2 2018 TLA Annual Conference & CTLA Midyear Meeting

May 2-5, 2018 | Waldorf Astoria Orlando, Orlando, FL May 2-5, 2018 | Waldorf Astoria Orlando, Orlando, FL

Welcome From President BottaI am excited to see each of you, and your families, in Orlando, Fla., Tuesday, May 2 through Saturday, May 5, 2018 for TLA’s 80th Annual Conference. Our members and guests will enjoy exceptional service in luxury surroundings at the Waldorf Astoria Orlando. Modeled after the New York Waldorf Astoria, this property is nestled among a breathtaking 482-acre nature preserve and surrounded by the Walt Disney World® Resort, providing not only quick access to, but respite from, all the Magic Kingdom has in store.

“The City Beautiful,” as Orlando is known, is mostly wetlands, consisting of many lakes and swamps. The terrain is generally flat, making the land fairly low and wet. The area is dotted with hundreds of lakes, the largest of which is Lake Apopka.

Built in 2009, The Waldorf Astoria Orlando infuses the jazz age-elegance of art deco from the Waldorf-Astoria in New York, complete with a stunning lobby clock, with the vibrant ambiance of Florida. Comprised of 497 deluxe rooms and suites, the hotel features signature dining establishments such as Aquamarine and Bull & Bear Steakhouse®. The Waldorf sister property, The Hilton Orlando Bonnet Creek, shares walkways and restaurants you and your families can access and enjoy – offering the amenities of two luxury brand hotels for the price of one. The Hilton Orlando Bonnet Creek boasts six distinct dining options including La Luce® by Napa Valley Chef Donna Scala, and a two-acre lagoon-style pool with lazy river.

Our Program Committee has been preparing for this conference for two years. Building a compilation of highly regarded international and state-side industry panel speakers and has carefully crafted a top notch educational program. You will not want to miss out on this innovative and entertaining educational concept that has never been attempted, at past TLA events.

It would not be a TLA conference if we didn’t also provide our attendees time to connect and network with colleagues and engage in friendly competition as well. Believe me when I say, our sports and social functions offer you all of this and so much more. We will absolutely take advantage of the beautiful, sunny Florida landscape, giving you and your families the opportunity to relax after mornings of exceptional learning. The TLA Annual Conference is the conference your colleagues and associates should attend. Time and again, I’ve been told it is the premiere educational event that convinces our members to not only join and be part of the TLA, but be active and participate in the growth of the Association. This year, I’m thrilled to offer our young professionals and corporate counsel members the opportunity to connect and learn in a dynamic, small group setting as well. First-time attendees need not worry about feeling out of place. TLA is unique because of the collegial atmosphere and immediate comradery our members provide.

With respect to our signature sports and social functions, Tuesday golfing is available for our members with serious handicaps and wagering hands. The golf is serious but the fun can’t be missed. On Wednesday, attendees and guests will enjoy the centerpiece of the Waldorf Astoria Golf Club -- the 18-hole 7,113-yard championship course designed by acclaimed golf course architect Rees Jones. Don’t be intimidated if you’re a beginner golfer, Wednesday’s golf tournament will champion players better known for their time in the bunker than on the fairway. Wednesday also offers our tennis players and their playing partners a chance to play on the green clay courts of the United States Tennis Association.

Other activities you can plan to attend with your families include the Wednesday night Welcome Reception and Dine Arounds, Thursday night’s 80th Anniversary Member Celebration and White Party, Friday night’s Annual Banquet and Saturday’s Fun Run/Walk, Pool Volleyball Tourney and our Cinco de Mayo Closing Reception.

Make plans now to join your fellow TLA and CLTA members in Orlando, Fla. I will ensure you will learn more than you can handle and enjoy yourself too. I, along with my family, the Officers and the Executive Committee look forward to welcoming you to the Sunshine State. “Yes! I Will” see you in Orlando!

