Point 2: Copy of the EC dated 18/10/2017 to be uploaded against column 6(d) otForm-2.
Glarification: Copy of the said EC letter had already been uploaded whilesubmitting the Form 2 along with EIA report online. As per your directions underlatest EDS; we are once again submitting a copy of the EC letter (dated 18.14.2017)for your reference and necessary further action.
Point 3: Firm commitment of the regulatory authority to supply surface water of 271cum/day.
Clarification: ln our Final EIA report submitted to MoEFCC; at Page No. 42; thetotal fresh water requirement in GIACL's integrated Project Complex (sugar; co-gen& distillery) has been pr^esented. Accordingly; it is seen that total annual fresh waterto the tune of 57,826 M3 (7,920 M3 During Sugarcane crushing Season + 49,906 M3 During
Non- Crushing season) is required (i.e. 0.057 Million Cu.M. I Annum). Also on the samepage, adequacy of total annual fresh water utilization by the industry complex (0.057Million Cu.M. / Annum) against sanctioned quota of 0.071 Million Cu.M. / AnnumbyIrrigation Department (lD); Govt. of Maharashtra is presented. From this it could beseen that the permitted fresh water quantity by lD; Govt. of Maharashtra is muchmore than actual requirement in the GIACL complex.
Herewith at Annexure -lll, the details of water consumption and adequacycalculations are presented for ready reference. Further at Annexure - IV, anagreement between GIACL and lrrigation Department; Govt. of Maharashtra isenclosed which gives the Industry a water lifting permission for 0.071 Million Cu.M. /Annum.

For the working pattern in GIACL complex, overall water requirement becomes as follows – A. For Crushing Season: 1. For Sugar Factory and Co-gen Plant; total fresh water requirement in a season of 180
Days shall be - 3 CMD X 180 Days = 540 M3/Season
2. For Distillery, total fresh water requirement in a season of 180 Days shall be - 41 CMD X 180 Days =7,380 M3/Season Hence, total water requirement during crushing shall be – 7,920 M3/Season.
B. For Non- Crushing Season: 1. For Co-gen Plant; total fresh water requirement in non crushing season of 52 Days shall
be - 178 CMD X 52 Days = 9,256 M3/Season
2. For Distillery, total fresh water requirement in a season of 150 Days shall be - 271 CMD X 150 Days = 40,650 M3/Season
Hence, total water requirement during non crushing shall be – 49,906 M3/Season.
From above calculations; it is seen that total annual fresh water requirement in GIACL campus is 57,826 M3 (7,920 M3+ 49,906 M3). This figure works out to be 0.057 Million M3.Permission granted to GIACL by Irrigation Department; Govt. of Maharashtra for lifting fresh water from the 'Jaikwadi Dam' reservoir is 0.071 Million M3 which is much higher than the actual total usage of water quantity.

charged at sing[e and. excess above 1O% without, prior permission
will be charged at penal rate of 1.25 times of the normal rate, as
mentioned in the relevant clause. However, the local cess shall be
charges on singte rate onlY.
12.(a) The Company shall pay to the Executive Engineer' water rates and
local fund cess either in advance every alternate month on the basis of
anticipated quantum of water to be drawn by it from the said source
during the months or on monthly basis within fifteen (15) days from
thedateofreceiptoft}rebi-mont}rlydemandbytheUSERfromtheExecutiveEngineer.ondefaultoftheUSERtopaythewaterrateorlocal fund cess as aforesaid vide clause 9 and 11, Government shall
without prejudice to its any other rights and remedies be entitled to
terminate this agreemqrt forthwith as Per clause No' 9'
(b) In the case of disputes regarding quantity of water billed or rate at
which the bill is prepared tJre company/Firm/individual water user

registered company if it is deilered at the registered ollice of the
company or sent by registered post to the registered address for the
time being of the comPany.

In case of default on the part of tJre company toper{orrrr and observe any of the said covenants, ter:ms and conditions itshall be laurfirl for the Government in its absolute discretion to theforfeit ttre whole of the security deposit or any part thereof withoutprejudice nevertheless to any rights and remedies which theGovernment may have against the company under these presents forsuctr breadr and tJ:e company shall forthwith pay up the amount so

refunded to the Comparry.
All amounts due to tJre Government by the Company under thisagreement shall be deemed to be arears of land revenue and may
without prejudice to any other rights and remedies of the Government
be recovered from the Company as arrears of land revenue.
On the exprry of the term of this agreement, Government may renew
this agreement within 90 days for such further period and on such
terms and conditions, as Government may at its absolute discretion
deem fit.
The cost incurred in the execution of this agreement including starnp
duty shall be borne and paid by the company.
Permission f6r extra water over and above the sanctioned quota will be
granted only when the written permission for expansion etc. isproduced by the Company from the tedustrial Deparbnent.
The agreement supercedes all the previous agreements entered into by
the USER with the Government in connection with tJ,.e supply of water
form Jaylavadi Resen oir.
The Comparry, should submit their water indent for every rotation to
the E:<ecutive Engineer Jaykwadi Inigation Division, Nath Nagar
(North) son or before starting of the rotation where the source is located
on canal. 'fhe cor,Fany should also furnish ttre exact quantity of water
actually drawn in each rotation after completion of the rotation.
