DEFINITION OF TEMNIS

Illvolu,,itarp Resettlemenit: impacts of development projects may result in losses,

unavoidable relocation that people affected have no option but have to rebuild their lives,

incomes and assets elsewhere.

Resettlemrzenit Plaii is a time-bound action plan with resettlement strategy, objectives,

impacts, entitlement, socio-economic survey, policy framework, legal framework,

measures to minimize impacts, resettlement sites, compensation, income restoration,resettlement implementation arrangement, resettlement schedule, participation andconsultation, grievance redresses, monitoring and evaluation, and possibly indigenouspeople development plan.

Project Alffectedl Personis (PAPs) or Displaced Personis (DPs) indicates any juridicalperson wlho may be an individLual, a household, or a private or pubic firm on account of

the execution of a project, or any of its components or sub-projects or parts thereof wouldhave their:(i) right, title or interest in anr house, land or any other asset acquired or possessed.

( iii) Standard of living adversely affected.

Replacemzenit cost is a sufficient cost to replace lost assets and cover transaction costs.

(i) For agricultural land, replacement cost of an affected plot is the value to buy a

plot which has an equally profitable potential and is located in a vicinity of theaffected plot plus the cost of preparing the plot to a level similar to those of the

affected plot, plus the cost of any registration and transfer taxes.

(ii) For land in urban areas, it is a pre-project market value of a plot with equal sizeand use, similar or improved public infrastructure facilities and services andlocated in the vicinity of the affected plot, plus the cost of any registration andtransfer taxes.

(iii) For houses and other structures, it is market costs of materials to build areplacement structure with an area and quality similar or better than those of the

affected structure. Or it is the cost to repair a partially affected structure, plus thecost to transport building materials to the construction site, plus the cost of anylabor and contractors fees, plus the cost of any registration and transfer taxes.

In process to determine replacement cost, depreciation of asset and value of salvablematerials are neither taken into account nor the value of benefits derived from theproject.

Cenistis is a data collection technique of completing enumeration to all PAHs and theirassets through a household questionnaire. Objectives of the census are (i) to prepare acomplete inventory of PAHs and their assets as a basis for compensation, (ii) to identifynon-entitled persons, and (iii) to minimize impact of later influx of "outsiders" to projectarea.

Socio-econoinic suirvel is carried out in order to collect profile data of PAHs and toprepare for Resettlement Plan. A sample about 20% of PAHs is surveyed through ahousehold questionnaire. The survey result is used (i) to assess incomes, identifvproductive activities, and plan for income restoration, (ii) to develop relocation options,and (iii) to develop social preparation phase for vulnerable groups.

Citu-off l'te determines eligibility for entitlement. The cut-off date could also be the datethe project area wvas delineated, prior to the census, provided that there has been aneffective public dissemination of information on the area delineated, and systematic andcontinuous dissemination subsequent to the delineation to prevent further populationinflux.

Vulnterable -roiup is defined as indigenous people, ethnic minorities, the poorest, women,children, the aged, the disabled, and other socially/economically vulnerable groups whocould adversely affected from a project.

Grieval,ce Redress procedures are set out the time frame and mechanisms for resolutionsof complaints about resettlement from PAHs. Grievance redress can be carried outthrough informally-constituted local committees with representation from key stakeholdergroups. Grievances can also be addressed through fornal channels. With an unresolvedgrievance, it will be dealt with at progressively higher levels.

EXECUTIVE SUM IMARY

1. Thze Project aiid Resettlemenit Plait

The 220 kV substation in Binh Tan is a subproject of the Transmission and DistributionProject that would be constructed to meet the demand of power consumption of Ho ChiNMinh City in the period of 2001-2010. This subproject includes (i) Binh Tan 220 kVsubstation; (ii) a short transmission line 220-1 10 kV with a length of 88 meters; and (iii)Access road. The subproject would acquire land from eight families only and thereforeonly an Abbreviated Resettlement Plan is prepared. According to the World Bank's OP4.12, an Abbreviated Resettlement Plan mainly covers the following minimum elements:(I) a census survey of displaced persons, and valuation of assets; (2) description ofcompensation and other resettlement assistance to be provided: (3) consultation withdisplaced persons about acceptable alternatives; (4) institutional responsibility forimplementation and procedures for grievances redress;: and (5) a timetable and budget.

