(6) Any county may fix the services of the district attorney at full time in the discretion of the county rom- missioners. In the year 1975 such determination shall he made not later than October 15, and in subsequent years shall he made prior to the first day for filing peti- tions by candidates for the office of district attorney.

The president judge of the court of common pleas of the judicial district shall make such recommendation to the county commissioners on the advisability of full time service by the district attorney, hut the same shall not be binding on them.

Where an election is made by the county commissioners to reouire a full time district attorney he shall be com- pensated at one thousand dollars ($1,000) lower than the compensation paid to a judge of the court of common pleas in the respective judicial district. Such district attorney shall devote full time to the office, and shall not he ~ e r m i t t e d any private practice during the period in which the individual serves in the aforesaid office.

Where no such election is made, the district attorney shall he permitted to have an outside practice, and his salary shall be fixed by the salary board of the said county at not less than fifteen thousand dollars ($15,000) nor more than twenty-five thousand dollars ($25,000). In no case shall the compensation for district attorneys in third through sixth class counties for such part time service he lpss than four thousand dollars ($4,000) more than the incumbent is presently receiving under section 5 of the act of November 1, 1971 (P. L. 495, No. 113).

Mr. BUTERA. Thank you, Mr. Speaker. Mr. Speaker, following the budget action last week,

the Pennsylvania Public Television Network provided 3 hours of time for statewide press conferences.

On Thursday night, the Governor appeared for an hour and a half, and on Friday night, the legislature responded through Senator Nolan, Representative Man- derino and myself. For those of you who may have missed those shows, I offer this brief report:

Governor is that the plan which h e submitted to the legislature last March indicated, by his figures, that there

he a need for $400 in taxes next year. This is shown on page 3, Volume I, of the document which the Governor submitted to us called the 1975-1976 Commonwealth of Pennsylvania Budget.


This use of misinformation seems to be planned. On March 16 of this year, just 10 days after he had certified to the need for the $400 million in 1876-'17 tax revenues, the Governor told the public this, and I quote: "I prepared a program without a t a x increase. It is up to the legislature lo decide what kind of budget it wants."

We say that the tax bite will he in the neighborhood of $482 million next year, and on Friday night Mr. Man- derino indicated that it would only be $160 million.

The Governor, of course, then atttacked the state hudget for favoring the two large counties but failed to mention that he opposed efforts on this floor to more equitably distribute the $46 million in additional school reimburse- ment dollars, which most of us sought to spread around the state equally to give each child an equal sharc of that money.

Mr. Shapp struck a vcry strong posture as a thrifty manager by insisting that the state payroll has only gone from 102,000 to 110,000 in his administration and blamed most 01 this rise on the Federal Government. Who else?

Our figures indicate that the payroll is about 118,000 and that the payroll cost has risen about $600 million annually since he took office.

The Governor, without seeming to blush, took personal credit lor the tax reduction of last session, a reduction he bitterly opposed for 6 months and which could not have come about had not Senator Nolan and other inde- pendent Democrats in the House and the Senate joined thc Republicans who insisted upon it.

The Governor made a strong plea lor the Pocnno Art Cenicr, which costs in the neighborhood of $100 million, as a method of stimulating the economy.

With all of this ringing in the public's ear, the legislature went on the network Friday night. Senator Nolan stole the show. Representative Manderino and I were in the role of sidemen.

Senator Nolan was very candid. He explained first the arithmetic of the hudget, which shows that the legislature indeed reduced the requested Governor's expendi- ture by some $60 million. He :xposed the political threats, which we have been hearing now for the past week, that human services are to be cut as being nothing more than threats. And he spilled the bcans on how Mr. Shapp attempted to make this budget.

Senator Nolan named case after case in which the Governor tried to settle the hudget by offering deals, Witnesses werc present at the time these offerings were made. They were made hchind closed doors and they were made without the knowledge of the public or of most of us in the legislature. Had the Senate Democrats entered into these agreements, the level of spending, ultimately, would have been considerably higher than that which we agreed upon as of last week.

