Health) WHEREAS, Section 2 of Republic Act (R.A) No. 10149 provides that "...the State shall ensure that: x x x (b) The operations of GOCCs are rationalized and monitored centrally in order that government assefs and resources are used efficiently and the government exposure to allforms of liabilities including subsidies is warranted and incurred through prudent means"; WHEREAS, Section 5(a) of R.A. No. 10149 mandates the Governance Commission for GOCCs (GCG) to "evaluate the performance and determine the relevance of the GOCC, to ascertain whether such GOCC should be reorganized, merged, streamlined, abolished or privatized, in consultation with the department of agency to which a GOCC is attached"; WHEREAS, PhilHealth requested 1 for approval of the Governance Commission to create one hundred thirty-six (136) additional positions under the Legal Sector to resolve the recent issues and address the concerns raised in GCG's operational audit; WHEREAS, one of the causes for the depletion of PhilHealth's fund identified by the Governance Commission in its Operational Audit2 of PhilHealth is the inefficient investigation and prosecution of fraudulent claims; WHEREAS, PhilHealth is expecting to decrease the potential fraud incidence, and improve the percentage of cases disposed and the percentage of appealed cases resolved within the prescribed period upon strengthening its legal sector; WHEREAS, the GCG determined that it is in the best interest of the State and the public to authorize the creation of additional positions for PhilHealth to promote better, effective, and efficient services to the public; 1 PhilHealth letter dated 14 June 2019 signed by Mr. Dennis S. CREATTON OF ONE HUNDRED TWENry-EIGHT (128) PLANTILLAPOSITIONS UNDER THE LEGAL SECTOR OF THE PHILIPPINE HEALTH

INSURANCE CORPORATION (Phi! Health)

WHEREAS, Section 2 of Republic Act (R.A) No. 10149 provides that "...theState shall ensure that: x x x (b) The operations of GOCCs are rationalized andmonitored centrally in order that government assefs and resources are usedefficiently and the government exposure to allforms of liabilities including subsidiesis warranted and incurred through prudent means";

WHEREAS, Section 5(a) of R.A. NOW, BE lT -RESOLVED, the creation of one hundred twenty-eight (128) plantilla

positions under the Legat Sector is hereby AUTHORIZED with the followingpositions:

Attached as Annex A is the distribution of the additional positions for the

organization units under the Legat Sector of PhilHealth.

RESOLVED FURTHER, that the above authorization is SUBJECT TO THE

FOLLOWING CONDITIONS:

a. Conformance of PhilHealth's Governing Board to this Order through

the issuance of the appropriate Board Resolution;

b. The process of filling-up of the additional positions shall commenceimmediately after PhilHealth's receipt of this Order and issuance of

the Governing Board's resolution as mentioned in item (a) above. Aquarterly progress report shallthereafter be submitted by PhilHealth

to the Governance Commission until the positions have been

comPletelY filled;

c. The authorization shall be without prejudice to future amendmentsin the Organizational Structure and Staffing Pattern (OSSP) ofphilHealtlr in its impending reorganization, and that this ordercannot be used as a reason to maintain the authorized staffingpattern of the Legal Sector. The above authorized positions are not

to be considered as an advanced implementation of the impending

reorganization to be proposed by PhilHealth;

d. Funds for the purpose shall be taken fully from the corporate funds

of the PhilHealth, as approved by its Governing Board, and no

budgetary support will be provided by the National Government forpersonal services; and

e. The pertinent budgetary, accounting, auditing, civil service and

other applicable laws, rules and regulations shall be comptied with.