2. Objectives of Resettlement Plaii

The main objectives of resettlement plan are (i) to minimize adverse impacts on landacquisition; and (ii) in unavoidable case, a resettlement plan will be prepared in order tomaLike sure that DP can improve or otherwise will be at least restored their livelihood aspre-project implementation.

3. Legalframnework

Abbreviated Resettlement Plan (ARP) for this project is based on laws and relevantDecrees of Viet Nam related to compensation and resettlement and OP 4.12 oninvoluntary resettlement of the World Bank. Eligibility for compensation and/orrehabilitation entitlement and other assistance includes all individuals, households andinstitutions who will be affected by the project, either temporarily or permanently.

4. Project imppacts

The project will impact on:

- Permanent land acquisition for the substation, access road; connection towerand underground cable line.

- Permanent houses, structures, trees, crops and other assets.- Temporarily acquired land required during the construction of the project.

The survey results are shown as follows:There will be a total of 08 affected households with 14 persons. Of which, numberof households to be fully affected on houses and has to be relocated is 08 families.

There are no impacts on natural preserving zones, vestiges, and pagodas orsensitive areas.There are no impacts on ethnic minorities.

5. Entitlenmenttpolicy

All of project affected individuals, families; institutions in the project area xvill becompensated for their lost assets and will be assisted with allowances and subsidies in atransition period to make sure that they could at least restore their livelihood.Compensation costs and allowances will be based on decision of HCMCPC and at thereplacement values.

6. Participationi antd conisultationz

The consultants of PECC2 have carried out consultation with the DP. The consultationincludes asking the DP with some formal questions in a questionnaire (such as options forcompensation in cash or in kinds, opt to be resettled to resettlement site or self-relocationwith cash compensation etc.). The consultants have also asked PAPs about the proposedeconomic restoration programs and any special needs required for resettlement in order toshorten the transition period.

7. Comlplainit anid 11no0iitoring

During the project implementation, the DP's complaints will be dealt with according tothe regulations of Vietnamese laws. The complainant will be treated fairly and to beguided by related agencies on the order, procedures. In addition, no fee will be charged'for their complaints.

The implementation of the RP shall be constantly supervised and monitored by theProject Management Unit under the Power Company of Ho Chi Minh City and allrelevant local authorities to make sure that the RP will be implemented smoothly.

8. Intstitutiontal arrangements

The Power Company of Ho Chi Minh City and its Project Management Unit will bemainly responsible for all of operations on investment guidelines, investigation anddesign, project construction as well as supervision of compensation and resettlement ofthe project. The Project Management Unit is also responsible for directly guiding thewhole implementation process of the project including RP implementation to all relatedinstitutions. To successfully implement the RP, PMU will be assisted by HCMPC city,district and ward authorities.

9. Schedule

RP implementation wvill be implemented in a close linkage to the civil works. The detailschedule of RP implementation will be planed later at the detail design phase of theproject. The project affected persons wvill be clearly informed about the quantity of theirloss assets, entitlement policy, compensation unit cost, compensation amounts and RPimplementation schedule.

10. Cost estiiz ate

Total compensation cost is estimated at about 18,526,526,685 equivalent to USD 1.176million (The rate of exchange is VND 15,750 per USD). This cost including costs forcompensation, rehabilitation activities allowances, as well as administrative management.

1. INTRODUCTION

1.1 The subproject

Ho Chi Mvlinh City is the biggest one of Viet Nam. Its power consumption is at a high rateand increasing rapidly from time to time. According to a forecast by the Energy Institute,the total capacity of substations needs to be increased about 70% up to 2010 to meet wvithdemand of industry, domestic use. Its current power network needs to be upgraded andexpended through many programs such as national program, city program and programsof some international donors such as the World Bank and Asian Development Bank.