. Speaker, only one major item was not clarified by the news conferences but rather became further clouded, and that is thc question as to how high taxes will soar onc year from now. I clo not think any of us has the absolute answer, but c~r ta inly we know that we are facing some kind of a crisis. Mr. Seltzer last week put the figure at $482 million: Governor Shapp's document shows the need tu be about $400 million; Mr. Man- derino fixed the gap at $160 million.

Mr. Speaker, therc is no more important question before this House than to bring the facts of the 1976 taxa- tion ler~els into focus. It makes no sense at all for us to

hide the truth from the public and from ourselves any longer. I will be requesting some clarification of these figures from Mr. Wojdak and I will call upon him to join with us in setting forth the facts which we think are most accurate to all the members of this House.

The most distressing thing to me as a legislator par- ticipating in this charade is, first, that none of the events of the last 2 weeks-the charges and countercharges, the confusing of the public with facts which exceed their imagination-would even have to occur if we would join together in ending the process by which we enact budgets year in and year out in Pennsylvania.

The second thing which is most distressing is that while the Governor in his press conference received wide notoriety in blaming the legislature-both parties this time, and that is a first-when it was exposed that the very basis upon which he was making his argument was false, there was not one word of notoriety. The Gover- nor based his entire argument on this budget upon the shift of funds from the administration's control to the control of the counties, when just days prior to taking this posture he was attempting to do what the Senate Democrats finally did by voting, by making a closed-door deal with them.

And worse than that, he attempted to settle the budget by dealing only with one or two large counties which, he then later stated, were trying to heist the rest of the state.

The Senate insisted, in trying to bring additional aid to Philadelphia and Allegheny Counties, on picking up all the costs in the state in the various items which they inserted into the budget. The Governor, we are now told, offered at least part of them just to be paid to Allegheny County.

It seems lo me that that kind of negotiation should be brought to light. I am happy that it was brought to light by one of the participants. I think that it is the kind of thing which we should guard against in the future.

I see nothing wrong with the Governor sitting down and negotiating hard with any group in this General Assembly or with any segment of our population. IIow- ever, I cannot condone his attempting to discredit all of us and, in the process, not acknowledging that he had attempted to negotiate the terms of those negotiations so that the people in hearing his report on the budget could weigh which side of the argument was the correct one.

I suppose that we will never be able to quite balance the kind of coverage which an executive gets i n this state and which the legislature gets until we buy up all the newspapers. But I did think that it was worthwhile placing these facts on the record in this House and again pleading, particularly with the majority, that we make efforts now, while this is fresh in our memory, to pro- hibit its repeat in the next hudget session next year.

Mr. MANDERINO. Mr. Speaker, on the same subject, I wish I could follow the words of Mr. Rr~tera better than I do. I frankly do not understand the arguments thnt he makes in many respects. Let me just point out a couple of them.

tions Committee chairman, myself and other leaders, duri!ig the passage of the budget in the House and de- tailed for Mr. Butera and for all the members of the House just exactly how the calculations that we arrived at would show a $160-million deficit next year. He chose to ignore everything that was told to him, all the facts that were given to him. We talked to him about revenue estimates for next year that we did not agree with the Governor on. We talked to him about welfare case laad projections that we did not agree with the Governor on, We talked to him about lapses u~hich were different, in our opinion, from the estimates in the budget document.

Now he was here; all the members of the ~ o u s e were here. Just to simply gloss aver the difference in the $400-million projected deficit and the $16O-mil]ion deficit that we, the members of the House, decided was the true deficit for next year does not do him credit nor does it

C clu crerlit to the process by which we adopt budgets. Th,e inz'jrlrity leader indicated that we have got to stop,

year after yca;, adopting the budget by the same process. I agree. But the thing that I object to most about the manner in which budgets are adopted is the blatant- blat;,nt, I call it-attempt to seek political advantage by budget votes.

