Ann Rowe and Kent Hamrick, Davis & Hamrick, LLP This session will discuss what carriers can expect from the recent NC Supreme Court decision in Hariston v. Harward, and are experiencing so far with excess verdicts based on UIM coverage. The interplay of liability coverage, UIM cover-age, and bad faith claims and the carrier’s increased exposure to a bad faith claim will be discussed.

General Liability: DIGITAL FORENSICS: VEHICLE ACCIDENT RECONSTRUCTION TECHNOLOGY Zeke Strawbridge, SEA Limited The presentation will outline the techniques engineering investigators use to collect data from scenes and vehicles following an accident. Areas covered include laser scanning, vehicle event data recorders, fault codes, and GPS, plus an explanation of digital simulation and animations and the differences between them.
Government: COMMON LITIGATION ISSUES FOR THE MUNICIPAL CLIENT Christa M. Cuccaro, Assistant Durham City Attorney Daniel E. Perterson, Parker Poe Adams & Bernstein, LLP This presentation covers the peculiar and, perhaps, not so peculiar issues con-fronting the municipal client in litigation. This survey of municipal litigation high-lights the unique position of and defenses available to cities in a lawsuit, and offers tips for municipal law practitioners, both in-house and outside counsel.

Employment: CHANGING INTERPRETATION OF THE “LEGITIMATE NON-DISCRIMINATORY REASON” FOR TERMINATION IN EMPLOYMENT LAW. Ryan B. Bolick, Virginia M. Wooten, Cranfill Sumner & Hartzog, LLP Traditionally the “legitimate non-discriminatory reason” provided counsel and claims handlers an almost ironclad defense against most federal and state employment law claims. More recently, however, the judiciary, both in their opinions and in their comments in open court, have signaled that this defense may be losing some of its power. In this presentation, we will share examples that show a “legitimate non-discriminatory reason” may be valid but insuffi-cient to obtain summary judgment or avoid damages at trial.
Medical Malpractice: CRIST V MOFFATT: THREE DECADES LATER Phillip Jackson, Roberts & Stevens, LLC The break out session will explore questions that remain thirty years after the North Carolina Supreme Court decided Crist v. Moffatt. Topics to include (a) Crist and the representation of large healthcare institutions that employ multi-ple healthcare providers, (b) Crist and non-physician healthcare providers (e.g. nurses, respiratory therapists, and advanced practitioners), (c) Crist and representation of the non-party provider at their deposition, and (d) whether Crist has a different application pre-litigation investigation versus post-litigation representation.
Product Liability: Failure to Warn and Continuing Duty to Warn Kenneth Kyre, Jr., Pinto Coates Kyre & Bowers, PLLC & Friends This session will discuss the failure to warn and the continuing duty to warn as a breach of the implied warranty of merchantability, as well as a continuing duty to warn. .