1.2 Objectives of Resettlement

rPnnciples and objectives of this RP arc defined in accordance with Vietnamese lawvs theand OP 4.12 of the World Bank on involuntary resettlement.

- Involuntary resettlement and loss of means of livelihood are to be avoided wherefeasible throuigh exploring all viable alternatives. But when, after examined, if it isproved unavoidable, then effective measures to minimize impact and tocompensate for losses must be agreed with the people who will be affected;

- People to be resettled involuntarily and people Nvhose means of livelihood will beIhinlder-ed or lost must be sufficiently compensated and supported by the projectproponernts a timely manner;

* The project proponents must mak-e efforts to enable the people affected by theproject to improve their standard of liviig, income earning opportunities andproduction levels, or at least to restore them to pre-project levels. Measures toachieve this include: providing land and monetary compensation for losses (tocover land and property losses), supporting means for an alternative sustainablelivelihood, and providing the expenses necessary for relocation and the re-establishment of a community at relocation site; and;

* Appropriate participation by the people affected and their communities must bepromoted in planning, implementation and monitoring of involuntary resettlementplans and measures against the loss of their means of livelihood.

To achieve these objectives, Resettlement Plan should be designed so as to follow theimprovement or at least a maintenance of the PAP's pre-project living standards.

2. LEGAL FRAlMEWORK

This Abbreviated Resettlement Plan is prepared in accordance with the projectresettlement policy. This policy is developed based on the relevant laws of Viet Nam and

OP 4.12 of the World Bank on involuntary resettlement. Key laws, decrees of

Government and Circulars of interministerial NMinistries, policies of HCMCPC on

compensation, support and relocation are as follows:

- Land law issued on November 26, 2003.- Decree 181/2004/NTD-CP on October 29, 2004 guiding the implementation of the

land laxv 2003.- Decision No. 1553/2004/'QD-TTg of Prime Mlinister on August 17, 2004 promulgating

the strategy orientation for sustainable development in Viet Nam (Vietnam's agenda

21).- Decree 197/2004/ND-CP on December 03, 2004 on compensation, support and

resettlement when land is recovered by the State.- Circular 116/2004/TT-BTC on December 7, 2004 guiding the implementation of

compensation, support and resettlement wvhen land is recovered by the state.- Decree I SS/2004/N'D-CP on November 16. 2004 on methods to determine land prices

and assorted land price brackets.- Circular I 14/2004/TT-BTC on November 26, 2004 guiding the implementation of the

Government's Decree No. I SS, 2004N D-CP on methods to determine land prices andassorted land price brackets.

- Decree 198/2004/ND-CP on December 3,2004 on collection of land use levies.

- Compensation and resettlement policies of HCMfC:(i) Compensation unit costs for lands (Decisions no. 316/2004/QD-U1B datedDecemiiber- 24, 2004):

(ii) Compensation ullits cost for building and other structures (Decision n1o. 118 QD-

UB dated April 2S, 2004);

3. EFFORTS IN INlIMIZING LAND ACQUISITION

The site of Binh Tan substation wvas selected based on the considerations of technical,

environmental and social viewpoints. These issues were carefully studied by checking at

the site and through consultation with local people, Binh Tan district authorities. There

are several alternatives that were studied. The site was selected with a shortest distance to

connect to the existing grid so that it would minimize impact to people under the right of

way and in a thin population area. Thanks to this consideration, only 08 HH will be

affected by all different categories (on land, building, crops and trees etc.).

4. SIOECONOMIC CONDITION, CENSUS AND INVENTORY

4.1 The socio-economic condition of DPs

The socio-economic survey was carried out for all of the DPs (08 households). Average

of family size is 02 persons. Of which, woman is 48.56%, and man is 51.44%.

