and Regulations to Implement RA No. 10708, otherwise known as “The Tax Incentives Management and Transparency Act (TIMTA)” as attached in this Bulletin.
Revenue Circular Lifting the Suspension of
Audit of the Bureau of Internal for Run Af-
ter Taxpayer Cases
Issued last August 23, 2016, BIR lifted the suspension of all field audit and other field operations relative to examination and verification of taxpayers’ books of accounts, records and other transactions, as issued by the Revenue Memorandum Circular No. 89-2016. “To continue the mandate of the BIR to investigate criminal violations of the National Internal Revenue Code of 1997, as amended, and to prosecute such cases to deter, to the great-est possible degree, tax evasion practices, and to encourage voluntary compliance with the internal revenue tax laws, the suspension of the implementation of Letters of Authority per-taining to the Run After Tax Evader (RATE) Program is LIFT-ED.” Therefore, as prescribed in the RMC, field audits, field opera-tions, any form of business visitations and all activities con-nected directly in the implementation of Letters of Authority pertaining to RATE cases shall be resumed/continued or con-ducted in accordance with the existing Rules and Regulations of the BIR.

Guidelines on the issuance of certification of Paid-up Capital
Issued last August 18, 2016, the Commission En Banc, in its meeting resolved to issue guidelines on the Issuance of Certification of Paid-Up Capital, as follows:
1. A certification of paid-up capital shall be issued upon request to be filed at the Company Registration and Monitoring Department (CRMD) and Extension Offices (Eos) of the Commission;
2. A certification of paid-up capital may be based on the following:
A. Audited Financial Statements (AFS) as of the last fiscal year
stamped received by the Bureau of Internal Revenue (BIR) and Securities and Exchange Commission (SEC); or
B. Audited Financial Statements duly received by the Commis-
sion; or C. Articles of Incorporation, with reference to the paid-up capital
in the Treasurer’s Affidavit and as certified by the Treasurer-in-Trust; or
D. Latest Approved Certificate of Filing of Increase of Capital
Stock, supported by a report of the Financial Analysis and Audit Division (FAAD) or Corporate and Partnership Registra-tion Division (CPRD) or CRMD or by Sec Extension Offices.
3. The Corporation shall submit the following:
A. Duly accomplished request form stating the basis of certifica-
tion in accordance with item no. 2;
B. Audited Financial Statements as of the last fiscal year stamped received by BIR and SEC;
C. Audited Interim Financial Statements duly received by the
Commission, in case there is/are payments to unpaid sub-scription(s) after the issuance of the AFS as of the last fiscal year.
D. Notarized Secretary’s Certificate on No Pending Intra-
Corporate Dispute; and E. Monitoring Clearance
The filing fee in the amount of Php1,000.00 shall be paid for the issu-ance of the certification.
General Information Sheet and Notification Update Form
Issued last August 04, 2016, the Com-mission En Banc in its meetings last June 21 and 30, 2016 had resolved to ap-prove the following revisions in the forms for General Information Sheet (GIS) and Notification Update Form (NUF): 1. In the GIS, the column for the Tax Identification Number (TIN) of the Board of Directors/Trustees, Officers, Stock-
holders/Members of Domestic Corporation and Resident Agent and Officers in the Philippines of Foreign Corporations shall be accom-plished in separate sheet denoted as TIN page;
2. In the NUF for Foreign Corporations the column for the TIN of
Officers shall be accomplished in a separate sheet denoted as TIN page; and
3. The Secretary’s Certification page of the GIS for stock and non-
stock Corporations shall now read as follows:
“I, ______________ Corporate Secretary of the above-mentioned declare under the penalty of perjury, that all matters set forth in this General Information Sheet which consists of (__) pages have been made in good faith, duly verified by me and to the best of my knowledge and belief, are true and correct.
I hereby certify that the persons indicated as members of the Board of Directors/Trustees and Offic-ers of the Corporation had consented to be nominated and elected.
I understand that failure of the Corporation to the GIS for Five (5) consecutive years shall be con-strued as non-operation of the Corporation and a ground for the revocation of the Corporation’s Certifi-cate of Incorporation in this eventuality, the Corpora-tion hereby waives its right to a hearing for the said revocation.”
These revised GIS and NUF shall be available in the SEC Website for downloading and shall be used by Corporations in January 2017.

Issued last August 5, 2016, Com-mission En Banc in its meeting held on August 2, 2016 had resolved to amend Item No. 2 of Memorandum Circular No. 6 series of 2012, which shall be amended as below: Consistent with the objectives of Republic Act 9485 (otherwise known as the Anti Red Tape Act of 2007), the Commission, in its meetings on July 12 and July 27, 2012, resolved to dispense with the
following requirements in the registration activities set forth below:
