CEO Alan Plummer stated by the recommendation of the Town Attorney it should stays Marijuana Facility not just facility. Closed at 6:33pm 5.2 Mechanic Falls Land Use Changes: Noise Abatement Public Hearing started at 6:33pm. Councilor Aikman asked if there were a lot of complaints, and Chief Goss stated loud music and fireworks were common. Public Hearing ended at 6:35pm 5.3 Mechanic Falls Land Use Changes: Kennels Public Hearing started at 6:35pm-closed at 6:38pm 5.4 Mechanic Falls Land Use Changes: Household Waste Councilor Aikman was concerned that is come on too strong, and who would it fall under to police. The CEO would be responsible because it would fall under the Health and Safety office. It was suggested to add a 24hr period. Closed at 6:48pm 5.5 Liquor License-American Legion Post 150 Public Hearing started at 6:48pm. No Comment. Closed at 6:49pm 5.6 General Assistance Ordinance Update: Town Manager Zakk Maher went over the changes in Appendix A. Public Hearing started at 6:49pm and closed at 6:51pm 6.0 Public Comments Paula Stotts of Standpipe Rd concerned about the Town Attorney and fells like he has been negligent to the Town in the last 19 months. She wanted to look at amending the Charter and possible start at Charter Commission. She had also expressed concerned with the council members and wanted that email to become a public document.

Town Council October 5, 2020 Page 3 of 6 James Vadeboncoeur of True Street stated that he felt there was a council member breaking the ordinances in Town and had a list of side business that someone had and thought that the council member he was accusing should resign. No names were mentioned. 7.0 Old Business 7.1 Council Discussion Topics Councilor Emery had asked if they could have a workshop to discuss some of Paula Stotts concerns. 7.2 22 Pleasant Street Bids Councilor Aikman motioned to use Androvise Realty seconded by Councilor Downing, all in favor 4-1. Councilor Emery abstained due to family relations. Town Manager Zakk Maher stated no new updates, but the contract has run out with current realtor. Councilor Emery asked if current realtor had commercial license, which he does not and Councilor Emery suggested a change. Councilor Aikman and Downing agreed. Town Manager Zakk Maher suggested putting out an RFP again. Councilor Lavoie stated he had spoken to someone in CMMC in finding out if they would be willing to have something in the works for the building again. Councilor Emery motioned to terminate contract with realtor and send out RFP to see what comes out of it, seconded by Councilor Downing, all in favor, so voted. 7.3 Managers Contract Councilor Aikman stated there was a typo in second 3 about vacation time. There was talk about the waiver of residency of the Town Manager. Councilor Downing motioned to table Town Manager contract until next month, motioned withdrawn it was no seconded. Councilor Emery motioned to sign the amended contract as presented seconded by Councilor Bennett, all in favor 2-3. No vote for Councilor Downing, Aikman, and Lavoie. 8.0 New Business 8.1 Notice of Appointment of Treasurer Town Manager Zakk Maher welcomed back Lisa Prevost as Treasurer.