Most of the DPs are doing business or working as government staff or in private firms.Few DPs are doing farming as a second occupation. But income from farming is quitesmall compared to other sources. The average income of the affected families is aboutVN'D S0 million per year.

Miost of the DPs have electricity, running water or drilling well, television, telephone,motorbike, refrigerator and furniture. Most of the DPs have main houses of more than 100m and good sanitation facilities.

A summarv of socioeconomic survey results is shown as in table 1.

4.2 Land acqiuisitioni imnpacts

Inmpacts on land include temporary ones in the construction time and permanent landacquistion for constructing the substation, access road and pole foundations. There are 08HHs who will be fully affected on houses. Of these, 06 HH remain land to reorganizetheir new houses (do not have to displace) and 02 HH do not remain residential land andhave to be relocated. Land acquisition is summarized as in a table no. 2, 3 and 4 below.

5. PRINCIPLES, ELEGIBILITY TO COMPENSATION AND ENTITLEiMIENT

5.1 Principle

Resettlement Plan should be designed to achieve an improvement or at least maintenanceof the PAH's pre-project living standards.

(a) Both Resettlement and land acquisition must be minimized as much aspossible

(b) Resettlement distance must be minimized. If the agricultural replacement

land needs to be given, then it should be as close as possible to the land

acquired.(c) Cash compensation for land, houses or structures shall be given at the

replacement costs free from depreciation cost of the salvage of the old

construction materials. Trees shall be compensated at replacement cost (the

cost of a seedling plus annual income from the tree multiplied by the

number of years that it takes for the seedling to be harvestable). Cash

compensation for crops shall be given at market price rates.

(d) Resettlement transition period must be minimized and compensation should

be paid to PAHs at least one month before the start of construction

activities. No land clearance if a full compensation has not been done.

(e) Resettlement and land acquisition plans and all replacement alternatives

should be carried out following consultation with the PAPs and it should

have their popular acceptance. The plans are also required to be approved

by local Authorities.(ft) Resettlement and compensation programs must provide adequately

institutional arrangements to warrant effective and timely implementation

and proper monitoring.(g) Financial and technical resources for the resettlenient, land compensation

and subsidies should be available when and wvhere reqluired.

(h) The previous level of community services and resoLurce should be

maintained or improved in the new sites.(i) Once approved by HCiMC People Committee, what stipulated in this RP

will be enforceable as an official legal document.

5.2 Displaced Persons and eligibility

The DPs include the following persons to be identified by the baseline infornation

collected for the Resettlement Plan:

(a) persons whose houses are partly or fully affected (temporanrly or permanently)

by the project;

(b) persons whose residential and/or agricultural land is partly or fully affected

(permanently or temporarily) by the project;

(c) persons whose businesses are partly or fully affected (temporarily or

permanently) by the project; and

(d) Persons whose crops (annual and perennial) and trees are affected partly or

fully by the Project.

The displaced or project-affected people eligible for compensation will include: (a)thosewho have formal legal rights to land or other assets; (b) those who initially do not haveformal legal rights to land or other assets but have a claim to legal rights based upon thelaws of the country; upon possession of documents such as land tax receipts and residencecertificates; or upon the permission of local authorities to occupy or use the projectaffected plots; and (c) those who have no recognizable legal right or claim to land theyare occupying.

Persons covered under (a) and (b) are provided compensation for land they lose, and otherassistance. Persons covered under (c) are provided resettlement assistance, in lieu ofcompensation for the land they occupy, and other assistances, as necessary, to achieve theobjectives set out in this policy, if they occupy the project area prior to the cut-off datesdefined in the RP. Persons wrho encroach on the project areas after the cut-off datedefined in the RP are not entitled to compensation or any other forms of resettlementassistance. Tlue cutt- off date of this RP is October 14. 2004.

