I M P O R T A N T N O T E S A B O U T O B J E C T I O N S T O P E R M I T APPLICATIONS I. This form is t o help you make an objection to an application in a way which complies with the Planning and

Environment Act 1987, and which can be readily understood by the responsible authority. There is no requirement under the Act that you use any particular form.

2. Your objection and the personal information on this form is collected by Bass Coast Shire Council for the purposes o f the planning process as set out in the Planning and Environment Act 1987. If you do not provide your name and address, Council will not be able to consider your submission.

3. Your objection will be available at the Bass Coast Shire Office a t Wonthaggi for any person t o inspect and copies may be made available to the applicant for the relevant period set out in the Planning and Environment Act 1987. You must not submit any personal information o r copyright material o f third parties without their informed consent. By submitting the material, you agree that the use of the material as detailed above does not breach any third party's right to privacy and copyright.

4. Make sure you clearly understand what is proposed before you make an objection. You should inspect the application at the responsible authority's office.

5. T o make an objection you should clearly complete the details on this form and lodge it with the responsible authority as shown on the Public Notice — Application for Planning Permit.

6. An objection must: • State the reasons for your objection; and

• State how you would be affected if a permit is granted. 7. The responsible authority may reject an application which it considers has been made primarily to secure or

maintain a direct o r indirect commercial advantage fo r the objector. In this case, the Act applies as if the objection had not been made.

8. If your objection related to an effect on property other than at your address as shown on this form, give details of that property and of your interest in it.

9. T o ensure the responsible authority considers your objection, make sure that the authority receives it by the date shown in the notice you were sent o r which you saw in a newspaper o r on the site.

10. If you object before the responsible authority makes a decision, the authority will tell you its decision. I I. If despite your objection the responsible authority decides to grant the permit, you can appeal against the

decision. Details o f the appeal procedures are set out on the back o f the Notice of Decision which you will receive. An appeal must be made on a prescribed form (obtainable from the Victorian Civil and Administrative Tribunal) and accompanied by the prescribed fee. A copy must be given t o the responsible authority. The closing date for appeals is 21 days o f the responsible authority giving notice o f its decision.

12. If the responsible authority refuses the application, the applicant can also appeal. The provisions are set out on the Refusal o f Planning Application which will be issued at that time.
