I. INTRODUCTION

1. The Second Chittagong Hill Tracts Rural Development Project (CHTRDP-II) was approved by ADB in July 2011 for an amount of $55.00 million. The Project cost is $70.80 million of which $14.40 million is Government of Bangladesh financing and the remainder from beneficiary’s contributions. The project implementation period is December 2011 - December 2018. The Ministry of Chittagong Affairs (MoCHTA) is the executing agency, the CHT Regional Council (CHTRC) is the lead implementing agency and the Local Government Engineering Department (LGED) is the implementing agency for rural roads. The Project impact is to increase rural household incomes in subproject areas in Chittagong Hill Tracts (CHT) and its outcome increased income-generating opportunities for people in subproject areas. There are five main outputs: (i) institutional development and capacity building, (ii) upgraded rural roads (166 km), (iii) maintenance of community infrastructure (in 600 villages), (iv) sustainable micro agribusiness development (MAD) in 9 sub-districts (upazilas), and (v) efficient project management operational.

2. Project management support includes Safeguards and Quality Monitoring Cell (SQMC), which is comprised of two national individual consultants (intermittent inputs of total 40 person-months for Environmental Engineer and Social Safeguards Specialist), recruited by ADB and engaged by the MoCHTA1. The Terms of Reference (ToR) for the SQMC consultants is attached as Appendix-A.

II. OBJECTIVES AND SCOPE OF WORKS

3. The overall objective of the assignment is to provide impartial observation of project implementation through monitoring quality of construction works and monitoring compliance with social and environmental safeguards and to be reported independently to the Asian Development Bank.

4. The scope of works for the SQMC consultants is Monitoring procurement activities (particularly tender processes and unit rates), maintaining quality control, adherence to social and environment safeguards as detailed in relevant Project documents and for reporting any deviations for further rectification, working closely with the LGED in establishing the clearance of alignments for undertaking of civil works by road contractors, and ensuring the required standard and quality maintained in safeguard implementation and reporting.

5. This report covers the inputs2 of SQMC consultants for the duration of 18 - 28 March 2013.

III. COMMENCEMNENT OF THE SERVICES

6. Both consultants of the SQMC have commenced their services on 18 March 2013. To observe implementation of physical works, specifically construction works January to May is the suitable period in Bangladesh. Considering working season and consultation with Project Director (PMO), Project Director (PIO), Team Leader and Deputy Team Leader of Project Implementing Consultant (PIC), time schedule for the Consultant has been prepared as shown below:

7. After commencement of the services, the SQMC consultants met Honorable Chairman (CHTRC), Project Director (PMO), Team Leader (PIC) including key team members, Deputy Project Directors (DPMO) of Rangamati, Bandarban & Khagrachari districts and Executive Engineers (LGED) of Rangamati & Khagrachar districts. The SQMC consultant also met Chief Engineer (LGED), Project Director (PIO) including SDS Consultants of PIO, Executive Engineer (LGED) of Banderban districts. The list of people met is in Appendix-B. The SQMC consultants described the purposes of their assignment including ToR and discussed about the project implementation progress. The SQMC consultants made a field visit to Khagrachari and visited Panchari GC - Bhaibonchara GC via Shantipur Arunya Kutir road and consulted beneficiary and potential affected people of CHT Community, Panchari Upazila of Khagarchari district. The SQMC consultant also visited LGED Quality Control Laboratories of Rangamati, Bandarban and Khagrachari districts.

IV. KEY OBSERVATIONS

8. PMO has deployed all of the required staff members in three Hill Districts Rangamati, Khagrachari and Bandarban. The Deputy Project Director along with other support staff members are on bard now. But deployment of the Non-governmental Organizations for implementation of the social safeguards including Resettlement Plans is not yet completed. Deployment of the resettlement specialist in the PIC is felt urgent at this moment. Reportedly the PIC has deployed all of the consultants except Resettlement Specialist. The Training Specialist of the PIC Mr. Kirti Nishan Chakma has been proposed for the post of Resettlement Specialist as told by the Team Leader. A new training specialist will be deployed in place of present one after official approval of the CV of Mr. Kirti Nishan as Resettlement Specialist.

9. During discussion about problems and constraints of the project implementation and probable mitigation measures and way of overcoming the constraints with the Deputy Project Directors and other staff members of Rangamati, Bandarban and Khagrachari it was felt that deployment of the Implementing NGOs would be helpful to resolve some of the problems. Awareness of the potentially affected/benefited people about the project would be created quickly if the INGOs are on board. Transportation facilities to the remote Upazilas of Rangamati is not sufficient. Total 7 Uapzilas out of 10 have no road communication with the Rangamati town. People move to these seven Upazilas by country boat. Motorised/speed boat essential for supervising project to easy moving to the remote Upazilas.