Best regards, Frank C. Botta

Through multiple acquisitions, the development of new technology, or creative contractual, corporate structure or risk management strategies, these players in the transportation industry have identified different ways to succeed. Transportation lawyers should understand the regulatory and legal requirements behind their solutions—including understanding the demands of integration post-merger, protecting intellectual property and strategies to protect cash flow and manage risk.

The session will conclude with an evaluation of the effects of the new Canal on the shipping of goods “internationally.”

In this session, panelists present best practices for intermediaries to utilize the contracting and sales personnel framework to effectively vet carriers and to match shipper expectation with carrier performance. They will also offer an in-depth review of the potential tension between an intermediary’s pursuit of new business opportunities, and the binding employment contract clauses of the sales team. Today an intermediary might be seeking someone else’s “business”, but tomorrow its client base might be a target. What due diligence and best practice steps should an itermediary consider, to manage and protect its own interests and legal risk? Are these steps enforceable or do they represent a restraint of trade?

This Q&A session with key executives and experts will focus on how to identify privacy concerns internally and externally, methods to best protect those concerns from deliberate and unintentional release and will explore ways that TLA members can assist their clients with understanding this complex and important area of business.

The U.S. Department of Transportation defines autonomous vehicles as, “the archetype of future transportation.” The National Highway Traffic Safety Administration has developed 15 guidelines for the testing and deployment of autonomous vehicles. But how do these vehicles work? Are they computers with a car built around it, or a car with a computer built into it? Will it be a service or a product? Who will insure these vehicles, and what should transportation lawyers learn about these developments so they implement this knowledge into their practice, whether regulatory, corporate or claims oriented? Our panelists will answer these questions in a visually interesting and dynamic presentation that combines risk management analysis and technology in a meaningful way.

10:00 a.m. – 11:00 a.m. NAFTA and Baseball: Different Game, Same Goal

“Your goal shouldn’t be to buy players. Your goal should be to buy wins and in order to buy wins, you need to buy your run.” Peter Brand, Moneyball

Re-negotiations for NAFTA are well underway, and this multi-national panel will identify the key issues for each country – Canada, the United States and Mexico. This session will review whether each country sees the same issues as being affected by NAFTA and then analyze how those issues will affect each country’s players in the transportation space. The moderators will lead NAFTA experts through difficult discussions as they identify areas of conflict and similar interest among countries with different financial and trading strengths, and will assist transportation attorneys with concluding whether the analytical, evidence-based approach to assembling a competitive baseball team as described in Moneyball is an exemplary approach for NAFTA negotiations and whether it can level the playing field in North America.

11:15 a.m. – 12:15 p.m. Don’t Let Plaintiff Lawyers and Healthcare Providers Give You the Split Fingered Fastball: How the Personal Injury Bar, Finance Companies and the Medical Profession Are Colluding to Increase Damages in Personal Injury Litigation

Casualty litigation can be costly, time consuming, and lead to significant economic loss for motor carrier clients. Casualty litigators who can reduce or limit damages at an early stage in litigation provide their clients with certainty, and more predictability in what can be a very unpredictable experience. Therefore, a focus on striking or limiting damages at the initial pleading stage can save money, but can also cause some plaintiffs to settle early or refocus their damage expectations to a more realistic scale. The moderator will lead this panel of experienced casualty litigators who have experience defending these claims through clear fact scenarios to help litigators anticipate when and where these claims are likely to be advanced, and will examine plaintiffs’ latest strategies to increase medical special damages through litigation finance/factoring arrangements, and finally will provide seasoned and practical advice and strategies for defense attorneys successfully defend by limiting or even eliminating these types of damages claims.

12:15 p.m. – 1:15 p.m. Cuba Represents a Significant, New Foreign Market, but Should Transportation Attorneys Be Seeking to Do or Expand Their Business in Cuba, and What Legal, Ethical and Compliance Issues Must Be Considered to Succeed?