5.3 Inipact Categories

Besides the direct compensation for the losses, the DPs are also entitled tosubsidies/allowances to restore their livelihood as stipulated in the Decree No.197, 2004of GOV. These allowances/ subsidies are as below:

(a) Subsidv for moving to new site (transport allowance)

This allowance is for DPs who have to be relocated to new sites: i) PAPs who haveto relocate within the City will be entitled to an allowance from VND 1,000,000 toVND 3,000,000; ii) PAPs who have to relocate out of City will be entitled totransport allowance of VND 3,000,000 to VND 5,000,000. This subsidyallowance is for the transportation of their salvageable materials and livingfacilities from affected site to the relocating sites.

(b) Relocation Subsidv for Resettlement

This subsidy allowance is a food allowance for DPs who will be relocated orreorganized in remaining land, and therefore they have to reconstruct their newhouses. Each member of PAHs will be equivalently subsidized 30kg rice permonth in six months.

(c) Rehabilitation Allowance

Vulnerable groups (the elderly, woman-headed householder, disable etc.,) and DPswvho are permanentlv affected more than 20% of total productive land area and orlost permanently more than 20% of their incomes will be entitled to training \vith5,O00,000() \'ND/ person.

(d) Bonus for self-relocation

DPs opting for self-relocation will be received a bonus package of VND20,000,000 per HH

6. RELOCATION AND ECONOiMIIC RESTORATION PROGRAMNIS

As described in (4) above, there are only two HH have to move to new sites, theremaining six HH will reorganize houses in their remaining land. Thus, relocation site forthe DP is not necessary. Through consultation with the DPs, all DPs agreed to receivecompensation in cash to manage relocation themselves. In the implementation period, theDP will be assisted by PMU and local authorities in purchasing and constructing theirhouses.

There is only one HH losing more than 20% of total productive land and this family willbe entitled to an economic restoration assistance . It is VND 5,000,000 per HH and thisfamily will be assisted with vocational training or any activity of economic restorationwhich the family prefers.

7. CONSULTATION AND PARTICIPATION

Information dissemination to, consultation with and participation of the affected peopleand involved agencies are to (i) reduce the potential of conflicts, (ii) minimize the risk ofproject delays, and (iii) enable to design the resettlement and rehabilitation program as acomprehensive development program to fit needs and priorities of the affected people,thereby maximizing economic and social benefits of the project investment.

The objectives of the Public Information Campaign and PAP Consultation Program are asfol lowiina:

- To fully share information about the proposed project, its components and its activitiesassociated with the affected people.

- To obtain information about needs and priorities of the affected people as well asinformation about their reactions/feedback to proposed policies and activities.

- To obtain cooperation and participation of affected people and communities whenimplementing the resettlement plan.

- To ensure transparency in all activities related to land acquisition, resettlement andrehabilitation.

Binhi Tan district authorities and DP were consulted through surveys and for the RP oniSSluCS such as (i) alternatives of substation sites, rouLte of the access road and cable ; (ii)DP's choice to modes of compensation (in cash or in kind); (iii) compensation unit costrecently issued by HCiMICPC; and (iii) implementation arrangement (payment, complaintimechanism, monitoring etc.)

Feedback of Binh Tan district and DP on the proposed project sites and relocatidnpreference were taken into account by engineers and resettlement planners.

The consultations were carried out through questionnaire of survey, meetings andindividual interview. The consultation and participation will be continued through thewhole period of th RP implementation.8. INSTITUTIONAL ARRANGEMENT

HCMCPC, its power company of HCMC, PMU and other administrative levels will beresponsible for implementing the RP. The co-ordination between the project developerand local authorities should be made closely in order to implement the RP smoothly andeffectively and to minimize a delay of the project.

8.1 Institutional Arrancements

8.2 The functions, taskforce and responsibility

HCMNICPC:

HCMIC PC is responsible in directing compensation and resettlement to Binh Tan

compensation, support and resettlement council. It wvill be also responsible for approval of

compensation plan and involves to complaint redresses.