Town Council October 5, 2020 Page 4 of 6 8.2 Bank Account Access for Treasurer Councilor Aikman motioned to remove Michelle Emery and add Lisa Prevost to Androscoggin Bank, seconded by Councilor Lavoie, all in favor 4-1 Councilor Emery abstained due to family. Councilor Aikman motioned to remove Michelle Emery and add Lisa Prevost to Dirigo Bank Accounts, seconded by Councilor Lavoie, all in favor 4-1 Councilor Emery abstained due to family. Councilor Aikman motioned to remove Michelle Emery from Northeast Bank and add Lisa Prevost, seconded by Councilor Lavoie, all in favor 4-1. Councilor Emery abstained due to family. 8.3 Fire Department Vehicle Reserve John Damon stated that the Fire Dept has been without a side by side all season. The current side by side is old and there are no parts available to fix it. They tried to get a second opinion and was told they could try to get used parts but it’s not feasible. The Fire Dept presented 3 different options for a new side by side. Fire Chief Fred Sturtevant suggested not purchasing an enclosed trailer and using that money towards a new side by side. Councilor Aikman motioned to send out for an RFP on a new side by side, seconded by Councilor Downing, all in favor, so voted. 8.4 Recreation Committee Resignation Ryan Cook and Jared Pinkham officially resigned from the Recreation Committee. 8.5 Office Closure November 3, 2020 Councilor Downing motioned to close office and set hours of Election 8am-8pm, seconded by Councilor Aikman, all in favor so voted. 8.6 Pickup Truck Bid Town Manager Zakk Maher stated the preference of Public Works would be 2021 Chevy Silverado. Councilor Downing motioned to go with Emerson Chevrolet for 2021 Chevy Silverado, seconded by Councilor Lavoie, all in favor, unanimous. 8.7 Follow up Skid steer Bid Follow up from last month’s meeting, there motioned to approve the purchase was not completed. Councilor Downing motioned to accept the CAT bid or skid steer, seconded by Councilor Lavoie, all in favor so voted.

Notes to the Financial Reports

10/26/2020 At this time, revenues should be at 33% and as you can see from the enclosed report they are at 56.65%. There are two major reasons when the percentage is so high. First, the Town received the first of two payments from the State for Homestead Exemption reimbursement. The first payment is always the largest. The Town will not receive the rest of the Homestead Exemption reimbursement money until next summer. The second reason is I transferred the money from the reserve account to cover the Rural Development loan payment. You will see in the expenditure report that debt service is 91% expended. That is because I transferred the money from the reserve and made the payment in early September. There are only the spring interest payments left to be paid out of the debt service. Expenditures should also be at 33%. Per the enclosed report, you can see we are at 50.27%. The Town has made the County Tax payment making that budget 100% expended. That is contributing to the higher percentage, as is the pay down of the Rural Development loan (see above). I have also transferred all the CIP money to the Reserve accounts making that line 100% expended. There are also items that are due in full or at least in half at the beginning of the year, such as property and casualty insurance, animal shelter fees, assessing fees, Trio software license and maintenance ect. As the year progresses, these percentages will even out.

Manager’s Report Town of Mechanic Falls

To: Town Council CC: Julie Ward, Town Clerk All, This month has been one of preparations, for both the impending cold weather as well as the elections on Nov. 3rd. Highlighted activities below:

Completed the office relocations within the admin office. This has opened up the larger office behind the Council Chambers for added overflow room for meetings.

Completed the PW Pickup truck bid processing to reserve the new truck with the winning bidder. Attended several sessions of the MMA annual conference and trainings with various Dept heads. Some of these

include road maint. and improvements, election preparedness, legislative updates and round tables with other managers.

Worked with CEO and Atty to correct title issues for Olde Birch Lane. Was appointed by Gov. Mills to serve as a commissioner representing local govt for Volunteer Maine, a state

service commission that builds capacity and sustainability in Maine’s volunteer and service communities. Attended first Commissioner’s meeting as well as a taskforce meeting.

Attended the Volunteer Maine conference for volunteer management training credits. Worked with planning office on several issues regarding Land Use changes, and MJ businesses. Updated existing Land Use code based on recent amendments. Attended and Facilitated Planning Board meeting. Worked with Safety Committee/Dept heads in response to MMA facilities inspection report. Worked with elections staff on planning, preparations and information campaign to inform voters of processes

and precautions being taken. Met with Ch.13 reporters to relay elections preparations. Met with Poland recreation staff to develop usage plans for municipal gym. Developed Covid-19 usage guide for municipal facilities to include contact tracing, temperature screening and

identified responsible parties for all activities. Worked with Finance and Clerk staff to demo new TRIO software upgrade. Met with Poland TM to discuss workforce challenges and winter preparations. Received draft IT audit report from Systems Engineering. Reviewed most pressing items and worked with AMS

to implement most immediate solutions. Continued implementing, purchasing and reporting on both Covid Grant and Elections grant. These will be spent

down and closed by mid-late Nov. Met with the town’s Auditors (Smith & Associates) and reviewed financial policies and reporting. We expect to

have the final audit early 2021. Released, collected, opened and processed bids for the Fire Department UTV. Completed preliminary research for JKL Surveying. Work has begun on the municipal property and we hope to

have an updates and topographical map so that we can begin the discussion about options for a municipal complex.