10. The Honorable Chairman (CHTRC) appreciated recruitment of the Environmental Engineer and Social Safeguard Specialist in the project by ADB to monitor quality of construction works and monitor compliance with social and environmental safeguards issues. He expressed satisfaction on the progress so far achieved as yet. But he expressed his dissatisfaction He emphasized on coordination among the executing agencies of the Project.

11. LGED implements the rural roads component of CHTRDP-II with LGED staff working at district and upazilas within the project area including 27 incremental project staff. During discussion with LGED officials it was learnt that LGED recruited/deployed 13 project staff out of 27 staff and reaming 14 project staff yet to be recruited/deployed. Also, LGED has shortage of field staff, who are related to implement the project. The vacant positions of project and field LGED staff are shown below. During discussion with Chief Engineer, he assured that these positions would be filled up immediately before starting implementation of rural road works.

A. Panchari GC - Bhaibonchara GC Via Shantipur Arunya Kutir Road

12. The SQMC consultants visited one of the pre-selected road sub-projects: Panchari GC - Bhaibonchara GC via Shantipur Arunya Kutir road under Panchari Upazila of Khagarchari district on 20 March. Total length of the road is 10.62 km, out of which 4.49 km upgraded under CHTRDP-I; reaming will be upgraded under CHTRDP-II.

13. The SQMC consultants consulted the potential affected and benefited people during the field visit. Some households and shops beside the proposed road may require

displacement. Some private land needs be acquired for the project. People are willing to offer the land with adequate compensation and other assistance. Resettlement planning would cover these issues.

14. About 1764 m of irrigation channel, out of which 370 brick lined and 1,394 m unlined (earthen), runs along the proposed road alignment. Irrigation cannel will be damaged during upgradation/improvement of the road. The portion of the channel to be damaged during upgradation/improvement of the road, should be re-installed as permanent irrigation channel; otherwise, farmers will build this cannel by cutting road slopes, which will be damaged the road again. Installation of PVC conduit for irrigation water supply along the road side may be an alternative permanent solution instead of lined channel.

15. A stretches of 60 m road at a valley (as shown in the following picture), the depth of sag at the point of vertical intersection (where the grade tangents intersect) is 5.1 m (change 6+800) between the point of vertical curvature (the place where the curve begins) and point of vertical tangency (where the curve ends) is too steep, which affects the comfort and safety of the users and fuel consumption of vehicles. This portion of the road should be upgraded with standard gradient.

B. Quality Control Lab

16. The SQMC consultant visited quality control laboratories at the LGED district offices of Rangamati, Khagrachari and Bandarban. A list of lab equipment, which are required for the quality control of rural road component works, which are available and, which are not available at district offices are shown in the following table. The lab equipment, which are not available at the project district, LGED should arrange these equipment before starting road work.

C. Goods and Equipment

17. LGED has procured 4 cross country vehicles, 4 double cabin pickups and 18 motorcycles and office equipments. LGED has issued notification of award to supplier 3 total stations, which will be received by LGED within 25 April 2013. LGED also has completed evaluation of bids for the procurement of 3 vibratory road rollers and 3 pay loaders and sent to ADB for concurrence. Bids for procurement of 6 plate compactors will be invited at the end of April 2013.

D. Rural Roads

18. Identification and selection of rural roads have been completed for upgradation to be taken up in the first year of the project (fiscal year 2012–2013) and CHTRC approved 12 roads, consisting 8 upazila roads and 4 union roads which were taken up from the long list provided in the PAM. Out of 12 roads, data collection, survey works, design, drawing and bill of quantities (BOQ) of 2 roads have been completed by the in-house individual consultants; data collection and survey works for 5 roads have been completed and another 1 road works are on-going. Survey and investigation for construction of bridges/culverts for 2 roads are also on-going. Community consultation on the final design, indigenous people plan, land acquisition and resettlement plan did not started as NGOs are not fielded.

19. The SQMC consultant reviewed densign parameters of rural road. The following parameters, which were fixed by the Planning Commission of Bangladesh, have been adopted for design of road pavement for upazila roads:

20. A typical section of road, which will be followed for upgradation of upazial roads under CHTRDP-II, is given below:

E. Functional Buildings

21. The plan, design and cost estimation for two functional buildings of LGED executive engineers for Rangamati and Banderban districts have been prepared by the in-house individual consultants and submitted to Project Director for PMO’s concurrence. PMO’s opined that according to the provision of DPP the floor area should be within 200 sqm for each functional building and LGED should start construction of three functional buildings at a time. On basis of these opinions plan, design and cost estimation for three functional buildings have been prepared and sent for PMO’s review and concurrence. LGED has expected that tender for construction of three LGED functional buildings will be invited by the district respective offices at the end of April 2013.