PoNwer company of HCiMC and its Project Management Unit:

Power company of HCNIC and its Project Management Unit are responsible for

implementing the RP, including impact survey, payment of entitlements, implementation

of restoration program, resolution of complaints, internal monitoring.

Citv Department of Finance, Department of Construction and DONRE:

The city Department of Finance is responsible for researching and issuing unit prices ofcompenisationi and then proposing to City PC for approval. At the beginning of the Rl'

implementation, the Department of Finance will closely co-ordinate with the Departmlientot Constl-uctioni. DONRE, People's Committee of the district in ordel- to evaluate the

applied unit prices in the RP and propose to City PC for adjustment if necessary. It is to

ensure that the compensation unit costs are at replacement values at the time of

compensation payment to the DPs.

District Compensation council

The District Compensation, support and resettlement council is mainly responsible to:- Assist PMU in preparing detailed plans for compensation and resettlement.- Conduct inventory of impacts, prepare detailed implementation plan for

compensation and resettlement, pay compensation to PAP and help them inmoving out of the project affected areas.

- Solve complaints at the district level.

Ward People's Committees

Ward People's Committees will be responsible to:- Contribute to census and inventory surveys.- Co-ordinate with Compensation, Support and Resettlement council of district

on issues related to RP implementation such as public meetings, informationdissemination, compensation/ allowance payment to DPs.

- Transfer all feedback by DPs to District authorities and settle the complaints atthe ward level. Suggest the solution for the outstanding issues (if any).Assist DPs in overcoming the difficulties during the construction period.

Displaced Persons (Project Affected Persons)

The DPs are responsible for carefully checking on their lost assets in the DMS form andrespective entitlements in the Entitlement form before signing in these forms

9. TASK FORCES AND IMPLEMENTATION SCHEDULE

9.1 Task forces

1. Anntouncemenst to P,1Ps

All DPs shall be fully informed about rights and policies of the RP includingeligibility, entitlement policy, modes and rates of compensation, schedules andcomplaint and grievances rights. In addition, a Resettlement Information Booklet(RIB) will be prepared by PMU and then delivered to all DPs or informed atmcetings in districts and wards; hung in public places such as ward people'scommittee and school etc. The public announcement tasks shall be implementedimmediately after City PC approval of project is obtained.

2. Compenisationi deadllinies

Compensation for affected assets will be paid before land clearance. For DPs wvhohave to be relocated, local authorities and PMU will make every effort to assistthem in purchasing land and reconstructing their houses and to be sure that, noland clearance if these DPs haven't completed the reconstruction of their houses atnew sites yet.

3. Resettlemenit anid clearanice deadlinie

The impacted DPs on houses and land after receiving full compensation andsubsidies are requested to move out of the affected portion of the houses forclearing land at least 15 days before the work commenced.

4. RP inplemenitatioti process

RP implementation will include three major actions as below:a) General action: Just at once when beginning the project implementation

work.b) Separate action: at several times, once for each component of the project.

c) Continuous action: Continuous action for stages of RP implementation.

9.2 Basic actions of the project

1. Actioni 1: Establish Comttpentsation, Support and Resettlement counzcil.Just after the investment approval of the project, Binh Tan district xvill establishCompensation, Support and Resettlement council. The Power Company of HCMCand its P.MU sets up a Compensation and Resettlement team.

2. A ction 2: Detail Mlleasiuremzent Survey

District Compensation, support and Resettlement Council carries out the DetailNleasurement Survey of affected assets and together with other related agencies toevaluate for the applied unit costs in the RP and propose to City PCs forreadjusting these prices (if it is necessary). It is to ensure that the DPs arecompensated with replacement costs at the time of RP implementation.

Immediately the ends of final inventorv survey, Binh Tan Compensation, Supportand Resettlemllent Commlittee will inspect and define the official number of DPs,impacted properties and total conmpensation amount for each HII.

Binh Tan Compensation, Support and Resettlement council officially announcesthe pblicy, schedule of RP implementation to DPs at public meetings includingissues related to compensation, resettlement and land clearance.