We here in the House discussed at length the $46 mil- lioil that the two largest intermediate school units in the state virre going to he receiving. w e discussed the reason, thc right. the equity, and the law of pennsylvania which aliou-s that $46 million to he paid to those districts. IIe just ignored that that is the law of the comnlonwealth when he talked about equitably distributing that money to the rest of the state. He ignored the arguments that were made here on the floor of the House that those two large school districts were, under the law, entitled to that rnoncy and we had to pay that money. He also ignored the fact as it occurred here in the House that we did decide when we ran the budget hill in the H ~ ~ ~ ~ , llouse bill No. 1336, tbat the new $34 million in spending that was not mandated he turned down because we did not fcel that we had the money to afford those unmet needs this year, and most of his side of the aisle agreed with turning those projects down. Most of the members over there voted "no." Yet when the conference committee camc back to the House, you engaged in the same old tactic of seeking political advantage by voting just the opposite to your vote the day before or 3 days before and to a man, except three or four, you changed your position. Now these new projects, these new spending programs, for which we are going to spend $34 million- $7.70 per person in those two urban areas and about 90 cents a person in your areas and other rural areas-you approved. You did not do that with reason; you did not do that objectively; you did that to seek political advantage, and time will only tell whether or not you were successful. My reading of the press so far indicates that you heve made a mistake.

You criticized the Governor for taking credit for a tax reduction in the Commonwealth. Much of the tax reduction, in my opinion, comes from savings initiated by the Governor through his management committee, through the reforms in welfare with the SWEEP program, with the checks at banks for welfare recioients in the larne

permanent tax relief and who asked that just the rebate, the surplus during that year, he sent back. And, again, I think the Governor was right, because no matter whose estimate we are looking at for revenue and spending, we are looking at a deficit next year, and we would not be looking at a deficit had we followed the plan to reduce taxes in a one-shot deal that was recommended by the Governor.

In one breath, the minority leader indicates that he sees nothing wrong with the Governor sitting down with anyone and negotiating and negotiating in earnest, yet he criticizes the Governor for attempting to make deals.

I wonder whether you would characterize the position of the Republican Party in the House which changed, in 3 days, on tile new spending program as a deal that was made in private caucus, not open to the press. I just wonder whether you characterize that particular transaction or that particular posture of your party as a deal.

YOU Say that you are sure that the budget would have been considerably higher had the negotiations between the Governor and the interested parties culminated in a Compromise agreement. I do not believe that you have the facts. You heard the same gentleman talk as I heard talk. We were at that press conference together, and Senator Nolan indicated that the reason he did not accept the compromise was that there just was not enough money in it as far as he was concerned. So any negotiating the Governor did was to try to keep the cost of the package down to something that was manageable within the parameters of the income that he knows is available and you know is available and I know is available. And when the statement is made that the course of action that we took in the House when we concurred in that budget that was sent from the Senate will lead us to a tax increase, there is no question about it.

YOU know that there was money in there for I<ane IIospital. You also know that Kane Hospital is one of many county hospitals that fall into that category. You know that the less than $7 million that we are talking about for Kane Hospital this year translates into $39 million or $40 million next Year to take care of the rest of the hospitals. Now you know i t because you voted for th2t program. It was in the bill as i t came hack from the Senate. So you know we are talking about accelerated SPpeding tbat was not planned, that was not part of the original budget document.

YOU also indicated that you know that the cuts we made in general government operation cannot he lived with in all cases, because you indicated that you expect these departments to come in here for deficiency appropriations one hy one and you will make the decision at that time which to fund and which not to fund. So, ob- v i o u d ~ , there are some that you intend to fund. So, again, We go outside the parameters of the revenue estimates and the money that is going to come in, and that can only mean one thing, downstream, raising new money.

I agree with the minority leader that we must change the method in which we adopt budgets, and my sugges- tion simply is this: Let us stop looking for political advantage in the adoption of the budget and let us do what is rigbt.