V. CONCLUSION

22. The project start up works has been completed except fielding of NGO. The SQMC consultants are thankful to Project Director (PMO), Project Director (PIO), PIC, Project Coordinator, LGED Executive Engineers of Rangamati, Khagrachari and Banderban districts for their supports.

TERMS OF REFERENCE

Objective/Purpose of the Assignment:

This consultancy will be part of the Safeguards and Quality Monitoring Cell (SQMC) that will be established in the Project Management Office to monitor quality of construction works and monitor compliance with social and environmental safeguards. It will have two-fold reporting responsibilities: (i) to the Project Director; and (ii) independently to the Asian Development Bank (ADB). The role of the SQMC will be to ensure that the Project is implemented with due concern for safeguards and quality and specifically to ensure that these issues are adequately addressed to the requirements of ADB: (i) compensation for land and asset acquisition; (ii) compensation for loss of income; (iii) continuing tenure of land by the original users; (iii) gender; (iv) indigenous people; (v) environment; and (vi) quality of work necessary to ensure sustainable outputs. The failure to adequately address any safeguard or quality aspect will cause the Project Director to withhold the disbursement of funds to the offending agency until such time that the process to rectify the fault is put in progress.

Scope of Work:

Monitoring procurement activities (particularly tender processes and unit rates), maintaining quality control, adherence to social and environment safeguards as detailed in relevant Project documents and for reporting any deviations for further rectification, working closely with the Local Government Engineering Department (LGED) in establishing the clearance of alignments for undertaking of civil works by road contractors, and ensuring the required standard and quality is maintained in safeguard implementation and reporting

Detailed Tasks:

A. Environmental Engineer

(i) The Environmental Engineer (EE) will be responsible for monitoring, trouble shooting and building the necessary capacity in implementing agencies for the correct implementation of the Environmental Management and Monitoring Plans (EMMPs). PMO and district project management office (DPMO) environment staff assigned to the Project may lack implementation experience. The EE will therefore carefully document expected daily, weekly and monthly activities and outputs, provide checklists and help to draft reporting templates and consultation records.

(ii) The EE will ensure all project staff and LGED counterparts for road subprojects understand their responsibilities for preparation of initial environmental examination reports (IEEs) and implementation of EMMPs according to the principles of the Environmental Assessment and Review Framework (EARF), including sharing information with affected people, consultation with indigenous peoples, and their roles and responsibilities with regards to the project‘s grievance mechanism. The EE will also initially review the IEEs prepared for subprojects prior to submission to the Department of Environment and ADB, and ensure responsible government and Project Implementation Consultant (PIC) staff are able to undertake this process to an acceptable standard.

(iii) Following the initial period of capacity building, the EE will review all EMMPs, monitor implementation monitoring by LGED district offices and contractors of environmental impacts, provide suggestions for quality improvement or undertaking remedial actions, and report the same to the Project Director (PD-PMO) and ADB. It is expected the EE will undertake regular visual inspections of subprojects and random consultations with affected persons in order to verify that all impacts are being recorded and dealt with in accordance with the EARF principles and the EMMPs.

(iv) The EE will also review procurement process and identify any specific issues to PD-PMO and ADB. This will include ensuring a transparent procurement process is implemented in accordance with ADB guidelines.

(v) The EE will report quarterly to the PD-PMO and ADB on implementation progress.

B. Social Safeguards Specialist

(i) The Social Safeguards Specialist (SSS) will be responsible for monitoring, trouble shooting and building the necessary capacity in implementing agencies for the correct implementation of the Indigenous Peoples Plan (IPP), Land Acquisition and Resettlement Framework (LARF) (plus all subsequent LAR Plans), and Gender Action Plan (GAP). (ii) Many of the safeguard staff assigned to the PMO as government officers and also the DPMO will be newly appointed. The SSS will therefore carefully document expected daily, weekly and monthly activities and outputs, provide checklists and help to draft reporting templates and consultation records. The SSS will ensure all project staff understands their responsibilities for implementation of the various Plans, including sharing information with affected people, obtaining free and prior consent of indigenous peoples, and their roles and responsibilities with regards to the project‘s grievance mechanism. The SSS will also initially review the LARPs prepared for subprojects and ensure responsible government and PIC staff are able to undertake this process to an acceptable standard. (iii) Following the initial period of capacity building, the SSS will review all LARPs, monitor implementation monitoring of the IPP, LARPs and GAP, provide suggestions for quality improvement or undertaking remedial actions, report the same to PD-PMO and ADB, and sign off on completion. (iv) Implementation progress on LAR, GAP and IP plans will be reported quarterly by the SQMU SSS to the PD and ADB. Successful implementation of resettlement activities according to each plan or works contract will be checked by the SSS and provided to ADB for nonobjection prior to mobilization of the contractors.