5. Actioni 5: Compensation pa-ment to DPs

Compensation and assistance are paid for DPs affected on houses, and then forDPs affected on other properties. The DPs are permanently lost more than 20% oftotal productive land area or incomes will be entitled to rehabilitation assistance.

6. Actioni 6: AMoniitorintg

During the project implementation, PMU will monitor all actions of the RPimplementation and rehabilitation programs. Because of small scale of landacquisition impact, independent monitoring might not be necessary or onlyindividual might be hired by the Power Company of HCMC for this task.

Monitoring includes the folloxving issues:

a) Monitoring whether the implementation of resettlement and compensation tasksare carried out as stated in this RP.

b) M\lonitoring the availability of budget for compensation and compensation coststo make sure that the DP are paid at the replacement costs.

c) Monitoring if compensation to the DP is in a timely manner.

d) Investigate and fairly assess each case of complaint and grievance.

e) P%Il; wvill prepare a quarterly detailing report on progress of RPimplementation. The report should be sent to relevant authorities.

9.3 Implementation schedule

One of RP provisions is that, RP Nwill be carried out to meet safety purpose of landclearance and implementation of civil work.

The RP implementation schedule wvill be wvith the main following steps:

(I) Preparation wvork, definition of scope and amount of project investment(2) Survey work for the RP: October, 2004(3) RP reviewed by relevant authlorities and approved by EVN, cleared by the\World Bank: February- April, 2005(4) Establishing Compenisation, Support and Resettlemiient Council of Binh Tandistrict: May, 2005

(5) Informllationl campaign: June, 2(005(7) Compensation Payment, land clearance for the project construction: About05 months before the beginning of civil work (according to bidding plan).(8) Implementation of economic rehabilitation programs: In the same time ofcompensation delivery.(9) Mvlonitoring of RP implementation and evaluation: Through whole period ofimplementing RP.(10) Commencing with Civil works of the project: After full compensation andcompletion of house construction of DP at new sites.

All RP activities mnust be satisfactorily comnpleted before PMU oive a no objectionfor award of contract for the sutb-projects.

10. COiMIPLAIN IVIECHANISM

To ensure that the DPs have opportunities to express their grievances related to anyaspect of compensation and resettlement, detailed procedures of grievances havebeen established for the project. Its objective is to respond to grievances of the DPsspeedily and transparently. Actions of the mechanism must be convenient,transparent and fair. By resolving grievances at the project level, implementation

of the project would be more effective ascertained. The procedures of grievancesare as followvs:

Stage 1: At wvard leVel

If any person is aggrieved by any aspect of RP implementation, he/she can lodgean oral or written grievance to ward authorities. Ward People's Committee willresolve the issue within 15 days

Stage 2: At district level

If a complainant is not satisfied with decision in stage 1, he or she can bring thecomplaint to district PC. WVithin 15 days from the date of the receipt of his/i-erpetition. district wvill reach a decision on the complaint.

Stage 3: At citv or district court level

If the PAP is still dissatisfied wvith the decision, he/she can appeal to the DistrictPcople's Court (DPC) in accordance with the "Civil Procedure Act" or to[fC',NICPC within 15 davs of receivin, the decision of the district wvithoUt beinecharged. No fees will be charged to complainant.

11. COST ESTIMATE

Compensation cost estimate for house, structure, residential land, agricultural land, treesand crops etc., are based on Compensation and resettlement policies of HCMC:

- Compensation unit costs for lands (Decisions no. 316/2004/QD-UB datedDecember 24, 2004).

- Compensation units cost for building and other structures (Decision no. 118/QD-UB dated April 28, 2004.

Cost for RP consists of:

- Compensation for permanent land acquisition- Compensation for trees and crops- Compensation for houses and structures- Subsidy, allowance for rehabilitation consist of relocation subsidy, transport

allowance, training subsidy etc.- Management cost, and- Contingency cost.