“I don’t put any foreign substances on the baseball. Everything I use is from the good old U.S.A.” George Frazier, Yankees Pitcher, Rules & Ethics, Pete’s Baseball Quotes

With a population of 11.5 million in 2016 (compared to 3.4 million in Puerto Rico), Cuba is already a familiar potential business partner for Canadian companies, but also could represent a significant and new market for American businesses, particularly those in the transportation space. Cuban authorities claim that foreign investors have anted up nearly $3 billion in investments in Cuba, and American companies who seek to do business in Cuba face competition from Mexicans, the Spanish and the Dutch. This session will examine the current status of restrictions for U.S. companies that wish to do business in Cuba, as well as explore the ethical, legal and regulatory implications of doing so. The panel will address the realities that impact business economics when a country is criticized for enriching the pockets of a military, known for controling a large part of the local economy.

Activities

GolfTuesday

Tuesday golf is currently being organized by the golf co-chairs, and a location will be announced in February 2018. While prizes will be awarded in various winning categories, golfers are responsible for paying their own greens fees (at a negotiated rate) as well as for food and drinks at the course. There is no pre-payment through the TLA. Stay tuned for future updates.

Wednesday

Wednesday afternoon golfers will have a blast, when TLA hosts its fun, yet challenging, golf tournament. Amidst the Bonnet Creek nature preserve is Golf Magazine’s prestigious, “Top Courses You Can Play,” and “2016-17 Gold Medal Premier Resort” – The Waldorf Astoria Golf Club.

Using the land’s natural contours as a canvas, this meticulously designed course was created by acclaimed golf course architect Rees Jones. This course pulls in elements from several of the world’s classic courses – some designed a century ago. The layout ingeniously blends its traditional character with endless subtleties for a challenging experience. Mindful of the natural elements and in homage to the game’s storied history, Jones created a golf course of great integrity and environmental consciousness that seamlessly folds into the terrain, so it appears to have been there forever.

Visually stunning and immensely playable, the Par 72 golf course is enhanced by natural elements like majestic cypress trees lining the fairways and features a five-tee system to accommodate golfers of every caliber. The Waldorf Astoria Golf Club measures an impressive 7,108 yards from the professional tees and maintains a course rating of 74.6 and slope of 139.

Other amenities of the on-property golf course include a Pro shop, practice range and putting green and individual private lessons.

Tennis The Tennis Tournament will be held Wednesday, May 2, at the United States Tennis Association National Campus, located just a quick 30 miles from the hotel. Players will get to experience the beautiful green clay courts at this storied outdoor venue. Get your pairs together now and go after the gold!

Welcome ReceptionWednesday evening, TLA will officially welcome you to the Annual Conference. Join colleagues for casual drinks and bites on the resort’s promenade and be prepared to be wowed, Carnivale-style, before heading to the Dine Around amongst the hotel’s three fine-dining establishments.

After Hours NetworkingThis year, TLA’s After Hours Networking will be in a setting for kings and queens at Sir Harry’s Lounge. Open just for TLA members and their guests, attendees can enjoy a drink and conversation, reflecting on the day’s education program, in a private, lounge setting.

Guest ExcursionTake a break from the parks and attractions for a day in Winter Park. Situated 25 miles northeast of the hotel, this historic resort town is a stately haven nestled between canal-linked lakes. Guests will enjoy private transportation for the day, departing from the hotel lobby promptly at 8:45 a.m. and returning by 3:15 p.m. on Thursday, May 3.

Upon arrival in Winter Park, guests will board the Scenic Boat Tour, cruising through three of the city’s lakes that border the area’s most prestigious homes. This one-hour, 12-mile cruise through lakes and canals is really the only way to see the true beauty of Winter Park. Floating past countless Gatsby-esque lakeside mansions, the captain keeps up a rolling commentary of fascinating facts and gossip about residents both old and new. Remember your sunscreen and hat!
