• This is unreasonable condition, so this is not valid.


Dhwal of Bikaner undertakes a wagering agreement with Yuvraj at Mumbai. Yuvraj deposits Rs. 5000

in the process and looses the money. Can he recover this money

from Dhawal?

• Wagering agreements are illigal in Mumbai and Bikaner, so this money cannot be recovered.


Mayank goes to Nepal and puts Rs. 10000 in wagering agreement

relting to horse race on behalf of Prateek (on Prateek’s request) and

loose this money. Will Mayank recover this money?

• Yes, because it is a legal activity in Nepal.


Dhawal makes a contract with Banta that if Banta gets married with Prices of Nepal, Dhawal will give him Rs. 40000 otherwise, he

will have to pay Dhawal Rs. 40000. Prices of Nepal died in firing at the moment when they were making

agreement. Will Dhawal be able to get 40000 (because Banta didn’t

marry princes of Bikaner)? • No (void agreement – as mistake of fact)


Dhawal wants to fight with Khali and put some money on the

contest. If he wins, Khali should give him some money, will it be a valid agreement or a Wagering

agreement? • Yes it is valid – skill based agreements are

not wagering agreements and wrestling is also a skill based activity.


Goti conducts Lottery, which is not approved by the Government. Is it

wagering agreement?

• Yes, it is also illegal and punishable under Section294 A of IPC.

An insurance company puts a condition in the policy that if the

claim is filed after 1 year, it will be void. Is this clause valid?

• No, any such condition that restrains other party by reducing time limits unreasonably, is void.


Goti is an employer and employs Mohit and puts a condition that Mohit will not serve any other

employer during the time when he is serving Goti, is this valid?

• Yes – this is a reasonable restraint by the employer.