Worked with Dept Heads to develop preliminary itemization of needs regarding facilities. Produced a first concept draft of the facilities to overlay onto the property survey once that is complete.

Started preliminary conversations with US Cellular on lease extension for cell tower located at Transfer Station. Updated previous research regarding Charter Amendment timelines and TM residency requirements. Met with regional managers to discus Covid safety operations, funding opportunities and winter maintenance

preparations. Worked with Poland Rec on Plans for hiking trails and river access.

French, Superintendent DATE October, 2020 RE Monthly Report Town Manager and Council, Second avenue, the grass is green and you can’t even tell we laid pipe there a month ago! After the pipe was laid the Highway crew re-established the ditch and replaced a couple of culverts. What a great feeling to accomplish a project like this, and to put the neighborhood back in better condition than we found it. We have all the hydrants pumped out for winter. A task we have to perform each year to keep them from freezing. The quarterly meters are all read and the bills will go out the first of November. Even in these troubled times we were able to pick up about ten new customers. Ben has been taking “zoom” classes so he can sit for his water operators’ license. Unlike the “olden days” when the state had its own version of the test, now it is a nation-wide exam. Before it was multiple choice, essays, true/ false, and lab demonstrations. Now you sit in front of a computer and answer one-hundred multiple choice questions. Because it is nation wide and not localized, the questions become much harder. We are a class two system. Bordering on a class three. Both Jake and I have class three licenses in both plant and distribution. Licenses have to be renewed every two years. In that time, you have to get credits to renew your license. There used to be classes where you would go and sit in a class and sometimes have “hands on” learning. Because of the times we are in, we are regulated to “zoom” classes. I am not a big fan of them, but we are managing to accumulate our credits. Steve French

AMENDMENT NUMBER ONE to Agreement dated August 7, 1995

Sec. 2, D, to fill a vacancy in the Town Council’s membership during their minimum mandatory one full year off the Council.” QUESTION #2: Shall Article II, Section 2, A. be amended as follows: “Councilors shall be registered voters of the Town and shall have their primary residence in the Town during their term of office.” QUESTION #4: Shall Article II, Section 2, D. be amended as follows: “…the Council shall fill vacancies in its number occurring between regular Municipal elections by an affirmative vote of a majority of the remaining members …” QUESTION #5: Shall Article II, Section 3, A. be amended by adding the following: “Except for provisions of a superceding employment contract with the Town Manager, the following shall be the process for removal: At least thirty (30) days before such removal shall become effective …” QUESTION #6: Shall Article II, Section 5, be amended as follows: “The Town Council shall meet at the usual place for holding meetings no later than the 30th of June following the regular Town election and at said meeting, Councilors-elect shall be sworn to the faithful discharge of their duties by a Notary Public, or by the Town Clerk, and a record made thereof. Councilors-elect begin their official duties on July 1st.” QUESTION #7: Shall Article II, Section 9, be amended by adding the following: “The Chairperson may not make or second a motion and shall vote only for the purpose of breaking a tie.” QUESTION #8: Shall Article II, Section 11, B. be amended as follows : “…the Council may not adopt it until the ordinance or its amended sections have been subjected to all the procedure hereinbefore required …” QUESTION #9: Shall Article III, Section 2, B. be amended by striking the following: “The Town Manager shall be Tax Collector, Town Treasurer, Code Enforcement Officer, Road Commissioner …”
